The Greenbrier is an award-winning hotel and resort located in White Sulphur Springs, West Virginia. The Greenbrier , a National Historic landmark, represents 227 years of history with its classic architecture, FCBA Breakfast Features Senator John Sununu and Representative Rick Boucher Senator John Sununu, Senate Committee on Commerce, Science and Transportation, and Representative Rick Boucher , House Committee on Energy and Commerce, will join FCBA members for a breakfast on April 26, 2006 at the Mayflower Hotel, 1127 Connecticut Avenue, NW. DEAR MEMBERS :

The FCBA welcomes our new Director of MembershipServices Kerry Loughney this month. Among otherresponsibilities, Kerry will coordinate with our committeesand chapters on their brown bag lunches, CLEs, social events,and other activities. We will be introducing Kerry to ourmembers at upcoming events, and we’re delighted to have herjoin the FCBA’s hard-working team.

April also marks the start of the FCBA election process. TheNominations Committee, led by Past-President Harry Martin, has nominated anoutstanding slate of candidates for the Executive Committee, the Foundation Board,and for the Nominations Committee for this coming year, and this year’s ballot willinclude photos as well as bios. Please take time to review and return your ballot –some years there are candidates who win or lose based on a single vote. In addition,incoming President Jennifer Warren will begin making FCBA committee andchapter assignments this month – please let her know if you’re interested in servingas a co-chair for the coming year (starting in July 2006).

Speaking of committees, several months ago I asked the Relations with Other BarAssociations Committee to reenergize their group and look for new opportunitieswith other bar associations. New Co-Chairs Jenell Trigg, Edgar Class, and Mark DelBianco rose to the challenge, leading our first-time efforts to partner with theAmerican Bar Association on two successful new CLEs this year, including thePrivacy CLE in March and the Antitrust CLE in January. (And later this month ourlong-standing FCBA-ABA-NAB “Representing Your Local Broadcaster” seminarcelebrates its 25th anniversary at the NAB convention.)

Many thanks to our committees and members who contributed to the success of ourMarch events, most notably the well-received luncheon to launch our newMentoring initiative, sponsored by the Diversity and Young Lawyers Committeesand led by Russell Frisby, and our “Turning the Tables” press luncheon moderatedby Bryan Tramont and Dan Brenner. Likewise, the Mass Media PracticeCommittee’s DTV CLE and the Economic Analysis CLE, coordinated by DavidSieradzki and Greg Rosston of the Stanford Institute for Economic Policy Research,were both timely and well-attended events.

Finally, congratulations to Southwestern University School of Law’s moot court teamfor winning the 2006 National Telecommunications Moot Court competitionsponsored by the FCBA and Catholic University, and kudos to our first-time MootCourt Committee Co-Chairs Ronnie London, Martin Price, and Jeffrey Gee –assisted by last year’s co-chair Ben Golant — for their months of hard work andpreparation for this event. And thanks to Past-Presidents Anne Swanson andMargaret Tobey for their excellent 70th anniversary column in this newsletter,featuring highlights from the past five years of FCBA history.

February Ice SkatingEvent with Martha’sTableOn Saturday, February 25, the FCBAFoundation sponsored an afternoon ofice-skating for children from Martha’sTable’s Children and Youth Program.Along with a few chaperones from

Martha’s Table, FCBA volunteersaccompanied the children to the Ft.Dupont indoor ice arena, where some ofthe children (and volunteers) had theirfirst experience on ice skates. The more“experienced” volunteer skaters helpedsome of the children navigate their wayaround the rink, while other childrenseemed to manage quite well on theirown. Helping Hands atMartha’s TableFollowing a large turnout of membersof the FCBA’s International PracticeCommittee in January, members of theFCBA’s Cable Practice Committee wereFebruary’s volunteers to assist inpreparing meals at Martha’s Table.Their response was so overwhelmingthat two shifts were required.

FCBA FoundationSeeks VolunteersThe FCBA Foundation Wants You! TheFoundation is looking for volunteersinterested in assisting in some of thevarious programs the Foundationsponsors. Most members are familiarwith the Foundation’s volunteer effortsat Martha’s Table and McKenna’sWagon, which are regular monthlyactivities that allow members to give alittle back to the Washington, DCcommunity. What is not as well knownis that FCBA members can alsovolunteer to help the Foundation withits other programs. Currently, theFoundation is gearing up to reviewapplications from high school studentsseeking one of the Foundation’s collegescholarships. FCBA members can assistthe Foundation review the students’written applications and participate inthe student interviews (scheduled forthe weekend of May 19-21). TheFoundation also is looking for memberswho are interested in serving as mentorsto the students who receive aFoundation scholarship. McKenna’s Wagon Volunteers Neededfor April 23

The FCBA Foundation is looking for afew members to volunteer on Sunday,April 23rd , with McKenna’s Wagon.McKenna’s Wagon is a mobile soup andsandwich wagon that goes “on location”to deliver food to the needy. For thosewho have volunteered, it has been awonderful experience and a great wayto help the needy in the D.C.community.

The Wagon is a white van that is loadedup with sandwiches, snacks and soup.We meet at Martha’s Table at 4:45 p.m.in comfortable clothes and shoes.

Martha’s Table is located in a yellowbuilding at 2114 Fourteenth Street, NW,in the District, near the intersection of14th and U Streets. On-street parking isavailable.

Upon arrival we get assignments (someof us will distribute snacks andsandwiches, others will serve soup), andput on aprons before we depart in thevan to 5th and New York Ave., NW(near the new Convention Center). Weare driven by one of our experiencedvolunteers and the trip to distributionlocation takes about 10-15 minutes.

We serve about 30-75 people per visitincluding a few mothers who come forfood for their families. The area is wellpatrolled by police. The fooddistribution is conducted in an efficient,calm and orderly fashion and many ofthe people we serve are quiteappreciative of our efforts. Once weserve all of the food, we do a clean up ofthe immediate area. Total time for thedistribution takes about one hour andwe usually return to Martha’s Table byor before 6:30 pm.

As with theprevious nine years of the tournament, ascrambles (Captain’s choice) format willbe used and groups may arrange theirown foursomes. Individuals are alsoencouraged to sign up and will bepaired with three other nice folks.Despite upward pricing on virtually alltelecommunications services and apremium Friday date, the fees for thetournament are the same as last year -$1,000 for an Eagle Club team; $200 forprivate sector FCBA members; $150 forgovernment FCBA members and younglawyers. For this bargain, you will beprovided with all the amenities thecourse has to offer, plus breakfast andlunch, use of all the practice facilities,and a list of acceptable excuses not toreturn to the office on a pleasant Fridayafternoon. All proceeds are donated astuition grants for deserving District ofColumbia High School graduates. AsStud Estey, one of the originalorganizers of the tournament would say,“what a great concept, do good andhave fun at the same time.”

FCBA Celebrates 70 YEARS

Continuity andGrowth — The FCBAFrom 2000 to thePresentBy Anne Swanson and Margaret Tobey

In the past six years, the FCBA has builton the successes of the nineties, addingmore events for members in the DC areaand increasing the opportunities formembers in chapters around the countryto participate in the organization’sactivities. The FCBA has truly become anational organization. At the same time,many events have continued, becomingestablished institutional features — theAnnual Seminar, the annual moot courtcompetition for law students, the fallCharity Auction, the December FCBA-PLI Conference and Chairman’s Dinner,the biennial legislative receptionhonoring Senate and House CommerceCommittee members and their staffs, theannual Charity Golf Tournament,“Comm Law 101” and many more.The FCBA’s growth over the period canbe traced not just to its officers,committee members, and members, butto the impressive professional staff it hasbeen able to retain and increase over thelast several years. Stan Zenor, ExecutiveDirector, and Heidi Kurtz, DeputyDirector, joined the FCBA in 1999. AllFCBA members were sorry to see Heidimove on to new opportunities earlier thisyear. Stan continues to hold everythingtogether with the help of Wendy Parish,who joined the FCBA office in 2001, andAnn Henson, who arrived in 2004.Without them, the accomplishmentsbelow would have been much fewer andnot nearly as well organized.

Anne Swanson’s term as president (2000-2001) included scores of events,luncheons, and seminars, including anumber of “firsts.” In August 2001, theFCBA held its first “Seminar West” atSilverado Resort in Napa Valley,California. Designed to give FCBAmembers from chapters outside DC acounterpart to the East Coast’s Annual

FCBA Seminar weekend, the eventbrought together over 150 attendees witha program that featured a number ofindustry speakers, Commissioner SusanNess, and the chairs of the California andWashington state public utilitycommissions. Anne’s “year” also broughtthe first CLE in northern Virginia, aseminar on technology basics taught byDale Hatfield, and the FCBA’s first co-sponsorship of the ABA/NAB’s Las Vegasprogram “Representing Your LocalBroadcaster.” During the year, Annerevitalized the monthly lunch series, withspeakers that included Cabinet memberand USTR Representative CharleneBarshefsky, FCC Chairman MichaelPowell, Rep. Fred Upton (R, MI), andDC Mayor Tony Williams. The Mayorkeynoted a special luncheon honoringthe Young Lawyers’ success with the fall’sannual FCBA Charity Auction as well asall the FCBA foundation volunteers whogive so generously of their time to makethe Nation’s Capital a better place. BillKennard also presided over his final“Chairman’s Dinner” in December 2000.Before her term ended, Annecommissioned the FCBA’s first everprofessional survey, a project supervisedby Sandy Wilson and Jennifer Warren.Anne’s principal memory of her year aspresident, however, was the tremendousoutpouring of help and support that shereceived from FCBA officers, executivecommittee members, and others as shespent practically every evening of herpresidency at the hospital tending toseriously ill parents. She knew the FCBAwas a people-friendly bar, but during her“year,” the members outdid themselves,particularly her president-elect MargaretTobey.

Margaret Tobey’s own term as president(2001-2002) began with the shock andhorror of September 11, in which twoFCBA members were killed — KarenKincaid of Wiley Rein & Fielding andRichard Aronow of the Port Authority ofNew York and New Jersey. The firstluncheon of the season — featuringnewly installed Commissioner KathleenAbernathy (herself a former FCBApresident) — was scheduled for just sixdays later. The Executive Committee

considered canceling the luncheon, butdecided in favor of proceeding asplanned. The decision was a wise one —Commissioner Abernathy gave aninspiring speech, and the luncheonreminded us of how important thecohesive FCBA community is in ourprofessional lives. Luncheons with theother two new commissioners —Commissioner Michael Copps andCommissioner (now Chairman) KevinMartin — followed. Chairman MichaelPowell took his first of several star turnsat the Chairman’s Dinner and wowed thecrowd with his biopic based on VH1’s“Behind the Music” and his famoussummersault off the stage. In October,the FCBA began delivering thenewsletter in electronic form, and inFebruary 2002, the FCBA launched theonline directory. Although it phased outthe paper version of the newsletter inApril, the Executive Committee decidedto retain the paper directory, a decisionbased in large part on the results of theFCBA’s membership survey, whichshowed that the directory was consideredone of the top benefits of FCBAmembership. During Margaret’s year aspresident, the FCBA Foundation markeda very important milestone — its 10thanniversary — which was recognizedthrough a year-long “Connecting OurCommunity” campaign spearheaded byPeter Ross of Wiley Rein & Fielding; itculminated in a special celebration at thePhillips Collection featuring ChairmanPowell.

Peter Shields kicked off his term aspresident (2002-2003) with two verywell attended events in July 2002 outsideDC — a “Seminar West” weekend in SanDiego, headlined as “Broadband: Feast orFamine?” and a reception at the NARUCsummer conference in Portland, Oregon.In the fall, Peter hosted the FCBA’s firstOktoberfest Reception to honor FCCBureau Chiefs and their staffs, an eventthat has since become a regular feature ofthe FCBA calendar. His term saw thenomination and confirmation of FCCCommissioner Jonathan Adelstein, andthe FCBA honored the newCommissioner at a reception in February2002. Peter’s year featured many

interesting luncheon speakers, includingFCC Chairman Michael Powell, NFLCommissioner Peter Tagliabue, andcommunications industry leaders. TheFCBA held a special day-long CLE onFCC enforcement issues in April.Commissioners Copps and Abernathyhelped Peter round out a great year bytraveling to Northern California andAtlanta, respectively, to help host FCBAevents.

Sandy Wilson made tackling associationmanagement issues a high priority of heryear (2003-2004) as FCBA president.Included among her initiatives wasimproving the association’s software,hardware, and workplace tools for thestaff. The FCBA’s website also wasredesigned, updated and made moreuser-friendly during Sandy’s year, inconjunction with a long-overdue revisionof the membership brochure. Sandylaunched the FCBA breakfast speakerseries, with the help of Henry Martin.During Sandy’s term, the FCBA heldanother in-depth enforcement seminar,this time in Atlanta, for the benefit ofmembers in the Southeast. Sandy alsobroke new ground for the FCBA’s EastCoast Annual Seminar, taking it to a new

venue on the Chesapeake Bay. InSeptember 2003, the FCBA Foundationand the Association of CommunicationsConsulting Engineers held their firstcombined charity auction to benefit thescholarship funds of both organizations.Near the end of Sandy’s term in June

2004, the FCBA hosted a reception tocelebrate the 70th Anniversary of theCommunications Act of 1934. FCCChairman Michael Powell andCommissioners Adelstein and Coppswere joined at the commemoration by 11individuals who had previously served asCommissioners.

During Harry Martin’s term as FCBApresident (2004-2005), the number ofFCBA events and their attendancecontinued to break records. During2004-2005, the FCBA held 16 CLEsessions, a new first. Three of the eightluncheon and breakfast events featuredmembers of Congress — Sen. TedStevens (R, AK), Rep. Joe Barton (R, TX),and Rep. Chip Pickering (R, MS). Harrypresided over three receptions, and histerm featured Michael Powell’s lastChairman’s Dinner. Under Harry’s watch,the FCBA launched a new chapter inFlorida, and the other FCBA chaptersaround the country continued holdingnumerous CLEs, seminars, andreceptions. The FCBA’s managementimprovements continued with theimplementation of a new associationsoftware program during Harry’s term.
