FOREWORD Edwards Windsor Real Estate places the highest possible priority on the health, safety and duty of care of staff, members of the public, or any other persons who may have reason to occupy the 39 Murray Street, Hobart. To this end, Building Fire Safety Australia, in conjunction with Management, has developed Emergency Response Procedures outlining a response to a fire or an alarm of fire within the building. These Procedures have been developed to meet the goals of minimising injury, risk and damage arising from a fire or an alarm of fire. These procedures will need to be reviewed and tested periodically to cater for changes to staff and the built environment. In recognition of the importance of preparedness for a fire or an alarm of fire, staff MUST: • Ensure they are familiar with their role in the event of a fire or an alarm of fire within the

building. • In the event of a fire or an alarm of fire, act in accordance with the Emergency Response

SECTION 1 - INTRODUCTION These Emergency Response Procedures have been developed to provide guidance to the occupants of the 39 Murray Street, Hobart. These procedures are for the safety of all occupants within the building and must not be contravened in any way, which may render a situation unsafe. An emergency incident may necessitate the need for building occupants to be evacuated from the building, or from the entire site. These Emergency Response Procedures are designed to assist in the orderly and safe evacuation in the event of fire or an alarm of fire.

AIM The aim of these Emergency Response Procedures is to provide clear guidance to staff and occupants of the 39 Murray Street, Hobart in identifying and reacting to a fire emergency or an alarm of fire.

OBJECTIVE The objectives of these procedures are to: • Outline the staffs’ obligation to act in accordance with the Emergency Response Procedures

for the 39 Murray Street, Hobart.

• Detail the warning system that will apply within the building to inform occupants of a potential fire.

• Specify the Emergency Response Procedures for the 39 Murray Street, Hobart.

• Specify detailed actions to be undertaken by staff in the event of a fire or an alarm of fire.

SCOPE The scope of these procedures is to provide an established and validated response for staff leading up to and during an evacuation as a result of a fire or an alarm of fire.

BUILDING OVERVIEW 39 Murray Street, Hobart is a 16 storey, multi-tenanted building consisting of office space on the upper levels and retail outlets providing a range of goods and services to the public on the ground floor level. Ground floor tenancies are accessible from outside 39 Murray Street.

The Building is fitted with an Automatic Fire Detection and Alarm System that will provide early warning for the occupants in the case of smoke or fire within the building. The system consists of heat and smoke detectors installed throughout the building as well as an automatic sprinkler system located in the basement area. RED Manual Call Points (Break Glass Alarm) are located on each level and in each ground floor tenancy of the building and should be utilised by person’s to initiate an alarm in any situation where a FIRE/SMOKE evacuation is necessary. Fire-fighting equipment is provided throughout the building and may be utilised by suitably trained personnel to extinguish the fire, if safe to do so. It should be noted that employees or occupants should not undertake initial firefighting operations if they are not suitably trained.

BUILDING OCCUPANT WARNING SYSTEM The building is fitted with a fire detection and alarm system which is designed to detect the advancement of fire through smoke and heat detectors or the activation of the sprinkler system. The system in turn is connected to an Emergency Warning and Intercommunications System (EWIS) which generates a building wide alarm to alert occupants of the potential for fire and the need to evacuate the building. An “Alert” tone is transmitted for 2 minutes prior to the “Evacuation” tone. The “Evacuation” tone is designed to alert occupants of the need to evacuate the building. Even though occupants normally do not have to evacuate on the “Alert” tone, it has been deemed appropriate due to the skill level and familiarity of the Chief Warden with the EWIS panel, to have a single stage evacuation system for this building. All building occupants MUST evacuate on hearing the “Alert” or “Evacuation” tone even in the event of a known false alarm. Note: General Fire Regulations: it is an offence for a person, in the event of a fire or fire alarm in a specified building, not to act in accordance with the fire evacuation plan and persons failing to comply can be subject to a fine not exceeding $1300.

AVAILABILITY OF PROCEDURES A copy of these procedures must be made available to all employees on request. The procedures will be available;

• In a hard copy onsite, and • Electronically, from each designated Warden. • Electronically, from Management.

SECTION 2 - EMERGENCY CONTROL PERSONNEL In the event of a fire emergency, the smooth operation of the Emergency Response Procedures can only be achieved if everyone is familiar with what is expected of them. The risk of panic, personal injury and loss of property can be significantly reduced by having an efficient structure in place should an emergency situation present itself.

EMERGENCY PLANNING COMMITTEE (EPC) The Emergency Planning Committee is a group established to oversee the ongoing development and implementation of the Emergency Response Procedures. Members will meet regularly to discuss the Emergency Response Procedures, their relevance and effectiveness and, compliance with relevant legislation. The group should also ensure that, should an emergency occur, all those resources and services that are needed to cope with the effects can be efficiently mobilized and deployed (EG Wardens, training etc.). MEMBERSHIP

• Building Management representative.

• Emergency Control Organisation – Chief Warden. • On an as required basis, other personnel with the expertise to advise the team e.g. external

emergency planning, engineering etc. • Building Fire Safety Australia MEETINGS

• Members should meet at least annually in accordance with AS 3745.

• A quorum is not necessary as this is not a formal committee and a decision will be made at the time whether or not to go ahead with a meeting.

• Notes are kept of meetings and distributed to team members and to executive management. ROLE AND FUNCTION

The main purpose of the committee is to maintain the Emergency Response Procedures for the building. This is done by:

• Identifying credible potential fire events.

• Developing an emergency plan and ensuring personnel and resources are available to combat these events.

• Distribution of the plans to appropriate persons.

• Conducting an annual practice of the ERP to ensure the effectiveness and efficiency of the response from ECO and building occupants.

• Ensuring that the procedures are reviewed after an emergency, an exercise, or any changes that affect the emergency procedures.

ECO STRUCTURE The following chart identifies the structure and identification of the Emergency Control Organisation (ECO) and its relation to the EPC and occupants.

WARDEN IDENTIFICATION The control of emergencies will be greatly assisted if the occupants of the building and officers of the emergency services can quickly identify key personnel. This identification can best be achieved by the use of coloured safety helmets as follows:

ASSEMBLY AREA The Assembly Area is a pre-determined area where building occupants can assemble with relative safety from any threat of fire within the building. The Assembly Area for a fire emergency will be -

RE-ENTRY PREVENTION Wardens should ensure that persons are not allowed to return to the building until advised by the Fire Service Officer in Charge. The silencing of the audible warning alarm does not signal this. Once permission to re-enter the building has been granted from the Fire Service, Staff should re-enter the building first.

CONTROL POINT This is an area identified to be the best place for the Chief Warden / Deputy Chief Warden to assemble and collate information about the emergency and identify the appropriate action to be taken. The Control Point is located in the Main Entrance Foyer to the building from Murray Street. If this area is affected by the emergency then the Chief/Deputy Chief will relocate to outside the building on Murray Street. If this area is affected by the fire/emergency, the Control Point is to move outside to a visible safe location.

MARSHALLING POINT The Marshalling Point is a predetermined area of response for ECO personnel within the building. This area is designed to allow for tasks to be delegated to ECO personnel prior to ensuring the complete evacuation of the building’s occupants. All ECO personnel (unless a predetermined role is designated) on hearing the alarm system activate must report to the Marshalling Point. Marshalling Points at 39 Murray Street are as follows:

If these areas are affected by the fire/emergency, the Wardens are to make contact with the Chief Warden and move the Marshalling Point to a safe location outside the building.

PREVENTATIVE MEASURES Prevention of fire is as important as the development of efficient means of fighting it. Staff should be encouraged to take note and bring to the attention of management:

• any accumulation of litter/rubbish;

• placement of equipment or furniture that might impair egress along exit routes;

• placement of equipment or furniture that might impair access to installed fire fighting equipment;

• Other similar hazards.

GOOD HOUSEKEEPING IS GOOD FIRE PROTECTION

AUTHORITY AND INDEMNITY During emergency situations or exercises, pending the arrival of Fire Brigade, Police or other emergency service, ECO personnel shall have absolute authority to issue instructions to evacuate all persons from the building and/or area. Such instructions shall over-rule normal management structure. ECO personnel are indemnified against civil liability resulting from a practice or an emergency evacuation of a building where personnel act in good faith and in the course of their duties.

PERSONAL EMERGENCY EVACUATION PLAN (PEEP) Occupants with disabilities who may need assistance in an emergency are to be provided with the option of a Personal Emergency Evacuation Plan (PEEP). Suitable strategies in an emergency or evacuation should be discussed with these occupants and included in the PEEP. A PEEP form is contained in the appendix of this manual. A current list of the names, workplaces and other necessary information about occupants with a disability should be kept at the Control Point.

ACTION BY STAFF IF YOU FIND A FIRE/SMOKE - FOLLOW THE QUICK ACTION GUIDE Upon activation of the Fire Alarm staff should. • Remain calm.

• Cease work activities.

• Check your immediate area for signs of smoke/fire.

• Evacuate the building and proceed to the designated Assembly Area via the nearest safe exit.

• DO NOT USE THE LIFT.

• Do not stop or return to collect belongings.

• Assist mobility/sensory impaired people and direct any visitors from the floor.

• Follow the directions of the Wardens.

• Do not re-enter the Building until advised by a Warden or the Fire Brigade.

IN THE EVENT OF FIRE OR OTHER EMERGENCY

• Relay status, nature and extent of emergency to the nearest Warden.

• Evacuate the floor by the nearest safe exit.

• Call the Fire Brigade (000).

NOTE:

Once you have completed the evacuation of your tenancy and you are evacuating the building, you may be given additional tasks by the Wardens. Additional personnel may be required to ensure the safety of building occupants and to reduce the time taken to give the all clear. Duties may include checking the toilets etc., or assisting with the flow of occupants from the building or preventing re-entry to the building.

WARDENS

Upon activation of the Fire Alarm, Wardens should carry out the following tasks;

• Check your immediate area for signs of smoke, fire or other emergency.

• Confirm the need to evacuate using verbal commands. E.g. “Everyone please evacuate the building!”

• Report to your designated Marshalling Point and meet with other Wardens. (See Page 10)

• As directed by the Floor Warden, conduct a strategic search of all areas including stairwell toilets looking for signs of smoke / fire and ensuring that all occupants are evacuating in an orderly flow via the nearest safe exit. Close doors and windows, if safe to do so.

• Assist mobility/sensory-impaired persons.

• When the evacuation of your area is complete, report to the Floor Warden and report the on the following;

• If your area is evacuated or not as may be the case, and

• If any cause for the fire alarm was found.

• Follow directions from the Floor Warden.

• Do not re-enter the building unless instructed to do so by the Chief Warden or the Fire Brigade.

IN THE EVENT OF FIRE (NO ALARM SOUNDING)

• Ensure that the fire and smoke have been isolated (close doors etc.), if possible.

• Direct building occupants to evacuate via the nearest safe exit path (away from danger).

• Proceed to the nearest Manual Call Point (Break Glass Alarm) located on your floor or in your tenancy and activate.

• Inform the Floor Warden or Chief Warden as to the nature of the emergency.

• Assist with the continued evacuation of the building.

• Do not re-enter the building unless instructed to do so by the Chief Warden or the Fire Brigade.

NOTE: it is vital that persons are not allowed to re-enter the building until safe to do so. Therefore every effort should be made by all Wardens/staff members to prevent re-entry into the building. A staff member should be posted outside entrance points to the building until the all is given to re-enter.

FLOOR WARDENS

Upon activation of the Fire Alarm the Floor Wardens should carry out the following tasks.

• Check your immediate area for signs of smoke, fire or other emergency.

• Confirm the need to evacuate using verbal commands. E.g. “Everyone please evacuate the building!”

• Report to the Marshalling Point and put on your Yellow Helmet.

• Direct Wardens to commence an immediate evacuation of the floor and stairwell toilet below your floor level.

• Using the RED WIP phone make contact with the Chief Warden and communicate that your floor is evacuating.

• Ensure the orderly flow of persons from your Floor. Assist with evacuation if circumstances dictate.

• Organise assistance for mobility/sensory-impaired persons, if required.

• Once advised by the Wardens, contact the Chief Warden and indicate that the evacuation has been completed and that all areas are clear of persons (or not if the case may be). Also relay any information of smoke or fire or on any person/s unable to evacuate.

• Direct Wardens to proceed to the Assembly Point.

• Report to the Control Point and assist Chief Warden as required. IN THE EVENT OF FIRE (NO ALARM SOUNDING)

• Ensure that the fire and smoke have been isolated (close doors etc.), if possible.

• Direct building occupants to evacuate via the nearest safe exit path (away from danger).

• Proceed to the nearest Manual Call Point (Break Glass Alarm) located on your floor or in your tenancy and activate.

• Inform the Chief Warden as to the nature of the emergency.

• Assist with the continued evacuation of the building ensuring that all area are checked.

• Contact the Chief Warden and indicate that the evacuation has been completed and that all persons are accounted for (or not if the case may be).

• Direct Wardens to proceed to the Assembly Point.

• Report to the Control Point and assist Chief Warden as required. Provide specific details to the Emergency Service when they arrive.

• Do not re-enter the building unless instructed to do so by the Chief Warden or the Fire Brigade.

The Floor Wardens should be the last to leave the Floor.

CHIEF WARDEN

Upon activation of the Fire Alarm the Chief Warden will carry out the following tasks;

• Check your immediate area for signs of smoke, fire or other emergency. • Proceed to the Control Point located at the fire Indicator panel in the main entrance foyer,

put on white vest or helmet and locate the Chief Warden Checklist. • Ensure that the Fire Brigade "000" have been contacted. This role should be delegated. • Call the lift to ground floor and lock off.

• Identify the Area of alarm on the Fire Indicator Panel (note Area on Checklist). Contact Floor Warden on the floor of activation via WIP phone and indicate that the alarm has activated on their Floor and that Wardens must proceed with care.

• Have a Warden posted on the main entry to the building to prevent re-entry.

• As Floor Wardens/Wardens report floor or tenancy evacuated via the WIP phone, mark off on checklist.

• Once the Floor Wardens/Wardens have given the all clear, utilise them to relocate people away from the building to the assembly area.

• Ensure that no one re-enters the building until all clear given by the Fire Brigade.

• On the arrival of the Fire Brigade notify the Officer in Charge of the area and details of emergency/alarm activation and reason (if known) for activation.

• Indicate to the fire service any Floor Warden/s or Wardens who has not reported to the Control Point.

• Once all clear given by the Officer in Charge allow all persons to re-enter the building. IN THE EVENT OF FIRE (NO ALARM SOUNDING)

• Ensure that the emergency has been isolated, if possible.

• Direct building occupants to evacuate via the nearest safe exit path (away from danger).

• Activate the nearest Manual Call Point (Break Glass Alarm). • Direct Wardens to ensure continued evacuation of all occupants via the safest exit path. • Proceed to the Control Point. • Relay status, nature and extent of emergency to the appropriate emergency service. • Ensure that ALL FLOORS are checked and that no person is left in the area (if safe to do so).

• Liaise with Emergency Services, Officer in Charge on arrival and provide details of emergency and progress details.

NOTE It is important that the Chief Warden or the Deputy Chief Warden is available in the building at all times. At times where the Chief Warden is not present then the Deputy Chief Warden will assume the role of Chief Warden.

AFTER HOURS RESPONSE

If the emergency occurs outside normal trading hours or if ECO members are absent, the occupants MUST follow the Quick Action Guide, evacuate the building and await the arrival of the Emergency Service for further direction by the Officer-In-Charge. On arrival of the fire service the most senior person should liaise with the Officer in Charge.

PROCEDURES FOR ENTERING ROOMS When entering rooms where it is not possible to visually inspect the room prior to entry e.g. no windows and door closed etc. the following procedures are to be followed;

• Check the area outside room for signs of smoke/fire. • Feel the door and door handle with the back of your hand for heat. • Open door slightly and check inside for signs of smoke/fire - Keep Low & Look Up. • If no signs of fire/smoke, enter and ensure it has been evacuated. • Once the room has been evacuated, exit the room closing the door behind you and then

move to the next room. • All rooms SHOULD be searched – if safe. • Wardens should always work in pairs.

PERSONS UNABLE TO BE EVACUATED If persons cannot be evacuated (due to injury/mobility) then they are to be placed in one of the fire isolated stairwells and their condition and location shall be given to either the Chief Warden or the Fire Service immediately on arrival. A Warden or other person shall remain with this person until Fire Service arrival. If the location becomes unsafe for both the affected person and the carer, there may be no other option than to remove the person despite their discomfort.

AREAS UNABLE TO BE SEARCHED If the fire/emergency impacts on any area which makes it unsafe to search and in which it is reasonable to expect a person may occupy, the location shall be reported to the Chief Warden immediately and then, reported to the Fire Service immediately on arrival.

SECTION 4 - FIRE PREVENTION

BUILDING AND EQUIPMENT

SMOKE DETECTORS are installed throughout the building. Smoke detectors react to smoke and other noxious fumes. HEAT DETECTORS are installed throughout the building. Heat detectors react to both a fixed heat temperature and a rapid increase in temperature. AUTOMATIC SPRINKLER SYSTEM is installed throughout the basement of the Building. Sprinkler system heads react to a fixed heat temperature and once activated produce a water spray to actively fight the fire. EXIT SIGNS AND EMERGENCY LIGHTING will automatically activate during power failure. The Exit signs and Emergency lights have battery back up and are required to operate for a minimum of 90 minutes. Emergency lighting is provided to allow occupants sufficient light to travel to a safe exit as indicated by the exit signs. RED MANUAL CALL POINT (Break Glass Alarm) Red Manual Call Points are located at the Fire Indicator Panel in the main entrance foyer, on each level in the lift foyer and in each ground floor tenancy. The red Manual Call Point (Break Glass Alarm) should be utilised to initiate a Warden/Staff and Fire Brigade response. FIRE INDICATOR PANEL (F.I.P) the main Fire Indicator panel is located in the main entrance foyer to the building. The Fire Indicator Panel monitors all fire detection equipment and upon alarm activation indicates the activated alarm zone. EMERGENCY WARNING AND INTERCOMMUNICATIONS SYSTEM PANEL (EWIS PANEL) is located in the main entrance foyer to the building adjacent to the FIP. Red WIP phones are located on each level and are used to communicate between each floor and the EWIS panel on the ground floor.

FIRE FIGHTING EQUIPMENT Firefighting equipment installed in or near the 39 Murray Street consists of the following. FIRE HYDRANTS

Fire Hydrants are situated internally and externally at 39 Murray Street. These will be utilised by the Tasmania Fire Service to obtain water to extinguish a fire.

FIRE HOSE REELS

Hose reels are also located throughout the building. The hose reels are designed to be used for class “A” fires only (paper, wood and textiles) and must not be used on electrical equipment. The hose reels should generally be located within 4 metres of an exit. The rationale for this is that if you are trapped inside a building you can use the hose to find your way to the exit, or at least within 4 meters of it.

THEY MUST NOT BE USED ON FIRES INVOLVING “LIVE” ELE CTRICAL

EQUIPMENT

FIRE EXTINGUISHERS

Dry Chemical Powder type fire extinguishers are installed throughout the building. These extinguishers are a multi-purpose type and can be used on most types of fires (refer selection guide Page 18). Carbon Dioxide (CO2) type fire extinguishers are installed throughout the building. These extinguishers are used primarily on fires involving electricity (refer selection guide Page 18).

LOCATION OF FIRE FIGHTING EQUIPMENT All occupants/tenants should familiarise themselves with the location and safe use of all equipment, and the Fire Exits for their area. Note Care should be exercised when operating any extinguisher or using a fire blanket and only staff trained in their use should attempt to extinguish a fire (refer selection guide).

FIRE EXITS A fire exit is defined as an exit that opens in the direction of egress, has a lever type handle fitted and a green exit sign positioned above the door. All doors must be kept clear at all times. All exit passageways must be kept clear at all times.

LIFTS Upon activation of the alarm or when a fire has been detected, the use of lifts is strictly prohibited. Building occupants must use the stairs provided. If there is a need to evacuate

mobility impaired people via lifts this will be done under the supervision of the Fire Brigade. Lifts should not be used for the following reasons: • Lifts may stop due to an electrical or mechanical fault.

• Smoke may enter the lift compartment.

• The lift may be called to the floor where the fire is.

• Lift doors with sensors may not close if smoke has broken the beam.

FIRE HAZARDS If a Staff member becomes or is made aware of any real or potential fire safety hazards within the building, they should immediately notify the building Manager. Examples of hazards could be, but are not limited to: • Obstructed exit paths,

• Failure of emergency lighting/exit signs,

• Chocked open fire/smoke doors.

• Anything that may impair the use of Fire-Fighting equipment.

HOT WORK PERMIT/DEACTIVATION OF ISOLATED ALARMS A person who is going to commence hot work in a building must: • Inform the owner or occupier of the building of the person’s intention to carry out the hot

work.

• Gain a permit to undertake the hot work and also observe the requirements of AS 1674. Persons undertaking any work that may cause the fire alarm to activate must follow the procedure for notification and isolation/de-isolation of detectors in the affected area.

MAINTENANCE OF EQUIPMENT

• All safety and health features installed within the building are to be inspected, tested and maintained in accordance with the relevant standard or code.

• Building Fire Safety Australia is contracted for managing Emergency Response Procedures and practices and providing fire education to staff.

1

5. Meaning of "specified building"

(1) For the purposes of these regulations, a specified building is any of the following:

(a) a building that is capable of accommodating more than 200 persons, as estimated or determined in accordance with Table D1.13 of the BCA;

(b) a building that, under an occupancy permit issued under the Building Act 2000, more than 200 persons are entitled to use at any one time;

(c) a building that is used to provide residential accommodation as part of an educational institution;

(d) a building that is used to provide residential accommodation for persons requiring medical, psychiatric or geriatric care;

(e) a building that is used to provide supported accommodation for persons with physical, developmental or psychiatric disabilities;

(f) a building that is used as or for a hostel, boarding house, guesthouse, lodging house or backpacker accommodation, being a building capable of accommodating 6 or more guests;

(g) a residential part of a hotel or motel, being a part capable of accommodating 6 or more guests;

(h) a child care centre within the meaning of the Child Care Act 2001;

(i) a detention centre;

(j) a healthcare building;

(k) a residential aged care facility;

(l) a school;

(m) a special fire hazard building within the meaning of the Building Regulations;

(n) a building that is fitted with a fire protection system monitored by the Fire Service;

(o) a building in respect of which a declaration under subregulation (2)(a) is in effect.

(2) The Chief Officer, by notice in the Gazette, may –

(a) declare a building to be a specified building for the purposes of these regulations if the Chief Officer reasonably determines, in accordance with established risk analysis and fire engineering principles, that the building presents or contains a special fire risk; and

(b) revoke any such declaration.

(3) A declaration under subregulation (2)(a) may be in respect of an individual building or in respect of a building by reference to its kind or class.

(4) A notice under subregulation (2) is not a statutory rule for the purpose of the Rules Publication Act 1953.

Division 2 - Fire evacuation plans

15. Fire evacuation plans for specified buildings

(1) The occupier of a specified building must ensure that the specified building has an approved fire evacuation plan.

Penalty:

Fine not exceeding 50 penalty units and, in the case of a continuing offence, a further fine not exceeding 1 penalty unit for each day during which the offence continues.

(2) For the purposes of subregulation (1), the approved fire evacuation plan may be one that –

(a) the occupier has had approved under this Division; or

(b) a previous occupier of the specified building has had approved under this Division.

(3) In any proceedings for an offence under subregulation (1), it is a defence if the defendant establishes that, at the relevant time –

(a) the defendant or the immediately previous occupier of the relevant specified building had submitted a proposed fire evacuation plan to the Chief Officer for in principle approval under this Division; and

(b) the defendant had not been formally notified of the Chief Officer's determination on the proposed fire evacuation plan.

(4) To avoid doubt, a fire evacuation plan that has in principle approval under regulation 17 is an approved fire evacuation plan for this regulation.

16. Fire evacuation plan guidelines

(1) For the purposes of this Division, the Chief Officer is to –

(a) prepare guidelines for the preparation of fire evacuation plans; and

(b) publish those guidelines electronically and in such other ways as the Chief Officer considers appropriate.

(2) The guidelines are to be in accordance with –

(a) AS 3745 (in so far as it is relevant to Tasmanian circumstances); and

(b) in their application to specified buildings that are used for or in connection with the provision of health care to any persons, AS 4083 (in so far as it is relevant to Tasmanian circumstances).

17. In principle approval of fire evacuation plans

(1) For the purposes of regulation 15(2)(a), the occupier of a specified building is to prepare a proposed fire evacuation plan for the specified building and submit it to the Chief Officer for approval.

(2) The proposed fire evacuation plan is to be in accordance with the guidelines published under regulation 16.

(3) The Chief Officer, in his or her absolute discretion, may give the occupier advice and practical assistance with the preparation of the proposed fire evacuation plan.

(4) On receipt of the proposed fire evacuation plan, the Chief Officer is to –

(a) give the plan in principle approval; or

(b) require the plan to be amended.

(5) If subregulation (4)(a) applies, the Chief Officer is to notify the occupier of –

(a) the in principle approval; and

(b) the date of the in principle approval (which date is when the plan takes effect as a fire evacuation plan with in principle approval for the purposes of this Division).

(6) If subregulation (4)(b) applies –

(a) the Chief Officer is to –

(i) notify the occupier that the plan has not been given in principle approval; and

(ii) specify or indicate the required amendments; and

(b) the occupier is to amend the plan accordingly and resubmit it to the Chief Officer.

(7) Subregulations (2), (3), (4), (5) and (6) have the same application to the resubmitted plan as to the plan requiring amendment.

18. Final approval of fire evacuation plans

(1) This regulation applies to a specified building having a fire evacuation plan with in principle approval.

(2) The occupier of the specified building must ensure that a practice evacuation of the specified building is carried out within –

(a) 60 days after the fire evacuation plan takes effect; or

(b) such greater number of days after the fire evacuation plan takes effect as the Chief Officer, by notice to the occupier within those 60 days, may allow.

Penalty:

Fine not exceeding 25 penalty units and, in the case of a continuing offence, a further fine not exceeding 1 penalty unit for each day during which the offence continues.

(3) Without limiting his or her discretion, the Chief Officer may allow an extension of time under subregulation (2)(b) if, since the fire evacuation plan was given in principle approval –

(a) the specified building has had a change in occupancy; and

(b) the required practice evacuation had not been carried out before the change in occupancy; and

(c) the Chief Officer is satisfied in the circumstances that the instant occupier has been left with insufficient time to ensure that the required practice evacuation is carried out within the time required by subregulation (2)(a).

(4) For the purposes of subregulation (2), the occupier of the specified building must ensure that the practice evacuation is carried out –

(a) at a time and date determined in consultation with the Chief Officer; and

(b) in the presence of an authorised person; and

(c) in accordance with the fire evacuation plan.

Penalty:

Fine not exceeding 40 penalty units.

(5) Following the practice evacuation, the Chief Officer is to give final approval to the fire evacuation plan if satisfied that –

(a) the practice evacuation was successful; and

(b) the practice evacuation was carried out in accordance with the requirements of this regulation.

(6) The final approval may be given subject to any final amendments the Chief Officer considers necessary or expedient in light of the experience with the practice evacuation.

(7) The Chief Officer is to notify the occupier of –

(a) the final approval; and

(b) any final amendments; and

(c) the date of the final approval (which date is when the plan takes effect as a fire evacuation plan with final approval for the purposes of this Division).

19. Annual practice evacuations

(1) This regulation applies to a specified building having a fire evacuation plan with final approval.

(2) The occupier of the specified building must ensure that a practice evacuation of the specified building is carried out at least once in each 12-month period after the fire evacuation plan takes effect.

Penalty:

Fine not exceeding 50 penalty units and, in the case of a continuing offence, a further fine not exceeding 1 penalty unit for each day during which the offence continues.

(3) For the purposes of subregulation (2), the occupier of the specified building must ensure that –

(a) the Chief Officer is given at least 5 days' advance notice of a practice evacuation; and

(b) a practice evacuation is carried out in accordance with the fire evacuation plan.

Penalty:

Fine not exceeding 40 penalty units.

20. Repetition of practice evacuations

(1) This regulation applies if an authorised person attending a practice evacuation of a specified building is not satisfied that it has been carried out in accordance with the relevant fire evacuation plan.

(2) The authorised person may require the occupier of the specified building to repeat the practice evacuation at a date and time determined by the authorised person.

(3) The occupier of the specified building must comply with the authorised person's requirement.

21. Exempting persons from taking part in practice evacuations

(1) The occupier of a specified building acting in consultation with an authorised person, or an authorised person acting alone, may exempt a person from taking part in a particular practice evacuation if reasonably satisfied that the associated stoppage or interruption of the person's work or activity would –

(a) cause commercial loss; or

(b) endanger life or property.

(2) The Chief Officer, by notice, may grant a person a standing exemption from taking part in practice evacuations of a specified building generally if reasonably satisfied that the associated stoppages or interruptions of the person's work or activity would routinely –

(a) cause commercial loss; or

(b) endanger life or property.

22. Implementation of fire evacuation plans with in principle approval

(1) This regulation applies to a specified building having a fire evacuation plan with in principle approval.

(2) The occupier of the specified building must –

(a) keep at least one copy of the fire evacuation plan in the occupier's own immediate possession; and

(b) ensure that at least one other copy of the fire evacuation plan is kept in the specified building.

Penalty:

Fine not exceeding 25 penalty units and, in the case of a continuing offence, a further fine not exceeding 1 penalty unit for each day during which the offence continues.

(3) The occupier of the specified building must, in the event of a fire or fire alarm in the specified building, produce a copy of the fire evacuation plan to an authorised person on demand.

Penalty:

Fine not exceeding 25 penalty units.

(4) The occupier of the specified building must ensure that, in the event of a fire or fire alarm in the specified building, the specified building is evacuated in accordance with the fire evacuation plan.

Penalty:

Fine not exceeding 50 penalty units.

(5) In any proceedings for an offence under subregulation (4), it is a defence if the defendant establishes that, in the circumstances, it was physically impossible or impracticable for the relevant specified building to be evacuated in accordance with the strict letter of the relevant fire evacuation plan.

23. Implementation of fire evacuation plans with final approval

(1) This regulation applies to a specified building having a fire evacuation plan with final approval.

(2) The occupier of the specified building must –

(a) keep at least one copy of the fire evacuation plan in the occupier's own immediate possession; and

(b) ensure that at least one other copy of the fire evacuation plan is kept in the specified building.

Penalty:

Fine not exceeding 25 penalty units and, in the case of a continuing offence, a further fine not exceeding 1 penalty unit for each day during which the offence continues.

(3) The occupier of the specified building must post and keep posted, in the specified building, such directions and notices about the fire evacuation plan at such locations as –

(a) the fire evacuation plan may require; and

(b) the Chief Officer, by notice to the occupier, may require.

Penalty:

Fine not exceeding 25 penalty units and, in the case of a continuing offence, a further fine not exceeding 1 penalty unit for each day during which the offence continues.

(4) The occupier of the specified building must ensure that a person taking up permanent work or residence in the specified building is, within 30 days of so doing, given basic education and training in what to do in the event of a fire or fire alarm in the specified building.

Penalty:

Fine not exceeding 50 penalty units.

(5) The occupier of the specified building must, in the event of a fire or fire alarm in the specified building, produce a copy of the fire evacuation plan to an authorised person on demand.

Penalty:

Fine not exceeding 25 penalty units.

(6) The occupier of the specified building must ensure that, in the event of a fire or fire alarm in the specified building, the specified building is evacuated in accordance with the fire evacuation plan.

Penalty:

Fine not exceeding 50 penalty units.

(7) In any proceedings for an offence under subregulation (6), it is a defence if the defendant establishes that, in the circumstances, it was physically impossible or impracticable for the relevant specified building to be evacuated in accordance with the strict letter of the relevant fire evacuation plan.

(8) In this regulation –

"basic education and training" means training and education (other than a practice evacuation) that meets, at a minimum, the education and training requirements of AS 3745; "permanent work or residence" means work or residence that is to last, or is expected to last, longer than 30 days.

24. Evacuation of buildings in event of fire or fire alarm, &c.

(1) A person who is in a specified building must, in the event of a fire or fire alarm in the specified building –

(a) act in accordance with the fire evacuation plan for the specified building; or

(b) follow such directions as the person may be given by –

(i) an authorised person; or

(ii) a member of the specified building's emergency control organisation.

Penalty:

Fine not exceeding 10 penalty units.

(2) A person who is required to evacuate a specified building or part of a specified building in a practice evacuation must –

(a) act in accordance with the fire evacuation plan for the building; or

(b) follow such directions as the person may be given by –

(i) an authorised person; or

(ii) a member of the building's emergency control organisation.

Penalty:

Fine not exceeding 10 penalty units.

(3) In this regulation –

"emergency control organisation" has the same meaning as in AS 3745.

25. Occupiers not to contravene own fire evacuation plans, &c.

(1) The occupier of a specified building must not, in the event of a fire or fire alarm in the specified building –

(a) contravene the fire evacuation plan for the specified building; or

(b) do anything to compromise the execution or effectiveness of the fire evacuation plan for the specified building; or

(c) fail to follow such directions as that occupier may be given by an authorised person or other officer of the Fire Service.

Penalty:

Fine not exceeding 50 penalty units.

(2) Except as provided by regulation 21, the occupier of a specified building must not, in the event of fire or fire alarm in the specified building, cause or allow any person to contravene the fire evacuation plan for the specified building.

Penalty:

Fine not exceeding 50 penalty units.

26. Expiry of fire evacuation plans

(a) a fire evacuation plan that has only in principle approval expires after it has been in effect for 3 months (if, by then, the approval has not been upgraded to final approval); and

(b) a fire evacuation plan that has final approval expires after it has been in effect for 5 years (as a fire evacuation plan with final approval).

27. Replacement of fire evacuation plans

(1) This regulation applies if –

(a) a specified building has an approved fire evacuation plan with final approval; but

(b) the Chief Officer reasonably apprehends that the plan has been rendered obsolete or less effective by –

(i) a change in the use of the specified building; or

(ii) a change in the number of occupants of the specified building; or

(iii) building works done to the specified building; or

(iv) building works done to premises adjoining the specified building; or

(v) municipal or other public works done to roads or land adjoining the specified building; or

(vi) new fire safety knowledge or technologies; or

(vii) other relevant factors.

(2) The Chief Officer, by notice, may direct the occupier of the specified building to submit a revised fire evacuation plan to the Chief Officer for approval.

(3) The occupier of the specified building must comply with the Chief Officer's direction within such reasonable period as the Chief Officer, by the direction, specifies.

Penalty:

Fine not exceeding 25 penalty units and, in the case of a continuing offence, a further fine not exceeding 1 penalty unit for each day during which the offence continues.

(4) Regulations 17 and 18 apply to the revised fire evacuation plan as if it were a newly proposed fire evacuation plan.

(5) In this regulation –

"reasonable period" means a period of at least 60 days.

28. Defence to prosecution for occupier left insufficient time in which to discharge duty

(1) In any proceedings for an offence under this Division involving the contravention of a duty by the occupier of a specified building, it is a defence if the defendant establishes that –

(a) in the period leading up to the time of the alleged offence there was a change in the occupancy of the specified building; and

(b) the duty arose in respect of the previous occupier of the specified building; and

(c) that previous occupier had not, by the time of the change in occupancy, discharged the duty fully or at all; and

(d) in the circumstances, the defendant had been left with insufficient time in which to discharge the duty; and

(e) by the time of the alleged offence, the defendant had nevertheless taken reasonable steps towards discharging the duty.

(2) Nothing in subregulation (1) limits any other defence available to the defendant under these regulations.
