MOTION FOR LEAVE TO FILE HEARING EXHIBITS
OUT OF TIME
Docket No. 2015-001 Cause No. 176-05
WHITING OIL AND GAS CORPORATION ('•Whiting"), by and through its
undersigned attorneys and pursuant to Rule R641-1 00-400 of the Utah Administrative Code
("U.A.C."), hereby moves the Board of Oil, Gas and Mining (the ''Board") for an order allowing
Whiting to file its hearing exhibits in this Cause out of time. In support of this motion, Whiting
respectfully states and represents as follows:
1. Whiting is the operator of the Moroni #llM-1107 Well (the ••weD"), the
·subject well in this matter.
2. Whiting filed its original Request for Agency Action (the "Original
Request'') in this Cause on December 11, 2014, before the Well was completed. Since filing its
Original Request, Whiting has completed the Well and production from the Well has commenced.
3. On April3, 2015, Whiting filed and served its Motion for Leave to Amend
Request for Agency Action. Whiting's motion to amend was granted by order issued on April 7,
2015. Whiting's Amended Request for Agency Action (the "Amended Request") updates the
Original Request with respect to completion and testing operations on the Well and seeks relief
consistent with the recent production from the Well. The Amended Request is based, in part, on a
Sundry Notice filed by Whiting on March 20, 2015, and approved by the Division of Oil, Gas and
Mining on March 31, 2015. Some of the technical information contained in Whiting's hearing
exhibits, which is relevant to the Amended Request, has only recently been obtained because it is
based on the recent production information from the Well.
4. Pursuant to U.A.C. Rule R641-105-500, Whiting's hearing exhibits should
be filed at least thirty days before the hearing for which the exhibits are intended. Pursuant to
U.A.C. Rule R641-I00-400, exhibits filed later than thirty days before a scheduled hearing may be
allowed by the Board upon good cause shown.
5. Good cause to grant this motion appears because some of the relevant
information contained in Whiting's hearing exhibits was not available thirty days before the Board's
regularly scheduled April22, 2015 hearing, and Whiting has diligently prepared and submitted its
proposed hearing exhibits, including the recently acquired information, in a reasonable manner
under the circumstances.
6. Whiting's proposed hearing exhibits and a proposed form of Order Granting
Leave to File Hearing Exhibits Out of Time are attached hereto.
WHEREFORE, for the foregoing reasons, Whiting respectfully requests that the
Board grant Whiting's Motion for Leave to File Hearing Exhibits Out of Time.

- The initial cost estimate is $60,000 per inch mile
- 12" pipeline x 25 miles x $60,000 per inch mile= $18.0 MM
- Permitting and right of way at $4/ft
- 25 miles x 5,280' x $4/ft = $528 K
- Total cost for pipeline only= $18.5MM
• Option 2. Kern River Gas Transmission at Dog Valley Tap (36 miles)
- The initial cost estimate is $60,000 per inch mile.
- 12" pipeline x 36 miles x $60,000 per inch mile= $25.9 MM
- Permitting and right of way at $4/ft
- 36 miles x 5280' x $4/ft = $760 K
- Total cost for pipeline only= $26.7 MM
• Gas Plant Cost
- Initial gas plant installation 20 MMcfpd = $22 MM

Exhibit E-11 Gas Pipeline Viability
• Permitting and installation will take 2 years.
• Addition high volume gas wells will need to be drilled to justify plant and pipeline construction.
• Questar: (Intrastate gas sales) - The vertical Moroni 11M-1107 WOBBE is 1562 BTU. Questar has a local distribution line
in the area. The BTU range for customers is between 950 to 1150 BTU with less than 3% inert gas. May be able to meet the BTU specs however it is highly unlikely that Questar will accept gas into this line since this is not a common practice. Questar line cannot accept high Ethane gas content of Moroni 11M-1107 well.
- Tap Fee is $50 K
• Kern River: (Interstate gas sales) - Best option to sell gas
- Higher capital cost requirement
- Tap Fee is $100 K

Exhibit E-12 Non-Pipeline Alternatives to Gas Flaring
• (CNG) Compressed Natural Gas 11Bakken Express" type of gas recapture process and transportation.
- Evaluating a gas recapture contract {C3 plus) with processing company Credence and trucking company Oscomp.
- Compressed natural gas would have to be transportation via truck.
- Cost is $100,000/month for four truck/trailer transports for 500 Mcfpd.
- Compression station and unloading station lease at $30,000 per month
- Each transport trailer must be pressured to 3,000 psi and can only carry 120 Mcf per trailer
- Un-known if Questar or Kern River would take gas in small volumes and would require both tap fee and un-loading facility installation to be built.
- Net Gas Sales economics projected to be at a loss of $94,000 per month at $3/Mcf.
• 15 MMcfpm x $3/Mcf = $45,000 per month gross income. Net gas income = $36,000
• Expense = $100,000 + $30,000 = $130,000
• Net loss from gas sales= $36,000 -$130,000 = -$94,000 per month

- Environmental impacts from burning 100 Mcfpd gas for fuel.

R649-3-19 Production Testing Rules • Production test for 24 hrs within 15 days of completion. • All gas for this test can. be vented or flared.
R649-3-20 Gas Flaring\Venting Rules • 1800 MCF may be vented monthly without approval on any well.
• For the first month after production testing, allowed to vent or flare 3000 MCF without approval.
• Written request may be filed with the board to allow for additional testing which may be approved for up to 30 days or 50 MMCF, whichever is less. 30/50 extension through the end of April 2015 approved on 3/31/2015 via sundry submitted on 3/20/2015.
• Additional flaring may be approved by the board as needed if filed as a docket item.

The Board of Oil, Gas and Mining (the "Board") having fully considered Whiting
Oil and Gas Corporation's ("Whiting") Motion for Leave to File Hearing Exhibits Out ofTime (the
"Motion") and the grounds and reasons provided therefore, and good cause appearing, hereby grants
the Motion. Whiting may file its hearing exhibits in this Cause in the form as attached to the
Motion.
For all purposes, the Chairman's signature on a faxed copy of this Order shall be
deemed the equivalent of a signed original.
