NEW HAMPSHIRE PUBLIC UTILITIES COMMISSION FY 2007 ASSESSMENT

Overview

The Fiscal Year 2007 assessment was calculated in accordance with RSA 362: Definition of Terms, Utilities Exempted and RSA 363A: Expenses of Public Utilities Commission Against Certain Utilities, Sections §363-A:1 Ascertainment of Expenses, §363-A:2 Assessment, §363-A:3 Certification of Assessment, §363-A:4 Collection and §363-A:5 Exemption From Assessment. The assessment was calculated by using the gross New Hampshire utility revenue of all utilities and allocating the FY 2007 (July 1, 2006 through June 30, 2007) budget estimate of the Public Utilities Commission (Commission) and the Office of Consumer Advocate (OCA) to each utility in direct proportion as the revenues relate to the total utility revenues as a whole. A minimum fee of $100 was assessed to utilities having revenues between $10,000 and $32,938. New Hampshire gross utility revenues were taken from the utilities’ Annual Reports. For the Fiscal Year 2007 Assessment, the Annual Reports reflect calendar year 2005 (January 1, 2005 through December 31, 2005) or other fiscal year basis. In accordance with RSA 363-A:5 Exemption From Assessment, any utility with less than $10,000 in gross revenue is not liable for any assessment.

Utilities whose gross utility revenues are greater than $32,938 are assessed $0.0030351333 per dollar as calculated below:

After the close of the prior fiscal year (Fiscal Year 2006), the Commission ascertained its actual expenses and then adjusted the assessment for the first quarterly payment (August 10, 2006) of the new fiscal year for the overcollection. The overcollection for FY 2006 was returned based on the gross utility revenue for calendar year 2004, as such calendar year was used in the

determination of the FY 2006 assessment. If a utility was not assessed in the prior fiscal year, no credit was applied to that utility. On August 10 and October 15, 2006 and January 15 and April 15, 2007, the Commission bills each public utility for the quarterly amount assessed. A utility can choose to pay the assessment in whole or in quarterly installments as shown on the assessment invoice. However, the obligation for payment of the total bill occurs July 1, 2006.
