S.*i..$From: Julie McQuade, Communify Outreach CoordinatorQDate: February 25,2071Subject: First Thursday FayettevillePROPOSAL: The City Administration is requesting an ordinance to amend Chapter 114.03 (B) of theFayetteville Code to include the block of Mountain Street between East and Block Streets and'prking spaceson both sides of this block for the First Thursday Fayetteville monthly cultural arts event.RECOMMENDATION:In 2010, Ordinance 5307 amended Chapter 114 of the Fayetteville Code to establish the First ThursdayFayetteville cultural arts event on the Fayetteville downtown square during the months of April throughNovember annually. Since that time, this cultural arts event has been succssful in bringing cultural arts to thepublic; increasing revenues for local artists, merchants and restaurants in the area; ana proviaing opportunitiesfor local non-profits to raise funds for their programs. First Thursday Fayetteville partiipation lre rapidly in2070 and continues to grow.In order to accommodate the growth of this monthly cultural arts event, city staff recommend adding the blockof Mountain Street between East and Block Streets to the area allowed for location of this event.

BUDGET IMPACT:There is no budget impact.

ORDINANCE NO. 5307AN ORDINANCE TO AMEND THE CODE OF FAYETTEVILLE BYENACTTNC $114.03 FIRST THURSDAY FAYETTEVTLLE TOAUTHORTZE THE FAYETTEVILLE CONVENTION AND VISITORSBUREAU TO CONTROL THE PUBLIC PARKING SPACES ON BOTH SIDESOF EAST STREET ON THE SQUARE AND TO CLOSE EAST STREET TTRAFFIC FROM 4:00 P.M. UNTIL 10:00 P.M. ON THE FIRST THURSDAYOF THE MONTHWHEREAS, First Thursday Fayetteville has been authorized by special event permits touse all public parking spaces on both sides of East Street between Center and Mountain and closeEast Street at that location on the first Thursdays of August, September, October and Novemberof2009; andWHEREAS, First Thursday Fayetteville has been very successful in providing manycitizens opportunities to view and purchase art and share the evening downtown environmentduring ttre initial four First Thursday events; and - |WHEREAS, it is preferable to establish by ordinance rather than monthly special eventpermit the authority to conduct First Thursday Fayetteville on a monthly basis.NOW, THEREFORE BE IT ORDAINED BV THE CITY COUNCIL OF THECITY OF FAYETTEVILLE, ARKANSAS:Section l: That the City Council of the City of Fayetteville, Arkansas hereby amends theFayetteville Code by enacting a new $ I 14.03 First Thursday Fayetteville as shown below:

"l 14.03 First Thursday Fayetteville."(A) Establishment, hours and dates. First Thursday Fayetteville ishereby established. This monthly event shall run on the f,rrst Thursday ofevery month from April through November dwing the hours of 4 P.M.through l0 P.M.

"(B) Location, parking reslrictions and administration. First ThursdayFayetteville shall be located and have control over the public parkingspaces along both sides of East Avenue during its hours of operation. TheFayetteville Convention and Visitors Bureau shall administer FirstThursday Fayetteville and shall be empowered to remove or request theticketing of vehicles parked within the East Street allocated area duringthe 4:00 P.M. to 10:00 P.M. operating hours. The Bureau shall also beempowered to close East Street between Mountain and Center Streets tovehicular traffic during the First Thursday Fayetteville event."(C\ Articles permitted to be sold. Only objects of art or craft producedand sold by a local artist or craftsperson may be sold at the First ThursdayFayetteville event. The Fayetteville Convention and Visitors Bureau isempowered to assign precise locations for any vendors wishing to displayor sell their personally created art or craft work."(D) Sanitation. Al the close of a vendor's operation (no later than 10:00P.M.), the vendor shall clean the immediate area around the vendor'soperation and ensure that all trash and debris are removed and properlydiscarded."
