    Spending Approval Authority for City Manager3:43:25 PMCouncilmember Peters introduced the agenda item by stating that historically the counciformer mayor to approve contracts up to $25,000 and then in 2007 the limit was raised tw$100,000 and finally lowered to $10,000. The change in the government requires the cityauthority to the city manager.

    City Attorney Paul McMurray stated he does not have a recommendation of what level oprovide to the city manager; that is the councils decision. He does ask though that the o

    to reflect the city managers signature so there is clear contracting authority for professioagreements approved in the budget. Mr. McMurray also suggested and requested that thecouncil at some point consider authorizing either through resolution or through ordinancto have a similar type of agreement for settlement authority.

The gentlemen from BIMPa next step could include developing a lease with the ability to do maintain the propertrelieved of management expenses while issue is worked out.

    AGREEMENT AND PETITION

    1. AGREEMENT AND PETITION1.1 This Winslow Way Improvement Project Agreement and Petition (

    is between the City of Bainbridge Island, a Washington municipal corporation

    2.2 Improvements. The City is considering the improvement of Winsutility infrastructure serving the Property (the Improvements), and described as

    RESOLUTION NO. 09-19

    A RESOLUTION of the City Council of the City of BainbridgeIsland, Washington, relating to the Winslow Way ReconstructionProject; declaring its intention to order the construction of utility andstreet improvements and to create a local improvement district toassess the cost and expense of carrying out those improvementsagainst the properties specially benefited thereby; and, notifying allpersons who desire to object to the improvements to appear and

    present their objections at a hearing before the City Council to beheld on September 23, 2009.

    BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BISLAND, WASHINGTON, as follows:

    Section 1. It is the intention of the City Council of the City of Bainb

    Washington, to order the improvement of the properties within the area described attached and incorporated by this reference, by the construction of the WReconstruction Project. The Winslow Way Reconstruction Project is to providreplacement of below and above-ground utility and transportation infrastructure bRoute 305 and Grow Avenue. Elements of the project include: replacement of watstormwater facilities; street improvements, including paving, curbs, gutters, sidelighting, street trees and other landscaping; retention of angled parking and additfacilities; and, undergrounding of electrical power, cable and telephone, and apbetween Ericksen Avenue and Madison Avenue all as more fully described in Exhiand incorporated by this reference (the Improvements.)

    All of the Improvements shall be in accordance with the plans and specificatfor the City by the SVR Design Company and Puget Sound Energy and may be moCity as long as modifications do not affect the purpose of the Improvements.

    Section 2. The total estimated cost and expense of the Improvements is dec

    amount not to exceed $1,00,000.01, only $1,000,000.01 of that cost and expense shaand assessed against the property specially benefited by the Improvements. Such proincluded in a local improvement district to be established; the local improvement distras nearly as practicable all the property specially benefited by the Improvements. The cost and expense of the Improvements shall be paid by the City. None of the amount against the property within the local improvement district is to be paid by the

    7:30 p.m. on September 23, 2009 which time and place are fixed for hearing all mattthe Improvements and all objections thereto and for determining the method of pay

    Improvements. All persons who may desire to object thereto should appear and objections at that hearing. Any person who may desire to file a written protest with themay do so within 30 days after the date of passage of the ordinance ordering the Impthe event the local improvement district is formed. The written protest should be property owner and should include the legal description of the property for which the pand that protest should be delivered to the City Clerk.

    Section 4. The city clerk is authorized and directed to give notice of the ado

    resolution and of the date, time, and place fixed for the public hearing to each owne

    owner of any lot, tract, parcel of land, or other property within the proposed local im

    district by mailing such notice at least fifteen (15) days before the date fixed for pub

    This report and the attached charts and supporting schedules provide a finaand overview representing the preliminary financial position of the City thro2009. Management reports the status of City operations under the following

    CASHTax Supported FundsCash balances in tax-supported funds (excluding special revdecreased by $.86ml from $2.81ml to $1.95ml as June is historicamonth of the year for inflows. There is continued restraint expenditures but June reports show scheduled debt service and capit$.7ml. The tax supported month end cash balance is augmented reconciling items resulting in a bank balance of $2.47ml.

    Utility FundsCash balances in utility funds decreased by $1.09ml from $4.00ml to normal monthly receipts offset by scheduled Wastewater Treatment payments. Balances in Water and SSWM are expected to be maintamonths with receipts but the Sewer construction activity and schservice in June will significantly depleted cash in that fund by thmonth. An interfund loan from the Water Fund of an amount not to was passed by the City Council on May 13, 2009 to supplement theuntil legal issues are addressed and permanent financing can befinish the Waste Water Treatment Plant project. At month end, it was draw $.825ml on that loan to maintain positive cash flows for the Sewutility fund month end cash balance is augmented by $.20ml in reco

    well as the overall revenue picture that continues to be positive.

    Revenue projections and the revised 2009 Budget for revenues reflect the January and April reductions. Revenues, year to date, over year decline of only $.16ml further exhibiting stabilization.

    Utility FundsNormal utility receipts brought revenues for the combined utilities to

    year to date figures. Utility Revenues year to date for 2009 are $.492008. Water utility connection fees continue to underperform due to development while Sewer and Stormwater connections are tracking annualized basis.

    OPERATING EXPENDITURESTax Supported FundsThere is continued restraint in operating expenditures reflected b

    benefits clearly $.27ml less than January of this year. June rscheduled debt service and capital projects of $.7ml. Tax supportexpenditures of $9.46ml for the period including encumbrances oftracking at 56.1% of the revised budget and 46.55% without encumExecutive Department has instituted City Council approved reductiobudgeted operating expenditures for the year but the full results of staare only now being recognized and will continue over the months foover year the operating actual expenditures have decreased $1.74mhalf of the year. The as reduced budgeted operating expenses $16.9ml versus $20.6 for 2008 (also as revised), a $3.7ml reduction.

    Utility FundsOperating expenditures of the Utility funds are tracking at $3.21ml orencumbrances of $.33ml or $2.88ml and 50.18% without. Contworkloads and shifting of labor resources from the tax supported fund

    and support required utility work brought salaries and benefits in budget. Considerable savings in Supplies and Services and Chargewhich brings overall operating expenditures in line with budget.

    CAPITAL/DEBT SERVICE EXPENSE

    Debt service through June reflects a refunding of $5.3ml but was

    scheduled. The City will save more than $.116ml in each of 2009 andrefunding. Debt Service Payments in June were $.43ml.

    Utility Funds

    Capital project expenditures recorded in the utilities funds contthrough June at $6ml with $3.8 of that encumbered predominately with the Waste Water Treatment Plant. Construction expense for tcontinue to run from $.15ml to $.5 a month through 2009. Scheduledpayments in the utility funds in June were $.81ml.

    DEBT/FINANCIAL MARKETSAs of July 29, 2009 the yield for a 20-year, triple-A rated, tax-exe

    obligation bond is 4.44%, down .05% from one month ago and dow4.95% 6-months ago (Bloomberg online, July 29, 2009). In SeptemCOBI issued 20-year capital bonds with an overall yield of 4.46%.2009, the City refunded $5.3ml of its 1998 LTGO bonds, which finanand other street improvements for a savings of $.116ml in 2009, an2010.
