November 2007: FAIR Start Event – Signing of Communique of official launch of FAIR
May 2008: Completion of the founding documents (the Convention with its five Annexes and the Final Act) ready for signature
Declared contributions (in-kind and in cash) amount to 1040 M€
Summer 2008: Confirmation of contributions of countries to the construction costs and designation of Shareholders of FAIR GmbH (Company with Limited Liability Company under German Law)
November 2008: Signing Conference of the Delegates of the Governments of the participating Countries

Discussion on legal Framework for FAIR since 2004:

Disadvantages of GmbH as legal framework for FAIR
Tax status: Exemption from value-added tax (VAT) was difficult to achieve
Staff Rules:Depend on rules of German Treasury for public funded institutions (TVöD).International Allowance and more adequate salaries in senior-scientist pay groupwere difficult to achieve.
Financial Rules:Significant Loans (e.g. from EIB) not permitted (only if shareholder does not pay in time hiscontribution (up to 10 % of the annual budget of the operation period) may be taken as a loan for 6 months).
FAIR GmbH has to perform annual financial statement on profit and lossand cameralistic accountancy (income and expenditures) two annual balance sheets
