AUTHORIZING THE AWARD OF PURCHASE ORDERS

FOR MATERIALS AND SUPPLIES PURCHASED UNDER CONTRACT BY THE

STATE DIVISION OF PURCHASE AND PROPERTY PURSUANT TO N.J.S.A. 40A:11-12

WHEREAS, the Board of Fire Commissioners of Fire District #1, Township of Mount Laurel, County of Burlington, State of New Jersey has authorized the purchase of materials and supplies

pursuant to New Jersey State Purchase Contracts issued pursuant to N.J.S.A. 40A:11-12 by the

State Division of Purchase and Property in accordance with the attached list of vendors from

which purchases were made pursuant to the State Contracts as evidence of these awards; and,

WHEREAS, the purchase of goods, materials and services by the Board of Fire Commissioners of Fire District #1 is authorized by the Local Public Contracts Law, N.J.S.A.

40A:11-12; and,

WHEREAS, the attached list of vendors has been awarded New Jersey State Contracts following a recommendation from the Administrator for the utilization of these contracts; and,

WHEREAS, there is no certification required by the Treasurer of the Board of Fire Commissioners because these contracts were bid as open end contracts by the State of New Jersey,

funds were certified by individual Purchase Order and were approved by the Treasurer of the

Board for the release of each Purchase Order to the individual vendors.

NOW, THEREFORE, BE IT RESOLVED by the Board of Fire Commissioners of Fire District #1, Township of Mount Laurel, Burlington County, New Jersey that the vendors as evidenced by the

WHEREAS, N.J.S.A. 40A:14-81.1 provides that a Fire District may establish paid positions within the Fire Department or for the Fire District as

such positions shall be determined by the Fire Commissioners to be required for

the purposes of the Fire District; and

ADOPTION OF TEMPORARY BUDGET FOR FISCAL YEAR 2016

WHEREAS, N.J.S.A. 40A:14-78.17 provides that a Fire District may adopt a temporary budget to make appropriations to provide for the period between the

beginning of the fiscal year and the adoption of the budget; and

WHEREAS, the total appropriations of the temporary budget may not exceed 14% of the total of the appropriations made for all purposes in the budget for

the preceding fiscal year, excluding appropriations made for interest and debt

redemption charges and capital improvements; and

WHEREAS, 14% of Fiscal Year 2015 appropriations amount to $1,379,858.20.


Fire District #1, Township of Mount Laurel, Burlington County, New Jersey that a

temporary budget of $1,379,858.20 be adopted for Fiscal Year 2016 to be used for

operating expenses until the Adopted Fiscal Year 2016 Budget is approved.

2016 BUDGET RESOLUTION

MOUNT LAUREL FIRE DISTRICT #1

FISCAL YEAR: From January 1, 2016 to December 31, 2016

WHEREAS, the Annual Budget for the Mount Laurel Fire District #1 for the fiscal year beginning January 1, 2016 and

ending December 31, 2016 has been presented before the Board of Fire Commissioners of Mount Laurel Fire District #1 at its open

public meeting of December 21, 2015, and

WHEREAS, the budget as introduced is in compliance with the Property Tax Levy Cap Law (N.J.S.A. 40A:4-45.44 et.

seq.); and,

WHEREAS, the Annual Budget as introduced reflects Total Revenues of $9,963,211.00, which includes an amount to be

raised by taxation of $8,279,776.03, and Total Appropriations of $9,963,211.00; and

WHEREAS, the amount to be raised by taxation to support the district budget shall be the amount to be certified to the

assessor of the municipality to be assessed against the taxable property in the district, pursuant to N.J.S.A 40A:14-79. Such amount

shall be equal to the amount of the total appropriations set forth in the budget minus the total amount of surplus and miscellaneous

revenues as set forth in the budget; and

WHEREAS, in calculating the amount to be raised by taxation, the Mount Laurel Fire District #1has taken into account the

assessed valuation of taxable property in the Mount Laurel Fire District #1.

NOW, THEREFORE BE IT RESOLVED, by the Board of Commissioners of Mount Laurel Fire District #1, at an open

public meeting held on December 21 2015 that the Annual Budget, including appended Supplemental Schedules, of the Mount

Laurel Fire District #1 for the fiscal year beginning January 1, 2016 and ending December 31, 2016 is hereby approved; and

BE IT FURTHER RESOLVED, that the anticipated revenues as reflected in the Annual Budget are of sufficient amount to

meet all proposed expenditures/expenses and all covenants, terms and provisions as stipulated in the Mount Laurel Fire District #1's

outstanding debt obligations, capital lease arrangements, service contracts, and other pledged agreements; and

BE IT FURTHER RESOLVED, that the Board of Commissioners of Mount Laurel Fire District #1 will consider the

Annual Budget for adoption on January 18, 2016.

WHEREAS, the Administrator has determined and certified in writing that the value of these services are unlikely to exceed $17,500; and

WHEREAS, the anticipated term of this contract is 1 year and may be extended as deemed necessary by the Board of Fire Commissioners of the Mount

Laurel Fire District #1; and,

WHEREAS, funds are available for the purpose of obtaining such services; and

WHEREAS, the Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq.) requires that the Resolution authorizing the award of this “non-fair and open

contract” for professional services without competitive bids must be publicly

advertised.

NOW, THEREFORE, BE IT RESOLVED by the Board of Fire Commissioners of Fire District #1, Township of Mount Laurel, Burlington County, New Jersey as

follows:

1. The firm Arthur J. Gallagher & Company, 200 Jefferson Park,

Whippany, NJ 07981-1054, be and are hereby appointed as Insurance Broker and

Consultant for the Board of Fire Commissioners of Fire District #1, Township of

Mount Laurel, Burlington County, New Jersey for Fiscal Year 2016 to perform

insurance services as required by the Board of Fire Commissioners.

2. This appointment is made without competitive bids as a

"Professional Service" under the provisions of the Local Public Contracts Law

because the aforesaid agreement encompasses professional services recognized,

licensed and regulated by law, and is of a nature where it is not possible to

obtain competitive bids.

pursuant to the provisions of N.J.S.A. 19:44A-20.5; and

WHEREAS, the Administrator has determined and certified in writing that the value of these services will likely exceed $17,500; and

WHEREAS, the anticipated term of this contract is 1 year and may be extended as deemed necessary by the Board of Fire Commissioners of the Mount Laurel Fire

District #1; and,

WHEREAS, Richard M. Braslow, Esq. has proposed to provide general legal services at a rate of $165 per hour; and,

WHEREAS, Richard M. Braslow, Esq. has completed and submitted a Business Entity Disclosure Certification which certified that he has not made any reportable

contributions to a political or candidate committee in Mt. Laurel Fire District in

the previous one year period, and that the contract will prohibit him from making any

reportable contributions through the term of the contract; and,

WHEREAS, funds are available for the purpose of general legal counsel services that the Board of Fire Commissioners of the Mount Laurel Fire District #1

may require.

NOW, THEREFORE, BE IT RESOLVED by the Board of Fire Commissioners of Fire

District #1, Township of Mount Laurel, Burlington County, New Jersey as follows:

1. That Richard M. Braslow, Esq., 516 Fielders Lane, Toms River, NJ 08755,

is hereby appointed as legal counsel for the Board of Fire Commissioners of Fire
