It was decided to recommend to the Council to grant approval for conduct / extension of approval / u/s 12 of the Pharmacy Act, 1948 of Diploma / Degree / Pharm.D / Pharm.D (Post Baccalaureate) / M.Pharm / B.Pharm (Practice) course and examination in Pharmacy subject to the following conditions - a) the institution shall submit SIF every year as per the Time-Schedule prescribed by the Council. b) the institution shall submit annual affiliation fee on or before due date. c) the institution shall appoint the teaching faculty with the qualification and experience as prescribed under the “Minimum Qualification for Teachers in Pharmacy Institutions Regulat ions, 2014”. B. Besides above conditions, institutions seeking approval of Pharm.D / Pharm.D (Post Baccalaureate) course shall comply with the following conditions - 1. The institution shall comply with the requirements of Pharm.D. Regulations, 2008 particularly regarding appointment of teaching staff, equipments and Hospital facility. 2. Further the PCI recommends that Pharmacy Practice Faculty including HOD shall undergo at least 1 Continuing Education Programme / Training Programme of minimum 3 days duration every year and participation in atleast one seminar/conference every year. 3. In view of above, it was decided to ask the institutions concerned to intimate the council per return of mail the number of such Continuing Education Programmes / Training Programmes / Seminar / Conference etc. attended by HOD and pharmacy practice faculty during the last one year with documentary evidence i.e. participation certificate etc. 4. A. It was decided to recommend to the Council to grant approval for conduct / extension of approval /u/s 12 of the Pharmacy Act, 1948 of Diploma / Degree / Pharm.D / Pharm.D (Post Baccalaureate) /M.Pharm / B.Pharm (Practice) course and examination in Pharmacy subject to the followingconditions -a) the institution shall submit SIF every year as per the Time-Schedule prescribed by the Council.

b) the institution shall submit annual affiliation fee on or before due date.

c) the institution shall appoint the teaching faculty with the qualification and experience asprescribed under the “Minimum Qualification for Teachers in Pharmacy Institutions Regulations,2014”.

B. Besides above conditions, institutions seeking approval of Pharm.D / Pharm.D (Post Baccalaureate)course shall comply with the following conditions -

1. The institution shall comply with the requirements of Pharm.D. Regulations, 2008 particularlyregarding appointment of teaching staff, equipments and Hospital facility.

2. Further the PCI recommends that Pharmacy Practice Faculty including HOD shall undergo atleast 1 Continuing Education Programme / Training Programme of minimum 3 days durationevery year and participation in atleast one seminar/conference every year.

3. In view of above, it was decided to ask the institutions concerned to intimate the council perreturn of mail the number of such Continuing Education Programmes / Training Programmes /Seminar / Conference etc. attended by HOD and pharmacy practice faculty during the last oneyear with documentary evidence i.e. participation certificate etc.

4. The institution to submit full compliance of the Pharm.D Regulations, 2008 as per followingdetails:-

C. Regarding M.Pharm course -

"(1) In pursuance of the provisions of sub section (1) of section 12 of the Pharmacy Act, 1948 (8 of1948), the Pharmacy Council of India declares the running of M.Pharm course in mentionedspecializations conducted by institution/s to be an approved “course of study” for the purposeof admission to an examination for M.Pharm course in respect of mentioned specializations,number of students and academic session as specified.

(2) Further as required under regulation 6 of Appendix-B of “The Master of Pharmacy (M.Pharm)Course Regulations, 2014”, the Examining Authority and institution shall communicate to thePCI, not less than six weeks in advance the dates fixed for examinations, the time-table for suchexaminations, so as to enable the Council to arrange for inspection to attend at suchexaminations.”

3.2 It was noted that inspection report has pointed out that -

5.1 The latest information on record was placed.

5.2 It was noted that vide order dt.30.10.2017, Hon’ble Supreme Court has ordered forregistration of respondents subject to outcome of SLP and tagged with SLP (C)No.25160/2017.

5.3 It was further noted that vide letter dt.11.12.2017, institution has informed that -

a) it is already running diploma course since 2014 by the name of Pratibhatai PawarCollege of Pharmacy at Wadala Mahadev, Dist. Ahmednagar.

b) though the institution has applied for both new D.Pharm (additional) and B.Pharmcourse, they are withdrawing their application for additional new diploma course and

their application be considered for B.Pharm course only from 2018-2019 academicsession.

5.4 As per inspection report (Dec., 2017), institution is running D.Pharm course with anintake of 120 students. The inspection report (Dec., 2017) reflected that -

a) the Principal is only identified and not appointed.b) teaching staff for both diploma and degree course is not appointed as per following

statutory Regulations -

The Education Regulations, 1991. The Bachelor of Pharmacy (B.Pharm) Course Regulations, 2014. Minimum Qualification for Teachers in Pharmacy Institutions Regulations, 2014.

c) equipments are ordered but not yet procured.d) exhaust fans are not installed in all the labs.e) fuming cupboard is required in the chemistry lab.

5.5 In view of above, it was decided to -

a) clarify to the institution that since the PCI does not permit intake above 60 students inD.Pharm course, the students admitted above 60 will not be eligible for registration asa pharmacist under the Pharmacy Act, 1948.

b) instruct the institution to rectify the above deficiencies and submit compliance withdocumentary evidence.

c) apprise the Hon’ble Court about the findings of above inspection report by filing anadditional counter, if required.

13.1 The latest information on record including findings of Personal Hearing Committee(PHC) dt.10.1.2018 were placed and considered.

13.2 It was noted that -

a) Principal was asked to appear before the PHC but he did not appear. Instead Dr.G.Saikiran claiming to be the Vice-Principal appeared before the PHC and submittedthe Staff Declaration Forms (SDFs) in respect of teaching staff which were in-complete. None of the SDFs were signed by the Principal and hence the SDFs werereturned back in original.

b) Under “Minimum Qualification for Teachers in Pharmacy Institutions Regulations,2014”, there is no post of Vice-Principal.

13.3 In view of above, it was decided to -

a) issue notice to Principal seeking explanation as to why action should not be initiatedagainst him under regulation (ix) of the “Minimum Qualification for Teachers inPharmacy Institutions Regulations, 2014”.

b) instruct the institution not to make admissions in any specializations in PG course.c) the above decision be immediately conveyed to institution under intimation to

AICTE.
