The Forest Service entered into an Memorandum of Intent (MOI) with the

State of California where-

• Region 5 received almost $12 million in OHV funds to perform Route Designation

• Region 5 committed to following the MOI 5-Step Route Designation Strategy

• Sequoia National Forest also received $189,000 in 2009 to complete the Piute Travel Plan

The 5-step OHV Strategy is required under the terms of Forest Service MOI

Steps “e” thru “g” were never done for the Piute Trails

A Process Error occurred when the Piute Motor Vehicle Use Map MVUMwas create without having completed

the required Forest Service 5-Step Route Designation Strategy for the

Piute Mountains

The Forest Supervisor has not done steps “e” thru “g” to propose Piute routes or analyze them as required

Enforcement of the Flawed Piute MVUM will

• Close over 100 existing historical trails

• Concentrated use and increase environmental impacts

• Harm the economy by eliminating most of the trail system

• Degrade remaining trails

• Degrade the recreation trail experience

Enforcing the Flawed Piute MVUM would

• Violate the MOI with the State• Violate the Route Designation Process• Violate the Public Trust• Constitute an additional Process Error

Further Inustices• Millions of dollars in Off Highway Vehicle Funds were

provided to perform and complete Travel Planning, including the Piutes, under agreements with the Forest Service

• Off Roaders volunteered thousands of hours to provide the necessary match to receive this funding and additional funding

• Funding that is being used to close the trails because the Forest Service says they lack the time to complete the Piute Travel Plan was provided by Off Roader Green Sticker funding in 2009 and before.

• The Forest Service decided to start Sequoia Forest Plan Revision even though Piute Travel Management had not been completed and they may lack the staff to do both

Existing Trails Under Consideration were signed in 2004 and have remained signed

New Signs Closing those Existing Trails for Rehabilitation, which have not yet completed the

planning process

Based on Forest Service estimated 2007 replacement cost of $34,000 per mile

Actual replacement cost could be much higher
