Starting Strong to

Finish FirstLEGAL STRATEGIES FOR EQUIPPING GLOBAL CORPORATE SUCCESS“Champions aren’t made in gyms. Champions are made from something they have deep inside them-a desire, a dream, a vision. They have to have the skill, and the will. But the will must be stronger than the skill.”—Muhammad Ali.

From the time we are young, we are taught that success only comes with hard work, awareness, preparedness and strength of commitment. In today’s global economy, our resolve to obtain corporate success by meeting these objectives remains unchanged. In this seminar, we will approach each of these objectives by presenting you, our clients, with a series of topics, in three distinct track opportunities, designed to better equip you for the challenges you face, in the boardroom, in the courtroom, and beyond. These three customized tracks, made up of ALFA International attorneys and our clients, combine in a “team effort” to grapple with some of today’s most challenging legal issues: corporate compliance, workforce management, and litigation. Each panel is tailored to address industry specific challenges that present the most vexing legal issues. The curriculum will be presented to you in an engaging and interactive manner that lets you not only learn from the panel, but lets you offer your own insight as to how to be part of the solution. As the conference draws to a close, it is our hope and our goal that you will leave not only feeling better equipped, but also with the assurance that your ALFA International attorneys stand committed to fight with you and for you in your efforts to achieve global corporate success.

PROGRAM TRACKS:

TRACK I—Litigation: Game On: No matter the effort, litigation happens. This track will offer insight into the challenges and the opportunities for success during key stages in litigation including Pre-Trial, ADR, and Trial.

TRACK II—Business: Minding the Playbook on the Corporate Playing Field: The international conflict arises, compliance is called into question, the investigations ensue, and wide spread fall-out begins. This track will equip you in dealing with corporate compliance issues, navigating corporate investigations and handling the now, wide-spread effects of social media fall out.

TRACK III—Employment: The Team, Coach, and Players: This track will address contemporary employment issues across borders pertaining to the global workforce.

All About Palm SpringsNestled at the base of the Mount San Jacinto Mountains, Palm Springs, California is known for its crystal blue skies, year-round sunshine, stunning landscape, palm tree lined streets and starry nights. Often described as a small city with the cultural amenities of a large metropolitan area, the shopping, entertainment, dining and recreational opportunities are truly world-class. Amongst the over 130 resorts and hotels in the area lies the beautiful La Quinta Resort & Club, the site of this year’s International Client Seminar. Built in the 1920’s by San Francisco businessman Walter H. Morgan, La Quinta provided a place of solitude and relaxation for Hollywood’s elite, far away from the glare of the spotlights. As the legends of stage and screen have come and gone, La Quinta has expanded into a playground for championship golf, world-class tennis, fine dining and blissful spa experiences. The resort is located approximately 30 miles from Palm Springs Airport (PSP), 90 miles from LA/Ontario airport (ONT) and 145 miles from Los Angeles International Airport (LAX). A rental car is recommended if you are flying into ONT or LAX and is easily accessible at both airports. A taxi cab is recommended if you are flying into PSP.

PLENARY SESSION:

WHAT THE HECK HAPPENED?We know better than to rely on our own memories for anything very important, yet we ask eyewitnesses what they remember and build our cases on their recollections. We have little choice really because courts give credence to eyewitness testimony, especially in civil cases. In spite of decades of psychological research documenting the fallibility of human memory and scores of criminal cases in which innocent people have been exonerated based on DNA evidence, few courts – or commentators – have given much thought to the impact false memories can have in business and employment disputes, or in contract and tort cases. Today, we are going to think about why courts should be more skeptical about memory and what we can do to encourage that.

CHARMING SNAKES AND VANQUISHING VARMINTS: A WILD WEST DUELReptile Theory has taken the plaintiffs' bar by storm, with a claim of over $6 Billion in “reptile verdicts and settlements” in the past six years. Reptile Theory asserts that plaintiffs’ counsel can prevail at trial by scaring the “primitive” part of jurors' brains that focuses on safety and survival. The defense bar is mounting a defense and counter-attack. This presentation will present a “duel” in Reptile Theory, with interactive discussions and demonstrations covering fact and expert depositions and trial examinations. The duel will be set in a Wild West town (saloon included) with “gunslingers,” a Big Boss who controls the crooked Sheriff, a singing showgirl, and lots more. It’s High Noon meets Clint Eastwood meets Blazing Saddles. The audience will participate through interactive responders and more. Be ready to join the fray. You won’t need no stinking badges!

21ST CENTURY ADRBargaining is morally complicated. Whenever negotiators interact, there is opportunity for deception, manipulation, evasion, and exploitation. Deception has been defined generally as “The business of persuasion aided by the art of selective display.” This panel will delve into the “art of the deal” by pushing the moral and ethical boundary lines of all parties to the deal. In an interactive and entertaining session, your knowledge and beliefs will be tested as we explore the dichotomy between deception being an unacceptable untruth vs. a spin of the facts to advance one’s position. CORPORATE YIN-YANG? YES, SMALL STEPS CAN LEAVE BIG FOOTPRINTS! MAKING CORPORATE SOCIAL RESPONSIBILITY A REALITYThis panel will examine how corporate success and social responsibility are intertwined and how companies successfully engage their employees, counsel and clients to fulfill that mission, not only by enlarging their corporate footprint, but also improving it. It will expand on the Yin Yang panel session from last year. The topic will dive into corporate responsibility as a part of our “work- life balance.” It will focus on how our work can and should be a part of our personal passion. Why? Because, with success comes responsibility. As we become more successful, we can/should do so much more to improve our community footprint, by giving back. So many corporations are doing incredible things. This panel will spotlight these efforts.
