1. General

1.1 Enactment Background of the Registration System

Factory registration system means that foreign manufacturers who are willing to export their gas-related products specified by High-Pressure Gas Safety Control Act and Safety Control and Business of Liquefied Petroleum Gas Act to the Republic of Korea (hereinafter referred to as "Korea") shall be registered in Ministry of Trade Industry and Energy prior to manufacturing and exporting the products to Korea.

The registration system was established to allow only the verified manufacturers with their quality assurance capability through the factory audit to export their gas products to Korea with a view to preventing gas accidents to be caused by gas products manufactured not conforming to Korean standards or imported (or distributed) from unapproved manufacturers with unverified manufacturing and inspecting capability, and maintaining the uniform quality of gas products to be distributed in the Korean market.

1.2.1.3 Objects Exempted from Registration

Cylinders, etc. imported for test, research and development, Cylinders, etc. imported to be used at foreign agencies and already inspected by

foreign institutes, Cylinders, etc. attached to imported industrial equipment and facilities, Cylinders, etc. imported by manufacturers or importers as samples, Cylinders, etc. imported for importation of high-pressure gases and to be sent back

after using up the gases, the cylinders shall be inspected by foreign institute authorized from the Ministry of Trade Industry and Energy according to the attached Tables 10, 10-2 and 12 of the inspection standard in the Enforcement Rule of the High-Pressure Gas Safety Control Act.

Cylinders, etc. for special high-pressure gases, the type of cylinder is not manufactured in Korea.

Aerosol Cylinders, Cylinders, etc. imported to be exported, and, Other foreign Cylinders, etc. of which manufacture registration is acknowledged to

be difficult and notified by the Minister of Knowledge Economy.

1.2.2 Gas Appliances in accordance with Safety Control and Business of Liquefied Petroleum Gas Act

1.2.2.3 Objects Exempted from Registration

Gas appliances imported for test, research and development, Gas appliances imported to be used at foreign agencies and already inspected by

1.3 Definitions

1.3.1 Definitions for the Audit

1.3.1.1 Manufacturer Any person who intends to manufacture cylinders, etc. or gas appliances.

1.3.1.2 Factory Registration The Ministry of Trade Industry and Energy (hereinafter referred to as "MOTIE") sees if the result for the technical and on-site audit conducted by the Korea Gas Safety Corporation (hereinafter referred to as "KGS”) is suitable against the registration criteria, and then issues the registration certificate.

1.3.1.3 Alteration Registration In case of some change (3.2.3.1 or 3.2.3.2) in contents registered at initial audit, the MOTIE accept the alteration registration applications and issues the registration certificate.

1.3.1.4 Technical Review The technical review means the document review (by KGS) of the general present

status, standards for manufacturing and testing technologies, quality control by processes, manufacturing and testing facilities of the manufacturer, and its subcontractors' quality control.

1.3.1.5 Factory Audit

Factory audit is the procedure for conducting field inspection of matters related to technical review and quality control regulation, and consists of checks on manufacturing and testing facilities, quality control by processes, subcontractors' quality control and quality control regulations.

1.3.1.6 Initial Audit The audit for the manufacturer applies for registration at the MOTIE initially consists of technical review (documental review) and on-site audit.

1.3.1.7 Alteration Audit The audit for some change (3.2.3.1①~④ or 3.2.3.2①~③) according to 1.3.1.3 con

sists of alteration technical review and on-site audit.

1.3.1.8 Renewal Audit The audit for the manufacturer applies for extension of registration within the expiration date. Renewal audit consists of on-site audit only.

1.3.1.9 Re-Audit The audit for non-conformity of the manufacturer got the result 'rejected'. Re-audit consists of technical review and on-site audit, depending on type of non-conformity.

1.3.2 Definitions for the Cylinders, etc.

1.3.2.1 High-Pressure Gases High-pressure gases means compressed gases of which the gauge pressure is more than 1 MPa at an ambient temperature, or liquefied gases of which gauge pressure is more than 0.2 MPa.

1.3.2.2 Cylinders, etc. Cylinders, etc. means cylinders, refrigerators, or specified equipment.

1.3.2.3 Cylinders and Cylinder Accessories Cylinders mean the cylinders to be filled with high-pressure gases and are movable, and "Cylinder accessories" mean the valves etc. (including safety valves) that are attached to the cylinders but are separable.

1.3.2.4 Specified Equipment Specified equipment means such equipment as storage tanks, tanks fixed to vehicles, pressure vessels, safety valves, emergency cut-off devices, valves for toxic gaspipe, etc. that are used for manufacturing high-pressure gases

1.3.2.5 Storage Tanks Storage tanks means the tanks fixed and installed aboveground or underground to be filled with and store high-pressure gases.

1.3.2.6 Tanks Fixed to Vehicles

Tanks fixed to vehicles means the tanks installed on vehicles in order to transport high-pressure gases.

1.3.2.7 Pressure Vessels Pressure vessels means the vessels of which the pressure at 35℃ or design pres

sure is more than 0.2 MPa in case of liquid gases, or more than 1 MPa in case of compressed gases, and of which the value obtained by multiplying the design pressure (MPa) by the internal volume (m3) exceeds 0.004.

1.3.2.8 Welded Cylinders Welded cylinders means the cylinders manufactured by joining a separately- formed shells and heads by welding.

1.3.2.9 Seamless Cylinders Seamless cylinders means the cylinders manufactured by forming the shell and end plates in a monolithic construction without any seam.

1.3.2.10 Composite Cylinders Cylinder that is made up of being circumferentially reinforced by winding liner with fiber pre-impregnated into resin or by being impregnated with fiber on resin without liner

1.3.2.11 Joined or Soldered Cylinders Joined or soldered cylinders are disposable cylinders of which the internal volume is less than 1 liter, and of which the shell and end plates are separately formed and joined together by seam welding or soldering.

1.3.2.12 Specified Equipment for Refrigeration Specified equipment for refrigeration means compressors, condensers, evaporators and pressure vessels of which the refrigeration capacity per day is more than 3 tons.

1.3.2.13 Emergency Cut-Off Devices Emergency cut-off devices means the devices which promptly block the high pressure gas equipment at the time of abnormal conditions.

1.3.2.14 Safety Valves Safety valves means the spring-type safety valves installed inside of the pressure vessels and release the internal pressure by opening the valve when the internal pressure exceeds the set value.

1.3.2.15 Valves for Toxic Gas Pipes Valves for toxic gas pipes means the valves installed inside of the pipes run with toxic gases.

1.3.2.16 Toxic Gases "Toxic Gas" under High-Pressure Safety Control ACT means that if there is more than a fixed amount in the air, gas has a toxic effect harmful to the human body and whose permitted concentration is 5,000/1 million or less.

Types of Toxic Gas specified in 『High-Pressure Safety Management ACT』

are as follows;

acrylonitrile, acryl aldehyde, sulfurous acid gas, ammonia, carbon monoxide, carbon disulfide, fluorine, chlorine, bromide methane, chloride methane, chloroprene, oxide ethylene, hydrogen cyanide, hydrogen sulfide, mono methylamine, di-methylamine, tri-methylamine, benzene, phosgene, hydrogen iodide, bromide hydrogen, chloride hydrogen, fluoride hydrogen, mustard gas, algin, monosilane, disilane, diborane, selenium hydrogen, phosphine, monogermane

1.3.3 Definitions for the Gas Appliances

1.3.3.1 Gas Appliances Gas appliances means devices for fuel gas (where refer to followings, from article 1.3.3.2 to 1.3.3.14)

1.3.3.2 Pressure Regulators mean the device used for allowing high-pressure fluid supply lines or tanks to be reduced to safe and/or usable pressures for various applications

1.3.3.3 Automatic Shut-off Device for Gas Leakage A device used for detecting leakage of gas and shut-off valve automatically, which consist of detector, controller and shutoff unit

1.3.3.4 Filters for Governor Stations A device used for eliminating impurities from gas flow in pipes

1.3.3.5 Governors for Underground Use A unit that is used underground and equipped with separate functional devices such as pressure regulator, filter, valve, safety device and other accessary

1.3.3.6 Hoses A flexible tube which is made with metallic or non-metallic material

1.3.3.7 Valves for Pipes A glove type or ball type valve that controls or open and close the flow of a fluid

1.3.3.8 Gas Corks A device used for open and close of a fluid flow by turning around cap 90 degrees. A fuse type cock, a box cock and a nozzle type cock for a cast burner are limited for this manual.

1.3.3.9 Joints (or Fittings) A rolled and welded pipe with the purpose of connecting two pipes

1.3.3.10 Forced Mixed Type Gas Burners A gas burner blowing air with a fan for combustion

1.3.3.11 Gas Burning Appliances Appliance that is designed for use in gas burning process, where gas capacity is not more than 232.6kW(200,000 Kcal/h)

1.3.3.12 Multifunctional Gas Safety Meters A gas meters that is equipped with safety devices like shut-off device for overflow or gas leakage.

1.3.3.13 Loading Arms for Gases A device that permits the transfer of liquid or liquefied gas from one tank to another through an articulated pipe system consisting of rigid piping and swivel joints to obtain flexibility

1.3.3.14 Gas Fuel Cells A device that converts the chemical energy from electric active substance (so-called fuel) into electricity through a chemical reaction and continuous elimination of dead product continuously

2.2 Details for Each Process

2.2.1 Technical Review

2.2.1.1 Application for Technical Review Applicant for the registration should fill out the Form-1 (Application From for Technical Review for Cylinders, etc.) or Form-2 (Application Form for Technical Review for Gas Appliances), prepare the required documents prescribed in the Appendix B, and submit those documents to KGS en bloc

All documents related to factory registration such as applications for technical review and factory audit shall be prepared in Korean in principle. In case it is not possible to submit the Korean version, the English version may be submitted.

The company name, address and name of representative should be filled out in the Applicant field.

2.2.1.2 Processing the Results Technical review is to be conducted within seven days after its document submission. In case there is any item to be supplemented or incomplete, supplementary documents shall be submitted for that part and that period is not included in the seven days.

The results of technical review are judged to be acceptable, unacceptable, or required to be supplemented.

Acceptable: In case the submitted documents conform to the registration standard, the case is judged to be acceptable.

Supplement required: In case the submitted documents fall short of the registration standard or are inappropriate, an immediate notice requiring supplement is issued and the supplementary documents shall be submitted additionally for the defective parts.

Unacceptable (rejected): In case supplementation is not made even after two notifications for supplementation, the application is to be declared unacceptable and all the application documents are to be returned to the applicant but the cost of technical review is not to be returned.

In case there is any change in the registered items of any object companies and the registration shall be modified, the change shall be subject to modification technical review and the review method shall be the same as that of initial technical review.

2.2.2 Factory Audit

2.2.2.1 Application for Factory Audit After consultation with the factory audit team for the desired audit date, applicants

for the registrations should fill out the Form-3 (Application Form for Factory Audit for Cylinders, etc.) or Form-4 (Application Form for Factory Audit for Gas Appliances) and submit the form to KGS with full payment for the factory audit.

The types and standards of products to be registered with the MOTIE after technical review and the desired audit date consulted with KGS shall be listed.

2.2.2.2 Filed for the Factory Audit & Processing the Results In principle, the audit days shall be 4days (or 3days) for initial audit, 3days for renewal audit and 2days for re-audit, but the audit days may be adjusted to reflect the types and standards of products

The item for 4 days for initial audit: Cylinders, Storage Tanks, Tanks Fixed to Vehicles, Pressure Vessels, Specified Equipment for Refrigeration

The audit team consists of 3 auditors (2 auditors for re-audit) in principle, but the number of auditors may be adjusted to reflect the types and standards of products

The factory audit consists of 3 fields (stages) as below.

Audit for the implementation of technical requirements specified in manufacturing standards and Korean law, where the technical requirements include manufacture (design, forming, etc.) and inspection.

Manufacturing and testing equipment

Audit for manufacturing and test facilities specified in the manufacturing standards and Korean law. the each facility shall maintain the performance and accuracy appropriate for manufacture and inspection of the products

Quality management

systems

Audit to comply with the quality control by process which can guarantee stable quality of the products and the quality management system throughout the factory.

The processing for the factory audit should be completed within 30 days from desired audit day, and the results of the factory audit are judged as accept, minor or major

<Minor Non-conformities> When one non-conformity to either KGS regulations or manufacturing specification is found.

When the found non-conformity factor is deemed not to affect the production quality.

<Major Non-conformities> When the relevant KGS regulations or manufacturing specifications are not met.

When any major fault is found.

When multiple minor faults, which are deemed to affect the production quality, are found.

<Corrective Action>

The corrective action to eliminate non-conformities should be confirmed by the document review for minor or on-site re-audit for major

In case of the corrective action completed over 1 year from the notification date for no-conformities, the audit shall be same as the renewal audit.

If the corrective action for minor nonconformities is completed over 3 months from the notification date for non-conformities, the on-site re-audit shall be added.

2.2.3 Factory Registration

2.2.3.1 Application for Factory Registration After receiving a notice of acceptance for technical review and factory audit, applicants for the registrations should fill out the Form-5 (Application Form for Factory Registration for Cylinders, etc.) or Form-6 (Application Form for Factory Registration or Alteration for Gas Appliances), prepare the required documents prescribed in the Appendix B, and submit those documents to MOTIE.

In case an agency or branch in Korea substitute for the applicant, the attorney shall be attached. (There is no special form for the attorney)

2.2.3.2 Processing the Results For factory registration, conformity to the registration standard and items required for quality assurance shall be checked on the basis of the results of technical review and subsequent factory inspection.

Factory registration is to be processed and the certificate of manufacture registration such as Form 9 or 10 issued within 5 days after the receipt of the application.

3. Pre-Audit Preparations & Responsibility

3.1 Pre-Audit Preparation

Interpreter(s), local transportation, and audit data translated into Korean shall be prepared by the applicant.

Documents related to facilities

Design documents, drawings, catalogs, handling manuals, etc. of manufacturing facilities

Specification, calibration certificates, handling manuals, etc. of test and inspection facilities

In the case of subcontractors' processes, documents related to subcontractors' process facilities

Documents related to quality control

Related documents such as ISO/QC manuals and procedures or quality

3.2 Responsibility

3.2.1 Maintaining the Registration

The manufacturer (Certificate Holder) shall comply with registration standards specified in the certificate, relevant Korean laws and regulations in the term of validity (3 years).

The manufacturer shall apply for the renewal factory audit in the term of validity which is 3 years before about 6 months before the validity date of certificate.

In case of expiration of the validity term without a prior application for renewal audit, your registration will be canceled. The initial audit which includes the technical review and on-site audit shall be conducted for the re-registration.

In case the result of renewal audit of which application is received before expiry is decided after a prior expiration date, the new term of validity for renewal factory audits shall be assessed as followings.

Case 1 – the result of the audit is conformity (pass) The new term of validity shall be extended for the next three years from the expiration date on the prior registration certification.

Case 2 – the result of the audit is non-conformity (fail) In case of passing re-audit by eliminating non-conformity, the new term of validity shall begin from acceptance date of the re-audit but expire in 3 years from the expiration date on the prior registration certification.

This means that the product manufactured between the expiration date on the prior registration certification and the acceptance date for the re-audit cannot be exported to Korea

In case that one of following is found, the registration shall be canceled. Once the registration is canceled, the manufacturer shall return the registration certificate to MOTIE.

3.2.2.1 Cylinders etc.

Where a registration has been obtained by false of other unjust means Where he/she fails to meet the criteria for registration Where he/she violates regulation for marking Where he/she manufactures cylinders, etc. or fails to report importation Where he/she violates any reclamation order (recall, exchange, refund and publicly

3.2.2.2 Gas Appliances.

3.2.3 Alteration Registration If there is some change of your company information registered to MOTIE, it would be the object of an alteration audit; the manufacturer shall inform KGS immediately and undergo the alteration audit. After the alteration audit, the manufacturer s

hall apply the alteration registration to MOTIE (But in case of 3.2.3.1⑤, ⑥ or 3.2.

3.1 ④, ⑤, the manufacturer can apply the alteration registration to MOTIE without

the alteration audit by KGS)

3.2.3.1 Cylinders etc.

3.2.4 Marking on Gas Products The manufacturers who export gas products to Korea shall place a mark on them as determined by Korean laws

3.2.5 Disclosure Order When it deems necessary for safety control of the gas products distributed in Korea, they may be collected and inspected. Where inspection results reveal any serious defect in a gas product, the manufacturer shall recall, exchange, refund it and publicly announce such fact.

[Appendix 4] Guide for Subcontract Registration

Guide for Subcontract Registration

Overseas Supplier Registration System (OSRS) of KGS is a voluntary application and registration system to ensure the quality of products as well as to resolve the inconveniences of frequent visiting of suppliers.

Objects of audit are limited to four types of process (i.e., NDE, Forming /Bending, Heat Treatment and Mechanical Testing) necessary for manufacturing cylinders and pressure vessels. Moreover, the application and registration are possible only when the manufacturer and its suppliers agree and the suppliers must supply products to be exported to the Republic of Korea.

Methods of audit application are determined by voluntary agreement and decisions between subcontractors and manufacturer who want to register or were registered to Korean government to export their products.

The applicant can choose to undergo the audit for suppliers simultaneously at the time of its factory audit.

The applicant can choose to undergo an audit separately with its factory audit. In this case, there will be no affections between each audit results.

Benefits expected by OSRS of KGS In case of registered suppliers, no site visiting is necessary within valid period of

registration. The NCRs of suppliers do not affect the results of the manufacturer. The manufacturer can reduce the auditing time for outside process. The manufacturer can choose OSRS assured by KGS.

Audit type consists of document review and on-site audit.

In the document review, the manuals (procedures) will be checked to assure the quality of products in accordance with the manufacture codes (standards) and requirements.

In the on-site audit, the activities and records will be checked to assure quality of products in accordance with manuals (procedures).

In addition, the kind of audits are as follows; the initial audit, renewal audit, additional audit (needs to audit for additional site of the company) and re-audit (for the rejected audit).
