INTRODUCTION

The Food Safety Modernization Act (FSMA) is the largest change to U.S. food laws since the enactment of the

Federal Food, Drug and Cosmetic Act in the 1930s. It imposes sweeping new regulations throughout the supply

chain—from farm to retail. For the first time, the U.S. Food and Drug Administration (FDA) will be regulating

produce safety practices on farms. Human and animal food manufacturing facilities are now subject to mandatory

hazard analysis and critical control point (HACCP) requirements. Importers must verify that the farms and factories

of their foreign suppliers produce food in accordance with U.S. standards. Transportation providers are subject to

new temperature monitoring and recordkeeping requirements. Third-party auditors have the option to be

recognized by a new FDA accredited program. Food defense compliance is now mandatory. Retailers must notify

consumers of recalls. And there are many more significant actions FDA is required to take under FSMA. This

document outlines the actions FDA has taken to implement FSMA to date as well as future actions required by the

law. Parenthetical references include the date of the action or publication followed by the FSMA section number

and U.S. Code reference. This document will be updated periodically and posted on the Lieberman PLLC website.
