GENERAL INFORMATION WEB REGISTRATION Web registration will be available for all courses during the times indicated in Table 1. To register online, log into the Hofstra portal at my.hofstra.edu using your Hofstra Network ID and password. If you do not know your Hofstra Network ID and/or password, please go to the Law School’s Office of Information Systems in Room 223, or contact the office at (516) 463-4192. You may also contact the Office of Information Systems via e-mail at [email protected]. In order to register on-line, please follow these instructions: 1) Log in to the My Hofstra Portal - https://my.hofstra.edu 2) Select the "Hofstra Online" option from the left hand side. 3) From the Main Menu, select the “Student Information” option. 4) From the “Student Information” option, select the "Registration" option. 5) Follow the links to complete your registration. Class Schedule for Fall 2011 The Class Schedule for Fall 2011 is contained in Appendix 1. This gives all the course information (CRN, Title, Professor, Days/Times, and credits) for the classes for Fall 2011.

REQUIRED CLASSES As sections must be balanced on a variety of factors, the Office of Academic Records automatically registers and assigns students to sections for first- and second-year required courses. Full Time 2nd Year students (as of Fall 2011) will be registered for a section of Constitutional Law I. Part Time 2nd Year students (as of Fall 2011) will be registered for a section of Criminal Law and Constitutional Law I. If you are an upper level student, and you need to take a first year course, please send an e-mail to [email protected]. The Office of Academic Records will take care of registering you for the course(s). Please make sure that you include your name and student ID number. Note for Upper Level Students: You may select any open elective courses scheduled at any time.

CLOSED CLASSES If a class that you wish to register for is closed, you may sign up for the waiting list on the Hofstra Online Information System. You will be notified via e-mail by the Office of Academic Records ([email protected]) should a seat become available. You will have 24 hours to register for this course. If you do not register for the course within 24 hours, you will be taken off the waiting list and the seat will be offered to the next student.

HOLD ON REGISTRATION If you have a “HOLD” on your registration, you will not be permitted to register on-line and you should come to the Office of Academic Records (room 114) to speak with the Registrar or Assistant Registrar. Most holds are due to an outstanding balance on a student’s account (e.g., hold placed by the University’s Office of Student Accounts).

GENERAL DROP/ADD PERIOD The General Drop/Add period will begin on Thursday, April 14, 2011, at 10:30pm and will end on Wednesday, August 24, 2011 at 11:59pm. During this period any student can drop and/or add courses to their schedule without penalty. After the Drop/Add period, students are not able to add classes to their schedules.

EXTENDED DROP PERIOD Beginning on Thursday, August 25, 2011 through Thursday, September 1, 2011 at 5:00pm, students can drop (no “W” grade will be recorded on the transcript) elective courses only, by completing the COURSE CHANGE OR WITHDRAWAL FORM available on the law school’s website at (www.law.hofstra.edu) or in the Office of Academic Records (room 114). The completed form must be brought to the Office of Academic Records for processing.

WITHDRAWAL FROM AN ELECTIVE COURSE Beginning Friday, September 2, 2011 at 9:00am, students may withdraw from elective classes only by completing the COURSE CHANGE OR WITHDRAWAL FORM available on the law school’s website at (www.law.hofstra.edu) or in the Office of Academic Records (room 114). The completed form must be brought to the Office of Academic Records for processing. If the request for withdrawal is received after the Extended Drop Period (i.e., starting on Friday, September 2, 2011), a “W” grade (withdrawal without penalty or prejudice) will be entered on the transcript. The last day to withdraw from an elective course is Friday, November 11, 2011 at 5:00pm. Students are not allowed to withdraw from required first or second year courses, or courses in which they have already earned 25% or more of their grade.

WITHDRAWAL FROM THE SCHOOL OF LAW If a student finds it necessary to withdraw from the Law School, the student must apply in writing to the Office of Student Affairs for permission to withdraw. The student may be entitled to tuition remission. The amount of remission diminishes as the student’s attendance at the School of Law lengthens. Upon recommendation from the Dean, the University will remit tuition (except the admissions seat deposit submitted by incoming first-year students) as follows: 100% Tuition Refund for withdrawal prior to the first week of classes 100% Tuition Refund for withdrawal during the first week of classes 75% Tuition Refund for withdrawal during the second week of classes 50% Tuition Refund for withdrawal during the third week of classes 25% Tuition Refund for withdrawal during the fourth week of classes 0% Tuition Refund for withdrawal thereafter Note: The first day of classes for upper level students is Thursday, August 18, 2011.

This schedule complies with federal regulations of the Department of Education. A copy of these regulations is on file in the Office of Financial Aid, Room 250, Law School. A student withdrawing from any semester without approval from the Office of Student Affairs is not entitled to remission of tuition and will automatically receive failing grades in all courses.

CANCELLED CLASSES The Law School reserves the right to cancel classes that are under enrolled. In most cases, a class will be cancelled if there are fewer than 7 students enrolled by the week before classes are scheduled to begin. Students enrolled in any course that is cancelled will be notified via e-mail by the Office of Academic Records ([email protected]).

ROOM ASSIGNMENTS Prior to the beginning of the semester, room assignments will be available online via the Hofstra Online Information System (accessed through the Hofstra portal at (my.hofstra.edu). Room assignments will also be posted outside of room 114 (Office of Academic Records).

FINAL EXAMINATION SCHEDULE The final examination schedule (subject to change) for the Fall semester is contained in Appendix 3. CONFLICT POLICY The Office of Academic Records is responsible for rescheduling examinations due to scheduling conflicts as defined by the Conflict Policy. A conflict is two examinations on the same calendar day or an evening exam followed by a morning exam on consecutive calendar days. For the Fall 2011 semester, the Final Examination period begins on Monday, December 5, 2011 and ends on Friday, December 16, 2011. DO NOT MAKE ANY TRAVEL PLANS OR PERSONAL COMMITMENTS DURING THE ENTIRE FINAL EXAMINATION PERIOD (i.e., MONDAY, DECEMBER 5, 2011 THROUGH FRIDAY, DECEMBER 16, 2011) AS AN EXAMINATION MAY NEED TO BE RESCHEDULED DUE TO UNAVOIDABLE CIRCUMSTANCES.

COURSE INFORMATION COURSE DESCRIPTION The course descriptions can be found in the on-line catalog (select the Law Catalog from the drop down menu on the right): http://bulletin.hofstra.edu/ COURSE SELECTION ADVICE Students are welcome to meet with staff from the Office of Student Affairs, the Office of Academic Support or any other faculty member to seek advice.

JOURNAL CREDITS Students must register for their journal credits. Consult Appendix 4 for the Rules for Election of Non-Classroom Courses. Hofstra Law Review, Family Court Review and Journal of International Business and Law: • First year staff members: Register for one credit to be awarded in the fall semester for the citing assignments. You will register for two credits in the spring semester for the completion of the student note. • Board Editors and Associate Editors: Register for one credit to be awarded in the fall semester. You will register for one credit in the spring semester. • Senior Staff: You will register for one credit in the Spring 2012 semester. Hofstra Labor and Employment Law Journal: Hofstra Labor and Employment Law Journal members will register for their journal credits in the spring semester. ACTEC Journal: All students will register for one credit to be awarded in the fall semester for the citing assignments. Those students who are electing to write a student note must seek approval to do so from Prof. Gans, and upon approval should register for two credits. INDEPENDENT STUDY To register for an Independent Study, students must:

• Read the course description in the Law School Catalog to make certain that you are eligible.

• Register for the Independent Study course (0 credits). The CRN for this course is 95077.

• Complete the Independent Study Form, which is available on the law school’s website at (http://law.hofstra.edu/Academics/AcademicRecords/Additional-Services-Forms.html), or in the Office of Academic Records (room 114). This form, with the supervising faculty member’s approval and the allotted number of credits for your independent study project, must be returned to the Office of Academic Records by Wednesday, August 24, 2011.

EXTERNSHIPS The Externship Program is an excellent way to gain legal experience and to earn 3 academic credits at the same time. You are required to extern for approximately 12 - 15 hours/week for the semester in a legal setting, in which your work is supervised by an attorney. You must also attend a one-hour seminar which meets once each week and you are required to complete 15 pages of written work based on legal research (25 pages are required for judicial placements). Students will be able to gain legal experience by working (on an uncompensated basis) in the public sector or for not-for-profit institutions, under the supervision of an attorney. Common placements include positions with state and federal judges, state and federal government agencies, public interest and non-profit organizations, and, in special circumstances, for-profit entities. Registration for the externship program is by approval only. In order to register, you must obtain a completed Field Placement Supervisors Letter that outlines your employers agreement to meeting the above requirements. The form letter may be found in the Field Placement Supervisor Manual available from Vernadette Horne in OCS or on the Law School website at http://law.hofstra.edu/Academics/Programs/acadpg_externship.html. Students may seek advisement regarding externships from the Office of Career Services or review the externship and job postings on Symplicity. If you have any questions, meet with Vernadette Horne, Director of Career Services, who can be contacted at [email protected] to make sure that you understand the requirements and to obtain help in identifying and securing an externship.

In addition to opportunities for placements with judges, district attorneys, public defenders, legal services and city, county, state and federal agencies, students may apply to participate in the Prosecutor’s Externship (worth 4 credits). This externship offers students the opportunity to work in a local District Attorney’s Office and to participate under a Student Practice Order in the prosecution of criminal cases under the close supervision of a faculty member, as well as an assistant district attorney who will serve as the field placement supervisor. Externs will be trained to assist and directly participate in all phases of criminal prosecution in the District Court, including case assessment, arraignments, interviewing witnesses, identifying legal issues, conferencing cases in court and plea bargaining/sentencing. Each student will be assigned a case load for which the student will be responsible under the direct supervision of the faculty member and an assistant district attorney in a hybrid clinic-extern format. Every effort will be made to permit each student to handle a hearing and/or trial. Students will be expected to work 15 hours per week in the District Attorney’s office; in addition, students will also be responsible for attending a one-hour weekly seminar (in conjunction with students participating in the Criminal Externship Program). Students will also participate in additional supervision as needed with the faculty member teaching the externship course. Students must have previously taken Evidence and Criminal Procedure I. To be approved for enrollment in this externship, students must apply via Symplicity job number 9333 and attend an interview with a field placement supervisor and the course instructor. You will need to receive approval from the course instructor.

To register for an Externship, students must: • Obtain from your externship employer the Placement Supervisor Agreement Letter that must be completed by your Placement Supervisor. This letter must be on the employer's letterhead and signed by your placement supervisor. It serves as the placement supervisor's agreement to adequately supervise your work.

Obtain approval by submitting the Placement Supervisor Letter Agreement to Vernadette Horne in OCS. If she is satisfied that the placement will satisfy the Law School’s requirements for the Externship Program, she will then notify the Office of Academic Records.

• Once you have been approved to register for the Externship, Vernadette Horne will notify the Office of Academic Records. Then you will receive an e-mail from the Office of Academic Records informing you that you are now able to register for the externship class. • Please note: Students may be permitted to take a second externship or extend their existing externship under exceptional circumstances and only after approval from the Dean’s Office. If you are interested in doing this, please contact Vernadette Horne. If you have any question or doubt about the appropriateness of a particular placement, see Vernadette Horne prior to approaching an employer about an externship opportunity. If you choose to contact a potential placement supervisor/employer that has not previously participated in this Program prior to consultation with Ms. Horne, make sure that he or she understands the requirements of the course and agrees to them.

CLINICS The Criminal Justice, Child Advocacy, Mediation, Community Development, Securities Arbitration and Political Asylum Clinics require acceptance before registration. Please visit the Clinic Offices for details on the interviewing procedures. If you have been accepted into a clinic, you will be notified by the Attorney-in-Charge of that particular clinic. The Attorney-in-Charge of that particular clinic will also notify the Office of Academic Records. Once the Office of Academic Records has processed your acceptance, you will be notified via e-mail and can then register for your clinic online. The CRNs for the clinics are listed in Appendix 1: Class Schedule – Fall 2011.

SKILLS REQUIREMENT In order to satisfy this requirement, an upper-division course must include a substantial amount of class time devoted to professional skills instruction, skills exercises or activity that calls upon the individual student to perform or practice the skill, and critique by the instructor of the individual students' skills performance. Such professional skills may include trial and appellate advocacy, alternative methods of dispute resolution, counseling, interviewing, negotiating, problem solving, factual investigation, organization and management of legal work, and drafting. The only courses fully satisfying this requirement are those certified by the faculty member as spending approximately 2 hours per week of class time on honing skills. Students may split the skills requirement over two courses, where the faculty has certified to the Office of Academic Records that each course fulfills half of the requirement (e.g. Depositions I and Depositions II). The courses in the Fall 2011 semester, which will fulfill the skills requirement (and how many credits will be applied to the skills requirement), are listed in Appendix 1: Class Schedule – Fall 2011.

WRITING REQUIREMENT CREDIT Writing Requirement I and Writing Requirement II are graduation requirements. It is highly recommended that the writing requirements be satisfied prior to your final semester. The writing requirements need not be taken in any specific order. Thus you may take Writing Requirement II before taking Writing Requirement I. WRITING REQUIREMENT I The first upper-class requirement (Writing Requirement I) is satisfied by a substantial writing (at least 20 pages) that involves independent research and legal analysis and is supervised by a full-time or visiting faculty member. The writing may be in the nature of a scholary research paper, a memorandum of law on an unsettled legal issue, a simulated judicial opinion or any other written format which requires extended critical analysis and deep reflection on a legal issue utilizing independent research involving secondary as well as primary sources. The writing should also involve some consideration of social policy or justice and should require the student to exercise judgment and discretion in considering various possible approaches in his or her analysis. The writing may be completed as part of a seminar or independent study, or in any upper-class course in which a qualifying writing is assigned and appropriately supervised. However, briefs written for clinics will be presumed not to satisfy the Writing I Requirement unless they are specifically approved for Writing I credit by the Faculty member supervising the writing and they meet all the above stated criteria. The minimum acceptable grade for Writing Requirement I is a C+. The grade of C+ must be for the paper itself, not a course grade that has been increased to reflect class participation. The courses in the Fall 2011 semester which can fulfill Writing Requirement I are listed in Appendix 1: Class Schedule – Fall 2011. WRITING REQUIREMENT II Writing Requirement II may be satisfied through writing a substantial research paper in a seminar or Independent Study, or by writing a paper or series of papers in a drafting, simulation, clinical course or other specified courses. To fulfill Writing Requirement II, a student must work under the supervision of a full-time, visiting or adjunct faculty member. Close faculty supervision of the writing process is required. The cumulative writing necessary to meet Writing Requirement II must be at least twenty pages, and the writing must involve legal analysis, legal reasoning, and/or philosophical reflection. The minimum acceptable grade for Writing Requirement II is C+. The grade of C+ must be for the paper itself, not a course grade that has been increased to reflect class participation. Additional Information about Selected Courses

Legal Interviewing, Counseling, and Negotiation As part of the law school’s commitment to expanding skills training, four sections of this 3-credit course will be offered each semester in 2011-2012. The theories and techniques of these interrelated skills are taught through simulation, with emphasis on legal diagnosis, development of goals and strategies, and the thinking required in helping another person make a decision. Students learn how to interview and counsel clients, interview witnesses, negotiate with each other, draft negotiated agreements and write supporting memoranda. Counseling and negotiation sessions are videotaped and critiqued. While Evidence is not a prerequisite, it is strongly recommended. Lawyer Malpractice This special 3-credit course will be taught by Prof. Susan Saab Fortney, a nationally-renowned legal ethics expert who has also specialized in legal malpractice. Prof. Fortney has legal practice experience in both the public and private sectors, particularly in business and coverage litigation, in which she principally handled legal malpractice and directors and officers liability cases. The Texas Bar Foundation selected her as the 2010 recipient of the Lola Wright Ethics Award in recognition of outstanding public service in advancing and enhancing legal ethics. Prof. Fortney comes to our faculty having served most recently as the Interim Dean of Texas Tech University School of Law. The Lawyer Malpractice course examines the growth and development of a rapidly evolving area of substantive law encompassing topics such as legal malpractice, lawyer liabilities, and client remedies. Students are exposed to and come to appreciate the impact of consumerism in a litigious society and how those forces are being increasingly turned against the legal profession. Analysis of theories is thoroughly explored as the foundation of legal malpractice suits and is developed into other areas and theories on which a lawyer can be held responsible for damages to clients and others. Such other areas include breach of fiduciary duty, RICO, and consumer protection statutes. A central purpose of the course is to stimulate students’ analytical skills by exposing them to several different substantive areas of law within the context of a legal malpractice setting. At the same time, students become sensitive to the need for and acquire the know-how to assist them in furnishing high-quality legal services.

Pretrial Skills Most cases do not go to trial or appeal but instead settle during the period between filing a complaint and the trial. The pretrial phases of litigation—complaints, answers, counterclaims and cross claims, motions, discovery, pre-trial orders, negotiating settlements and advocacy in alternatives to litigation such as mediation—are thus critical skill areas for practicing lawyers. This Course introduces you to these vital subjects. The Fall 2011 version created by Professors Andrew Schepard, Eric Freedman, and Amy Stein has been completely redesigned to accommodate more students than in the past. The emphasis of the Course remains, however, on “learning by doing;” overview lectures alternate with skills exercises and feedback. Much of the work of the Course will be done in student law firms working from a semester-long case file. This Course will enable all students to deepen their understanding of how to put the concepts and rules studied in the basic Civil Procedure course into action on behalf of a client. It will also provide a valuable foundation for future civil litigation advocacy courses and clinics. Because of its foundational nature, this course is particularly appropriate for students at the beginning of their second year of law school. Law and Medicine: Cooperative Professionalism Hofstra University will soon have a Medical School. This course explores a portion of the critical medico-legal questions which arise in health law. It is a skills course that should be taken in the same semester with Health Law or Bioethics, or after a student has completed at least one of those courses. It will be taught in part at the Nassau University Medical Center (NuHealth) and will include both medical and law students. The course will teach students about hospital care and about the manner in which lawyers and physicians might respond to a wide set of clinical and bioethical dilemmas that occur in hospital settings. Further, the course will encourage both law and medical students to understand the professional culture of the other group. The course will be divided into two parts. The first part will introduce law students to the theory and skills required for legal and bioethical consultations about patient care in hospitals. The second part of the course will occur at NuHealth and will join law students with medical students doing clinical rotations at the Hospital. Weekly seminar sessions will focus around case presentations. Students will engage in structured exercises, based on the cases. In these exercises, students will be assigned to play the roles of lawyers, bioethicists, health care providers, patients, and patients’ family members. Enrollment is limited. Elder Law This seminar has not been taught at Hofstra for several years, but it deals with an important legal area and we are glad to be able to offer it again. The course will be taught by Nancy Burner, a Hofstra Law graduate who has an active elder law and estate planning practice. She is a member of the National Academy of Elder Law Attorneys, as well as the Elder Law and Trust and Estates sections of the New York State Bar Association. The seminar focuses on the legal problems of the elderly and the disabled. It will approach the Elder Law practice from an interdisciplinary perspective. Topics include planning with Government benefits, including Medicare, Medicaid, Social Security Disability and SSI benefits; long-term care insurance; and estate planning and the utilization of trusts to protect and preserve assets. Additional topics will include Guardianship proceedings under Article 81 of New York’s Mental Hygiene Law as well as the Health Care Decisions Act, and advance directives such as health care proxies, living wills and MOLST forms. Private Equity: Fund Formation and Transactional Issues The course is designed to introduce upper-level students to the fundamental and critical issues arising in private equity fund formation and the transactions engaged in by private equity funds. It will be taught by Robert C. Schwenkel, who is the chair of Fried Frank's corporate department and head of the firm's M&A and private equity groups. Mr. Schwenkel has a diverse transactional corporate practice concentrating in private equity transactions and mergers and acquisitions. The course will focus on understanding the legal and commercial aspects of private equity as an asset class and on introducing students to the legal documents used in the process of raising and investing capital. Contract, corporate, partnership, limited liability company and securities laws will be the principal legal regimes applied in the course. The course will also deal incidentally with various other laws, including tax, ERISA, bankruptcy and anti-trust laws. Business Organizations is a pre-requisite.

APPENDIX 4: Rules for Election of Non-Classroom Courses Out of the total 87 credits required for graduation, the New York Court of Appeals rules for admission of attorneys permit Hofstra students to select up to 27 semester hours of non-classroom courses during their course of study. In calculating this 27-hour limitation, only the non-classroom portion of clinical and like courses must be counted. The current courses in the curriculum that are classified as non-classroom courses are contained in the following table. In choosing courses that contain a non-classroom component, students should be mindful of and consider the 27-hour limitation
