CAMPAIGN, THE CLOUD FOUNDATION, RETURN TO FREEDOM,

Pursuant to Rule 24 of the Federal Rules of Civil Procedure, the American Wild
Horse Preservation Campaign (“AWHPC”), the Cloud Foundation, Return to Freedom,
Carol Walker, and Kimerlee Curyl (“Proposed Intervenors”) seek to intervene in this case
as Respondents to protect their professional, economic, aesthetic, recreational,
educational, conservation, and other interests in the wild horses that use the public lands
throughout the state of Wyoming and the habitat that supports those wild horses.
As demonstrated in the accompanying memorandum of law, Proposed Intervenors
meet all of the criteria for intervention of right under Rule 24(a). Alternatively,
permissive intervention should be granted pursuant to Rule 24(b).
In support of this motion, Proposed Intervenors submit the accompanying
memorandum of law, and the Declarations of Suzanne Roy, Ginger Kathrens, and Carol
Walker. Counsel for Proposed Intervenors conferred with counsel for Petitioners and
counsel for Federal Respondents telephonically concerning their positions on this motion.
Counsel for Federal Respondents takes no position to the proposed intervention; counsel
for Petitioner “believes that the interests of [Proposed Intervenors] are adequately
represented by the federal government, however, [Petitioner] will not oppose the motion
to intervene.”
