DESCRIPTION

The formation and establishment of a People's Oversight Commission is the result of repeated insult and injury to the people by their public servants. Potentatus Res Republica means "Political Power of the People". "All political power is inherent in the people" as both Washington Constitutions state, followed by "and governments derive their just power from the consent of the governed." The people, according to their Creator endowed unalienable rights and reserved powers not delegated to government, do ordain and establish this People's Oversight Commission.

    DeclaratiOn/Asseveration and Certification of the Formation and Establishment Of the First People's Oversight Commission

    Comes now, the undersigned, ernie-lee: hoch, Declarant, being of lawful age and competent to testify, by way of this Declaration/Asseveration! and avers that the following statements are true and factual based upon Declarant's personal knowledge, concerning Certification of the Formation and Establishment of the People's Oversight Commission.

    1. Declarant states the people are in possession of the birthright as described in 4 Wheat 402 and acknowledged in RCW 42.56.030, RCW 42.30.010, WAC 44-14-01003, and, RCW 42.17A.001 as not yielding their sovereignty to the agencies that serve them.

    2. Declarant states that "We in America do not have government by the majority. We have government by the majority who participate", quoting the 3rd President of the United States, Thomas Jefferson.

    3. That, on June 5, 2014, Declarant did witness and assist with the facilitation of an election to form a People's Oversight Commission at a publicly noticed and scheduled meeting held at the Colville Library/Stevens County Library.

    4. Declarant states the aforementioned election was publicly noticed with flyers posted on bulletin boards at businesses located around the area and by publication in the Chewelah Independent and Statesman Examiner Newspapers with text submitted as follows:

    PUBLIC NOTICE People to Form Oversight Commission

    We the People on Stevens County, in order to maintain control over the instruments of government that we have created, call for an election to form a People's Oversight Commission consisting of 12 volunteer members, excluding public servants and BAR members. This election, validated by the majority who participate according to their reserved powers, unalienable rights and the common law, will be held at the Stevens County Library in Colville on June 5, 2014 at 6:30PM.

    5. Declarant states that an affidavit of publication of the above Public Notice was published in the Chewelah Independent and is attached to this Declaration.

    1 Asseveration: The proof which a man gives of the truth of what he says, by appealing to his conscience as a witness. It differs from an oath in this, that by the latter he appeals to his Creator as a witness of the truth of what be says, and invokes him, as the avenger offalsehood and perfidy, to punish him ifhe speaks not the truth.

    6. Declarant states that an affidavit of publication of the above Public Notice was published in the Statesman Examiner and is attached to this Declaration.

    7. Declarant states that a template narrative was basically followed and read to those in attendance by the election facilitators. (See attached)

    8. Declarant states that during the public election 10 people were nominated and each was elected by specific showing of hands and counting of the votes by 2 volunteer vote counters.

Declarant states that there were 10 people nominated and duly elected to the first Board of the People's Oversight Commission wherein after election took and subscribed their People's Oversight Commission Vow (hereinafter "Vow") as attached to this Declaration; the 10 elected Commissioners are:

Declarant states that attached to this Declaration, as Certification to the facts of this election to constitute the People's Oversight Commission, are Declarations from Robert Mackowiak, Michael David Lojas and Paul Dye establishing that this election to constitute a People's Oversight Commission was conducted, duIy voted and approved by the people who participated in this duly noticed public election.

    PUBLIC MEETING TO ELECT FIRST PEOPLE'S OVERSIGHT COMMISSION

    MEETING OPENED WITH PRAYER AND PLEDGE-

    Welcome and Greeting-

    It's my honor to be asked to facilitate tonight's gathering--This peaceful assembly to redress our many grievances with our Government agents. Hundreds of neighbors have participated in creating a new tool for We the People. One forged from our Reserved Powers. One designed to regain liberty and justice. The integrity and skill by which we use this new tool will be the same measure by which the o People grant it authority. >l

    There is only one rule here tonight. To be a part of this historic event you must be pledged now to creating peace and unity.

    A few questions to that end, by a showing of hands please:

    How many people in attendance here tonight believe those holding public office are doing a good job and spending your tax dollars Wisely?

    How many of you believe those holding public office should follow the laws that apply to them?

    How many of you believe those holding public office should be protecting your rights and pocket books?

    How many are willing to unite tonight for your own and your family's rights to life, liberty and the pursuit of happiness?

    A powerful unifying document is our state Constitution. It creates our Government structure on the condition of protecting our rights.

    "AII political power is inherent in the people, and government derives its just powers from the consent of the governed." We the People created this government populated with public servants who by their sworn oaths are duty bound to protect and maintain our individual rights.

    This constitutional principle of the People's inherent political powers and authority to create such instruments as the will of the People believe necessary in order to protect and maintain their unalienable rights is paramount to a free people.

    Why a People's Oversight Commission is Created-

    Whereas,

    The People's grant of life to Government, given birth by our Constitutions, is conditioned upon its duty to protect our individual rights to life, liberty and the pursuit of happiness,

    The People on Stevens County, Washington, upon due diligence, discovered our several elective offices to be vacant absent an Oath of Office on the record binding any officer to the protection of the People's Rights.

    And Whereas)

    On April 8, 2014, the People) in Public Assembly, served notice on those persons presuming the mantle of our county Government to the discovery of their non-compliance with the People's lawful requirements to be in office,

    And Whereas,

    These persons served notice are: oT1

    Kendle Allen - [occupying the office of Sheriff] Tim Rasmussen - [occupying the office of Prosecutor] Gina Tveit - [occupying the office of District Court Judge] Tim Gray - [occupying the office of Auditor] AI Taylor - [occupying the office of Assessor] Sue Harnasch - [occupying the office of Treasurer] Patti Hancock - [occupying the office of Coroner] Patty Chester - [occupying the office of County Clerk/Ex officio Clerk of the Superior Court] Wes McCart - [occupying the office of County Commissioner] Don Dashiell [occupying the office of County Commissioner] Steve Parker [occupying the office of County Commissioner]

    Each were treated with respect and mercy was tendered by way of an offer of 45 days amnesty in which to rectify and come into compliance with the People's mandate through state law requiring a valid Oath of Office on the record in order to govern,

    And Whereas,

    On May 27,2014, the persons named herein above were served notice of the Vacancy of Office caused by their silent non-feasance and rejection of the People's amnesty and to relinquish their occupation of our county's Government,

    And Whereas,

    The persons named herein and those conspiring to create their non-feasance have destroyed the People's goodwill, confidence, faith and trust in Government and exposed to the People a train of abuse and usurpation in the People's efforts to seek justice and redress our grievances with Government,

    Now Therefore,

    On this 5th day of June, 2014 We the People, on Stevens County, compelled by this unprecedented affront to our liberties) do now, by this instrument, exercise our Right and Duty to oversee these non

    compliant Government servants and Declare to all People, by our Reserved Powers, that we hereby constitute, establish and ordain this People's Oversight Commission. The intent and purpose of this commission shall be to redress grievances, investigate abuses of public office and take such action as deemed necessary when the instruments of the People's creation fail to uphold the People's grant from our Supreme Ruler of the Universe to our natural rights of Life, Liberty and the pursuit of Justice for all.

    Review Purpose and Authority of Commission-

    This Commission is now assembled for and serving with the express purpose of operating as watchdog organization, for assurance that the People's public servants at every level are abiding by the law.

    Commissions have the historical authority to investigate, hold hearings and invite witnesses to testify before it, make public the findings of the Commission and is duty bound to report their findings to the People and take such action as is deemed appropriate and in the best interest of the People. The first order of business for the newly formed Commission is the creation of its operating procedures which shall be posted for review by the People.

    The formation of our People's Oversight Commission is the culmination of a reasoned, transparent and deliberative process by hundreds of People to address grievances with Government when Government itself fails. These grievances go much further, deeper and longer than the Oath of Office issue. As a commission this mediating body being advisory in nature has only that authority supported by the People. The degree to which the commission acts with honor and integrity is the measure by which it will gain or lose the People's support. This direct and honorable exercise of our Reserved Powers is a reflection of our hope that, now established, the commission may rekindle faith and trust in our elected agents. We continue to hold our hands out to our Government. Working together we can create the effective solutions needed to restore liberty and justice.

    We offer this INTERIM MISSION STATEMENT FOR THE PEOPLE'S OVERSIGHT COMMISSION

    We the People, with deference to our Creator's condition of liberty being eternal vigilance, shall jealously guard the unalienable rights of liberty and justice through the Reserved Powers ofthe People in order to maintain accountability and oversight ofthe Government instruments we have created.

    Nomination and election procedure-

    Qualifications

    The following qualifications are recognized to ensure an Oversight Commission served by honorable People committed to their ministerial duty and in the best interest of the People to investigate and/or oversee the functions of government, its officers, agents and employees when challenged to be in noncompliance with or in violation of the People's unalienable right to liberty and justice.

    Nominees are accepted under the following criteria, upon their honor:

    -You must be one of the People of the States of America united.

    -You promise to complete your duties based on the foundational principles of Honor, Integrity, Justice and Mercy.

    -You are not a member of the BAR (British Accredited Registry)

    Election of Commissioners

    Nominations will be accepted from the floor until there are a preferred minimum of 12 and up to 24 nominees who have accepted the nomination in person. A commission of less than 12 may be established according to the will of the people. You may nominate yourself. After nominations are closed we will take a 10 minute break. When we rejoin each nominee will have one minute to share why they want to serve on the People's Oversight Commission.

    Our facilitator will call for the vote. We will count by a showing of hands confirmed by two or three volunteers. You may vote for as many nominees as you wish. The nominees with the highest number of votes to fill the number of seats agreed upon shall be the first sworn officers of our People's Oversight Commission.

    Open Nominations-We are electing folks based on a willingness to serve, which is a matter of heart, so don't think you have to have a polished speech to get our votes. Speak from your heart and we will listen. Record names of nominees

    We are now ready to hear from the nominees. Folks, most of us are uncomfortable speaking to groups. Please listen to our nominees hearts as much as their words. With that, Mr/s. if you will please be so brave as to go first.

    Voting-

    Call for 2 or 3 volunteers to count and record nominee votes. Name each nominee. Tally and announce the commissioners (to the number of seats agreed upon by the people - suggested 12 but can be less).

    Thank you all for being a part of this historic moment. Through unity we have created a template for others to follow. The measure of our success tonight will be the authority given to our creation as it lives and grows. Please take time to visit with one another while our new commissioners sign their Oaths. Their is a donation box (or pass the baskets) to help cover the cost of recording our Commissioners Oaths.

    Before assuming the office of a People's Oversight Commissioner, every elected Commissioner shall file his or her Vow in the Office of the County Auditor, pay the filing fee and cause said vow to be a part of the official public records of the County and State.

    On Thursday, June 5, 2014, at the Stevens County Library located across the street from the Stevens County Courthouse, Colville, Washington, I attended an election of the first People's Oversight Commission. There I witnessed an open election by the showing of hands wherein ten Commissioners were duly elected and seated. This Oversight Commission was constituted by the People and for the People and formed according to the people's reserved powers wherein all political power is inherent in the people pursuant to the acknowledged fact that the People do not yield or relinquish their sovereignty to the agencies of government that serve them because the condition upon which our Creator has given liberty to man is eternal vigilance. The people's resolve was that the Commission carries out such oversight duties as are determined for the people to have an effective voice and to maintain control over the instruments they have created. All newly elected Commissioners were then administered their Vow by a Notary Public.

    DECLARATION STATEMENT I, ~~~-o~ declare1 according to the penalty of perjury under the I laws of the United States of America that the foregoing is true and correct to the best of my knowledge. This Declaration/Asseveration is made without purpose of evasion or intent to mislead.
