APPOINTMENT OF LICENSED BUYINGAGENTS FOR THE 1960-61 COCOA SEASON

It is notified for general information that theBoard is prepared to consider applications forappointment as licensed buying agents for the 1960-61 Cocoa Season which will open about the middleof September, 1960 (the exact date will be notifiedlater by publication in the Western Region ofNigeria Gazette). , : ,

2. Applicants will be required to produce evidencethat they are likely to be able to fulfil the minimumconditions set out in the following paragraphs,which are based on:

(2) the normal functions which a licensed buyingagent is required to petform ; -

3 (6) ability to purchase and handle a minimumpurchase required of0.25 per cent (i.e., one four-hundredth) of an average crop. This is felt tobe the lowest possible figure of purchases com-patible with orderly marketing and is taken as aquantity of 250 tons for an average sesaon ;

(c) average conditions as regards storage,’ evacuation, etc., ruling in past seasons,

3. Functions of Licensed Buying Agents—The mainfunctions which licensed buying agents will berequired to perform on. behalf of the Board are :—

(a) to purchasecocoa atbuying stations at notless than the minimum prices ;

(c) to finance purchases and provide suitablestorage until the time of shipment; _

(d) to make returns of purchases and stocks asthe Board or its duly authorised executive mayrequire 5

4, Minimum Conditions :(@) Purchases—Applicants must «produce

evidence of ability to purchasewith reasonableregularity throughout a season a minimum of 250tons of cocoa(7.e., Main and Light crops inclusive);

(6) Bags—Applicants must produce ‘evidenceof ability to provide at least 14 bales of 300 new

:. bags each, and twine therefor to cover the mini-mum purchase requirement; :

(c) Capital—Applicants will be required to_ Produce acceptable evidence of their ability to

satisfy the minimum capital requirement necessaryto fulfil the obligations of a licensed buying agent.The minimum capital requirement based on the1959-60 season producer price is- £9,000. This.minimum capital requirement may however beadjusted in proportion to any increase of decrease |in the producer price of cocoa announced by the |Board before the opening of the 1960-61 cocoaseason and any such alteration will be taken intoaccount in assessing an applicant’s ability tofinance purchases ; :

(d) Storage—Applicants must be able to provideevidence that they have available in their proposedareas of operation proper storage to cover at leasta hundredtons of cocoa, and adequate port storagewhere appropriate, bay,

(t) Inspection of Cocoa—That they will beable to provide an adequate labour force at allstores to handle cocoa at the time of inspection.

Gi) Returns—That they will render promptlyand accurately all returns, particularly ofpurchases and stock’, which may be called for.

Git) Evacuation—That they will be able tomake arrangements! to secure the necessarytransport by road, rail and water to ensure thesmooth and regular evacuation of .cocoa byapproved routes, :

(iv) Shipping Documents—That they possesse necessary organisation at port or the ability

to secure reliable agents to ensure the accuratepreparation and prompt submission of shippingdocuments as required by the Board, and thecarrying outof all duties involved in the delivery -

Duties.—The Director of Public Prosecutions hasauthority to institute and conduct criminal proceed-ings. He is further empowered to take over andcontinue proceedings which have been institutedby other authorities and may, in his discretion,discontinue such proceedings. These powers, whichare specifically conferred upon him by the Nigeria(Constitution) Orders in Council are vested in the .Director of Public Prosecutions to the exclusion of

’ any other person orauthority.

Other conditions of seruxce-—The post is pension-able and, in the case of a new entrant into the PublicService of the Eastern Region, appointment will beon probation for three yeats. There shall also bepaid to the holderof the office on account of expensesincurred in connexion with his office such allowancesas are paid from time to time to members. of thepublic service holding an appointment at an equiva-lent salary. The salary and allowances are protectedy law.
