50.2 It was decided to clarify the institution as under -

a) section 10 of the Pharmacy Act empowers the PCI to frame Regulations called Education Regulations. Accordingly, the PCI has framed the Education Regulations for B.Pharm course namely “The Bachelor of Pharmacy (B.Pharm) Course Regulations, 2014” with the prior approval of the Ministry of Health and Family Welfare, Government of India. The said Regulations were notified in the Gazette of India.

b) section 10 to 12 and 14 of the said Regulations relate to Examination, Eligibility for appearing examination, Mode of examinations and Minimum marks for passing the B.Pharm examination.

c) Similarly Regulation 16 of the “The Bachelor of Pharmacy (B.Pharm) Course Regulations, 2014” very specifically mandates that every student who has passed the examinations for the B.Pharm shall be granted a certificate by the examining authority.

In pursuance of the above statutory provisions of the Pharmacy Act, the nomenclature approved by the PCI is Bachelor of Pharmacy (B.Pharm) for the purpose of registration as a pharmacist.

50.3 In view of above, the institution may take the urgent necessary action to enable its student to become eligible for registration as a pharmacist under the Pharmacy Act.
