The answers to your specific questions are as follows: Please provide all the information you have given to new junior doctor starters at induction at the beginning of August 2016 regarding the new junior doctor contract. Please state if you are requiring any of these new junior doctors of any grade to sign a contract that differs from the 2002 national terms and conditions of service*. If you are requiring any doctor to sign a contract or other document different to this, please provide a generic copy of that contract/statement that you are requesting any doctor sign. The Trust will transfer all Doctors onto the new 2016 TCS as stipulated in the Implementation Timeline attached above. As such, no Doctors within the Trust have as yet been asked to sign the 2016 TCS. 1. Terms and Conditions
1.1 Your appointment is subject to the Terms and Conditions of Service of Hospital Medical and Dental Staff and doctors in Public Health Medicine and the Community Health Service (England and Wales) as amended from time to time and any reference in those Terms and Conditions to any employing Authority shall be construed as if it were to include a reference to an employing Trust. Your contract of employment will not override any statutory provisions.
1.2 The Trust reserves the right, in agreement with a recognised union or other employee representative, to amend your Terms and Conditions of Service of Hospital Medical and Dental Staff and doctors in Public Health Medicine and the Community Health Service (England and Wales). In accepting employment with the Trust you accept that your terms and conditions of employment may be varied according to this procedure and accept any such variation. You will be notified of any variations in writing. Such local terms and conditions shall prevail over any provision in this Contract.

1.4 By accepting these Terms and Condition of employment, you enter into an express commitment to abide by the NHS Constitution and the specific staff pledges:
aim to maintain the highest standards of care and service, taking responsibility not only for the care you personally provide, but also for your wider contribution to the aims of your team and the NHS as a whole.
aim to take up training and development opportunities provided over and above those legally required of your post.
aim to be open with patients, their families, carers or representatives, including if anything goes wrong; welcoming and listening to feedback and addressing concerns promptly and in a spirit of co-operation. You should contribute to a climate where the truth can be heard and the reporting of, and learning from, an error is encouraged.
2. Duties
2.1 You will be available for duty hours, which in total will not exceed the duty
hours set out for your working pattern in paragraph 20 of the Terms and
conditions of Service.
2.2 Your working pattern is described as full shift with controls on hours as defined
in the Terms and Conditions of Service paragraph 20. Changes to the work
pattern are not permitted without the agreement of your Clinical Director,
Senior General Manager and Medical Staffing to comply with EWTD 2009
and Health and Safety Legislation.

2.3 A non-pensionable supplement at paybands detailed above will be payable in
accordance with paragraph 22 of the Terms and conditions of Service. (For
rotations, banding supplements may differ for each individual
post/placement).
2.4 Banding supplements may be altered (in accordance with paragraphs
5.5 and 6.3 below) in the light of changes in working patterns in order to
make posts compliant with the New Deal. If the payband changes, you
will be issued with a letter of variation (in accordance with paragraph 6
below). Pay protection will apply in accordance with paragraph 21 of the
Terms and Conditions of Service.
3. Pay
3.1 Your base salary is detailed on the front page of these terms and conditions,
paid monthly and will progress by annual increments, per annum, in
accordance with the current national agreed salary scale for your grade.
(These rates are subject to amendment from time to time by national
agreement.) See Note 1.
3.2 Your incremental date is listed on the front page of these Terms and
Conditions. Your salary has incremental credit for previous service. If you
have any enquiry about how this has been calculated, please contact Medical
Staffing.
3.3 You will receive, in addition to your base salary a supplement at the rate
shown overleaf of your base salary for duty contracted band as set out in
paragraph 2.3 above, which will be payable monthly. (These rates may be
amended from time to time by national agreement).
4. Pension Scheme
4.1 The Pension Act 2008 requires employers to automatically enrol all new employees into a pension scheme on commencement of their employment. Details of the scheme benefits are contained in the NHS Pension Scheme Guide which you can download from the website: www.nhsbsa.nhs.uk/pensions
4.2 The NHS Pensions Scheme (NHSPS) is a qualifying pension scheme and
is the default Scheme for all NHS employees. You will be automatically enrolled in the NHS Pension Scheme if you meet the scheme’s eligibility criteria. If you do not meet the eligibility, the Trust will enrol you in the alternative qualifying pension scheme, National Employee’s Savings Trust (NEST).
4.3 Retirement
In order to retire and claim your NHS Pension Benefits, please contact the
trusts pensions department, at least four months before your intended
retirement date.
5. Monitoring of working patterns
5.1 The Trust is contractually obliged to monitor junior doctors’ New Deal
compliance and the application of the banding system, through robust local
monitoring arrangements supported by national guidance. You are
contractually obliged to co-operate with those monitoring arrangements.
5.2 These arrangements will be subject to:
Review by the regional improving junior doctors working lives action team (or equivalent) and
For the Trust, the performance management systems.
5.3 The Trust must collect and analyse data sufficient to assess hours’
compliance and/or to resolve pay or contractual disputes. Therefore, when
the Trust reasonably requests you to do so, you must record data on hours
worked and forward that data to the Trust.
5.4 The Trust is required to ensure that staff in all training grades comply with the
controls on hours of actual work and rest detailed in sub-paragraph 22.a of
the Terms and Conditions of Service, and with the requirements of the
Working Time Regulations as amended from time to time.
5.5 You are required to work with your employer to identify appropriate working
arrangements or other organisational changes in working practice which
move non-compliant posts to compliant posts and to comply with reasonable
changes following such discussion.
6. Revision to Pay Banding
6.1 The Trust will notify you in writing of its decision on banding.
6.2 Full details of the procedure for appealing against banding decisions are in
the Terms and Conditions of Service sub-paragraph 22.l
6.3 Full details of the procedure for rebanding posts are in the Terms and
Conditions of Service sub- paragraph 22.m.
7. Notice
7.1 The Departments and the profession have agreed that minimum periods of
notice should be applied as follows, unless there is agreement by both parties
to a contract that a different period should apply:
Foundation Year 1 2 weeks
Foundation Year 2 1 month
Specialty Registrar (Fixed term) 1 month
Specialty Registrar (Core Training) 1 month
Specialty or Specialist Registrar 3 months
7.2 The Employment Rights Act 1996 provides entitlement to minimum periods of
notice, dependent upon an employee’s length of continuous employment as
follows:

8. Registration and insurance
.
8.1 You are required to be registered and hold a licence to practice with the
General Medical Council throughout the duration of your employment.
8.2 You are normally covered by the NHS Hospital and Community Health
Services indemnity against claims of medical negligence. However, in certain
circumstances (especially in services for which you receive a separate fee)
you may not be covered by the indemnity. The Health Departments therefore
advise that you maintain membership of your medical defense organisation.
9. Continuous Service
9.1 Trust employment date
For the purposes of the Employment Rights Act 1996, your period of continuous
service with the Trust is stated on the first page of these terms and conditions
9.2 Previous eligible employment
Your continuous employment with other relevant NHS bodies, for this purpose, will
be recognised in relation to the entitlements such as annual leave, sick pay,
maternity pay and redundancy benefits.
10. Additional Work
You agree not to undertake locum medical or dental work for this or any other
employer where such work would cause your contracted hours (or actual
hours of work) to breach the controls set out in paragraph 20 of the Terms
and conditions of Service.
11. Residence
The appointment does not require you to reside in hospital but should you
choose to do so a deduction from salary for lodgings will accordingly be made
in accordance with the Terms and Conditions of Service and occupation set
out in the tenancy agreement/licence.
It is your responsibility to ensure that when on call you will be available by
telephone and able to reach your hospital in time to meet your clinical
commitments. Copies of HSC2000/036 relating to standards of residential
accommodation may be obtained on request.
12. Leave
12.1 Your leave entitlement is detailed on the front page of this terms and
conditions.
12.2 Full details of both annual leave and sick leave allowances and the conditions
governing those allowances and study leave, are set out in the Terms and
Conditions of Service. All leave to be approved by the Consultant and co-
ordinated by the Clinical Unit Administrator.
13. Property
13.1 East Sussex Healthcare NHS Trust accepts no responsibility for damage to or
loss of personal property, with the exception of small valuable handed to their
officials for safe custody. You are therefore recommended to take out an
insurance policy to cover your personal property.
13.2 Notwithstanding (a) above, East Sussex Healthcare NHS Trust undertakes,
so far as is reasonably possible, to ensure that lodgings are maintained in a
secure condition.
13.3 You should, through the exercise of normal diligence, also seek to maintain
the security of your lodgings.
14. Deductions
East Sussex Healthcare NHS Trust will not make deductions from or
variations to your salary other than those required by law without your
express written consent.
15. Sickness Absence
The provisions relating to absence by you because of sickness appear in
paragraph 225 – 244 of the Terms and Conditions of Service.
16. Grievance procedure
The Grievance procedures, which apply to your employment, are set out on
the Intranet
17. Disciplinary procedure
Wherever possible, any issues relating to conduct, competence and
behaviour should be identified and resolved without recourse to formal
procedures. However, should we consider that your conduct or behaviour
may be in breach of our code of conduct, or that your professional
competence has been called into question, the matter will be resolved
through our disciplinary or capability procedures and will be subject to the
appear arrangements set out in these procedures (which will be consistent
with the ‘Maintaining High Professional Standard in the Modern NHS’
framework). Copies of HSC 2000/031 – Modernising Pay and Contracts for
Hospital Doctors and Dentists in Training may be obtained on request.
18. Acceptance
If you agree to accept the appointment on the terms specified above, please
sign the form of acceptance and return one complete copy of this terms and
conditions to me. A second signed copy of this is attached, which you should
also sign, and retain for your future reference

STATEMENT OF TERMS AND CONDITIONS OF EMPLOYMENT

THE POST
1. Doctor in Approved Training
1.1. Your job title is [ i] in [ ]ii.
1.2. The appointment is subject to the national Terms and Conditions of Service for doctors and dentists in training (“the TCS”), 2016, which may be amended from time to time. A copy of the TCS is available on the NHS Employers website.
1.3. Your employment is conditional upon you continuing to hold a place in an approved postgraduate training programme.
1.4. It is a condition of your employment that you sit and pass such examinations as are required for the completion of your training. These must be completed in accordance with the curriculum and within the timescale approved by the General Medical Council (GMC) and/or for dentistry the General Dental Council (GDC) or other relevant body.
1.5. It is a condition of your employment that you have, and retain throughout your employment, the correct level of professional registration commensurate with your grade, and that during this period, you additionally continue to hold a licence to practise.
2. Commencement of Employment and Pay Point
2.1. Employment under this contract commences on 5th October 2016 and will terminate/terminates on 4th October 2017.
2.2. Your continuous employment with this employing organisation, for the purposes of the Employment Rights Act 1996, begins on [ iii].
2.3. For the purposes of certain NHS conditions of service, previous service within the NHS, whether with this employer or another NHS employer, although not continuous for the purposes of the Employment Rights Act 1996, will count as reckonable. For some purposes, dates prior to the dates in paragraphs 2.1 and 2.2 above may, therefore, be taken into account.
2.4. The standard full-time working week under this contract is 40 hours per week. Your actual hours of work under this contract will be no more than 48 hours per week on average and will be as set out in your work schedule. Should the hours in your work schedule be varied following a change of post or placement or following a work schedule review (as detailed in Schedule 5 of the 2016 TCS), your salary will be amended accordingly.
2.5. Your salary will be assessed in accordance with the pay framework set out in Schedule 2 of the 2016 TCS. If you are working less than the standard full-time working week, your salary will be adjusted pro rata in accordance with your contracted hours of work.

2.6. The maximum number of hours that may be worked in any given week is set out in Schedule 3 of the 2016 TCS.
2.7. Up to 40 hours of work per week are pensionable in the NHS Pension scheme.
3. General Mutual Obligations
3.1. While it is necessary to set out formal employment arrangements in this contract, we also recognise that you are a professional employee. It is essential that you and your employer work in a spirit of mutual trust and confidence. Your employment in a training post requires you to actively progress in your training, including the sitting and passing of such examinations as are set out in your training curriculum, and requires your employer to provide an appropriate training environment. You and we agree to the following mutual obligations in order to achieve the best for patients and to ensure the efficient running of the service:
3.1.1. to co-operate with each other and maintain goodwill;
3.1.2. to carry out our respective obligations in operating a work schedule;
3.1.3 to carry out respective obligations in accordance with educational and training requirements;
3.1.4 to carry out our respective obligations relating to the employer’s policies, objectives, rules, working practices and protocols; and
3.1.5 to carry out our respective obligations as defined in the Terms and Conditions of Service for NHS Doctors and Dentists in Training (England) 2016.
THE WORK
4. Location
4.1. Your principal place of work is [ iv]. Other work locations, including off site working, may be incorporated in your work schedule where appropriate. You will be expected to undertake duties at the principal place of work, other sites where your employer offers services or other locations identified in the work schedule. You may also be required to travel between work sites and attend official meetings at other locations.
5. Duties
5.1. Except in emergencies or where otherwise agreed with your manager, you are responsible for fulfilling the duties and responsibilities set out in Schedule 1 of the 2016 TCS and undertaking the activities set out in your work schedule, as reviewed from time to time in line with the provisions in paragraph 7.2 below.

6. Emergency Responses
6.1. In exceptional circumstances you may be asked to return to site or remain at work for emergencies outside of the expectations in your work schedule; however, you are not required to be available for such eventualities.
7. Work Scheduling
7.1. In accordance with Schedule 4 of the 2016 TCS, the purpose of your work schedule is to set out in clear and transparent terms the service commitments expected of you while in the post, and the parts of your training curriculum which can be achieved in the post. Additionally, you will be required to meet with your educational supervisor to agree and to include in your personalised work schedule other objectives that should reasonably be covered during this employment. The work schedule is not contractually binding in itself, but you have a duty to make all reasonable efforts to follow it.
7.2. The process for discussion and review of work schedules is set out in Schedules 4 and 5 of the 2016 TCS.
7.3. Scheduling of Activities
7.3.1. The work schedule will set out the hours and range of activities that are necessary to fulfil your duties and responsibilities under this contract, and include the duration and locations at which these activities are scheduled to take place.
7.3.2. Additional hours (up to the maximum set out in Schedule 3 of the TCS) may be contracted for separately from time to time. The rates for basic pay are set out in the latest pay circular.
7.3.3. Any variations in your scheduled weekly commitments should be averaged out over the length of the rota cycle, the length of your placement or 26 weeks, whichever is shorter, so that your average commitment is consistent with the provisions of the Working Time Regulations 1998 as amended from time to time.
7.4. Where emergency work takes place at regular and predictable times and / or in predictable amounts, it will be accounted for prospectively within the work schedule. You may be required to participate in an on-call rota to respond to unpredictable emergencies.
7.5. Where you have approved external duties included in your work schedule, you will provide six weeks’ written notice to your employer of the dates upon which the external duties will be carried out. 8. Spare Professional Capacity
8.1. The 2016 TCS, Schedule 3, outlines contractual limits on working hours and rest periods. While in this employment, you should not ordinarily undertake work outside of this contract. Where you do wish to undertake any such work as a locum, you must first offer your services to the NHS as set out in the paragraphs pertaining to locum work in Schedule 3 of the TCS.

PAYMENT
11. Pay

12. Deductions from Pay
12.1. We will not make deductions from, or variations to, your salary as set out at paragraph 11.1 other than those permitted by law without your express written consent.
13. Pension
13.1. Unless you are deemed ineligible, you will automatically be enrolled as a member of the NHS Pension Scheme subject to its terms and rules, which may be amended from time to time.
13.2. Pensionable pay will include basic salary and any other pay expressly agreed to be pensionable in Schedule 2 and Schedule 14 of the 2016 TCS.
14. Expenses
14.1. You may be entitled to reimbursement for travel, subsistence and other expenses, as set out in Schedule 11 of the 2016 TCS. Claims for expenses must be submitted in a timely manner (normally within one month of the time that the expenses were incurred).

THE POST
1. Doctor in Approved Training

1.2. The appointment is subject to the national Terms and Conditions of Service for doctors and dentists in training (“the TCS”), 2016, which may be amended from time to time. A copy of the TCS is available on the NHS Employers website.

1.4. It is a condition of your employment that you sit and pass such examinations as are required for the completion of your training. 1.5. It is a condition of your employment that you have, and retain throughout your employment, the correct level of professional registration commensurate with your grade, and that during this period, you additionally continue to hold a licence to practise.
2. Commencement of Employment and Pay Point

3. General Mutual Obligations
3.1. While it is necessary to set out formal employment arrangements in this contract, we also recognise that you are a professional employee. It is essential that you and your employer work in a spirit of mutual trust and confidence. Your employment in a training post requires you to actively progress in your training, including the sitting and passing of such examinations as are set out in your training curriculum, and requires your employer to provide an appropriate training environment. You and we agree to the following mutual obligations in order to achieve the best for patients and to ensure the efficient running of the service:
3.1.1. to co-operate with each other and maintain goodwill;
3.1.2. to carry out our respective obligations in operating a work schedule;
3.1.3 to carry out respective obligations in accordance with educational and training requirements;

THE WORK
4. Location

6. Emergency Responses
6.1. In exceptional circumstances you may be asked to return to site or remain at work for emergencies outside of the expectations in your work schedule; however, you are not required to be available for such eventualities.
7. Work Scheduling
7.1. In accordance with Schedule 4 of the 2016 TCS, the purpose of your work schedule is to set out in clear and transparent terms the service commitments expected of you while in the post, and the parts of your training curriculum which can be achieved in the post. Additionally, you will be required to meet with your educational supervisor to agree and to include in your personalised work schedule other objectives that should reasonably be covered during this employment. The work schedule is not contractually binding in itself, but you have a duty to make all reasonable efforts to follow it.
7.2. The process for discussion and review of work schedules is set out in Schedules 4 and 5 of the 2016 TCS.
7.3. Scheduling of Activities
7.3.1. The work schedule will set out the hours and range of activities that are necessary to fulfil your duties and responsibilities under this contract, and include the duration and locations at which these activities are scheduled to take place.
7.3.2. Additional hours (up to the maximum set out in Schedule 3 of the TCS) may be contracted for separately from time to time. The rates for basic pay are set out in the latest pay circular.
7.3.3. Any variations in your scheduled weekly commitments should be averaged out over the length of the rota cycle, the length of your placement or 26 weeks, whichever is shorter, so that your average commitment is consistent with the provisions of the Working Time Regulations 1998 as amended from time to time.
7.4. Where emergency work takes place at regular and predictable times and / or in predictable amounts, it will be accounted for prospectively within the work schedule. You may be required to participate in an on-call rota to respond to unpredictable emergencies.
7.5. Where you have approved external duties included in your work schedule, you will provide six weeks’ written notice to your employer of the dates upon which the external duties will be carried out. Your working pattern is arranged across a rota cycle of 8 weeks, and includes:
20 Normal days – on normal days typically allocated doctors will attend clinics, maternity day units,
elective caesarean patients, and antenatal and postnatal ward rounds.
7 Long days (of which 2 are at the weekend) - on long days you will typically be doing an all day
theatre list, antenatal and postnatal ward rounds.
7 Night shifts (of which 2 are at the weekend) - on nights you will typically be providing emergency

Training Opportunities:

with the formal and informal learning opportunities available to the post-holder.
St Elsewhere NHS FT expects that the following should be able to be achieved whilst in this post, in
line with the Royal College of Obstetricians and Gynaecologists expectation of educational
progression:
Curriculum progression (as evidenced in the log book on the ePortfolio) - progress with signing
off intermediate competencies, completion of basic ultrasound modules for trainees starting as
ST1 from August 2013.
Clinical skills - work on-call without direct supervision when competencies have been confirmed.
Formative OSATS (SLE) showing evidence of training since last ARCP – hysteroscopy,
laparoscopy, operative laparoscopy (e.g. laparoscopic sterilisation/ simple adnexal surgery.
At least 3 summative OSATS confirming competence by more than one assessor (can be
achieved prior to the specified year) - Basic ultrasound modules with relevant summative OSATs
for trainees starting as ST1 from August 2013 onwards.
Evidence of at least one consultant observed summative OSAT for each item confirming
continuing competency since last ARCP - caesarean section, operative vaginal delivery, surgical
management of miscarriage.
Mini-CEX x8 and CbDs x8 - These should be obtained throughout the year, not just in the weeks
before ARCP/RITA. The WBAs should reflect a level of complexity expected at that year of
training. Trainees should have a mixture of obstetrics and gynaecology WBAs and, in the first 5
years of training, there should be four in obstetrics and four in gynaecology. Thereafter, they
should reflect the nature of the attachments undertaken.
Reflective practice x8 - The number of reflective practice logs that have been revealed to the
educational supervisor. Reflective practice logs should include reflection on all serious and
untoward incidents and complaints that the trainee has been named in.
Regional teaching - attendance at regional teaching programme as per regional guidelines.
Obligatory courses - obstetric simulation course – ROBUST or equivalent for trainees entering
ST1 from August 2015 onwards.
Team observation (TO) forms - TO1s at least twice per year as per RCOG recommendations.
