$ith regar to the con!ct of s!ch tests+ e0aminations an

inspections+ an more than one person or instit!tion can)e recognize as a competent person in relation to a

factory4

• &c)( 3hazaro!s process3 means any process or activity in

relation to an in!stry specifie in the 7*irst Sche!le $here+

!nless special care is ta#en+ ra$ materials !se therein or theintermeiate or finishe pro!cts+ )ye-pro!cts+ $astes or

effl!ents thereof $o!l-

&ection 4. oer to dec+are different de-artments to bese-arate factories or to or more factories to be a sin/+efactory.*

The State 9overnment may+ on its o$n or on an application mae in

this )ehalf )y an occ!pier+ irect )y an orer in $riting an s!)2ect tos!ch conitions as it may eem fit+ that for all or any of the p!rposesof this Act ifferent epartments or )ranches of a factory of the

occ!pier specifie in the application shall )e treate as separate

factories or that t$o or more factories of the occ!pier specifie in theapplication shall )e treate as a single factory.

Provie that no orer !ner this section shall )e mae )y the State9overnment on its o$n motion !nless an opport!nity of )eing hear is

given to the occ!pier.

&ection 0. oer to eem-t drin/ -b+ic emer/ency.*

In any case of a p!)lic emergency the State 9overnment may+ )ynotification in the :fficial 9azette+ e0empt any factory or class or

escription of factories from all or any of the provisions of this Acte0cept section ?@ for s!ch perio an s!)2ect to s!ch conitions as it

may thin# fit8

Provie that no s!ch notification shall )e mae for a perio e0ceeingthree months at a time.

Explanation.- *or the p!rposes of this section 7p!)lic emergency7

means a grave emergency $here)y the sec!rity of Inia or of any partof the territory thereof is threatene+ $hether )y $ar or e0ternal

aggression or internal ist!r)ance.

&ection 6. A--ro2a+, +icensin/ and re/istration of factories.*

&'( The State 9overnment may ma#e r!les-

&a( Re6!iring for the p!rposes of this Act+ the s!)mission of plans of

any class or escription of factories to the Chief Inspector or the State9overnment4

• &aa( re6!iring the previo!s permission in $riting of the State

9overnment or the Chief Inspector to )e o)taine for the site on$hich the factory is to )e sit!ate an for the constr!ction or

e0tension of any factory or class or escription of factories4

• &)( re6!iring for the p!rpose of consiering applications for s!ch

permission the s!)mission of plans an specifications4

• &c( prescri)ing the nat!re of s!ch plans an specifications an )y

$hom they shall )e certifie4

• &( re6!iring the registration an licensing of factories+ or any

class or escription of factories+ an prescri)ing the fees paya)lefor s!ch registration an licensing an for the rene$al of

licenses4

• &e( Re6!iring that no license shall )e grante or rene$e !nless

the notice specifie in section @ has )een given.

&/( If on an application for permission referre to in cla!se &aa( ofs!)-section &'( accompanie )y the plans an specifications re6!ire

)y the r!les mae !ner cla!se &)( of that s!)-section+ sent to theState 9overnment or Chief Inspector )y registere post+ no orer is

comm!nicate to the applicant $ithin three months from the ate on$hich it is so sent+ the permission applie for in the sai application

shall )e eeme to have )een grante.

&1( "here a State 9overnment or a Chief Inspector ref!ses to grantpermission to the site+ constr!ction or e0tension of a factory or to the

registration an licensing of a factory+ the applicant may $ithin thirty

ays from the ate of s!ch ref!sal+ appeal to the Central 9overnmentif the ecision appeale for $as of the State 9overnment+ an to the

State 9overnment in any other case.

E0planation. - A factory shall not )e eeme to )e e0tene $ithin themeaning of this section )y reason only of the replacement of any plant

or machinery+ or $ithin s!ch limits as may )e prescri)e+ of theaition of any plant or machinery. If s!ch replacement or aition

oes not re!ce the minim!m clear space re6!ire for safe $or#ing

aro!n the plant or machinery or aversely affect the environmentconitions from the evol!tion or emission of steam+ heat or !st or

I!mes $hich are in2!rio!s to health.

&ection . Notice by occ-ier.*

&'( The occ!pier shall+ at least fifteen ays )efore he )egins to occ!py

or+ !se any premises as a factory+ sen to the Chief Inspector a $rittennotice containing-

• &a( the name an sit!ation of the factory4

• &)( the name an aress of the occ!pier4

• &))( the name an aress of the o$ner of the premises or

)!iling &incl!ing the precincts thereof ( referre to in section

• &c( the aress is $hich comm!nication relating to the factory

may )e sent4

• &( the nat!re of the man!fact!ring process-o &i( carrie on in the factory !ring the last t$elve months

in the case offactories in e0istence on the ate of thecommencement of this Act+ an

o &ii( to )e carrie on in the factory !ring the ne0t t$elve

months in the case of all factories4

• &e( the total rate horse po$er installe or to )e installe in the

factory+ $hich shall not incl!e the rate horse po$er of any

separate stan)y plant4

• &f( the name of the manager of the factory for the p!rposes of

this Act4• &g( the n!m)er of $or#ers li#ely to )e employe in the factory8

• &h( the average n!m)er of $or#ers per ay employe !ring the

last t$elve months in the case of a factory in e0istence on theate of the commencement of this Act4

• &i( s!ch other partic!lars as may )e prescri)e.

&/( In respect of all esta)lishments+ $hich come $ithin the scope of

the Act for the first time the occ!pier shall sen a $ritten notice to the

Chief Inspector containing the partic!lars specifie in s!)-section &'($ithin thirty ays from the ate of the commencement of this Act.

&1( efore a factory engage in a man!fact!ring process $hich is

orinarily carrie o!t for less than one h!nre an eighty $or#ingays in the year+ res!mes $or#ing+ thc occ!pier shall sen a $ritten

notice to the Chief Inspector containing the partic!lars specifie ins!)-section &'( that least thirty ays )efore the ate of the

commencement of $or#.

&( "henever a ne$ manager is appointe+ the occ!pies shall sen tothe Inspector a $ritten notice an to the Chief Inspector a copy

thereof $ ithin seven ays from the ate on $hich s!ch person ta#esover charge.

&=( >!ring a perio for $hich no person has )een esignate as

manager of a factory or !ring $hich the person esignate oes notmanage the factory+ any person fo!n acting as manager+ or if no s!ch

person is fo!n+ the occ!pier himself+ shall )e eeme to )e the

manager of the factory for the p!rposes of this Act.

#'AT% II The Ins-ectin/ &taff

&ection A. enera+ dties of the occ-ier.*

&'( Every occ!pier shall ens!re+ so far as is reasona)ly practica)le+ the

health+ safety an $elfare of all $or#ers $hile they are at $or# in thefactory.

&/( "itho!t pre2!ice to the generality of the provisions of s!)-section

&'(+ the matters to $hich s!ch !ty e0tens+ shall incl!e-

• &a( the provision an maintenance of plant an systems of $or#

in the factory that are safe an $itho!t ris#s to health4

• &)( the arrangement in the factory for ens!ring safety an

a)sence of ris#s to health in connection $ith the !se+ hanling+

storage an transport of articles an s!)stances4

• &c( the provision of s!ch information+ instr!ction+ training an

s!pervisions as are necessary to ens!re the health an safety ofall $or#ers at $or#4

• &( the maintenance of all places of $or# in the factory in a

conition that is safe an $itho!t ris#s to health an theprovision an maintenance of s!ch means of access to+ an

egress from+ s!ch place as are safe an $itho!t s!ch ris#s4

• &e( the provision+ maintenance or monitoring of s!ch $or#ing

environment in the factory for the $or#ers that is safe+ $itho!tris#s to health an ae6!ate as regars facilities anarrangements for their $elfare at $or#.

&1( E0cept in s!ch cases as may )e prescri)e+ every occ!pier shallprepare+ an+ as often as may )e appropriate+ revise+ a $ritten

statement of his general policy $ith respect to the health an safety of

the $or#ers at $or# an the organization an arrangements for thetime )eing in force for carrying o!t that policy+ an to )ring the

statement an any revision thereof to the notice of all the $or#ers in

s!ch manner as may )e prescri)e.

&ection . enera+ dties of manfactrers, etc., as re/ardsartic+es and sb*stancesfor se in factories.*

&'( Every person $ho esigns+ man!fact!res+ imports or s!pplies anyarticle for !se in any factory shall-

• &a( ens!re+ so far as is reasona)ly practica)le+ that the article is

so esigne an constr!cte as to )e safe an $itho!t ris#s to

the health of the $or#ers $hen properly !se4

• &)( carry o!t or arrange for tlle carrying o!t of s!ch tests an

e0amination as may )e consiere necessary for the effective

implementation of the provisions of cla!se &a(4• &c( ta#e s!ch steps as may )e necessary to ens!re that

ae6!ate information $ill )e availa)le-

o &i( in connection $ith the !se of the article in any factory4

o &ii( a)o!t the !se for $hich it is esigne an teste4 an

o &iii( a)o!t any conitions necessary to ens!re that the

article+ $hen p!t to s!ch !se+ $ill )e safe+ an $itho!tris#s to the health of the $or#ers8

Provie that $here an article is esigne or man!fact!re o!tsie

Inia+ it shall )e o)ligatory on the part of the importer to see-

• &a( that the article conforms to the same stanars if s!ch

article is man!fact!re in Inia+ or

• &)( if the stanars aopte in the co!ntry o!tsie for the

man!fact!re of s!ch article is a)ove the stanars aopte in

Inia+ that the article conforms to s!ch stanars

&/( Every person+ $ho !nerta#es to esign or man!fact!re any article

for !se in any factory+ may carry o!t or arrange for the carrying o!t ofnecessary research $ith a vie$ to the iscovery an+ so far as is

reasona)ly practica)le+ the elimination or minimization of any ris#s tothe health or safety of the $or#ers to $hich the esign or article maygive rise.

&1( othing containe in s!)-sections &'( an &/( shall )e constr!e to

re6!ire a person to repeat the testing e0amination or research $hichhas )een carrie o!t other$ise than )y him or at his instance on so far

as it is reasona)le for him to rely on the res!lts thereof for thep!rposes of the sai s!)-sections.

&( An !ty impose on any person )y s!)-sections &'( an &/( shalle0ten only to things one in the co!rse of )!siness carrie on )y himan to matters $ithin his control.

&=( "here a person esigns+ man!fact!res+ imports or s!pplies an

&ection 8. Ins-ectors.*

&'( The State 9overnment may+ )y notification in the :fficial 9azette+

appoint s!ch persons as possessing the prescri)e 6!alification to )eInspectors for the p!rposes of this Act an may assign to them s!ch

local limits as it may thin# fit.

&/( The State 9overnment may+ )y notification in the :fflcial 9azette+appoint any person to )e a Chief Inspector $ho shall+ in aition to

po$ers conferre on Chief Inspector !ner this Act+ e0ercise thepo$ers of an Inspector thro!gho!t the State.

&/A( The State 9overnment may+ )y notification in the :fficial 9azette+

appoint as many Aitional Chief Inspectors+ 5oint Chief Inspectorsan >ep!ty Chief Inspectors an as many other offlcers as it thin#s fit

to assist the Chief Inspector an to e0ercise s!ch of the po$ers of theChief Inspector as may )e specifie in s!ch notification.

&/( Every aitional Chief Inspector+ 5oint Chief Inspector+ >ep!ty

Chief Inspector an every other officer appointment !ner s!)-section&/A( shall+ in aition to the po$ers of a Chief Inspector specifie in

the notification )y $hich he is appointe+ e0ercise the po$er of an

Inspector thro!gho!t the State.

&1( o person shall )e appointe !ner s!)-section &'(+ s!)-section

9overnment+ a!thorize any 6!alifie meical practitioner to e0erciseany of his po$ers !ner this Act for s!ch perio as the certifying

s!rgeon may specify an s!)2ect to s!ch conitions as the State9overnment may thin# fit to impose+ an references in this Act to a

certifying s!rgeon shall )e eeme to incl!e references to any

6!alifie meical practitioner $hen so a!thorise.

&/( In any factory in $hich the h!miity of the air is artificially

increase+ the $ater !se for the p!rpose shall )e ta#en from a p!)lics!pply+ or other so!rce of rin#ing $ater+ or shall he effectively p!rifie

)efore it is so !se.

&1( If it appears to an Inspector that the $ater !se in a factory for

increasing h!miity $hich is re6!ire to )e effectively p!rifie !ner

s!)-section &/( is not effectively p!rifie he may serve on the managerof the factory an orer in $riting+ specifying the meas!res $hich in his

opinion sho!l )e aopte+ an re6!iring them to )e carrie o!t )eforespecifie ate.

&ection 16. $2ercrodin/.*

o room in any factory shall )e overcro$e to an e0tent in2!rio!s to

the health of the $or#ers employe therein.

&/( "itho!t pre2!ice to the generality of s!)-section &'(+ there shall

)e in every $or#room of a factory in e0istence on the ate ofcommencement of this Act at least ,., c!)ic metres an of a factory

there$ith in respect of the room is !nnecessary in the interest of thehealth of the $or#ers employe therein.

&'( In every part of a factory $here $or#ers are $or#ing or passing+

there shall )e provie an maintaine s!fficient an s!ita)le lighting+nat!ral or artificial+ or )oth.

&/( In every factory all glaze $ino$s an s#ylights !se for the

lighting of the $or#room shall )e #ept clean on )oth the inner ano!ter s!rfaces an+ so far as compliance $ith the provisions of any

r!les mae !ner s!)-section &1( of section '1 $ill allo$+ free fromo)str!ction.

&1( In every factory effective provision shall+ so far as is practica)le+

)e mae for the prevention of-

• &a( glare+ either irectly from a so!rce of light or )y reflection

from a smooth or polishe s!rface4

&'( In every factory effective arrangements shall )e mae to proviean maintain at s!ita)le points conveniently sit!ate for all $or#ers

employe therein a s!fficient s!pply of $holesome rin#ing $ater.

spittoons in convenient places an they shall )e maintaine in a clean

an hygienic conition.

&/( The State 9overnment may ma#e r!les prescri)ing the type an

n!m)ers of spittoons to )e provie an their location in any factory

an provie for s!ch f!rther matters relating to their maintenance in aclean an hygienic conition.

maintaine to prevent the cage from over-r!nning.

&1( The Chief Inspector may permit the contin!e !se of a hoist or lift

installe in a factory )efore the commencement of this Act $hich oes

not f!lly comply $ith the provisions of s!)-section &'( !pon s!chconitions for ens!ring safety as he may thin# fit to impose.

&( The State 9overnment may+ if in respect of any class or escriptionof hoist or lift+ is of opinion that it $o!l )e !nreasona)le to enforce

any re6!irements of s!)-sections &'( an &/(+ )y orer irect that s!ch

re6!irement shall not apply to s!ch class or escription of hoist or lift.

Explanation.- *or the p!rposes of this section+ no lifting machine or

appliance shall )e eeme to )e a hoist or lift !nless it has a platform

or cage+ the irection or movement of $hich is restricte )y a g!ie org!ies.

&ection !9. 7iftin/ machines, chains, and ro-es and +iftin/tac+es. *

e0plosive or inflamma)le gas or vapo!r !ner press!re greater thanatmospheric press!re+ that part shall not )e opene e0cept in

accorance $ith the follo$ing provisions+ namely8-

• &a( )efore the fastening of any 2oint of any pipe connecte $iththe part or the fastening of the cover of any opening into the

Central 9overnment as a mem)er of that Committee.

&( The Site Appraisal Committee shall have po$er to call for any

information from the person ma#ing an application for theesta)lishment or e0pansion of a factory involving a hazaro!s process.

hazaro!s process have reasona)le apprehension that there is a

li#elihoo of imminent anger to their lives or health !e to anyaccient+ they may+ )ring the same to the notice of the occ!pier+

agent+ manager or any other person $ho is in-charge of the factory orthe process concerne irectly or thro!gh their representatives in the

Safety Committee an sim!ltaneo!sly )ring the same to the notice ofthe Inspector.

&/( Tt shall )e the !ty of s!ch occ!pier+ agent+ manager or the person

in-charge of the factory or process to ta#e immeiate remeial actionif he is satisfie a)o!t the e0istence of s!ch imminent anger an sen

a report forth-$ith of the action ta#en to the nearest Inspector.

&1( If the occ!pier+ agent+ manager or the person in-charge referre toin s!)-section &/( is not satisfie a)o!t the e0istence of any imminent

anger as apprehene )y the $or#ers+ he shall+ nevertheless+ refer

the matter forth-$ith to the nearest Inspector $hose ecision on the6!estion of the e0istence of s!ch imminent anger shall )e final.
