The Making Home Affordable Program is a critical part ofthe government's effort to stabilize the housing marketand help struggling homeowners get relief and avoid foreclosure. The Program includes opportunities forhomeowners in bankruptcy to modify their mortgage to make their payments more affordable through the HomeAffordable Modification Program (HAMP).

Homeowners whose monthly mortgage payment exceeds 31 percent of their verified gross (pre-tax) income mayapply for a HAMP modification before or after filing bankruptcy. To qualify for HAMP, a homeowner musr:

r Own a one- to four-unit home that is their principal residence;. Have received their mortgage on or before January 1, 2009;. Have a mortgage payment (includlng taxes, insurance, and homeowners' association dues) that is

more than 31 percent of their gross (pre-tax) monthly income;. Owe an amount that is less than or equal to $729,750 on their first mortgage for a one-unit

property (there are higher..limits fortwo-to four-unit properties); ando Have a documented financial hardship.

To be el ig ible for a loan modif icat ion under HAMP, you must:

. Be the owner-occupant of a one- to four-uni t home.

Q+. Can I be considered for a HAMP modification if I am in bankruptcy?

Yes, if you are in an active (open) chapter 7 or chapter L3 bankruptcy case, vou must beconsidered for a HAMP modification if you, your attorney, or the bankruptcy trusteesubmits a request to the servicer. With your permission, the bankruptcy trustee maycontact the servicer to request a HAMP modification.

l f you have already missed one or more mortgage paymenis and have not yet spoken toyour mortgage servicer, cal l your servicer immediately.

Q5: How much wil l a HAMP modification cost me?

lf you qual i fy for HAMP, you wi l l never be required to pay a modif icat ion fee or past-duelate fees. lf there are costs associated with the modification, such as payment of backtaxes, your mortgage servicer wi l l g ive'you the opt ion of adding them to the amount youowe on your mortgage or paying some or al l of the expenses in advance. Paying theseexpenses in advance wi l l reduce your new monthly payment and save interest costsover the l i fe of your loan.

l f you would l ike assistance from a housing counsel ing agency approved by HUD or arereferred to a HUD-approved counseloras a condit ion of the modif icat ion, you wi l l notbe charged a counsel ing fee. Beware of any organizat ion that at tempts to charge an up-front fee for housing counsel ing or modif icat ion of a del inquent loan, or anyorganizat ion that c laims to guarantee success.

q7. How will the HAMP modification affect my loan?

Your mortgage servicer may offer various options to you, including:

. Reducing your interest rate to as low as 2 percent.

. Extending the term of your loan upr to 40 years.

. Deferr ing a port ion of the pr incipal payment to a bal loon payment at the end ofthe loan term.

. Forgiv ing a port ion of the pr incipal .

Before you agree to a HAM P modification, consult with your attorney for informationabout the affect of the modification.

QS. Do I have to go through a trial perriod for a HAMP modification?

Generally, i f you are eligible for HAMP, your rnortgage servicer wil l put you on a three-month tr ia l p lan to demonstrate your abi l i ty to make t imely payments at the newmonthly payment level . l f you successful ly make al l required payments dur ing the tr ia lper iod and the income and expense inforrnat ion you provided is determined to beaccurate, your servicer wi l l execute an off ic ia l modif icat ion agreement. You wi l l berequired to s ign the modif icat ion agreem€rnt and other documents and attest that al l ofthe informat ion you provided to your servicer was true and accurate. Misrepresent ingany required informat ion is a v iolat ion of Federal law and has ser ious legalccnsequences.

At the discretion of the mortgage servicer,, i f you are in an active (open) chapter 13bankruptcy case and you are determined to be el ig ible for HAMP, you might not have tocomplete a tr ia l per iod plan. For more infrormat ion about waiver of the tr ia l per iod,consult with your attorney or, i f you do nort have an attorney, consult with thebankruptcy trustee.

Qg. What if my home is scheduled for a foreclosure sale?

Contact your mortgage servicer immediatr: ly and ask to be considered for HAMP.Servicers part ic ipat ing in the HAMP progrerm are not al lowed to proceed with aforeclosure sale whi le you are being evaluated for HAMP. In order to conduct theHAMP evaluat ion, your servicer must receive al l the required documents pr ior to sevenbusiness days before the scheduled foreclrosure sale date. You may also contact a HUD-approved housing counselor for help by car l l ing 888-995-HOPE (4673).

Q10. Will I be able to get a modification fif I am in a HAMP trial period plan andsubsequently f i le bankruptcy?

Yes, i f you are in a HAMP tr ia l per iod pl lan and subsequent ly f i le bankruptcy, you maynot be denied a HAMP modif icat ion on the basis of the bankruptcy f i l ing. The montgageservicer must work with you or your at torney to obtain any required court and/ortrustee approvals. The servicer should extend the trial period plan as necessary toaccommodate delays in obtaining court approvals or receiving your t r ia l per iodpayments when they are made to a trustee. However, servicers are not required toextend the tr ia l per iod beyond two months, resul t ing in a maximum f ive-month tr ia lper iod. l f the tr ia l per iod is extended, ) /ou shal l make a tr ia l per iod payment for eachmonth of the tr ia l per iod, including any'extension month.

Q11. What happens in chapter 13 bankruptrcy if t 'm in a trial period plan under HAMP?

lf you are in an active (open) chapter l- i3 bankruptcy case and, after f i l ing bankruptcy,you made payments as required by a HAMP tr ia l per iod plan, the mortgage servicer maynot do any of the following: (1) object to confirmation of your chapter 1-3 plan, (2) movefor relief from the automatic bankruptcy stay, or (3) move for dismissal of your chapter13 case on the ground that you paid only the amounts due under the tr ia l per iod plan.

Q12. Am I eligible for HAMP if I have received a chapter 7 bankruptcy discharge?

Yes, even if you have received a chapter 7 bankruptcy discharge, you are eligible forHAMP. l f you did not reaff i rm your montgage debt, the fol iowing language must beinserted in the Home Affordable Modification Agreement:

" l was discharged in a chapterT bankruptcy proceeding subsequent to the execut ion ofthe Loan Documents. Based on this representat ion, Lender agrees that I wi l l not havepersonal l iabi l i ty on the debt pursuant to this Agreement."

Purpose of form, lndividuals can use Form4506T-EZ to request a tax return transcriptthat includes most lines of the original taxreturn. The tax return transcript will notshow payments, penalty assessments, oradjustments made to the originally filedreturn. You can also designate a third party(such as a mortgage company)to receive atranscript on line 5. Form 4506T-EZ cannotbe used by taxpayers who file Form 1040based on a fiscal tax year (that is, a taxyear beginning in one calendar year andending in the following year). Taxpayersusing a fiscal tax year must file Form4506-T, Request for Transcript of TaxReturn, to request a return transcript.

Use Form 4506-T to request the following.

o A transcript of a business return(including estate and trust returns).o An account transcript (containsinformation on the financial status of theaccount, such as payments made on theaccount, penalty assessments, andadjustments made by you or the IRS afterthe return was filed).o A record of account, which is acombination of line item information andIater adjustments to the account.r A verification of nonfiling, which is prooffrom the IRS that you did not file a returnfor the year.
