Cosmetic

� "cosmetic" means any article intended to be

rubbed, poured sprinkled or sprayed on, or

introduced into, or otherwise applied to, the

human body or any part thereof for cleansing,

beautifying, promoting attractiveness, or

altering the appearance, and includes any

article intended for use as a component of cosmetic.

Drugs

� The definition of 'drugs' is an inclusive one. It

includes all medicines for external or internal

use of human beings or animals or any

substances itended to be used for or in the

diagnosis, treatment, mitigation or prevention

of diseases in human beings or animals

Low concerning food

5. Any person who sells an article of food which

(a) has in or upon it any poisonous or harmfulsubstance;

(b) is unfit for human consumption;(c) consists in whole or in part of any filthy, putrid,disgusting, rotten, decomposed or diseased animalor vegetable substance;

(d) is adulterated; or

(e) was manufactured, prepared, preserved, packagedor stored under unsanitary conditions, is guilty of an offence.

6. (1) Any person who labels, packages, treats,processes, sells or advertises any food in amanner that is false, misleading or deceptive or islikely to create an erroneous impression

regarding its character, value, quantity,composition, merit or safety is guilty of anoffence.

(2) An article of food that is not labelled or packagedas required by the Regulations, or is labelled or

packaged contrary to the Regulations shall bedeemed to be labelled or packaged contrary tosubsection (1).

7. Where a standard has been prescribed for

a food, any person who labels, packages,

sells or advertises any article in such a

manner that it is likely to be mistaken for

the food, is, unless the article complies

with the prescribed standard, guilty of an

offence.

8. Any person who manufactures, prepares,

preserves, packages or stores for sale

any food under unsanitary conditions isguilty of an offence.

8A. The offences created by sections 5 to 8

shall apply to food processed or prepared

or to be processed or prepared for export.

9. Any person who sells any drug which

(a) was manufactured, prepared, preserved,

packed or stored under unsanitaryconditions; or

(b) is adulterated, is guilty of an offence.

11. (1) Where a standard has been prescribed for a drug,any person who labels, packages, sells oradvertises any substance in such a manner that it islikely to be mistaken for the drug, is, unless the

substance complies with the prescribed standard,guilty of an offence.

(2) Where a standard has not been prescribed for adrug, but a standard for the drug is contained inany publication mentioned in the Second Schedule,

any person who labels, packages, sells or advertisesany substance in such a manner that it is likely to bemistaken for the drug, is, unless the substancecomplies with the standard, guilty of an offence.

(3) Where a standard for a drug has not beenprescribed and no standard for the drug iscontained in any publication mentioned in theSecond Schedule, any person who sells the drug is,

unless(a) it is in accordance with the professed standard

under which it is sold; and

(b) it does not resemble, in a manner likely todeceive, any drug for which a standard has beenprescribed or is contained in any publicationmentioned in the Second Schedule, guilty of anoffence.

13. (1) Any person who distributes or causes to be

distributed any drug as a sample is guilty of an offence.

(2) Subsection (1) shall not apply to thedistribution of samples of drugs by mail orotherwise to physicians, dentists or veterinarysurgeons or to the distribution of drugs other

than those mentioned in the Third Scheduleto registered pharmacists for individualredistribution to adults only or by a

Distributor in compliance with individual requests.

14. Any person who sells any cosmetic which

(a) has in or upon it any substance that may cause injuryto the health of the user when the cosmetic is used

(i) according to the directions on the label or

accompanying the cosmetic; or(ii) for such purposes and by such methods of use as

are customary or usual therefore;

(b) consists in whole or in part of any filthy ordecomposed substance or of any foreign matter; or

(c) was manufactured, prepared, preserved, packed orstored under unsanitary conditions, is guilty of anoffence.

Law concerning devices

17. Any person who sells any device which,

when used according to directions or

under such conditions as are customary orusual, may cause injury to the health of 

the purchaser or user thereof, is guilty of 

an offence.

18. (1) Any person who labels, packages, treats,processes, sells or advertises any device in amanner that is false, misleading or deceptiveor is likely to create an erroneous impressionregarding its character, value, composition,merit or safety, is guilty of an offence.

(2) A device that is not labelled or packaged asrequired by the Regulations, or is labelled or

packaged contrary to the Regulations, shall bedeemed to be labelled or packaged contraryto subsection (1).
