ORDER IN COUNCIL.WHEREAS the enactment contained in Section 74 of"The Constitution Act, 1889," whereby the appoint-ment of all public officers under the Government of theState is vested in the Administrator in Council, does notapply to minor appointments which by Order in Councilare vested in Heads of Departments or other officers orpersons within the State: And whereas it is desirablethat the appointment of foreman and all other personsemployed at a daily rate of wage on works under thecontrol of the Public Works Department should be vestedin Mr. Herbert John Sheppard: Nov, therefore, HisExcellency the Administrator, by and with the adviceof the Executive Council, hereby vests in the said Her-bert John Sheppard, and any person or persons appointedto temporarily act in place of such officer, the appoint-ment of foreman and all persons employed on such worksat a daily rate of wage. Seliittg Goods on the Reserves.10. No person shall sell or expose for sale any goods,

wares, merchandise, or things on any portion of the saidreserves or caves unless, the consent, ill writing, of theBoard shall be previously obtained, and upon paymentof such fees as the Board may direct in each ease.

Waste .Litter of Picnics to be removed.11. When any person, party, company, Society, club,

or organisation of any kind shall play any game, orshall picnic ill or upon the reserves, he or they (as thecase may he) shall immediately prior to leaving thegrounds collect and remove, or cause to be collected andremoved, all -waste material, bottles, broken glass, scraps,paper, litter, or rubbish of any kind imought or madeupon the ground by them.

Camping and lighting Fires.12 No person or parsons shall camp or light any fire

oi.on any cave reserve, except in such poSition and underncln conditions as may be approved by the authorised

guide or caretaker, or a servant of the Board duly au-thorised, and upon permission of sue'': authorised ;'aid:,or caretaker or servant of the Board having first beenobtained.

Gallic not to be &pastured.NO person shall cause, suffer, or allow any horse,sheep, goats, camel, donkey, mule, pig or other

animal to stray or departure upon any reserve or re-serves without the special approval of the Board havingbeen first obtained in writing., and upon payment of suchfees as the !Board may direct in each case.

Lights to be used.14. No person shall use in ally cave any artificial

light or lights except those provided by the Board orits servants.

Smoking in Cares.13. No person shall smoke within any cave.

Taking Photographs.16, No person shall take photographs in any cave

without the permission of the guide or earetaker, andupon payment of any or such fees as the Board maydirect in each case.Guide or Caretaker may remove any person guilty of

improper conduct.1 7. Any guide, caretaker, or servant of the Board

may exclude or remove, from the reserves or caves anyperson or persons guilty of a breach of these By-laws.

11S. No person shall, without the permission of theBoard first obtained, ply for motor or other vehicularDire or cal'ig CUO convey any passenger or luggagefor hire (Within Reserve A 8427, within which Cave House,Yallingup, is situated.

Any such permission as aforesaiit may be given forsuch period as the Board of Management may fromtime to time determine.

The Board Of Manrigmnent may make it a conditionof the granting of any permission under these 13y -lawsthat the person applying for such permission shall paysneh fees as may i. from time to time ordered by theBoard of Mantrimment with the approval of the ColonialSecretary.

Penalty.10. Every person offending against any of the pro-

visions of these By-laws shall forfeit and pay, on con-viction, a penalty not exceeding Twenty pot-link.

MARINERS and all persons navigating the Inner Har-bour Basin at Fremantle, Western Australia, are herebynotified that dredges are engaged in deepening opera-tions in the basin, and Mariners approaching thesedredges must use the whistle (sound) signals laid downin Article No. 28 of the Board of Trade Regulations forpreventing collisions, viz.:

Upon which the dredge will (provided she is not show-Mg by day a red flag or by night two vertical red lightsas provided for hereunder) haul over as far as possiblein the direction opposite to the side which the approach-big vessel has indicated as above that she desires touse. Approaching Mariners must be careful in .usingthese sound signals to give sufficient time for the dredgeto move as indicated.

If the approaching vessel makes no signal the dredgewill remain stationary.

The signals exhibited by dredges working in the fair-way are as follows:--

1. When dredge exhibits a Black Ball shape by day ora Green Light under a White Light, four feetapart by night Vessels coining in must leavedredge on their own starboard hands, and outgoingvessels must leave dredge on their own port hands.

2. When dredge exhibits a Black Diamond shape byday or a Red Light under a White Light, fourfeet apart, by nightVessels coining in must leavethe dredge on their own port hands, and outgoingvessels must leave dredge on their own starboardhands.

3. When dredge exhibits a Red Flag by day or twoRed Lights vertically four feet apart by night,this denotes that dredge cannot be moved fromher position, and if sufficient room exists forvessels to pass, the side on which they are to passwill be indicated by one of the signals detailedunder No. I and 2 above being also shown. If,however, neither of these latter signals is shown,the dredge must not be passed till either daylightappears or definite orders have been received fromthe Harbour Master.

Occrtimc.(a.) For work done beyond the hoursor duty On any ordinary day payment shall be at therate of time and a half for the first two hours and doubletime thereafter.

(b.) Duty on Sundays or holidays shall be paid atdouble time,

(e.) These overtime rale;s shall not apply to excesstime due to private arrangement between the employeesthemselves, or which is necessary for effecting periodicalrotation of shifts or which is owing to a relieving mannot coming at the appointed time.

The time for which any worker may be paid at ordin-ary rates instead of overtime, due, to a relieving mailnot coming at the proper time shall not exceed twohours, after the expiration of which overtime rates shallapply.

(0.) When workers arc engaged on a process whichis necessarily continuous such process may be workedon Sunday at the ordinary rate, if the workers are notrequired to work more than six days consecutively.

(e.) When computing overtime the district allowanc:?sshall not be computed as an addition to the day's pay.

6. Wet Planes.Ill all wet or hot places eighteen-pence extra per shift shall be paid in addition to therates set out. This extra payment shall not apply toSul:clause (e) of Clause 4.

7. Dry Crushing Plant,s.No dry crushing plant shallhe operated unless such conditions as obviate dust as faras is reasonably practicable. It shall be the duty ofthe Inspector of Mines to make an examination of alldry crushing plants in his districts, once in each month,and at such other times as he may be requested so to doby the Secretary of the 'Union. He shall examine andreport to the Court, and such report shall be prima facieevidence of the facts stated therein.

Piece ll'orker8.--There shall be implied in everycontract in which it worker is engaged to perform anykind. of work at or for It remuneration other than therates fixed he' this Award, the terms and conditions here-inafter set forth, viz.:

(a.) Where the engagement is for a period of timesuch period shall not be determined before the expira-tion thereof, without the written consent of the worker.

(b.) Where the engagement is to perform It specifiedquantity of ~cork the amount of work to be performedshall not be curtailed by a greater amount than 5 per

(f.) Where the work is to be carried out by a boclyof workers acting together, the number of workers tobe employed shall be specified in the contract. In theevent of the specified number of workers not being pre-sent 0uring any shift, the employer may provide a sub-stitute in the pia,. of any worker absent, and shall paysuch substitute wages at the rate fixed by this Award,or 1)y- the contract whichever shall be the greatest, forthe work done by -him during the time he is so employedas it substitute, and may charge such payment againstally Malley found due under the contract.

11. Mixed Fanetions.Any worker carrying out workclassified at a higher minbnum than his ordinary ratefor to.0 hours in any shift, shall be paid at the minimumrate for such work for the whole of that shift, providedthat such minimum is not lower than such worker 'sregular rate of pay. If he be employed for less thantwo hours at work classified at a higher minimum thanhis ordinary rate, he shall be paid Ids ordinary rate forthe whole shift.

15. Changc nooms.If more than four persons areemployed_ umh.rground in any mine in one shift, sufficientaccommodation shall be provided above ground near theprincipal entrance to the mine, 1111,1 not in the engineroom or boiler house, for enabling the persons employedin the mine to conveniently dry and change their clothes,and in no case shall men change their clothes upon a

IT. Nedaction of liaPds.Should occasion arise toreduce the number of men employed, the management, inselecting those to be retained, shall give full weight tothe cousideration of length of service, and, all thingsbeing equal, shall retain those who have been longest inthe employ of the company.

18. Accidei;1 Pay.In the event of an employee meet-ing with ;111 accident during the shift, or being requiredto attend to one who has met with an accident, he shallhe deemed to have rendered fluty during the whole ofthe shift, and be paid accordingly.

19. Rell Payment for Shift.After beginning a shiftworkers shall not be paid less than for a full shift,unless they leave of their 011.11 ileesallt, or are dismissedfor misconduct. This shall not apply in matters beyondthe contra] of the management.

20. Water Jets.Provision of the regulations madeunder the Mines Regulation Act for the prevention ofdust shall be deemed to be incorporated in this Award.

21. Payment of .frages.Pa.y day shall be in accord-ance with Section 55 of the Mines Regulation Act. Anytyorker leaving. or being discharged shall be paid thefull amount of wages due to him within one hour ofceasing work, or within one hour of the opening of themine office, if such office was closed at the time of hisceasing work, or if the work done requires to be measuredor assessed, within two hours of ceasing, work.

22, Hours in 1-Tot Places.No person shall be allowedto work for a longer period than six hours in any partof the underground working of a mine when the tem-perature in that part ascertained by the reading of theloot bulb thermometer exceeds Ti degrees Fahrenheitfor n period of four consecutive hours. The reading ofthe thermometer shall he ascertained at intervals of one-half hour over four hours, and the average of suchreading's shall be taken as the temperature during thatperiod. The Inspector of Mines shall take readings10110n requited so to (.10 by any worker or by the Secre-tary of the Union. The manager of the mine shall pro-N'1116 a wet bulb thermometer.

23. Annual Ilcnidays. A fortnight's holiday, includ-ing twelve working days, shall be granted once in eachyear to every worker on full pay. Provided that, shouldthe employment be terminated before the holiday is clue,the worker shall, after the completion of one month'sservice, be entitled to one clay's pay in lieu of holidaysfor every month and proportionately for any portion ofmonth of service. Provided further that where theworker is dismissed to wilful misconduct he shall notbe entitled to the benefit of the provisions of this clause.A piece-worker shall be entitled to be paid when on holi-day the minimum rate for his grade.

24. Underground Workers.All men who have to gounderground to work, and the bracemen, shall work thesame hours as miners.

25. .Explasives.All men using explosives shall beclassed as miners.

26. Linte.Lime used in the reduction of ore shallnot be mixed in battery bins.

27. District Adcocances.ln addition to the wagesprescribed in Clause 3 of this Award, the followingallowances shall be paid for six' days per week to workersemployed in the districts of:

(1.) Hampton Plains, Mount Nit:sager, Gwalia,Laverton, and St. IvesOne shilling per day orportion of a day extra.

(2.) Mulline, Iliverina, Yundamindera, and LindenOne shilling and sixpence per day or portion ofa day extra.

(3.) Lawlers and WilunaOne shilling and ninepenceper day or portion of a day extra.

(4.) NorsemanSixpence per clay or portion of aday extra.

In addition to the above the Court reserves to itselfthe power on the application of any person or partybound by this Award to prescribe a district allowancefor any area not specified and comprised within the areacovered by this Award.

28. Definitions." Wet Places."Should any dispute arise as to

whether any place is wet or especially wet within themeaning of Clause 4, Subclatise (e), such dispute shallbe referred to a Board, constituted of a representativeappointed by the employer and a representative appointedby the Miners' -Union of which the worker concerned isa member, with the Warden of the Goldfields in whichsuch mine is situated as Chairman. The decision of amajority of the Board shall be final.

"Timber Man" (ordinary).Timber man shall meana worker engaged in underground timberwork, but aminer timbering his own working's shall not be classedas a timber man.

"Timber Man" (shaft).A shaft timber man shallmean a worker engaged in shaft timbering or timberwork, but a. miner timbering his own shaft shall not lieclassed as a shaft timber man.

"Braceman."Braceman shall mean any worker ischarge of a cage at the mouth of a shaft; if more thanone cage each worker shall be classed as a bracemen,but shall not include any worker who may be temporarilyassisting a braceman in loading.

" Platman '' (or "Skipman") shall mean any workerin charge of a cage or skip; if more than one cage orskip each worker so in charge shall be classed as a plat-man or skipman.

"Hot Places" shall mean places underground wherethe temperature exceeds 76 degrees Fahrenheit, using'the wet bulb.

29. Antendinent of Award. This Award may, on theapplication of any party or person affected by its pro-visions, be amended by the Court after the expiration oftwelve months from the date hereof.

15. Apprentices. (a.) Au apprentice means a workerregistered as an apprentice in manner hereinafter pro-vided.

(b.) The term of apprenticeship shall be five years.A probationary period of three months previous to beingbound shall be lawful, such probationary period to becounted as portion of the term in the event of the pro-bationer becoming bound.

(c.) Any employer hereafter taking an apprentice orprobationer shall, within fourteen days theremfter, regis-ter such apprentice or probationer by giving noticethereof to the Clerk of the Court, in the prescribed form:Provided that an apprentice or probationer shall bedeemed to be duly registered during the said period offourteen days.

(d.) The proportion of apprentices to Carpenters shallbe one to three or fraction of three.

(e.) H. the apprentice is employed on a mine, andthe mine ceases any operations in which. the apprenticeis engaged, the afTrenticeship may be terndnated, inwhich case the apprentice Shall he given a certificate toshow the time he has served. Should the apprenticedesire to complete his nJprenticeship with another em-ployer, the certificate lie has received from a formeremployer shall be prima facie evidence of the wageshe is entitled to receive and of the period accessary tocomplete his apprenticeship.

(f.) The following provisions shall apply in 'respectof all apprentices:

(1.) An employer 'shall be deemed to undertake theduty which he agrees to perform, viz., teaching Deapprentice the trade as a duty enforceable under thisAward, and shall pay the apprentice the rate of wagesherein proVided.

(2.) At the end of the period of apprenticeship theemployer shall give the apprentice a certificate to showthat lie has served his apprenticeship. Should the em-ployer at any time before the termination of the termof apprenticeship desire to dispense with the servicesof the apprentice he may, with the consent of theapprentice, transfer him to another employer carryingon business within a reasonable distance of the originalemployer's place of business willing to continue to teachthe apprentice and to pay the rate of wages prescribedby this Award, according to the total length of timeserved, and generally to perform the obligations of theoriginal employer. He shall also give tin apprentice acertificate of the time served and of the rate of wagespaid, and shall give notice to the Cleric of the Court ofArbitration of such transfer in the form provided. Itshall not be obligatory upon the employer to find theapprentice another employer if lie shall so misconducthimself as to entitle the employer to discharge him, buthe shall nevertheless give him a certificate for the timeactually served.

(3.) An employer shall be deemed to fail in his dutytowards his apprentice if he wilfully migeets to keep himconstantly at work, but slackness of work may forum aproper ground for transferring him to an employer will-ing to undertake the responsibility of teaching

(4.) When an apprentice is discharged for cause, theemployer shall send notice in writing of the diseliargeand of the cause thereof to the said Clerk of the Court.

16. The minimum wage of any apprentice engagedunder the terms of this Award shall be subject to altera-tion by the Court when the wages of workers under thisAward are being revised or a new Award is made.

Should the apprenticedesire to complete his apprenticeship with another em-ployer, the certificate he has ,received from a formeremployer shall be prima fade evidence of the wageslie is entitled to receive and of the period necessary tocomplete his apprenticeship.

(f.) The following provisions shall apply in respectof all apprentices:

Should the em-ployer at any time before the termination of the termof apprenticeship desire to dispense with the servicesof the apprentice he may, with the consent of theapprentice, transfer him to another employer carryingon business within a reasonable distance of the originalemployer's place of business willing to continue to teachthe apprentice and to pay the rate of wages prescribedby this Award, according to the total length of timeserved, and generally to perform the obligations of theoriginal employer. Tie shall also give the anprenticecertificate of the time served and of the rate of wagespaid, and shall give notice to the Clerk of the Court ofArbitration of such transfer in the form provided. Itshall not be obligatory upon the employer to find theapprentice another employer if he shall so misconducthimself as to entitle the employer to discharge him, buthe shall nevertheless give him a certificate of the timeactually served.

(3.) An employer shall be deemed to fail in his dutytowards Ids apprentice if he wilfully neglects to keephim constantly at work, lint slackness of work may forma proper ground for transferring him to an employerwilling to undertake the resuonsibility of teaching him.

(4.) When an apprentice is discharged for cause, theeinnloyer shall send notice in writing of the discharge,and the cause thereof, to the said Cleric of the Court.

13. The minimum wage of any apprentice engagedunder the terms of this Award shall be subject to altera-tion by the Court, when the wages of workers underthis Award are being reviewed, or a new Award is made.

(b.) A day's work on the surface shall be deemed tobe satisfied if time of duty be eight and three-quarterhours 011 five days in each week and four and a-quarterhours on one clay.

5. 0 vertime.(a.) For work done beyond the hoursof duty on any ordinary day payment shall be at therate of time and a-half for the first two hours anddouble time thereafter.

(b.) Duty on Sundays or holidays shall be paid atdouble time.

(c.) When computing overtime the district allowancesshall not be computed as an addition to the clay's pay.

6. holidays. The following days shall be holidays:Christmas Day, !Easter Monday, and Labour Day. IfChristmas Day fall on a Sunday the following Mondayshall be kept.

7. Casual IF orkers.--Mell employed for less than oneweek shall be considered casual, and shall receive oneshilling' per shift above the rates specified for the work.

S. Free IF a,1 cr.In all districts where free wateris supplied by the employer, single men shall get threegallons, and married nee six gallons per day.

9. Union. 0 cia' .A duly accredited official of the.Union shall be allowed to collect Union fees at theoffices of the mine on pay days, and shall be allowedto inspect time sheets and pay sheets relating to anyworker affected by this Award, and make extracts there-from.

10. A mt,kat Holidays.A fortnight's holiday, includ-ing twelve working days, shall be granted once in eachyear to every worker on full pay. Provided that, shouldthe employment be terminated before the holiday is duethe worker shall, after the completion of one month'sservice, be entitled to one day's pay in lieu of holidaysfor every month and proportionately for any portionof month of service. Provided further that where theworker is dismissed for wilful misconduct he shall notbe entitled to the benefit of the. provisions of this clause.A pieceworker shall be entitled to be paid when onholiday the minimum rate for his grade.

11. District At' owances.In addition to the wagesprescribed in Clause 3 of tlds Award, the followingallowances shall lie paid for six days per week to workersemployed in the districts of:

(1.) Flampton Plains, Mount Monger, Murrill., Gwalia,Laverton, and St. IvesOne shilling per dayor portion of a day extra.
