No. 4 Where planning permission has been granted for development(s), but said development has not been commenced or completed to date, within the boundary of the agglomeration and this development is being, or is to be, served by the waste water works, provide the following information:

i. Information on the calculated population equivalent (p.e.) to be contributed to the waste water works as a result of those planning permissions granted;

ii. The percentage of the projected p.e. to be contributed by the non-domestic activities; and,

iii. The ability of the waste water works to accommodate this extra hydraulic and organic loading without posing an environmental risk to the receiving water habitat.

No.6 Section F: Existing Environment and Impact of the Discharges: Assess the likelihood of significant effects of the waste water discharges from the Swinford agglomeration on the relevant European site(s) by referring to Circular L8/08 “Water services Investment and Rural Water Programmes – Protection of Natural Heritage and National Monuments” issued by the Department of Environment, Heritage and Local Government. In particular, the flow diagram in Appendix 1 should be completed and the results of each section recorded. Provide details of the results of this assessment within one month of the date of this notice. If significant effects are likely then an appropriate assessment must be carried out and a report of this assessment forwarded to the Agency within one month of the date of this notice. You are advised to provide the requested information in accordance with the “Note on Appropriate Assessments for the purposes of the Waste Water Discharge (Authorisation) Regulations, 2007 (S.I. 684 of 2007)” which is available at www.epa.ie Answer 6 Find enclosed details of the Appropriate Assessment Screening for Swinford Waste Water Discharge Licence Application 2009’. No. 8 Section G.1- Provide evidence that emissions from the agglomeration are in compliance with the Council Directives listed in section G of the application form. Answer 8 Dangerous Substances Directive 2006/11/EC This Directive is transposed into Irish law by the Water Quality (Dangerous Substances) Regulations, 2001 (S.I. No. 12 of 2001). Pesticides and Solvents Substances standards and Metal and other Substances standards, listed in the Standards Schedule of the Regulations apply to substances in a water body. The discharge from Swinford wastewater treatment plant was monitored for all these substances as part of the wastewater discharge licence application and results in Table 1 below, indicate that levels are below those acceptable in a water body.

Water Framework Directive 2000/60/EC This Directive is transposed into Irish law by the European Communities (Water Policy) Regulations, 2003-2008. A draft Plan for the Western River Basin District has yet to be adopted by Mayo County Council. If adopted, Mayo County Council will pay regard to this Plan in its management of Swinford Waste Water Treatment Plant. Birds Directive 79/409/EEC This Directive is transposed into Irish law by the European Communities (Conservation of Wild Birds) Regulations, 1999-2006. There are no SPA’s in proximity to the Swinford wastewater treatment plant outfall. Groundwater Directive 80/68/EEC & 2006/118/EC This Directive is transposed into Irish law by the Protection of Groundwater Regulations, 1999 (S.I. No. 41 of 1999). There are no direct groundwater discharges from the Swinford treatment plant and agglomeration. Drinking Water Directive 80/778/EEC This Directive is transposed into Irish law by the European Communities (Drinking Water) (No.2) Regulations, 2007 (S.I. No. 278 of 2007). Urban Waste Water Directive91/271/EEC This Directive is transposed into Irish law by the Urban Waste Water Treatment Regulations, 2001 (S.I. No. 254 of 2001). Swinford treatment plant discharges to the Swinford stream, a tributary of the River Moy. This river is not listed as sensitive in accordance with the Third Schedule of the Regulations. Table 2 shows compliance with the parametric limits set in the Regulations.

SECTION A: NON-TECHNICAL SUMMARY Advice on completing this section is provided in the accompanying Guidance Note. A non-technical summary of the application is to be included here. The summary should identify all environmental impacts of significance associated with the discharge of waste water associated with the waste water works. This description should also indicate the hours during which the waste water works is supervised or manned and days per week of this supervision.

The following information must be included in the non-technical summary:

A description of:

− the waste water works and the activities carried out therein, − the sources of emissions from the waste water works, − the nature and quantities of foreseeable emissions from the waste water

works into the receiving aqueous environment as well as identification of significant effects of the emissions on the environment,

− the proposed technology and other techniques for preventing or, where this is not possible, reducing emissions from the waste water works,

- further measures planned to comply with the general principle of the basic obligations of the operator, i.e., that no significant pollution is caused;

− measures planned to monitor emissions into the environment.

SECTION C: INFRASTRUCTURE & OPERATION Advice on completing this section is provided in the accompanying Guidance Note.

C.1 Operational Information Requirements

Provide a description of the plant, process and design capacity for the areas of the waste water works where discharges occur, to include a copy of such plans, drawings or maps, (site plans and location maps, process flow diagrams), and such other particulars, reports and supporting documentation as are necessary to describe all aspects of the area of the waste water works discharging to the aquatic environment. Maps and drawings must be no larger than A3 size.

C.1.1 Storm Water Overflows For each storm water overflow within the waste water works the following information shall be submitted:

• An assessment to determine compliance with the criteria for storm water overflows, as set out in the DoEHLG ‘Procedures and Criteria in Relation to Storm Water Overflows’, 1995 and any other guidance as may be specified by the Agency, and

• Identify whether any of the storm water overflows are to be decommissioned, and identify a date by which these overflows will cease, if applicable.

C.1.2 Pumping Stations For each pump station operating within the waste water works, provide details of the following:

• Number of duty and standby pumps at each pump station; • The measures taken in the event of power failure; • Details of storage capacity at each pump station; • Frequency and duration of activation of emergency overflow to

receiving waters. Clarify the location where such discharges enter the receiving waters.

This section requires the provision of information on the ambient environmental conditions within the receiving water(s) upstream and downstream of any discharge(s). Where development is proposed to be carried out, being development which is of a class for the time being specified under Article 24 (First Schedule) of the Environmental Impact Assessment Regulations, the information on the state of the existing environment should be addressed in the EIS. In such cases, it will suffice for the purposes of this section to provide adequate cross-references to the relevant sections in the EIS.

A.1 Non-Technical Summary 1. Waste Water Discharge Licence Background Mayo County Council, Aras an Chontae, Castlebar, County Mayo is making an application to the Environmental Protection Agency (EPA) for a Waste Water Discharge Licence for the Swinford Waste Water Treatment Plant & Agglomeration, in compliance with the Waste Water Discharge (Authorisation) Regulations 2007 (S.I. No. 684 of 2007). Under Schedule 2 of the above regulations, the prescribed date for submission of Waste Water Discharge Licence Applications for agglomerations (with discharges with a population equivalent of 2001 PE to 10,000 PE) is 22nd September 2008. The waste water treatment plant at Swinford falls under this category, presently having an agglomeration with a population equivalent (PE) of 3,000 persons. 2. Description Of Swinford Waste Water Treatment Works The Swinford Waste Water Treatment Plant (WWTP) was commissioned in 1993 and is located at a site adjacent to the Ballina/ Foxford Road (N26) north of the town. It has a design capacity to treat flows from a population equivalent (PE) of 6,500 and a peak flow (6DWF) capacity of 357m³/hr. Flows in excess of 6DWF are overflowed to the Swinford Stream at the Treatment Works after passing through the screen and grit trap. Treated Effluent from the plant is discharged to the Swinford Stream approximately 3.5km upstream of its confluence with the River Moy. The CSO 2006 Population figure for Swinford town is 1,502 persons. In addition approximately 2,500m³/annum of secondary sludge is imported from 6 neighbouring WWTPs, where no sludge dewatering facilities exist. As these sludges are of variable quality they go through the full treatment process at the Swinford Plant. Allowing for schools, hospitals, businesses and imported sludges it is estimated that the current PE for Swinford WWTP to be 3,000 persons. The sewerage collection system serving the town comprises a mixture of foul and combined sewers with the newer developments having separate foul and surface water systems. Due to topographical constraints there are 6 pumping stations on the system. The treatment works is based on the activated sludge process with Phosphorous removal and treats flows up to 6DWF in accordance with the Urban Waste Water Treatment Directive.

The treatment process consists of the following;

• Inlet works with mechanical 6mm screen, standby manual screen, screenings washing, compaction, grit removal, inlet control valve and storm overflow

canteen • Ferric Sulphate Dosing/ Sludge Press Building – ferric sulphate bulk

storage tanks, dosing equipment and sludge press. The Swinford WWTP is operated and maintained by Mayo County Council. The plant is manned 9.00AM – 5.00PM (Monday – Friday) by a Technician. There is a SCADA system which allows the Technician change process control points, trending of stored data and records all alarms generated within the works. All critical alarms are linked to an automated dial out system where an SMS text message is sent to the Technicians mobile phone notifying him of the alarm. The Technician also has a facility whereby he can view the SCADA screens by remotely dialling into the plants SCADA system using a lab top. 3. Sources of Emissions The pollution load for Swinford agglomeration arises from the following sources

The treated effluent is discharged to the Swinford Stream through a 600mm diameter pipe which is the Primary Discharge point SW1. There is one secondary discharge point SW2 which is an emergency overflow at the Pump House No 1 which is located at Rathscanlon on the old N5 road. This emergency overflow is provided in case of difficulties, such as power cuts, with the pumping plant. However, before the emergency overflow will be employed, the pumping station is designed with an 8-hour emergency volume of storage which will need to be filled before any discharges take place from the pumping station. This is to give sufficient time for repair to the pumping plant or power supply. There is a storm water overflow discharge facility at the Treatment Works Site which discharges flows in excess of 6DWF to the Swinford Stream through a 600mm outfall pipe SW3. 4. Nature and Quantities of Foreseeable Emissions The waste water treatment plant is designed to treat the waste water to the standards required by the Urban Wastewater Treatment Regulations i.e. BOD 25 mg/l, COD 125mg/l and SS 35 mg/l. Phosphorus removal facilities are in place to achieve a final effluent discharge standard of less than 2mg/l Total P. The average effluent volume currently discharged from the treatment plant is 1500m3/day. This is equivalent to an average discharge of 15 kg BOD( 10mg/l ), 15kg Suspended Solids( 10mg/l ) and 0.75 kg Total Phosphorous per day( 0.50mg/l ) in the treated effluent. It is not expected that the PE being treated by the Swinford Waste Water Treatment Plant will increase significantly in the short to medium term. The Draft Local Area Plan 2008 for Swinford sets out a growth target of 490 additional persons by 2013 bringing the population to approximately 1992 persons. 5. Technology for Prevention or Reduction of Emissions Emissions from the waste water treatment works are monitored and the treatment process is constantly adjusted to maximise the efficiency of the plant in removing any pollutants. The process, as has already been summarised above, is successful in removing BOD5, nitrogen, phosphorous and suspended solids from the final effluent which results in a reduction of harmful emissions from the treatment works. A large variety of technology in terms of mechanical equipment is used at the treatment plant in order to reduce the concentration of potentially harmful substances in the effluent.

6. Further Measures Planned to Eliminate or Reduce Emissions There are no immediate proposals. 7. Measures planned to monitor emissions to the environment Sampling currently takes place at the wastewater treatment works final effluent chamber in accordance with the provisions of the Urban Wastewater Treatment Regulations. This will continue to be the case. Swinford WWTP is operated using a SCADA system with a call out facility so that any problems occurring while the treatment works or pumping stations are unmanned can be rectified before causing a deterioration in the effluent discharged to the receiving water. The storm water overflow point is subject to regular inspection.

C.1 Operational Information Requirements Plant process and design The Swinford treatment plant process flow diagram is shown on Map C.1.1, and the treatment plant layout is shown on Map B2. Swinford sewerage treatment plant has a design capacity to treat flows from a population equivalent (PE) of 6,500 and a peak flow (6DWF) capacity of 357m³/hr. Flows in excess of 6DWF are overflowed to the Swinford Stream at the Treatment Works after passing through the screen and grit trap. Treated Effluent from the plant is discharged to the Swinford Stream approximately 3.5km upstream of its confluence with the River Moy. Preliminary treatment at the inlet works, removes the coarse material from the raw waste water. The screenings are removed by a Jones and Attwood Screezer Mark III Fine Drum Screen which has a flow capacity of 1000 l/s and a 5mm slot width. Subsequently the screenings are dewatered by a Jones and Attwood screw compactor and discharged to a covered bin in the adjacent holding area for disposal to landfill. Following screening, grit is removed using a Jones and Attwood Grit Trap. Removal of the collected grit is carried out by an air lift pump. The pump delivers the grit to a separate screw classifier from which the cleaned grit is collected in a skip for disposal to landfill. It is expected that loads of grit up to 50 kg/day could be processed at the works. Secondary treatment is mainly the biological decomposition of the soluble and suspended organic matter into settleable inorganic form. This is achieved by the activated sludge process. After the preliminary treatment the waste water flow is split between the two 15.50m square aeration basins, each having an operating volume of 900 m³ and designed to operate at a food to mass ratio of 0.05 to 0.2, with a mixed liquor suspended solids (MLSS) in the range 2000 to 4500 mg/l. Completely mixed aeration basins achieve uniform loading conditions and provide buffering of any shock loads. Variable speed surface aerators regulate dissolved oxygen (DO) levels in the aeration basins within the range 1-2 mg/l. A wastewater retention time of 29.6 hours is achieved at DWF. Mixed liquor from the aeration tanks passes over outlet weirs, where Ferric Sulphate is dosed as a coagulant. Ferric Sulphate successfully reduces total phosphorus levels to <1 mg/l (as P) without adversely affecting the treatment process. The effluent passes from here to the settlement stage.

After the aeration basins the wastewater flows to the 2no. circular radial flow Final Settlement Tanks (clarifiers), with 16.8m diameter and 512 m³ capacity each. The tanks are designed on the basis of a peak flow rate of 7.5 times DWF, which allows for a throughput rate of 6 times DWF and a return activated sludge rate of 1.5 times DWF. The sludge is swept into a central sump for collection and consolidation by blades supported from a rotating radial bridge. Sludge withdrawal is by hydrostatic pressure. Floating solids migrate slowly to the edge of the tank and are prevented from passing above the peripheral weir with the clarified effluent by a scum box. The clarified effluent passes over V-notch weirs in the Settlement Tanks and passes to the final effluent flume chamber where the effluent flow is measured by an ultrasonic flow meter before it discharges gravitationally via a 600mm diameter outfall pipe to the Swinford Stream. This is the primary discharge point (SW1(P)). The activated sludge, which accumulates at the bottom of the final settling tanks passes into the sludge return pump sump. The sludge takes either of two routes:

1) In order to feed the biological process, a portion is returned to the Aeration Basin, by means of submersible sludge return pumps, which operate on a duty/standby basis at a design rate of 31.5 l/s at a head of 5.8m; 2) The surplus activated sludge is pumped to the Picket Fence Thickener by means of sludge wastage pumps. The dilute sludge is allowed to settle over a period of 24 hours. The supernatant released from the sludge is returned to the Inlet works. Sludge, at approximately 3% total dried solids, from the Picket Fence Thickener is pumped directly by Sludge Forward Feed Pumps (Mono pumps) to the Sludge Press House for subsequent dewatering by double belt press. Polyelectrolyte is added to combine particles and dewatered sludge cake produced by the press at approximately 16% Total Dried Solids (TDS) and falls into a skip. Collection of the sludge cake is by a licensed carrier, Ormonde Organics, who supply the sludge for spreading to agricultural land. The water extracted during the dewatering process is returned to the Inlet works by the supernatant pumps.

There is a SCADA system which allows the Technician change process control points, trending of stored data and records all alarms generated within the works. It is used to monitor, control and optimise the performance of the plant. All critical alarms are linked to an automated dial out system where an SMS text message is sent to the Technicians mobile phone notifying him of the alarm. The Technician also has a facility whereby he can view the SCADA screens by remotely dialling into the plants SCADA system using a lab top.

1. INTRODUCTION

Mayo County Council, Aras an Chontae, Castlebar, County Mayo made an application to the Environmental Protection Agency (EPA) for a Waste Water Discharge Licence, for the Swinford Wastewater Treatment Plant & Agglomeration (i.e. ‘Swinford Agglomeration), in compliance with the Waste Water Discharge (Authorisation) Regulations 2007 (S.I. No. 684 of 2007), in early September 2008.

Under Part II Schedule 5 (5) of the Wastewater Discharge (Authorisation) Regulations 2007, In considering an application, where it appears to the Agency (i.e. Environmental Protection Agency) that the discharge concerned, or the proposed discharge, as the case may be, is likely to have a significant effect on a European site, either alone or in combination with other operations or activities, the Agency shall cause an assessment to be made of the implications for the site in view of that site’s conservation objectives, and the Agency in deciding on the application shall have regard to the conclusions of the assessment.

The Swinford WWTP discharges into the Swinford River which is a tributary of the Moy River SAC (Site Code 002298) via primary and secondary discharge points. This report contains the screening of the Swinford Waste Water Treatment Plant in order to determine whether an Appropriate Assessment is required.

Purpose of Appropriate Assessment

Articles 6(3) and 6(4) of the Habitat Directive 92/43/EEC require an Appropriate Assessment of plans to prevent significant adverse effects on Natura 2000 sites.

Article 6(3) Any plan or project not directly connected with or necessary to the management of the site but likely to have a significant effect there on either individually or in combination with other plans or projects, shall be subject to appropriate assessment of its implications for the site in view of the site’s conservation objectives. In the light of the conclusions of the assessment of the implications for the site and subject to the provisions of paragraph 4, the competent national authorities shall agree to the plan or project only after having ascertained that it will not adversely affect the integrity of the site concerned and if appropriate, after having obtained the opinion of the general public.

Article 6(4) If, in spite of a negative assessment of the implications for the site and in the absence of alternative solutions, a plan or project must nevertheless be carried out for imperative reasons of overriding public interest, including those of social or economic nature, the Member State shall take all compensatory measures necessary to ensure that the overall coherence of the Nature 2000 site is protected. It shall inform the Commission of the compensatory measures adopted.

The purpose of this Appropriate Assessment (AA) is to address the potential impacts of discharges from the Swinford Wastewater Treatment Plant on the conservation objectives of a Natura 2000 Site River Moy SAC (Site Code 002298). The Killaturly Turlough pNHA Site Code 000511) is approximately greater than 4km from the primary discharge and therefore will not be considered only mentioned here in this screening document.

The AA must determine whether the project is likely to have significant adverse effects on these sites either along or in conjunction with other plans and projects in the area and whether these effects will adversely affect the integrity of the SAC in terms of its nature conservation objectives.

2. APPROPRIATE ASSESSMENT - THE PROCESS

According to European Commission Methodological guidance on the provisions of Article 6(3) and (4) of the Habitats Directive 92/43/EC (2001) and MN2000, the assessment requirements of Article 6 establish a stage-by-stage approach as follows:

Stage 1 - Screening for a likely significant effect: An initial assessment of the project or plans effect on a European site(s). If it cannot be concluded that there will be no significant effect upon a European site, an AA is required;

Stage 2 - Appropriate Assessment: The consideration of the impact on the integrity of the Natura 2000 site of the project or plan, either alone or in combination with other projects of plans, with respect to the site’s structure and function and its conservation objectives. Additionally, where there are adverse impacts, an assessment of the potential mitigation of those impacts.

Stage 3 – Assessment of alternative solutions: The process which examines alternative ways of achieving the objectives of the project or plan that avoid adverse impacts on the integrity of the Natura 2000 site:

Stage 4 – Assessment where no alternative solutions exist and where adverse impacts remain: An assessment of compensatory measures where, in the light of an assessment of imperative reasons of overriding public interest (IROPI), it is deemed that the project or plan should proceed.

Each stage determines whether a further stage in the process is required. If, for example, the conclusions at the end of Stage One are that there will be no significant impacts on the Natura 2000 site, there is no requirement to proceed further.

3. STAGE 1 - SCREENING

Screening is the process of deciding whether or not an AA is required for the project or plan. Screening only requires sufficient information to determine if there is a likely significant effect on a Natura 2000 site and does not require the detailed information needed for the AA.

The following Stage 1 Screening was undertaken according to the Department of Environment, Heritage and Local Government Circular L8/08 and EC Methodological guidance on the provision of Article 6 (3) and (4) of the Habitats Directive 92/443/EEC. This Screening is used below to ascertain if an AA is required.

3.1 – Description of the Project

The Wastewater discharge application is for the licensing of 3 No. discharges from the existing Sewerage Scheme that serves the Swinford agglomeration. Swinford Wastewater Treatment Plant (WWTP) was built in the 1990’s and commissioned in 1993 and consists of inlet works with screening, 2 surface aeration tanks, 2 secondary settlement tanks with phosphorus removal. Sludge is stored in a sludge thickening tank prior to dewatering for final removal from the site. The WWTP has a design capacity to treat flows from a Population Equivalent of 6,500 and a peak flow (6DWF) capacity of 357m3/hr. Currently the WWTP is operating at 3000 PE.

Emissions from the WWTP are discharged into the Swinford River through a primary discharge point at SW1 (see Figure 3.1 below). There are 2 No. secondary discharge points (labelled SW2 and SW3 see Figures 3.1 and 3.2 below). SW2 is an emergency overflow located at the pump house at Rathscanlon on the old N5 road. The SW3 outfall is a storm water overflow discharge which is located at the Treatment Works. In addition there are six pumping stations – PS1 located at the Old Dublin Road, PS2 located at the mart, PS3 at Kilbride, PS4 at the Parochial House, PS5 at Bollingbrook Drive and PS6 at Fraun Hill.

Final effluent is treated to a level of less than 25mg/l BOD, 125mg/l COD, 35mg/l Suspended Solids and Phosphorus levels of <2mg/l Total P. The average volume currently discharge from the WWTP is 1500m3/day.

3.2 – Description of Natura 2000 Site

Name: River Moy SAC (Site Code 002298)

(see Appendix A for site synopses)

The River Moy comprises almost the entire freshwater element of the Moy and its tributaries including both Loughs Conn and Cullin. It comprises an area of approximately 231ha. The Site is an SAC and is designated for five Annex 1 habitats as follows:

- Active Raised Bog (Habitat Code 7110) (approx 1% of the site).

- Degraded raised bogs still capable of natural regeneration (Habitat Code 7120) (approx. 3% of the site).

- Depressions on peat substrates of the Rhynchosporion (Habitat Code 7150) (approx. 1% of the site).

- Old sessile oak woods with Ilex and Blechnum in British Isles (Habitat Code 91AO) (approx. 1% of the site) and

- Alluvial forests with Alnus glutinosa and Fraxinus excelsior (Alno-Padion, Alnion incanae, Salicion albae) (Habitat Code 91EO) (approx. 1% of the site)

The underlying geology is Carboniferous Limestone for the most part though Carboniferous Sandstone is present at the extreme west of the site with Dalradian Quartzites and schists at the South West Region of the site. There are many towns adjacent to the site including Ballina, Crossmolina, Foxford and Swinford; however, these towns are not within the site.

The site has a number of species present that are listed in Annex II of the Habitats Directive

Around the Southern Shores of Loughs Conn and Cullin there are oak woodlands present. The rare Narrow-leaved Hellebroine protected under the Flora Protection Order 1999 occurs in association with the woodlands. Plant species of note along the lake-margins include Heath Cudweed, Great Burnet and Irish Lady’s Tresses – these three species are listed on the Irish Red Data list and are protected under the Flora Protection Order 1999.

The Moy System is a significant catchment for Atlantic Salmon. In addition, the site also supports mammal species including Red Data Book Species such as Pine Marten, Badger, Irish Hare and Daubenton’s Bat, Common Frog and Common Scoter.

3.3 – Other projects and plans to be considered ‘in combination’.

There have been 139 planning applications since 2004 within the Agglomeration serviced by the Swinford WWTP, 111 of which were granted permission. None of these planning applications were for significant projects or plans that would impact on sites of nature conservation importance, or that would have an impact ‘in combination’ with the Swinford WWTP and associated discharges.

The Swinford Local Area Plan was adopted in January 2009 by Mayo County Council. The Plan sets out the planning authorities objectives for proper planning and sustainable development in Swinford. Under Section 3.7.3 Designated Ecological Sites – ‘no projects giving rise to significant adverse direct, indirect or secondary impacts on the integrity of Natura 2000 sites having regard to their conservation objectives arising from their size or scale, land take, proximity, resource requirements, emissions (disposal to land, water or air), transportation requirements, duration of construction, operation, decommissioning or from any other effects shall be permitted on the basis of this Plan’ (either individually or in combination with other plans or projects) (except as provided for in Section 6(4) of the Habitats Directive.)

In relation to Salmonid Waters under Section 3.7.4 of the Local Area Plan, any planning applications within 15 meters of the banks of a Salmonid Waters, or surface waters feeding into salmonid waters, shall demonstrate that development would not impact upon salmonid species or the habitats which sustain them and under Section 3.7.9 the plan states that the Wastewater Treatment Plant capacity requirements of new development under the Swinford Local Area Plan must not exceed available wastewater treatment capacity.

Conclusion: There are no other projects and plans that need to be considered in ‘combination’.

3.4 – Assessment Criteria

3.4.1 – Is the development in or on the boundary of the aforementioned nature conservation sites?

No. The Swinford WWTP and agglomeration is not in or on the boundary of the River Moy SAC.

3.4.2 – Will nationally protected species be directly impacted? Wildlife Acts (1976 and 2000), Flora Protection Order (S.I. 94 of 1999)

Flora Protection Order Species: No Flora Protection Order species have been recorded in the study area by the NPWS.

Wildlife Acts Species: An Otter survey completed by Bailey and Rochford (2004/2005) within the Western River Basin District noted the presence of Otter in the Moy Catchment. A data search of the National Parks and Wildlife 10km2 grid surveys recorded the presence of Pine Marten in 2009 on a River Bank near Swinford. Otter was recorded at Cloonagh and at Derrybrack in 1991 and 1990 respectively, however, these locations are approximately greater than 8km from the primary discharge. No other Wildlife Acts Species have been recorded in the immediate study area by the NPWS.

3.4.3 – Is the development a surface water discharge or abstraction in the surface water catchment or immediately downstream of a nature conservation site with water dependant qualifying habitats/species?

No. There are no surface water abstraction points in close proximity to Swinford WWTP Agglomeration. The development involves three surface water discharges to the Swinford River which is a tributary of the River Moy. The discharges are not immediately downstream of a nature conservation site.

3.4.4 – Is the development a groundwater discharge or abstraction in the ground water catchment or within 5km of a nature conservation site with water-dependant qualifying habitats/species?

No – all discharges from the Swinford Agglomeration are to surface waters.

3.4.5 - Is the development in the surface water or groundwater catchment of salmonid waters?

The Swinford River is not classed as a Salmonid Water, however, it is a tributary of the River Moy which is classed as a Salmonid Water under the First Schedule of the European Communities (Quality of Salmonid Waters) Regulations, 1988 (S.I No. 293/1988)

3.4.6 – Is the treatment plant in an active or former floodplain or flood zone of a river, lake etc.?

No. The OPW recorded a flooding in Swinford in 1999. This involved one house and was due to excessive weed growth in the channel of the Swinford River, however, maintenance occurred in 2001/2002 and now all scheduled channels in the Swinford area are maintained by the OPW.

3.4.7 – Is the development of a surface discharge or abstraction to or from marine waters and within 3km of a marine nature conservation site?

No.

3.4.8 –Will the project in combination with other projects (existing and proposed) or changes to such projects affect the hydrology or water levels of sites of nature conservation interest or the habitats of protected species?

No. A review of all planning applications in the agglomeration since 2004 shows no major development has been proposed that would affect the hydrology or water levels of sites of mature conservation interest or the habitats of protected species.

3.4.9 - Conclusion:

It is considered that an Appropriate Assessment is required to assess the impacts of wastewater discharges to the River Moy SAC (Site Code 002298).

5. – THE ASSESSMENT OF SIGNIFICANCE OF EFFECTS

5.1 - Describe how the project or plan (alone or in combination) is likely to affect the Natura 2000 site.

L8/08 states that if the screening process under section 3 above is to “Assess Impacts” then the project must be referred to the DEHLG Development Applications Unit (DAU). This Screening and Appropriate Assessment Report will be forwarded to the DAU along with the EPA.

Impacts are summarized below based on Figure 1: Screening Matrix of the EC Guidance (2001).

APPENDIX A: SITE SYNOPSES SITE NAME: RIVER MOY SITE CODE: 002298 This site comprises almost the entire freshwater element of the Moy and its tributaries including both Loughs Conn and Cullin. The system drains a catchment area of 805 sq. km. Most of the site is in Co. Mayo though parts are in west Sligo and north Roscommon. Apart from the Moy itself, other rivers included within the site are the Deel, Bar Deela, Castlehill, Addergoole, Clydagh and Manulla on the west side and the Glenree, Yellow, Strade, Gweestion, Trimogue, Sonnagh, Mullaghanoe, Owengarve, Eighnagh and Owenaher on the east side. The underlying geology is Carboniferous Limestone for the most part though Carboniferous Sandstone is present at the extreme west of the site with Dalradian Quartzites and schists at the south west. Some of the tributaries at the east, the south of Lough Conn and all Lough Cullin are underlain by granite. There are many towns adjacent to but not within the site. These include Ballina, Crossmolina, Foxford, Swinford, Kiltimagh and Charlestown. The site is a candidate SAC selected for old oak woodlands, raised bog, degraded raised bog, and Rhynchosporion, all habitats listed on Annex I of the E.U. Habitats Directive. The site is also selected for the following species listed on Annex II of the same directive – Atlantic Salmon, Otter, Sea Lamprey and White-clawed Crayfish. On the slopes and rising ground around the southern shores of Loughs’ Conn and Cullin, Oak woodlands are seen. Sessile Oak (Quercus petraea) is the dominant tree with an understorey of Holly (Ilex aquifolium), Hazel (Corylus avellana) and Birch (Betula pubescens) with some Ash (Fraxinus excelsior). Additional species are associated with the lakeshore such as the white beam (Sorbus rupicola), Aspen (Populus tremula), Silver Birch (B. pendula) and the shrubs Guelder Rose (Viburnum opulus), Buckthorn (Rhamnus catharticus) and Spindle Tree (Euonymus europaeus). The ground flora is usually composed of Bilberry (Vaccinium myrtillus), Wood Rush (Luzula sylvatica), Wood Sorrel (Oxalis acetosella), Buckler Ferns (Dryopteris aemula and D. dilatata), Hard Fern (Blechnum spicant), Cow-wheat (Melampyrum spp.) and Bracken (Pteridium aquilinum). The rare Narrow-leaved Helleborine (Cephalanthera longifolia), protected under the Flora Protection Order, 1999, occurs in association with the woodlands. Also found in these woodlands is the snail (Acanthinula lamellata), associated with old natural woodlands. On higher ground adjacent to the woodlands is blanket bog with scattered shrubs and trees on the drier areas. The rocky knolls often bear Juniper (Juniperus communis) or Gorse (Ulex europaeus), with some unusual rare herb species such as Intermediate Wintergreen (Pyrola media) and Lesser Twayblade (Listera cordata).

Within the site are a number of raised bogs including those at Kilgarriff, Gowlaun, Derrynabrock, Tawnaghbeg and Cloongoonagh. These are examples of raised bogs at the north-western edge of the spectrum and they possess many of the species typical of such in Ireland, including an abundance of Bog Asphodel (Narthecium ossifragum), Carnation Sedge (Carex panicea) and the moss Campylopus atrovirens. Some of the bogs include significant areas of active raised bog habitat. Well developed pool and hummock systems with quaking mats of bog mosses (Sphagnum spp.), Bog Asphodel (Narthecium ossifragum) and White Beaked-sedge (Rhynchospora Alba) are present. Many of the pools contain a diversity of plant species, including Bog bean (Menyanthes trifoliata), the bog moss Sphagnum cuspidatum, Campylopus atrovirens, Common Cotton grass (Eriophorum angustifolium), Great Sundew (Drosera anglica) and occasional Lesser Bladderwort (Utricularia minor). Several of the hummock-forming mosses (Sphagnum fuscum and S. imbricatum) which occur here are quite rare in this region and add to the scientific interest of the bogs within the overall site. Depressions on the bogs, pool edges and erosion channels, where the vegetation is dominated by White Beaked-sedge (Rhynchospora Alba) comprise the habitat Rhynchosporion. Associated species in this habitat at the site include Bog Asphodel, Sundews, Deergrass (Scirpus cespitosus) and Carnation Sedge. Degraded raised bog is present where the hydrology of the uncut bogs, has been affected by peat cutting and other land use activities in the surrounding area such as afforestation and associated drainage and also by the Moy arterial drainage. Species typical of the active raised bog habitat are still present but the relative abundance of them is different. A typical example of the degraded habitat, where drying has occurred at the edge of the high bog, contains an abundance and more uniform cover of Ling Heather (Calluna vulgaris), Carnation Sedge, Deergrass and sometimes Bog-myrtle (Myrica gale). Occurring in association with the uncut high bog are areas of wet regenerating cutover bog with species such as Common Cotton grass, bog mosses and Sundew, while on the drier areas, the vegetation is mostly dominated by Purple Moor-grass (Molinia caerulea). Natural regeneration with peat-forming capability will be possible over time with some restorative measures. The open water of Loughs Conn and Cullin is moderately hard with relatively low colour and good transparency. The phytpoplankton of the lake is dominated by diatoms and blue-green algae and there is evidence that the latter group is more common now than in former years. This indicates that nutrient inflow is occurring. Arctic Charr (Salvelinus alpinus) appear to have disappeared from the lake over the same period of time. The changes in Lough Conn appear to represent an early phase in the eutrification process. Stoneworts that are still present include Chara aspera, C. delicatula and Nitella cf. opaca. Other plants found in the shallower portions are the pondweeds. Where there is a peat influence Intermediate Bladderwort (Utricularia intermedia) is characteristic while Water Lobelia (Lobelia dortmanna) often grows in sand. Narrow reed beds and patches of Yellow Water-lily (Nuphar lutea) occur in some of the bays.

Drainage of the Moy in the 60s lowered the level of the lakes, exposing wide areas of stony shoreline and wet grassland, which are liable to flooding in winter. This increased the habitat diversity of the shoreline and created a number of marginal wetlands, including fens and marshes. Plant species of note in the lake-margin include Heath Cudweed (Omalotheca sylvatica), Great Burnet (Sanguisorba officinalis) and Irish Lady’s-tresses (Spiranthes romanzoffiana). These three species are listed on the Irish Red Data list and are protected under the Flora Protection Order 1999. Other habitats present within the site include wet grassland dominated by Rushes (Juncus spp.) grading into species-rich marsh in which sedges are common. Among the other species found in this habitat are Yellow Iris (Iris pseudacorus), Water Mint (Mentha aquatica), Purple Loosestrife (Lythrum salicaria) and Soft Rush (Juncus effusus). Grey Willow (Salix cinerea) scrub and pockets of wet woodland dominated by Alder (Alnus glutinosa) have become established in places throughout the site. Ash (Fraxinus excelsior) and Birch (Betula pubescens) are common in the latter and the ground flora is typical of wet woodland with Meadowsweet (Filipendula ulmaria), Angelica (Angelica sylvestris), Yellow Iris, Horsetail (Equisetum spp.) and occasional tussocks of Greater Tussock-sedge (Carex paniculata). Small pockets of conifer plantation, close to the lakes and along the strip both sides of the rivers, are included in the site. The Moy system is one of Ireland’s premier salmon waters and it also encompasses two of Ireland’s best lake trout fisheries in Loughs Conn and Cullin. Although the Atlantic Salmon (Salmo salar) is still fished commercially in Ireland, it is considered to be endangered or locally threatened elsewhere in Europe and is listed on Annex II of the Habitats Directive. The Moy is a most productive catchment in salmon terms and this can be attributed to its being a fingered system with a multiplicity of 1st to 5th order tributaries which are large enough to support salmonids < 2 years of age while at the same time being too small to support significant adult trout numbers and are therefore highly productive in salmonid nursery terms. Salmon run the Moy every month of the year. Both multi-sea-winter fish and grilse are present. The salmon fishing season is 1st February to 30th September. The peak of the spring fishing is in April and the grilse begin running in early May. The average weight of the spring fish is 9 lb and the grilse range from about 3-7 lb. In general spring fish are found more frequently in the rivers at the western extent of the Moy system. The Arctic Char (Salvelinus alpinus), an interesting relict species from the last ice age, which is listed as threatened in the Irish Red Data Book has been recorded from Lough Conn and in only a few other lakes in Ireland. The latest reports suggest that it may now have disappeared from the site.

The site is also important for the presence of three other species listed on Annex II of the E.U. Habitats Directive, namely Sea Lamprey (Petromyzon marinus), Otter (Lutra lutra) and White-clawed Crayfish (Austropotamobius pallipes). The Sea Lamprey is regularly encountered in the lower stretches of the river around Ballina, while the otter and crayfish are widespread throughout the system. In addition, the site also supports many more of the mammal species occurring in Ireland. Those which are listed in the Irish Red Data Book include Pine Marten, Badger, Irish Hare and Daubenton’s Bat. Common Frog, another Red Data Book species, also occurs within the site. Loughs Conn and Cullin support important concentrations of wintering waterfowl and both are designated Special Protection Areas. A nationally important population of the Annex I species Greenland White-fronted Geese (average 113 over 6 winters 1994/95 to 1999/00) is centred on Lough Conn. Whooper Swans also occur (numbers range between 25 and 50), along with nationally important populations of Tufted Duck 635, Goldeneye 189 and Coot 464. A range of other species occur on the lakes in regionally important concentrations, notably Wigeon 303, teal 154, Mallard 225, Pochard 182, Lapwing (>1,000) and Curlew 464. Golden Plover also frequent the lakes, with numbers ranging between 700 and 1,000. Loughs Conn and Cullin are one of the few breeding sites for Common Scoter in Ireland. Breeding has occurred on Lough Conn since about the 1940s when about 20-30 pairs were known. A census in 1983 recorded 29 pairs. Breeding was first proved on Lough Cullin in 1983 when 24 pairs were recorded. In 1995, 24-26 pairs were recorded at Lough Conn and 5 pairs at Lough Cullin. The latest survey in 1999 gives a total of 30 birds for both lakes, comprising only 5 pairs, 18 unpaired males and 2 unpaired females. The reason for the decline is not known but may be due to predation by mink, possible changes in food supply and/or redistribution to other sites. The Common Scoter is a Red listed species. Agriculture, with particular emphasis on grazing, is the main land use along the Moy. Much of the grassland is unimproved but improved grassland and silage is also present. The spreading of slurry and fertiliser poses a threat to the water quality of this salmonid river and to the large lakes. Fishing is a main tourist attraction on the Moy and there are a large number of Angler Associations, some with a number of beats. Fishing stands and styles have been erected in places. The North Western Regional Fishery Board has erected fencing along selected stretches of the river as part of their salmonid enhancement program. Other aspects of tourism are concentrated around Loughs Conn and Cullin.

Afforestation has occurred in the past around the shores of Loughs Conn and Cullin. The coniferous trees are due for harvesting shortly. It is proposed to replant with native tree species in this area. Forestry is also present along many of the tributaries and in particular along the headwaters of the Deel. Forestry poses a threat in that sedimentation and acidification occurs. Sedimentation can cover the gravel beds resulting in a loss of suitable spawning grounds. The Moy has been arterially dredged in the 60s. Water levels have been reduced since that time. This is particularly evident along the shores of Loughs Conn and Cullin and in the canal-like appearance of some river stretches. Ongoing maintenance dredging is carried out along stretches of the river system where the gradient is low. This is extremely destructive to salmonid habitat in the area. The site supports populations of several species listed on Annex II of the EU Habitats Directive, and habitats listed on Annex I of this directive, as well as examples of other important habitats. The presence of a fine example of broad-leaved woodland in this part of the country increases the overall habitat diversity and adds to the ecological value of the site as does the presence of the range of nationally rare and Red Data Book plant and animal species. 16.05.2005
