BORROWER COVENANTS thatBorrowerislawfullyseisedoftheestateherebyconveyedandhas
therighttograntandconveythePropertyandthatthePropertyisunencumbered,exceptforencumbrances
ofrecord.BorrowerwarrantsandwilldefendgenerallythetitletothePropertyagainstallclaimsand
demands,subjecttoanyencumbrancesofrecord.
THIS SECURITY INSTRUMENT combinesuniformcovenantsfornationaluseandnon-uniform
covenantswithlimitedvariationsbyjurisdictiontoconstituteauniformsecurityinstrumentcoveringreal
property.
UNIFORM COVENANTS. BorrowerandLendercovenantandagreeasfollows:
1. PaymentofPrincipal,Interest,EscrowItems,PrepaymentCharges,and LateCharges.Borrowershallpaywhen duetheprincipalof,andintereston,thedebtevidencedby theNoteandany
prepaymentchargesandlatechargesdueundertheNote.BorrowershallalsopayfundsforEscrowItems
pursuanttoSection3. PaymentsdueundertheNoteandthisSecurityInstrumentshallbemadeinU.S.
currency.However,ifanycheckorotherinstrumentreceivedbyLenderaspaymentundertheNoteorthis
SecurityInstrumentisreturnedtoLenderunpaid,Lendermay requirethatanyorallsubsequentpaymentsdueundertheNoteandthisSecurityInstrumentbemadeinoneormoreofthefollowingforms,asselected
byLender:(a)cash;(b)moneyorder;(c)certifiedcheck,bankcheck,treasurer'scheckorcashier'scheck,
providedanysuchcheckisdrawnuponan institutionwhosedepositsareinsuredby a federalagency,
instrumentality,orentity;or(d)ElectronicFundsTransfer.
Paymentsaredeemedreceivedby LenderwhenreceivedatthelocationdesignatedintheNoteorat
suchotherlocationasmay bedesignatedbyLenderinaccordancewiththenoticeprovisionsinSection15.
Lendermay returnanypaymentorpartialpaymentifthepaymentorpartialpaymentsareinsufficientto

bringtheLoancurrent.Lendermay acceptanypaymentorpartialpaymentinsufficienttobringtheLoan
current,withoutwaiverofanyrightshereunderorprejudicetoitsrightstorefusesuchpaymentorpartial
paymentsinthefuture,butLenderisnotobligatedtoapplysuchpaymentsatthetimesuchpaymentsare
accepted.IfeachPeriodicPaymentisappliedasofitsscheduledduedate,thenLenderneednotpayinterest
onunappliedfunds.LendermayholdsuchunappliedfundsuntilBorrowermakespaymenttobringtheLoan
current.IfBorrowerdoesnotdosowithinareasonableperiodoftime,Lendershalleitherapplysuchfunds
orreturnthemtoBorrower.Ifnotappliedearlier,suchfundswillbeappliedtotheoutstandingprincipalbalanceundertheNoteimmediatelypriortoforeclosure.No offsetorclaimwhichBorrowermighthave
now orinthefutureagainstLendershallrelieveBorrowerfrommakingpaymentsdueundertheNoteand
thisSecurityInstrumentorperformingthecovenantsandagreementssecuredbythisSecurityInstrument.
2. ApplicationofPaymentsorProceeds.ExceptasotherwisedescribedinthisSection2,all
paymentsacceptedandappliedbyLendershallbeappliedinthefollowingorderofpriority:(a)interestdue
undertheNote;(b)principaldueundertheNote;(c)amountsdueunderSection3. Suchpaymentsshallbe
appliedtoeachPeriodicPaymentintheorderinwhichitbecamedue.Any remainingamountsshallbe
appliedfirsttolatecharges,secondtoanyotheramountsdueunderthisSecurityInstrument,andthento
reducetheprincipalbalanceoftheNote.IfLenderreceivesa paymentfromBorrowerfora delinquentPeriodicPaymentwhichincludesa
sufficientamounttopayanylatechargedue,thepaymentmay beappliedtothedelinquentpaymentandthe
latecharge.IfmorethanonePeriodicPaymentisoutstanding,Lendermay applyanypaymentreceivedfrom
BorrowertotherepaymentofthePeriodicPaymentsif,andtotheextentthat,eachpaymentcanbepaidin
full.To theextentthatanyexcessexistsafterthepaymentisappliedtothefullpaymentofoneormore
PeriodicPayments,suchexcessmay beappliedtoanylatechargesdue.Voluntaryprepaymentsshallbe
appliedfirsttoanyprepaymentchargesandthenasdescribedintheNote.
Any applicationofpayments,insuranceproceeds,orMiscellaneousProceedstoprincipaldueunder
theNoteshallnotextendorpostponetheduedate,orchangetheamount,ofthePeriodicPayments.3. FundsforEscrowItems.BorrowershallpaytoLenderonthedayPeriodicPaymentsaredue
undertheNote,untiltheNoteispaidinfull,asum (the"Funds")toprovideforpaymentofamountsdue
for:(a)taxesandassessmentsandotheritemswhichcanattainpriorityoverthisSecurityInstrumentasa
lienorencumbranceontheProperty;(b)leaseholdpaymentsorgroundrentsontheProperty,ifany;(c)
premiumsforany andallinsurancerequiredby LenderunderSection5;and(d)MortgageInsurance
premiums,ifany,oranysumspayablebyBorrowertoLenderinlieuofthepaymentofMortgageInsurance
premiumsinaccordancewiththeprovisionsofSection10. Theseitemsarecalled"EscrowItems."At
originationoratanytimeduringthetermoftheLoan,Lendermay requirethatCommunityAssociation
Dues,Fees,andAssessments,ifany,beescrowedbyBorrower,andsuchdues,feesandassessmentsshall
beanEscrowItem.BorrowershallpromptlyfurnishtoLenderallnoticesofamountstobepaidunderthis
Section.BorrowershallpayLendertheFundsforEscrowItemsunlessLenderwaivesBorrower'sobligationtopaytheFundsforanyorallEscrowItems.Lendermay waiveBorrower'sobligationtopaytoLender
FundsforanyorallEscrowItemsatanytime.Any suchwaivermay onlybeinwriting.Intheeventof
suchwaiver,Borrowershallpaydirectly,whenandwherepayable,theamountsdueforanyEscrowItems
forwhichpaymentofFundshasbeenwaivedbyLenderand,ifLenderrequires,shallfurnishtoLender
receiptsevidencingsuchpaymentwithinsuchtimeperiodasLendermay require.Borrower'sobligationto
makesuchpaymentsandtoprovidereceiptsshallforallpurposesbedeemedtobeacovenantandagreementcontainedinthisSecurityInstrument,asthephrase"covenantandagreement"isusedinSection9, If
BorrowerisobligatedtopayEscrowitemsdirectly,pursuanttoawaiver,andBorrowerfailstopaythe

thewaiverastoanyorallEscrowItemsatanytimeby anoticegiveninaccordancewithSection15and,
uponsuchrevocation,BorrowershallpaytoLenderallFunds,andinsuchamounts,thatarethenrequiredunderthisSection3.
Lendermay,atanytime,collectandholdFundsinanamount(a)sufficienttopermitLendertoapplytheFundsatthetimespecifiedunderRESPA, and(b)nottoexceedthemaximum amounta lendercan
requireunderRESPA. LendershallestimatetheamountofFundsdueonthebasisofcurrentdataand
reasonableestimatesofexpendituresoffutureEscrowItemsorotherwiseinaccordancewithApplicableLaw.
The Funds shallbe heldin an institutionwhose depositsareinsuredby a federalagency,
instrumentality,orentity(includingLender,ifLenderisaninstitutionwhosedepositsaresoinsured)orin
anyFederalHome LoanBank.LendershallapplytheFundstopaytheEscrowItemsnolaterthanthetime
specifiedunderRESPA. LendershallnotchargeBorrowerforholdingandapplyingtheFunds,annually
analyzingtheescrowaccount,orverifyingtheEscrowItems,unlessLenderpaysBorrowerinterestonthe
FundsandApplicableLaw permitsLendertomakesuchacharge.UnlessanagreementismadeinwritingorApplicableLaw requiresinteresttobepaidontheFunds,LendershallnotberequiredtopayBorrower
anyinterestorearningsontheFunds.BorrowerandLendercanagreeinwriting,however,thatinterestshall
bepaidontheFunds.LendershallgivetoBorrower,withoutcharge,anannualaccountingoftheFunds
asrequiredbyRESPA.Ifthereisa surplusofFundsheldinescrow,asdefinedunderRESPA, Lendershallaccountto
BorrowerfortheexcessfundsinaccordancewithRESPA. IfthereisashortageofFundsheldinescrow,asdefinedunderRESPA, LendershallnotifyBorrowerasrequiredbyRESPA, andBorrowershallpayto
LendertheamountnecessarytomakeuptheshortageinaccordancewithRESPA, butinnomorethan12
monthlypayments.IfthereisadeficiencyofFundsheldinescrow,asdefinedunderRESPA, Lendershall
notifyBorrowerasrequiredbyRESPA, andBorrowershallpaytoLendertheamountnecessarytomakeupthedeficiencyinaccordancewithRESPA, butinnomorethan12monthlypayments.
Upon paymentinfullofallsumssecuredby thisSecurityInstrument,Lendershallpromptlyrefund
toBorroweranyFundsheldbyLender.4. Charges;Liens.Borrowershallpayalltaxes,assessments,charges,fines,andimpositions
attributabletothePropertywhichcanattainpriorityoverthisSecurityInstrument,leaseholdpaymentsor
groundrentsontheProperty,ifany,andCommunityAssociationDues,Fees,andAssessments,ifany.To
theextentthattheseitemsareEscrowItems,BorrowershallpaytheminthemannerprovidedinSection3.
BorrowershallpromptlydischargeanylienwhichhaspriorityoverthisSecurityInstrumentunless
Borrower:(a)agreesinwritingtothepaymentoftheobligationsecuredbythelieninamanneracceptabletoLender,butonlysolongasBorrowerisperformingsuchagreement;(b)conteststhelieningoodfaith
by,ordefendsagainstenforcementofthelienin,legalproceedingswhichinLender'sopinionoperateto
preventtheenforcementofthelienwhilethoseproceedingsarepending,butonlyuntilsuchproceedingsare
concluded;or(c)securesfromtheholderofthelienanagreementsatisfactorytoLendersubordinatingthe
lientothisSecurityInstrument.IfLenderdeterminesthatanypartofthePropertyissubjecttoalienwhich
canattainpriorityoverthisSecurityInstrument,Lendermay giveBorrowera noticeidentifyingthelien.
Within10daysofthedateonwhichthatnoticeisgiven,Borrowershallsatisfythelienortakeoneormore
oftheactionssetforthaboveinthisSection4.
LendermayrequireBorrowertopayaone-timechargeforarealestatetaxverificationand/orreportingserviceusedby LenderinconnectionwiththisLoan.

5. PropertyInsurance.Borrowershallkeeptheimprovementsnow existingorhereaftererectedon
thePropertyinsuredagainstlossby fire,hazardsincludedwithintheterm"extendedcoverage,"andanyotherhazardsincluding,butnotlimitedto,earthquakesandfloods,forwhichLenderrequiresinsurance.
Thisinsuranceshallbemaintainedintheamounts(includingdeductiblelevels)andfortheperiodsthat
Lenderrequires.WhatLenderrequirespursuanttotheprecedingsentencescanchangeduringthetermof
theLoan.TheinsurancecarrierprovidingtheinsuranceshallbechosenbyBorrowersubjecttoLender's
righttodisapproveBorrower'schoice,whichrightshallnotbeexercisedunreasonably.Lendermay requireBorrowertopay,inconnectionwiththisLoan,either:(a)aone-timechargeforfloodzonedetermination,certificationandtrackingservices;or(b)aone-timechargeforfloodzonedeterminationandcertification
servicesandsubsequentchargeseachtimeremappingsorsimilarchangesoccurwhichreasonablymightaffectsuchdeterminationorcertification.Borrowershallalsoberesponsibleforthepaymentofanyfees
imposedbytheFederalEmergencyManagementAgencyinconnectionwiththereviewofanyfloodzone
determinationresultingfromanobjectionbyBorrower.IfBorrowerfailstomaintainanyofthecoveragesdescribedabove,Lendermay obtaininsurance
coverage,atLender'soptionandBorrower'sexpense.Lenderisunderno obligationtopurchaseany
particulartypeoramountofcoverage.Therefore,suchcoverageshallcoverLender,butmightormightnot
protectBorrower,Borrower'sequityintheProperty,orthecontentsoftheProperty,againstanyrisk,hazard
or liabilityand mightprovidegreateror lessercoveragethanwas previouslyineffect.Borrower
acknowledgesthatthecostoftheinsurancecoveragesoobtainedmightsignificantlyexceedthecostof
insurancethatBorrowercouldhaveobtained.Any amountsdisbursedbyLenderunderthisSection5shall
becomeadditionaldebtofBorrowersecuredbythisSecurityInstrument.Theseamountsshallbearinterest
attheNoteratefromthedateofdisbursementandshallbepayable,withsuchinterest,uponnoticefrom
LendertoBorrowerrequestingpayment.Allinsurancepoliciesrequiredby LenderandrenewalsofsuchpoliciesshallbesubjecttoLender's
righttodisapprovesuchpolicies,shallincludea standardmortgageclause,andshallname Lenderas
mortgageeand/orasanadditionallosspayee.Lendershallhavetherighttoholdthepoliciesandrenewal
certificates.IfLenderrequires,BorrowershallpromptlygivetoLenderallreceiptsofpaidpremiumsand
renewalnotices.IfBorrowerobtainsanyformofinsurancecoverage,nototherwiserequiredbyLender,for
damageto,ordestructionof,theProperty,suchpolicyshallincludea standardmortgageclauseandshall
name Lenderasmortgageeand/orasanadditionallosspayee.Intheeventofloss,BorrowershallgivepromptnoticetotheinsurancecarrierandLender.Lender
may makeproofoflossifnotmadepromptlybyBorrower.UnlessLenderandBorrowerotherwiseagreeinwriting,anyinsuranceproceeds,whetherornottheunderlyinginsurancewasrequiredby Lender,shall
beappliedtorestorationorrepairoftheProperty,iftherestorationorrepairiseconomicallyfeasibleand
Lender'ssecurityisnotlessened.Duringsuchrepairandrestorationperiod,Lendershallhavetherightto
holdsuchinsuranceproceedsuntilLenderhashadanopportunitytoinspectsuchPropertytoensurethework
hasbeencompletedtoLender'ssatisfaction,providedthatsuchinspectionshallbeundertakenpromptly.Lendermay disburseproceedsfortherepairsandrestorationinasinglepaymentorinaseriesofprogress
paymentsastheworkiscompleted.Unlessanagreementismade inwritingorApplicableLaw requiresinteresttobepaidonsuchinsuranceproceeds,LendershallnotberequiredtopayBorroweranyinterestor
earningsonsuchproceeds.Feesforpublicadjusters,orotherthirdparties,retainedbyBorrowershallnot
bepaidoutoftheinsuranceproceedsandshallbethesoleobligationofBorrower.Iftherestorationor
repairisnoteconomicallyfeasibleorLender'ssecuritywouldbelessened,theinsuranceproceedsshallbe

IfBorrowerabandonstheProperty,Lendermay file,negotiateandsettleanyavailableinsuranceclaimandrelatedmatters.IfBorrowerdoesnotrespondwithin30daystoanoticefromLenderthattheinsurancecarrierhasofferedtosettleaclaim,thenLendermay negotiateandsettletheclaim.The30-dayperiodwill
beginwhen thenoticeisgiven.Ineitherevent,orifLenderacquiresthePropertyunderSection22 or
otherwise,BorrowerherebyassignstoLender(a)Borrower'srightstoanyinsuranceproceedsinanamountnottoexceedtheamountsunpaidundertheNoteorthisSecurityInstrument,and(b)anyotherofBorrower's
rights(otherthantherighttoanyrefundofunearnedpremiumspaidby Borrower)underallinsurance
policiescoveringtheProperty,insofarassuchrightsareapplicabletothecoverageoftheProperty.Lender
may usetheinsuranceproceedseithertorepairorrestorethePropertyortopayamountsunpaidunderthe
NoteorthisSecurityInstrument,whetherornotthendue.6. Occupancy.Borrowershalloccupy,establish,andusethePropertyasBorrower'sprincipal
residencewithin60daysaftertheexecutionofthisSecurityInstrumentandshallcontinuetooccupythe
PropertyasBorrower'sprincipalresidenceforatleastoneyearafterthedateofoccupancy,unlessLenderotherwiseagreesinwriting,whichconsentshallnotbe unreasonablywithheld,orunlessextenuatingcircumstancesexistwhicharebeyondBorrower'scontrol.
7. Preservation,Maintenanceand ProtectionoftheProperty;Inspections.Borrowershallnot
destroy,damageorimpairtheProperty,allowthePropertytodeteriorateorcommitwasteontheProperty.WhetherornotBorrowerisresidingintheProperty,BorrowershallmaintainthePropertyinorderto
preventthePropertyfromdeterioratingordecreasinginvalueduetoitscondition.Unlessitisdetermined
pursuanttoSection5 thatrepairorrestorationisnoteconomicallyfeasible,BorrowershallpromptlyrepairthePropertyifdamagedtoavoidfurtherdeteriorationordamage.Ifinsuranceorcondemnationproceedsarepaidinconnectionwithdamageto,orthetakingof,theProperty,Borrowershallberesponsiblefor
repairingorrestoringthePropertyonlyifLenderhasreleasedproceedsforsuchpurposes.Lendermaydisburseproceedsfortherepairsandrestorationinasinglepaymentorinaseriesofprogresspaymentsas
theworkiscompleted.Iftheinsuranceorcondemnationproceedsarenotsufficienttorepairorrestorethe
Property,BorrowerisnotrelievedofBorrower'sobligationforthecompletionofsuchrepairorrestoration.Lenderoritsagentmay make reasonableentriesuponandinspectionsoftheProperty.Ifithas
reasonablecause,Lendermay inspecttheinterioroftheimprovementsontheProperty.LendershallgiveBorrowernoticeatthetimeoforpriortosuchaninteriorinspectionspecifyingsuchreasonablecause.
8. Borrower'sLoan Application.Borrowershallbe indefaultif,duringtheLoanapplicationprocess,Borroweror anypersonsorentitiesactingatthedirectionofBorrowerorwithBorrower's
knowledgeorconsentgavemateriallyfalse,misleading,orinaccurateinformationorstatementstoLender
(orfailedtoprovideLenderwithmaterialinformation)inconnectionwiththeLoan.Materialrepresentationsinclude,butarenotlimitedto,representationsconcerningBorrower'soccupancyofthePropertyas
Borrower'sprincipalresidence.9. ProtectionofLender'sInterestinthePropertyand RightsUnderthisSecurityInstrument.
If(a)BorrowerfailstoperformthecovenantsandagreementscontainedinthisSecurityInstrument,(b)thereisalegalproceedingthatmightsignificantlyaffectLender'sinterestinthePropertyand/orrightsunderthis
SecurityInstrument(suchasa proceedinginbankruptcy,probate,forcondemnationorforfeiture,for
enforcementofalienwhichmay attainpriorityoverthisSecurityInstrumentor toenforcelawsor
regulations),or(c)BorrowerhasabandonedtheProperty,thenLendermay do andpayforwhateveris
reasonableor appropriatetoprotectLender'sinterestinthePropertyandrightsunderthisSecurity

Instrument,includingprotectingand/orassessingthevalueoftheProperty,andsecuringand/orrepairingtheProperty.Lender'sactionscaninclude,butarenotlimitedto:(a)payinganysumssecuredby alien
whichhaspriorityoverthisSecurityInstrument;(b)appearingincourt;and(c)payingreasonableattorneys'feestoprotectitsinterestinthePropertyand/orrightsunderthisSecurityInstrument,includingitssecured
positioninabankruptcyproceeding.SecuringthePropertyincludes,butisnotlimitedto,enteringthe
Propertytomakerepairs,changelocks,replaceorboardupdoorsandwindows,drainwaterfrompipes,eliminatebuildingorothercodeviolationsordangerousconditions,andhaveutilitiesturnedon oroff.
AlthoughLendermay takeactionunderthisSection9,Lenderdoesnothavetodosoandisnotunderany
dutyorobligationtodo so.ItisagreedthatLenderincursno liabilityfornottakinganyorallactions
authorizedunderthisSection9.
Any amountsdisbursedby LenderunderthisSection9 shallbecomeadditionaldebtofBorrower
securedby thisSecurityInstrument.TheseamountsshallbearinterestattheNoteratefromthedateof
disbursementandshallbepayable,withsuchinterest,uponnoticefromLendertoBorrowerrequesting
payment.IfthisSecurityInstrumentisonaleasehold,Borrowershallcomplywithalltheprovisionsofthelease.
Borrowershallnotsurrendertheleaseholdestateandinterestshereinconveyedorterminateorcancelthe
groundlease.Borrowershallnot,withouttheexpresswrittenconsentofLender,alteroramendthegroundlease.IfBorroweracquiresfeetitletotheProperty,theleaseholdandthefeetitleshallnotmergeunless
Lenderagreestothemergerinwriting.10.MortgageInsurance.IfLenderrequiredMortgageInsuranceasaconditionofmakingtheLoan,
BorrowershallpaythepremiumsrequiredtomaintaintheMortgageInsuranceineffect.If,foranyreason,theMortgageInsurancecoveragerequiredby Lenderceasestobeavailablefromthemortgageinsurerthat
previouslyprovidedsuchinsuranceandBorrowerwas requiredtomakeseparatelydesignatedpaymentstowardthepremiumsforMortgageInsurance,Borrowershallpaythepremiumsrequiredtoobtaincoverage
substantiallyequivalenttotheMortgageInsurancepreviouslyineffect,atacostsubstantiallyequivalentto
thecosttoBorroweroftheMortgageInsurancepreviouslyineffect,fromanalternatemortgageinsurer
selectedbyLender.IfsubstantiallyequivalentMortgageInsurancecoverageisnotavailable,Borrowershall
continuetopaytoLendertheamountoftheseparatelydesignatedpaymentsthatwereduewhentheinsurance
coverageceasedtobeineffect.Lenderwillaccept,useandretainthesepaymentsasanon-refundableloss
reserveinlieuofMortgageInsurance.Suchlossreserveshallbenon-refundable,notwithstandingthefact
thattheLoanisultimatelypaidinfull,andLendershallnotbe requiredtopayBorroweranyinterestor
earningsonsuchlossreserve.LendercannolongerrequirelossreservepaymentsifMortgageInsurance
coverage(intheamountandfortheperiodthatLenderrequires)providedby aninsurerselectedbyLender
againbecomesavailable,isobtained,andLenderrequiresseparatelydesignatedpaymentstowardthe
premiumsforMortgageInsurance.IfLenderrequiredMortgageInsuranceasa conditionofmakingthe
LoanandBorrowerwasrequiredtomakeseparatelydesignatedpaymentstowardthepremiumsforMortgage
Insurance,BorrowershallpaythepremiumsrequiredtomaintainMortgageInsuranceineffect,ortoprovideanon-refundablelossreserve,untilLender'srequirementforMortgageInsuranceendsinaccordancewith
anywrittenagreementbetweenBorrowerandLenderprovidingforsuchterminationoruntilterminationis
requiredbyApplicableLaw. NothinginthisSection10affectsBorrower'sobligationtopayinterestatthe
rateprovidedintheNote.
MortgageInsurancereimbursesLender(oranyentitythatpurchasestheNote)forcertainlossesitmayincurifBorrowerdoesnotrepaytheLoanasagreed.BorrowerisnotapartytotheMortgageInsurance.

Mortgageinsurersevaluatetheirtotalriskonallsuchinsuranceinforcefromtimetotime,andmayenterintoagreementswithotherpartiesthatshareormodifytheirrisk,orreducelosses.Theseagreementsareontermsandconditionsthataresatisfactorytothemortgageinsurerandtheotherparty(orparties)to
theseagreements.Theseagreementsmay requirethemortgageinsurertomakepaymentsusinganysource
offundsthatthemortgageinsurermay haveavailable(whichmay includefundsobtainedfromMortgageInsurancepremiums).
Asaresultoftheseagreements,Lender,anypurchaseroftheNote,anotherinsurer,anyreinsurer,anyotherentity,oranyaffiliateofanyoftheforegoing,may receive(directlyorindirectly)amountsthatderive
from(ormightbecharacterizedas)aportionofBorrower'spaymentsforMortgageInsurance,inexchangeforsharingormodifyingthemortgageinsurer'srisk,orreducinglosses.Ifsuchagreementprovidesthat
anaffiliateofLendertakesashareoftheinsurer'sriskinexchangeforashareofthepremiumspaidtothe
insurer,thearrangementisoftentermed"captivereinsurance."Further:
(a)Any suchagreementswillnotaffecttheamountsthatBorrowerhasagreedtopay for
MortgageInsurance,oranyothertermsoftheLoan. Suchagreementswillnotincreasetheamount
Borrowerwillowe forMortgageInsurance,andtheywillnotentitleBorrowertoanyrefund.
(b)Any suchagreementswillnotaffecttherightsBorrowerhas-ifany-withrespecttothe
MortgageInsuranceundertheHomeownersProtectionActof1998oranyotherlaw.Theserightsmayincludetherighttoreceivecertaindisclosures,torequestand obtaincancellationoftheMortgage
Insurance,tohavetheMortgageInsuranceterminatedautomatically,and/ortoreceivearefundofany
MortgageInsurancepremiumsthatwereunearnedatthetimeofsuchcancellationortermination.
11.AssignmentofMiscellaneousProceeds;Forfeiture.AllMiscellaneousProceedsarehereby
assignedtoandshallbepaidtoLender.IfthePropertyisdamaged,suchMiscellaneousProceedsshallbeappliedtorestorationorrepairofthe
Property,iftherestorationorrepairiseconomicallyfeasibleandLender'ssecurityisnotlessened.Duringsuchrepairandrestorationperiod,LendershallhavetherighttoholdsuchMiscellaneousProceedsuntil
LenderhashadanopportunitytoinspectsuchPropertytoensuretheworkhasbeencompletedtoLender's
satisfaction,providedthatsuchinspectionshallbeundertakenpromptly.Lendermaypayfortherepairsand
restorationina singledisbursementorina seriesofprogresspaymentsastheworkiscompleted.Unless
anagreementismade inwritingorApplicableLaw requiresinteresttobepaidon suchMiscellaneous
Proceeds,LendershallnotberequiredtopayBorroweranyinterestorearningson suchMiscellaneous
Proceeds.IftherestorationorrepairisnoteconomicallyfeasibleorLender'ssecuritywouldbelessened,theMiscellaneousProceedsshallbeappliedtothesumssecuredbythisSecurityInstrument,whetherornot
thendue,withtheexcess,ifany,paidtoBorrower.SuchMiscellaneousProceedsshallbeappliedinthe
orderprovidedforinSection2.Intheeventofatotaltaking,destruction,orlossinvalueoftheProperty,theMiscellaneousProceeds
shallbeappliedtothesumssecuredbythisSecurityInstrument,whetherornotthendue,withtheexcess,ifany,paidtoBorrower.
Intheeventofapartialtaking,destruction,orlossinvalueofthePropertyinwhichthefairmarket
valueofthePropertyimmediatelybeforethepartialtaking,destruction,orlossinvalueisequaltoorgreaterthantheamountofthesumssecuredby thisSecurityInstrumentimmediatelybeforethepartialtaking,
destruction,orlossinvalue,unlessBorrowerandLenderotherwiseagreeinwriting,thesumssecuredbythisSecurityInstrumentshallbereducedbytheamountoftheMiscellaneousProceedsmultipliedby the
followingfraction:(a)thetotalamountof thesums securedimmediatelybeforethepartialtaking,

Intheeventofapartialtaking,destruction,orlossinvalueofthePropertyinwhichthefairmarket
valueofthePropertyimmediatelybeforethepartialtaking,destruction,orlossinvalueislessthanthe
amountofthesumssecuredimmediatelybeforethepartialtaking,destruction,orlossinvalue,unless
BorrowerandLenderotherwiseagreeinwriting,theMiscellaneousProceedsshallbeappliedtothesums
securedbythisSecurityInstrumentwhetherornotthesumsarethendue.
IfthePropertyisabandonedbyBorrower,orif,afternoticebyLendertoBorrowerthattheOpposing
Party(asdefinedinthenextsentence)offerstomakeanawardtosettleaclaimfordamages,Borrowerfails
torespondtoLenderwithin30daysafterthedatethenoticeisgiven,Lenderisauthorizedtocollectand
applytheMiscellaneousProceedseithertorestorationorrepairofthePropertyortothesumssecuredbythisSecurityInstrument,whetherornotthendue. "OpposingParty"meansthethirdpartythatowes
BorrowerMiscellaneousProceedsorthepartyagainstwhom Borrowerhasarightofactioninregardto
MiscellaneousProceeds.Borrowershallbeindefaultifanyactionorproceeding,whethercivilorcriminal,isbegunthat,in
Lender'sjudgment,couldresultinforfeitureofthePropertyorothermaterialimpairmentofLender's
interestinthePropertyorrightsunderthisSecurityInstrument.Borrowercancuresuchadefaultand,if
accelerationhasoccurred,reinstateasprovidedinSection19,by causingtheactionorproceedingtobe
dismissedwitha rulingthat,inLender'sjudgment,precludesforfeitureofthePropertyorothermaterial
impairmentofLender'sinterestinthePropertyorrightsunderthisSecurityInstrument.Theproceedsof
anyawardorclaimfordamagesthatareattributabletotheimpairmentofLender'sinterestinthePropertyareherebyassignedandshallbepaidtoLender.
AllMiscellaneousProceedsthatarenotappliedtorestorationorrepairofthePropertyshallbeappliedintheorderprovidedforinSection2.
12.BorrowerNot Released;ForbearanceBy LenderNot a Waiver. Extensionofthetimefor
paymentormodificationofamortizationofthesumssecuredbythisSecurityInstrumentgrantedbyLender
toBorroweroranySuccessorinInterestofBorrowershallnotoperatetoreleasetheliabilityofBorrower
oranySuccessorsinInterestofBorrower.Lendershallnotberequiredtocommenceproceedingsagainst
any SuccessorinInterestofBorrowerortorefusetoextendtimeforpaymentor otherwisemodifyamortizationofthesumssecuredbythisSecurityInstrumentbyreasonofanydemandmadebytheoriginalBorroweroranySuccessorsinInterestofBorrower.Any forbearancebyLenderinexercisinganyrightor
remedyincluding,withoutlimitation,Lender'sacceptanceofpaymentsfromthirdpersons,entitiesor
SuccessorsinInterestofBorrowerorinamountslessthantheamountthendue,shallnotbeawaiverofor
precludetheexerciseofanyrightorremedy.13.JointandSeveralLiability;Co-signers;SuccessorsandAssignsBound. Borrowercovenants
andagreesthatBorrower'sobligationsandliabilityshallbejointandseveral.However,anyBorrowerwho
co-signsthisSecurityInstrumentbutdoesnotexecutetheNote(a"co-signer"):(a)isco-signingthis
SecurityInstrumentonlytomortgage,grantandconveytheco-signer'sinterestinthePropertyunderthe
termsofthisSecurityInstrument;(b)isnotpersonallyobligatedtopaythesumssecuredby thisSecurity
Instrument;and(c)agreesthatLenderandanyotherBorrowercanagreetoextend,modify,forbearormake
anyaccommodationswithregardtothetermsofthisSecurityInstrumentortheNotewithouttheco-signer'sconsent.
SubjecttotheprovisionsofSection18,anySuccessorinInterestofBorrowerwho assumesBorrower's
obligationsunderthisSecurityInstrumentinwriting,and isapprovedby Lender,shallobtainallof

Borrower'srightsandbenefitsunderthisSecurityInstrument.Borrowershallnotbe releasedfrom
Borrower'sobligationsandliabilityunderthisSecurityInstrumentunlessLenderagreestosuchreleasein
writing.ThecovenantsandagreementsofthisSecurityInstrumentshallbind(exceptasprovidedinSection
20)andbenefitthesuccessorsandassignsofLender.14.Loan Charges.Lendermay chargeBorrowerfeesforservicesperformedinconnectionwith
Borrower'sdefault,forthepurposeofprotectingLender'sinterestinthePropertyandrightsunderthis
SecurityInstrument,including,butnotlimitedto,attorneys'fees,propertyinspectionandvaluationfees.
Inregardtoanyotherfees,theabsenceofexpressauthorityinthisSecurityInstrumenttochargeaspecificfeetoBorrowershallnotbeconstruedasaprohibitiononthechargingofsuchfee.Lendermay notchargefeesthatareexpresslyprohibitedbythisSecurityInstrumentorbyApplicableLaw.
IftheLoanissubjecttoalawwhichsetsmaximum loancharges,andthatlawisfinallyinterpretedso
thattheinterestorotherloanchargescollectedortobe collectedinconnectionwiththeLoanexceedthe
permittedlimits,then:(a)anysuchloanchargeshallbereducedbytheamountnecessarytoreducethe
chargetothepermittedlimit;and(b)anysumsalreadycollectedfromBorrowerwhichexceededpermittedlimitswillberefundedtoBorrower.Lendermay choosetomakethisrefundbyreducingtheprincipalowed
undertheNoteorbymakingadirectpaymenttoBorrower.Ifarefundreducesprincipal,thereductionwill
betreatedasapartialprepaymentwithoutanyprepaymentcharge(whetherornotaprepaymentchargeis
providedforundertheNote).Borrower'sacceptanceofanysuchrefundmade by directpaymentto
BorrowerwillconstituteawaiverofanyrightofactionBorrowermighthavearisingoutofsuchovercharge.15.Notices.AllnoticesgivenbyBorrowerorLenderinconnectionwiththisSecurityInstrumentmust
beinwriting.Any noticetoBorrowerinconnectionwiththisSecurityInstrumentshallbedeemedtohave
beengiventoBorrowerwhen mailedby firstclassmailorwhen actuallydeliveredtoBorrower'snotice
addressifsentbyothermeans.NoticetoanyoneBorrowershallconstitutenoticetoallBorrowersunless
ApplicableLaw expresslyrequiresotherwise.The noticeaddressshallbe thePropertyAddressunless
Borrowerhasdesignateda substitutenoticeaddressby noticetoLender.BorrowershallpromptlynotifyLenderofBorrower'schangeofaddress.IfLenderspecifiesaprocedureforreportingBorrower'schangeofaddress,thenBorrowershallonlyreportachangeofaddressthroughthatspecifiedprocedure.TheremaybeonlyonedesignatednoticeaddressunderthisSecurityInstrumentatanyonetime.Any noticetoLender
shallbegivenbydeliveringitorby mailingitby firstclassmailtoLender'saddressstatedhereinunless
LenderhasdesignatedanotheraddressbynoticetoBorrower.Any noticeinconnectionwiththisSecurityInstrumentshallnotbedeemedtohavebeengiventoLenderuntilactuallyreceivedbyLender.Ifanynotice
requiredbythisSecurityInstrumentisalsorequiredunderApplicableLaw,theApplicableLaw requirementwillsatisfythecorrespondingrequirementunderthisSecurityInstrument.
16.GoverningLaw; Severability;Rulesof Construction.ThisSecurityInstrumentshallbe
governedbyfederallawandthelawofthejurisdictioninwhichthePropertyislocated.Allrightsand
obligationscontainedinthisSecurityInstrumentaresubjecttoany requirementsand limitationsof
ApplicableLaw. ApplicableLaw mightexplicitlyorimplicitlyallowthepartiestoagreeby contractorit

18.TransferofthePropertyora BeneficialInterestinBorrower.As usedinthisSection18,"InterestintheProperty"meansanylegalorbeneficialinterestintheProperty,including,butnotlimited
to,thosebeneficialintereststransferredinabondfordeed,contractfordeed,installmentsalescontractor
escrowagreement,theintentofwhichisthetransferoftitlebyBorroweratafuturedatetoapurchaser.IfalloranypartofthePropertyoranyInterestinthePropertyissoldortransferred(orifBorrower

19.Borrower'sRighttoReinstateAfterAcceleration.IfBorrowermeetscertainconditions,BorrowershallhavetherighttohaveenforcementofthisSecurityInstrumentdiscontinuedatanytimepriortotheearliestof:(a)fivedaysbeforesaleofthePropertypursuanttoanypowerofsalecontainedinthis
SecurityInstrument;(b)suchotherperiodasApplicableLaw mightspecifyfortheterminationofBorrower's
righttoreinstate;or(c)entryofajudgmentenforcingthisSecurityInstrument.Thoseconditionsarethat
Borrower:(a)paysLenderallsumswhichthenwouldbedueunderthisSecurityInstrumentandtheNote
asifnoaccelerationhadoccurred;(b)curesanydefaultofanyothercovenantsoragreements;(c)paysall
expensesincurredinenforcingthisSecurityInstrument,including,butnotlimitedto,reasonableattorneys'
fees,propertyinspectionandvaluationfees,andotherfeesincurredforthepurposeofprotectingLender's
interestinthePropertyandrightsunderthisSecurityInstrument;and(d)takessuchactionasLendermay
reasonablyrequiretoassurethatLender'sinterestinthePropertyandrightsunderthisSecurityInstrument,andBorrower'sobligationtopaythesumssecuredbythisSecurityInstrument,shallcontinueunchanged.Lendermay requirethatBorrowerpaysuchreinstatementsuntsandexpensesinoneormoreofthefollowing
forms,asselectedbyLender:(a)cash;(b)moneyorder;(c)certifiedcheck,bankcheck,treasurer'scheck
orcashier'scheck,providedanysuchcheckisdrawnuponaninstitutionwhosedepositsareinsuredby a
federalagency,instrumentalityor entity;or (6)ElectronicFundsTransfer.Upon reinstatementby
Borrower,thisSecurityInstrumentandobligationssecuredherebyshallremainfullyeffectiveasifno
accelerationhadoccurred.However,thisrighttoreinstateshallnotapplyinthecaseofaccelerationunder
Section18.20.SaleofNote;ChangeofLoanServicer;NoticeofGrievance.TheNoteorapartialinterestin
theNote(togetherwiththisSecurityInstrument)canbesoldoneormoretimeswithoutpriornoticeto
Borrower.A salemightresultinachangeintheentity(knownasthe"LoanServicer")thatcollectsPeriodic
PaymentsdueundertheNoteandthisSecurityInstrumentandperformsothermortgageloanservicing
obligationsundertheNote,thisSecurityInstrument,andApplicableLaw. Therealsomightbeoneormore
changesoftheLoanServicerunrelatedtoa saleoftheNote.Ifthereisa changeoftheLoanServicer,
Borrowerwillbegivenwrittennoticeofthechangewhichwillstatethenameandaddressofthenew Loan
Servicer,theaddresstowhichpaymentsshouldbemade andanyotherinformationRESPA requiresin

NeitherBorrowernorLendermay commence,join,orbejoinedtoanyjudicialaction(aseitheran
individuallitigantorthememberofaclass)thatarisesfromtheotherparty'sactionspursuanttothisSecurityInstrumentorthatallegesthattheotherpartyhasbreachedanyprovisionof,oranydutyowedbyreasonof,thisSecurityInstrument,untilsuchBorrowerorLenderhasnotifiedtheotherparty(withsuchnoticegivenincompliancewiththerequirementsofSection15)ofsuchallegedbreachandaffordedtheotherpartyhereto
areasonableperiodafterthegivingofsuchnoticetotakecorrectiveaction.IfApplicableLaw providesa
timeperiodwhichmustelapsebeforecertainactioncanbe taken,thattimeperiodwillbedeemedtobe
reasonableforpurposesofthisparagraph.The noticeofaccelerationandopportunitytocuregivento
BorrowerpursuanttoSection22andthenoticeofaccelerationgiventoBorrowerpursuanttoSection18shall
bedeemedtosatisfythenoticeandopportunitytotakecorrectiveactionprovisionsofthisSection20.
21.HazardousSubstances.As usedinthisSection21: (a)"HazardousSubstances"arethose
substancesdefinedastoxicorhazardoussubstances,pollutants,orwastesby EnvironmentalLaw andthe
followingsubstances:gasoline,kerosene,otherflammableortoxicpetroleumproducts,toxicpesticidesand
herbicides,volatilesolvents,materialscontainingasbestosorformaldehyde,andradioactivematerials;(b)"EnvironmentalLaw"meansfederallawsandlawsofthejurisdictionwherethePropertyislocatedthatrelate
tohealth,safetyorenvironmentalprotection;(c)"EnvironmentalCleanup"includesanyresponseaction,remedialaction,orremovalaction,asdefinedinEnvironmentalLaw;and(d)an"EnvironmentalCondition"
meansaconditionthatcancause,contributeto,orotherwisetriggeranEnvironmentalCleanup.Borrowershallnotcauseorpermitthepresence,use,disposal,storage,orreleaseofanyHazardous
Substances,orthreatentoreleaseanyHazardousSubstances,onorintheProperty.Borrowershallnotdo,norallowanyoneelsetodo,anythingaffectingtheProperty(a)thatisinviolationofanyEnvironmental
Law,(b)whichcreatesanEnvironmentalCondition,or(c)which,duetothepresence,use,orreleaseofa
HazardousSubstance,createsaconditionthatadverselyaffectsthevalueoftheProperty.Theprecedingtwo
sentencesshallnotapplytothepresence,use,orstorageonthePropertyofsmallquantitiesofHazardous
Substancesthataregenerallyrecognizedtobeappropriatetonormalresidentialusesandtomaintenanceof
theProperty(including,butnotlimitedto,hazardoussubstancesinconsumerproducts).BorrowershallpromptlygiveLenderwrittennoticeof(a)anyinvestigation,claim,demand,lawsuit
orotheractionbyanygovernmentalorregulatoryagencyorprivatepartyinvolvingthePropertyandanyHazardousSubstanceorEnvironmentalLaw ofwhichBorrowerhasactualknowledge,(b)anyEnviromnental
Condition,includingbutnotlimitedto,anyspilling,leaking,discharge,releaseorthreatofreleaseofanyHazardousSubstance,and(c)anyconditioncausedbythepresence,useorreleaseofaHazardousSubstance
whichadverselyaffectsthevalueoftheProperty.IfBorrowerlearns,orisnotifiedbyanygovernmentalorregulatoryauthority,oranyprivateparty,thatanyremovalor otherremediationofanyHazardous
SubstanceaffectingthePropertyisnecessary,Borrowershallpromptlytakeallnecessaryremedialactions
inaccordancewithEnvironmentalLaw. Nothinghereinshallcreateanyobligationon Lenderforan
EnvironmentalCleanup.
NON-UNIFORM COVENANTS. BorrowerandLenderfurthercovenantandagreeasfollows:

herebyassignedandshallbepaidtoLender.Lendershallapplytheproceedstothesumssecuredby the
SecurityInstrument,whetherornotthendue,withtheexcess,ifany,paidtoBorrower.
C. PublicIJabilityInsurance. Borrowershalltakesuchactionsasmay bereasonabletoinsure
thattheOwnersAssociationmaintainsapublicliabilityinsurancepolicyacceptableinform,amount,and
extentofcoveragetoLender.
D. Condemnation. Theproceedsofanyawardorclaimfordamages,directorconsequential,
payabletoBorrowerinconnectionwithanycondemnationorothertakingofalloranypartofthePropertyorthecommon areasandfacilitiesofthePUD, orforanyconveyanceinlieuofcondemnation,arehereby
assignedandshallbepaidtoLender.SuchproceedsshallbeappliedbyLendertothesumssecuredbythe
SecurityInstrumentasprovidedinSection1L
E. Lender'sPriorConsent. Borrowershallnot,exceptafternoticetoLenderandwithLender's
priorwrittenconsent,eitherpartitionorsubdividethePropertyorconsentto: (i)theabandonmentor
terminationofthePUD, exceptforabandonmentorterminationrequiredby lawinthecaseofsubstantial
destructionbyfireorothercasualtyorinthecaseofatakingbycondemnationoreminentdomain;(ii)anyamendmenttoanyprovisionofthe"ConstituentDocuments"iftheprovisionisfortheexpressbenefitof

Association;or(iv)anyactionwhichwouldhavetheeffectofrenderingthepublicliabilityinsurance

F. Remedies. IfBorrowerdoesnotpayPUD duesandassessmentswhendue,thenLendermay paythem.Any amountsdisbursedbyLenderunderthisparagraphF shallbecomeadditionaldebtofBorrower
securedbytheSecurityInstrument.UnlessBorrowerandLenderagreetoothertermsofpayment,these
amountsshallbearinterestfromthedateofdisbursementattheNoterateandshallbepayable,withinterest,
uponnoticefromLendertoBorrowerrequestingpayment.
