THIS MATTER was heard by the Florida Elections Commission (Commission) at its

regularly scheduled meeting on October 28, 2014, in I allahassee, Florida.

Based on the Complaint, Report of Investigation, Staffs Recommendation, and oral

statements (if any) made at the probable cause hearing, the Commission finds that there is

probable cause to charge Respondent with the following violation(s):

Count 1:

On or about November 12, 2013, Jesus Salas violated Section 106.07(1), Florida Statutes, when he failed to file timely with the filing officer, Florida's Families First's 2013 Ml 0 Report, listing all contributions received and all expenditmes made, by or on behalf of the committee

Count2:

STAFF RECOMMENDATION FOLLOWING INVESTIGATION

Pursuant to Section 106 25(4)(c), Florida Statutes, undersigned staff counsel files this written recommendation for disposition of the refonal in this case recommending that there is probable cause to charge Respondent with violating Section 106.07(1), Florida Statutes. Based upon a thorough review of the Report of Investigation submitted on May 23, 2014, the following facts and law support this staff recommendation:

I On January 21, 2014, the Florida Elections Commission ("Commission") received a refonal fiom the Department of State, Division of Elections ("Division"), alleging that Jesus Salas, chairman and treasurer of Florida's Families Fhst ("Respondent") violated Chapter 106, Florida Statutes

2 Florida's Families First, a political committee ("Committee") filed its State of Florida Appointment of Campaign I reasurer and Designation of Campaign Depository for Political Committees form ("DS-DE 6") on August 8, 2013, appointing Respondent as its treasurer. (ROI Exhibit I, page 3) 1

3 By letter dated April 8, 2014, the Executive Director notified Respondent that Commission staff would investigate the following statutory provision:

Section 106.07(1), Florida Statutes: Jesus Salas, chairman and treasurer for Florida's Families First, a political committee, failed to timely file the 2013 MIO and 2013 Mil campaign treasurer's teports.

4. By letter dated August 16, 2013, Kristi Reid B1onson, Chief, Bureau of Election Records, sent Respondent a letter acknowledging that the Division had teceived the Committee's Statement of Organization form and Appointment of Campaign I reasurer and Designation of Campaign Depository fo1m ("DS-DE 6") and that the Committee was placed on the list of active committees (ROI Exhibit 2, page I)

5 Ms Bronson's August 16, 2013 letter advised Respondent that all committees filing reports with the Division are required to use the electronic filing system (EFS), and provided Respondent with a use1 identification number and initial password to giant access to the EFS Id The lette1 farther advised Respondent that all of the Division's publications and

The Committee's 2013 MIO Repo1t was due by November 12, 2013, but Respondent failed to file timely the report. The Division sent four notifications to Respondent's address listed on the Committee's DS-DE 6 fo1m informing Respondent that the Committee's 2013 MIO Repo1t had not been 1eceived The final notification was confitmed delivered on Januaiy 8, 2014 .. When we conclude the investigation, a copy of the Report of Investigation will be mailed to you at the above address. All 1cports must be completed and filed through the EFS not later than midnight, Eastern Standard Time. of the due date Reports not filed by midnight, East em Standard T imc, of the due date are late filed and subject to the penalties in Section 106 07(8), Florida Statutes In the event that the EFS is inoperable on the due date, the report will be accepted a' timely filed if filed no later than midnight, Eastern Standard Time, of the first business day the EFS becomes opernble .. No fine will be levied during the period the EFS was inopeiable.

Any political committee failing to file a report on the designated due date is subject to a fine of $50 per day for the first 3 days and, thereafter, $500 per day for each day, not to exceed 25% of the total receipts or expenditures, whichever is greater, for the period covered by the late report However, for the reports immediately preceding each primary and general election, the fine shall he $500 per day .. not to exceed 25% of the total receipts or expenditures, whichever is greater, for the period covered by the late report.
