The agency has invited public comment on a Petition for Rulemaking and a Petition for Declaratory Ruling , both filed by the Wireless Infrastructure Association (WIA). The association asked the Commission to adopt new rules or explain existing ones regarding Section 6409(a) of the Spectrum Act of 2012. The Commission is also seeking public input on a similar request from CTIA. WIA asked the FCC to amend its rules to reflect that collocations requiring an expansion of the current site—within 30 feet of a tower site—qualify for relief under Section 6409(a) and to require that fees associated with eligible facilities requests under Section 6409 be cost-based. WIA also asked the Commission to clarify: 1. that Section 6409(a) and related rules apply to all state and local authorizations; 2. when the time to decide an application begins to run; 3. what constitutes a substantial change under Section 6409(a); 4. that “conditional” approvals by localities violate Section 6409(a); and 5. that localities may not establish processes or impose conditions that effectively defeat or reduce the protections afforded under Section 6409(a). It doesn’t take much imaginationto realize an unsecured helmet won’t do you any good if it comes off your head in wind or in the middle of a fall.   • Massachusetts Telecom Act Still Has Teeth in North AndoverBy Jim Fryer, Inside Towers Managing Editor

    North Andover, MA will be getting a 115-foot monopine erected sometime in the near future at 122 Foster St.following a ruling by a Massachusetts District Court judge siding with the plaintiff, Varsity Wireless, over the town ofNorth Andover Planning Commission. The decision both supported and cited the Telecommunications Act of 1996.The tower will accommodate AT&T and Verizon.

    “This is another in the long line of successful cases supporting the Telecommunications Act,” Varsity’s legalrepresentative Brian Grossman of Bowditch, a Framingham, MA law firm, told Inside Towers, “that trend continues.We’re thrilled with the decision”. The court action follows the local board’s denial of a cell tower permit for Varsity Wireless Towers LLC (VWI...sinceacquired by Everest Infrastructure) that the company filed in August of 2017. The permit for a 130-foot structure hadinitially been approved by the town’s zoning board which then ordered a series of five public sessions to discuss theproject.

    During the hearings, VWI submitted a list of 19 sites they had considered and rejected. Among them was multiple C-RAN nodes on small cell sites and publicly-owned properties located farther outside of town. The town hired an“expert”, David Maxon, who agreed that a coverage gap existed and many of the alternative sites were not usable,but several sites on the list and others were still viable alternatives and should be reconsidered.     FCC Seeks Insight Into CA Carrier Wildfire Prep

    Wildfires in California have ravaged parts of the state, affecting communications networks and the public’s ability tocall 911. Now, to reduce the risk of electrical equipment triggering wildfires, some California energy providers,including Pacific Gas and Electric, announced plans to shut off power at times in areas where wildfire risk is high.

    These actions prompted FCC Public Safety and Homeland Security Bureau Chief Lisa Fowlkes to ask severalcarriers operating in the state how they intend to provide continued wireless service in the event of a power shutoff.She queried AT&T, Sprint, T-Mobile, U.S. Cellular and Verizon.

    Fowlkes asked the carriers to describe their contingency plans, or steps they’ve taken, to mitigate the effects of thesepotential power shutoffs. Responses “should include details related to its contingency plans to promote the continuityof communications for public safety officials and residents (including preparations to use back-up power), its strategy

  • for outreach to consumers, and its plan for coordination with public safety officials, power companies, and otherrelevant stakeholders,” Fowlkes said in a letter.

    The FCC would also like to know details of carriers efforts to harden their communications infrastructure orconstruction of new infrastructure in areas prone to wildfires. She seeks a reply within ten days.

    IllinoisSubdivision Developer Allows Space for Towers

    The Batavia City Council unanimously approved a land annexation agreement to make way for two cell towers,reported the Daily Herald. Developer M/I Homes will now have three fewer houses, now 110 total, for the plannedWinding Creek subdivision due to the project approval.

    The amendment will create a half-acre unincorporated "island" to accommodate the towers that would "not alter thecharacter of the development," according to the documents. Per planning and zoning officer Joel Strassman, "Amunicipality can annex property it surrounds. We call them doughnut holes."

    The city wants to close some of those “donut holes,” according to the Herald. "Having a doughnut hole is not ideal forall the other positives we can draw from it," added Strassman. "We have the ability to annex [these areas], even if theowner doesn't like it."

  • Sprint opened a 5G test bed last week and Verizon is working with Mcity at theUniversity of Michigan to advance transportation safety and shape the future ofautonomous vehicles and smart cities using 5G. The Verizon 5G Ultra Widebandnetwork is now live at the Mcity Test Facility where the carrier is testing various 5Gsolutions designed to boost pedestrian safety and avoid car accidents. Thisincludes installing 5G-connected cameras at every intersection inside the Mcity testtrack to help identify traffic and pedestrian patterns to prevent collisions.

    Several key components of 5G service — high bandwidth, low latency and theability to connect hundreds of devices in a relatively small area — make the safetyboost possible, according to Verizon. If each vehicle passing through an

    intersection is able to relay and receive information from other vehicles and streetlight cameras, that information canbe used to notify cars when lights turn red or vehicles ahead come to a sudden stop. Verizon’s 5G Ultra Widebandnetwork is able to quickly transmit that data, enabling autonomous vehicles to react faster than humans when itcomes to braking to avoid a collision. Continue Reading

    FloridaIt’s Raining Small Cells In Florida’s Panhandle

    Last month, Verizon received approval for seven, 4G small cell permit applications. Now, six more applications areunder review, reported the Pensacola News Journal, but that’s just a drop in the ocean. Per a city permitting official,Verizon and AT&T submitted requests for 90 more small cell locations, and 40 more are in the works.

    Florida laws passed in 2018 and 2019, severely limit any input local municipalities have over the new small cellantennas in the right of ways, reported the News Journal. Several residents expressed frustration to PensacolaCouncilman Jared Moore and state Rep. Alex Andrade, during a neighborhood meeting.     CaliforniaMenifee Nixes Plea From AT&T

    The California town of Menifee continues to debate allowing a cell tower a place within its borders. The MenifeePlanning Commission met last week, and Menifee 24/7 reported the results. The latest round chalks up a victory forthe NIMBYs as the vote was 3-to-2 in favor of denial. AT&T has argued that the site at Wheatfield Park is the only suitable location for a cell tower, but the commissionersdisagreed. The City Council will be the next to weigh in with their decision on the fate of the proposed tower.

    MarylandPoor Cell Reception is For the Birds

    Thanks to the Migratory Bird Protection Act, the ospreys in Chestertown, MD havetaken control of the airwaves, nesting in cell towers and “fowling” [sic] up the signal,so to speak. As the Chestertown Spy reports, cell reception for businesses andresidents is spotty at best when the birds and their families are in town.
