    November 3, 1998. Prior Notice was sent to the Committee on Sep tember30, 1998 (Attachment 2). Th e Notice includes a section titled "48 HourNotices on Contributions". This section reads "Notices are required if th ecommittee receives contributions (including in-kind gifts or advanccs ofgoods or services; loans from the candidate o r other non-bank sources; andguarantees or endorsements of loans to the candidate or committee) of$1,000 or more, during the period October 15 through October 31 . Thenotices must reach the appropriate federal and state filing offices within 48hours of the committee's receipt of the contributicn(s)."

    sent to the Committee (Attachment 4). The RFAI notes on an informational basisthat the Committee may have failed to file one or morc of the required 48-HourNotices for "last minute" contributions of $1,000 or more. The notice requests theCommittee to review their procedures fo r checking contributions received duringthe aforementioned time period. I n addition, the notice states that although theComm ission may take legal steps, any response would be taken into consideration.

    that some of these contributions were included in a 4X hour report which failed toreach the Commission, . . . all or most of these contributions were apparentlyomitted inadvertently from the 48 hour reporting process. The Comm ittee furthercxplains that, This oversight may have resulted from a lapse in communicationbetween two of the Comm ittees offices. In October of I W X , the contributions wereprocessed in one office, while the 48 hour reports were gexrated in a differentoffice at a separate location. Since that time, the fiindraising office of thcCommittee has been consolidated to one office for all operations, lessening thechance of miscom munication. Accordingly, the Committee has talten actions tocnsure that the situation that caused this reporting problem cannot be repeated(Attachment 5) .

    Commission of conmiu tions which are received and then returned before being deposited.Obviously, it makes sense to d o this only if th e Commission would find such notificationhelpful. We w o d d appreciate your guidance as to whether the Commission would likesuch no tic ati on . The Committee hopes that its response ofJanuary 31,1999 wasadequate in addressing the concern about contributions which were disclosed on 48 hourreports, but not on schedule-A of the Post-General report.

    155m WOAs to the issue of appiuently excessive contributions, questions were asked aboutcontributions from Henry Lord, Ru th Lord and Mary Pennock.

    The appearance of excessive contributions in the cases of Henry Lord and Ruth Lord wascreated because tne Committee reported these two contributions incorrectly. Thecontributions were made through a conduit, and although it may appear that contributionswere excessive, they simply needed to be reported accurately as appropriate conduitcontributions. The C ommittee mistakenly reported th e same contributions twice on th eschedule-A portion of the 1998 Post-General report. (The only checks from the Lordsreceived by the Committee (attachment #3), the schedule-A form which vias previouslyfiled (arrachmer.+l),nd an amendment explaining th e Lord's contributions (aaachment#5) ,which should have been sent previously, are attached. A h ttached is a correctedschedule-A formwhich correctly reports other conduit contributions asthey should haveappeared on schedule-A of the 1998 Post-General Election Report (bttachmentM).) TheCommittee understands the need to report conduits accurately, and correctly reportedconduits on the 1998 Year End Report, which was due on, and filed by, January 3 ,1998.(Attached are copies of several pages of th e 1998 Year End Report WitR conduitcontributions as they are now reported by the Com mittee (uffachment 7).)

    The $250 contribution from Mary Pennock received by the Committee on October 27,1998put her $200 over the $1,000 limit on contributions for the 1998General election.At the time of her contribution, the Committee nadvertently M e d either to r e b d $200t o Ms.Pennock or to seek Ms. Pennocks permission in redesignaiing the additional $200for the 2004 Primary election. At t h i s time, the Committee has refunded $200 to Ms.Pennock, and has taken ineasures to ensure this mistake wiU no t occur n the hture. (Acopy of Ms. ennocks contributions filed by the Committee &chent #8), he $200refund check and refund form is attached (attachment#9).)The Committee understandsthe importance o f federal limits on contributions.

    The Committee is also carefully examinirlg all of our contributions to check for thepossibility of any additional excessive contributions. Because this process is timeconsuming, th e Committeewill contact the Commission as soon as possible in a follow-upcorrespondence to no@ the Commission ifany other mistakes are located. We have alsocorrected our method of reporting conduits under the direction of the Commission; andwe are also carefully reviewing and consolidating the procedures for processingcontributions

    ISSUE THREEFinally, let me address the concern of certain48 hour reports which were not and shouldhave been filed. While the Committee correctlyreported all the contributions in questionon the schedule-A portion of the 1998Post-General Election Report, a number of thecontributions were inadvertently not reported under the 48 hour report requirement for thefinal weeks of October 1998. Although there is a possibllrty that some ofthesecontributions were included in a 48 hour report which fd e d to reach the Commission,(The October 17, 1998 48 hour report is attached (attuchment #IO) .) all or most of thesecontributions were apparently omitted inadvertently from th e 48 hour reporting process.

    (The 48 hour reports which should have been prepared and sent in a timely manner arealso attached, dated March 11, 1999 (uftuchmentCfll).) he Committee sincerelyapolo-eizes for these omissions, recognizing and respecting the i m p o m c e of the 48 hourdisclosure requirement. As you recommended, the Comm ittee's procedures for filing the48 hour notices have been reviewed and the Committee ha s taken action to e r w e hat theproblem will not be repeated.

    For your information, it appears that the problem largely resulted fiom an internal lapse incommunication in the context of the Committee's effort to abide by Senator Feingo ldsvoluntary pldges to limit the amount of out-of-state and PA C contributions which hiscampaign received to certainmaximum percentages of the campaign's total receipts Asyou will note, most of the contributions in question were either PAC contributions or QUt-of-state contributions. and therefore were not always immediately accepted by thecampaign in order to ensure Senator Feingolds pledges were never violated. In otherwords. sometimes contributions were not deposited for a brief period o f h e , as perminedunder federal law, given that they might have had to be returned ifthe y would put theFeingold Senate Committee out of compliance with Sena tor Feingold's fundraisinginstructions

    The om issions apparently occurred when these checks were ultimately deposited and ?.herelevant campaign staff simply failed to file the 48 hour notices that had been fi ed forother contributions. This oversight may have res dte d from a lapse in commuilicationbetween tw o of the Committee's offices. In October of 1998, the contributions wereprocessed in one oE ce, while the 48 hour reports were generated in a differe:nt office at aseparate location. Since that time, the hd r a is i n g office of th e Committee h r s eenconsolidated to on e office or all operations, lessening the chance ofmiscommunication.
