AND WHEREAS by the Acts of the Provinoe of Nova Scotia, passed in the year 1931, Chapter 72, The City of Halifax was authorized to borrow a sum not. exceeding 0140 000000 to defray the cost of the purchase of a motor 'pumper for the Fire Department and no money has heretofore been borrowed under said statutory authority, and it is now desired to borrow the sum of J14,000000 for the purpose aforesaid;

Dear Sir:.

Notioe of motion re reduotion of interest rates on unpaid taxes was referred. by your oorarnittee to me for a report.

My opinion is that a rate per annum not lower than 6% should be made effective from Hay lst 1935. This rate now applies to BettermentCharges. Such a rate should be made to apply to poll taxes with a minimum charge of .250.

If a lower tat e.•is- made• :- effeotive it will affect • the raoraentUra'•'of -tax. payments, inasmuch as the civic rate will be taken advantage NZ to a large extent to Gelay making tax payments until, the lien: is close to :expiry. -The civic rate should be not lower than the bank rate available to borrowers°

As all interest colleoted in excess of interest outgo, eventually finds its way back to the estimates, the taxpayers at large obtain . full advantage of all interest profit made by the City. At Present this relieves the civic tax rate by six to seven points°

Moreover, the profit in question could very readily be foregone if there were no taxpayers in arrears. At best, thereforeOthe profit is only a partial recovery of the cost of a large oolleoting staff, whose chief work is aesooiated with accounts of taxpayers in arrears. From such accounts only is interest collected and, exoept for theta, the collecting staff could be reduoed to three or four.

Some time ago I was requested by your committee to advise as to the City's liability to pay the above named amount deduoted from his remuneration under the 10% feduotion in salary scheme. I have given this matter considerable thought and might any that I have found it womewhat difficult to get down to the actual -facts of the oaee. However, I understand the same as follows:

In July 1932, Mr. Coles Was engaged as a temporary Poll Tax Sub-Collector, pursuant to an advertisement in the daily press at Hal,fax. This appointment was made for the period from July, not to exceed the balance of the then current civic year of 1932-1933. This was in accordance with the decision of the City Council. During this period Mr. Coles received a commission of 15% on all his collections. In April 1933 the City Council reappointed Mr. Coles to be a temporary collector for a period of six months from May lst, 1933. No mention is made in this appointmant by the Council of the amount of remuneration, and no resolution of Council stating that he was to be subject to a 10% reduction was passed. On receiving his first pay for the year 1933-1934, some time about the middle of May, Mr. Coles made a complaint and ultimately the matter oame before your oommittee on a report from the City Collector on July 12th, 1933*

Your committee forwarded the same to the City Counoil for information and the neoessary action. A motion was made at a meeting of the Council on July 13th, 1933, that the five temporary collectors 1De exempted from the 10% reduction in commissions and that they be repaid all reductions .made. It was moved in amendment however, and duly passed that the matter stand as it is and that the

temporary oollectors be subjeot to the 10% reduotion“.

It would seem to me that the resolutions for reduction of salaries and wages by 10% did not oont emplat e a reduction of the remuneration of persons who were being paid by °omission. In my opinion this is borne out by the fact that a further resolution was .considered necessary insofar as ruoh em4oyees were ooncerned, and it seems to me therefore that Hr. Coles is entitled to reoeive his full commission without any refluotion up until the 13th day of July,19331 that is during the period May 1st, 1933, to July 13th, 1933, for the reason that at the time of the reappointment.of:Nr. Coles nothing appearg on the minutes of the Qity Cloumollregarding hie remuneration, and I think .it) is quite reasonable td assume that the xemuner'alcion . will_oontinua to be the same as that which he received under his original appointment.

Since the completion of the pavement on the Dutch Village Road the use of this street by tourist and pleasure traffic is gradually increasing and is beooming one of our main entranoes to the City, for this class of traffic. It would appear advisable to make the southern portion, if not all of i1 a residential district.

Under the Charter it ie necessary that a petttlon signed by persons owning not lees than seventy-five peroent of the frontage of the properties fronting on a street or part of a street, asking that such street or part of a street be oreated a restaential distriot s be presented to the City*

In this oases in view of the,publio nature of the improvement; it is recommended that legislation be obtained creating a residential district on the east side of the road, oovering the area defined in the proposed amendment to the Charters

It is also recommended that the County ahthorities be approached with a view to their obtaining similar legislation for the west side of the road0 •

I beg to report on the applioation of Mr. Walter Brookfield for City water out aide the Oity limits, that heproposed to erct a dwelling on lot noo 14 on the division of the Egan property on the west side of the Dutuh Village Road, 'this lot is about 270 feet west of the road.

At present there is a pipe supplying ilouses . belonging to the Egan estate and it is proposed to extend this pipe to the lots mentioned.

It is recommended that a permit,Pe. granted under the usual terms and conditione4 the owner to pay d%1 costs that may be incurred by the City and at the rate of 20 cents per 1000 gallons, but in any case a minimum rate ofnot, less than 45000 per half yearn

It will be necessary also that formal permission to use the pipe be filed by the representatives of the Egan emtate.

In connection with this applioation, the committee is reminded that last year the matter of increased rates for water supplied outside the City ,limits was deferred for further consideration.

This endorsement does not very olearly state the real matter which is to be decided and there are no pleadings°

The parties however have filed in lieu, of pleadings on agreement in regard to facts and issues. They have headed this "Stated Case" which is perhaps not a very satisfaotory heading, but table clear enough that this statement is intended to define the matters in oontroversy and ii'a issue settled in conformity with Order XXX111

The endorsement on the writ would appear to be objectionable as raising alari#a0 questions of law, but the statement of facle an interpreted by counsel at the hearing dhows that the questions to be deoidod have reference to a particular matter which has arisen in connection with the permanent paving of South Park Street in the City of. Halifaxo

The city has given notice thatAt intends to pave South Park Street between Spring Garden Road and South Street with permanent 'paving and has required the defendant to move its tracks to a different location in the street from that in which they were placed many years ago when the tramway was built° This the defendant oompany refuses to do and the motion is for a deolaration as to the respective rights of the parties under these circumstances. I understand that dedlaratory judgments under the provisions of Order. XXV, Rule 5, are to be granted with some degree of mutton, but in my viow this is a proper oase for a declaratory judgment as these partioular facts.

The defendant company was incorporated by an. Aot of the Legislature of Nova Scotia, Chapter 107 of the Aots of 15920 Under this act it is given authority to construct and operate and, electric tramway in the City of Halifax and, particularly over the street in question.

Under the provisions of the Halifax City Charter the consent and approval of the city is necessary before the company has any right

to build construct or place a line of railway or tramway or poles on any streets Section 580. It is admitted that this consent has been given so far as South Park Street is concerned,

The provisions in regard to the Company's powers are to be found in its Act of Inoorporation, Chapter 107 of the Acts of Nova Sootia 1895, and amendraent s thereto

When a tramway is to be construoted on a certain street the Act provides the supervision and control which the city through its engineer may exercise over such construct ion.

Before considering the effect of these sections it may 1)'.: to consider briefly the relationship betwee:i the city and the company. Many oases were cited from United States courts to show that a residuary power was implied in the city by which it could exercise control over the tramway in ways not particularly setout in the Act, on the other hand, other cases of high authority were cited to show that the granting of particular powers excluded , any implication of go:leral powers I think that it i s clear that ; fInder our Canadian system th&re are no poters implied 'in whether city or st3famway whioh can not be reasonably inoludtod lila the ,gt.eatt by-the legislature to which all the power' in ,question have been assigned by the British North America Act. The Act which. gives-pow. drs and privileges to the defendant oompany is divided into twp parts, One, the Act itself consisting of 41 Emotions and second, the Rules, which are ',part and parcel!' of the Act() By whioh phrase I understand that these rules apply to every part of the Act and are of equal foroo with the Act itself. Section 3. The company has power to construct and maintain .1.1 tramway upon and along the streets of the oity of Halifax° This power is stated to be subject to clauses 6 and 230 Clause 6, provides fox the expenses of breaking open and closing the streets, Clause 23, provides for the supervision of construction by the oity ongineer


There can be no doubt that the power is also subjeot to the rules in the schedule to the Aot. Rule 2, direots that tracks shall approve. In this oase he has approved a oertain location in South Park Street.

So far there is no difficulty.

The rails are down. The Oity oannot compel the company to take them up except under circumstances set out in the Act. There is,I think, nodoubt however that the oompany may itself take up the rails from time to time for the purpose of repairing or replacing worn out parts for that is inoluded in maintenanoe. I oan see no reason why, if the company should desire at any time to change the place in the streets where tracks are laid, the engineer could not approve of another location. In other words, a construction which restricts the approval of the engineer to ono expression of approval, unnecessarily restricted construction.

In my opinion the word nreplace4 has nothing to do with looation6 It simply means that the company must take up the rall:s • substitute "approved rails, points and substruoturesn for them.

The rails are up under this section and when they are to go back Ruile 2 is still effective and the engineer must approve the place where they axe to be laid,

With deference therefore I would allow the appeal and would answer question (a) in the affirmative°

As to question (b) I am not satisfied that the city has such power but I would prefer to reserve judgment until some particular oase arises.

The facts sufficiently appear in the judgment appealed from. In view of the way in which this action has been framed, I seriously doubt whether any of the questions in the stated case should be answered. The only justifioation for answering the first question is, that there does seem to be, at the present time a real issue between the plaintiff and defendant, involving the right of the plaintiff to direct a relocation of the tracks of the defendant on South Park Street in the Oity of Halifax, at the latteris expense.

In my opinion the answer of the learned trial Judge to the first question is oorreot. There is only one matter in his judgment to which I wish to refer. The learned trial judge expressed an opinion that under section 29 of the oompanys act of Incorporation, there was an undoubted right in the city to demand a relocation of tracks in the event of a change of grade. With deference I am not for the moment convinced that such right does exist, but as the question does not arise in these proceedings, I wish to be understood, as reserving my opinion on the point,

Some two or three years ago when the question of eliminating the level crossing of the railway on the Dutch Village Road Was under disoussion, the suggested schemes anticipated the extension of a street on the east side of the railway adjoining the existing Dutoh Village Road at Mumford Road, approximately in a location shown on the a000mpanying plan K.K0107935

A ref erenoe to the plan will show that if Stanford Street were extended in a straight line to the Dutch Village Road, there would be lees damage done to the corner properties and this would be the logioal looation for the street exoept for the f aot that it would mean a sharp reverse curve in the Dutoh Village Road and from the point of view of accommodating modern past trawl, the location of the street as laid down; enclosed in ured lines" on the plan, is in any opinion, the proper location for it.

The paving of the St. Margaret I Bay Road will probably be undertaken during this season. This will .have the effect of inducing more building activities thus increasing the danger of pollution and also of additg to the value of the land so that the present would seem to, be an opportune time to secure the properties required.

I hve been in communioation with the owners as far as they can be ascertained and the prices asked vary very considerably and are in general, in my opinion, excessive. There are also properties the titles of which are in dispute. For these reasons it would appear advisable to expropriate the lands required and have the price to be paid fined in accordance with the provisions of the City Ohartero

The accompanying plan (No.8014) and description of the lands required have, beep.; prepared and it is recommended that the said lands • be acquired .by expropriation.
