The global manufacturing sector islooking at a major paradigm shift, according to Deloitte’s Report –The Future of Manufacturing. Changesin consumer demand, the nature ofproducts, the economics of productionand the economics of the supply chainhave led to a fundamental shift in theway companies do business.

In line with this, a half-day seminarwas co-organised by FMM andDeloitte Malaysia on September 23,2015 and attended by close to100 participants from the industry.

The Trans-Pacific PartnershipAgreement (TPPA) is without doubtthe most important trade negotiationsince the World Trade Organizationcame into effect in 1995. Malaysiaand 11 other countries recentlyconcluded the negotiations of thismajor agreement. The full text ofthis agreement has since been madeavailable in the public domain.

The Federation of MalaysianManufacturers (FMM) remains a strongadvocate of the TPPA. We believe thatthe TPPA will boost exports, enhanceemployment and also provide agreater degree of transparency forMalaysian companies investing inTPPA countries leading to strongerand more sustainable economicgrowth. We are therefore heartenedby the positive outcomes outlinedby the cost-benefit analysis studies, namely the National Interest Analysisby the Institute of Strategic andInternational Studies (ISIS) and theStudy on Potential Economic Impactof TPPA on the Malaysian Economyand Selected Key Economic Sectorsby PricewaterhouseCoopers (PwC).The results of these studies wererecently released by the Ministry ofInternational Trade and Industry.

PwC in its analysis on the economicimpact of the TPPA on ten strategicsectors highlighted that Malaysiawould enjoy net economic gainsmostly because of lower non-tariffmeasures of between 25 to 50%. The Malaysian gross domestic productis estimated to increase by up toUS$211 billion within the first decadeof the implementation of the TPPA.Investments are also projected toincrease by up to US$239 billion, largely in the textile, construction anddistributive trade sectors. Malaysia’snon-participation in the TPPA isprojected to incur a cumulativeGDP loss of up to US$16 billion overten years after the TPPA comes intoforce. This would be the opportunitycost of not ratifying the TPPA.

According to the National InterestAnalysis study, Malaysia’s participationin the TPPA is, on balance, in the nationalinterest. ISIS analysis indicated thatjoining the TPPA would be consistentwith Malaysia’s New Economic Modeland reduce tariff restrictions in theUS, Canada, Mexico and Peru. ISIShighlighted that independent estimateshave indicated positive effects onMalaysia’s growth, investment andjob creation. It pointed out that theGovernment had secured numerousexclusions and exemptions to safeguardthe nation’s and stakeholders’ interestsespecially in the areas of nationalsovereignty, Government Procurement,State Owned Enterprises and theBumiputera agenda. The Governmentretains its rights of affirmative action forthe Bumiputera community. Malaysiacan also elect to deny tobacco controlmeasures from Investor State DisputeSettlement provisions.

We would like to commend the Ministryof International Trade and Industryand its team of negotiators for havingsuccessfully handled the contentiousissues surrounding the TPPA andnegotiating a favourable net positionfor Malaysia as highlighted by thestudies undertaken by ISIS and PwC.

ISSUES TAKEN UP BY FMM

Malaysia’s Participation in the Trans-PacificPartnership Agreement is in the Nation’s Interest

It is increasingly important for Malaysiato diversify its export markets andbuild investor confidence in order tosustain the growth enjoyed by Malaysiathus far. This is especially so in thecontext of uncertainties surroundingworld growth, in particular the growthof our traditional export markets.Recognising the benefits that can bereaped from the TPPA, countries likethe Philippines, Thailand, Indonesia,South Korea and Taiwan have alsoexpressed their interest in joining theAgreement. Taking into cognisancethe positive overall impact of theTPPA, FMM would like to reiterate itscalls to the Government to expeditethe signing and ratification of thisimportant Agreement.

We look forward with equalanticipation to the successfulconclusion of other important FreeTrade Agreements in particular theMalaysia-EU Free Trade Agreementand the Regional ComprehensivePartnership Agreement that are beingnegotiated, for the same reasons.

FMM IN THE NEWS

An increase in foreign worker levyfor certain industries by at least 30%early next year would be too steepfor manufacturers. In fact, given thecurrent challenging times, any increasewould be a burden for manufacturers.Adequate consultation and moredetails on the proposed increase inlevies are necessary and a grace periodbe allowed before the changes takeeffect to assist industries to make thenecessary adjustments.

The Federation of MalaysianManufacturers (FMM) has alwaysemphasised to the government thatany increase that would impact onthe cost of doing business, like levy forforeign workers, should be gradual, planned and pre-announced. Theincrease in levy should not be so steepand immediate that it would adverselyimpact the competitiveness andviability of the manufacturing sector.

It is recognised that the levy rate is aneffective market mechanism to changebusiness behaviour in reducing thedependence on foreign workers andlabour-intensity of industry. At the

same time, a market based levymechanism would remove uncertaintyand inconsistencies in governmentpolicies and procedures with respectto the recruitment of foreign workers. In this respect, we urge theGovernment to concurrently simplifythe current process and reduce thecost of recruitment of foreign workers. The existing system of control byquotas should be removed. Employersshould be allowed to recruit foreignworkers based on their need as long asthey are prepared to pay the levy.

Additional levies collected becauseof higher levies should be ploughedback to provide financial assistance toindustry to promote automation, skillstraining and the provision of childcarefacilities such as crèches (company orcommunity based) to raise femaleparticipation in the workforce.

FMM is also strongly of the viewthat levy rates should be eventuallystandardised across all economicsectors to prevent abuse especiallyamong those with diversified business interests, who could bring

Manufacturers Call for Adequate Consultation anda Gradual Increase in Foreign Worker Levy

in workers through the sector withlower levies only to re-deploy themin the sectors with higher levies. The manufacturing sector should notbe made to bear a disproportionatelyhigher burden.

FMM reinforces that adequateconsultation with all stakeholders onnew policies and procedures is veryimportant to ensure that changes topolicies are reasonable, practical andaffordable to the business sector, particularly during challengingeconomic conditions. There shouldalways be a grace period beforemeasures are implemented.

Details of the proposed increasein levy and the affected industriesshould be made known quickly, inparticular to associations so thatfeedback could be provided tothe Government.
