2 NATURE OF THE CASE

Defendants AT&T Mobility National Accounts, Inc. and AT&T Corp.

(together “ AT&T ” or “ defendants” ) are Georg ia and New Jersey based prov iders of

te lecommunication serv ices, includ ing cellu lar te lephone serv ices.

During the class period, AT&T know ingly and actively charged plain tiff and

the class In ternet Serv ices Tech Support 360 (“ Tech 360” ) fees w ithout plain tiff and the

class having purchased or subscribed to the Tech 360 serv ice, and w ithout the know ledge

and consent of plain tiff and the class.

AT&T ’ s conduct is a v io lation of Californ ia Business & Professions Code

section 17200 et seq., is a breach of contract, and has resu lted in AT&T ’ s unjust

enrichment. Further, th is case presents a prototyp ical situation for class treatment.

AT&T ’ s conduct - includ ing all relevant practices, deception, representations, documents

and om issions; is uniform among all customers. The application of uniform law to a

common course of conduct w ill determ ine liab ility for the class as a whole, ensuring that

the rights of many small businesses are v ind icated through the effic iency of a sing le tria l.

19 A. The Plaintiff:

Plain tiff Specialized Realty , Inc. (“ Specialized” ) at all material tim es herein ,

was and still is a resident of the state of Californ ia.

Specialized is a relationship and transaction oriented real estate brokerage

office located in G lendale, Californ ia.

During the class period, plain tiff purchased and/or subscribed to a Mobile

Business phone plan from AT&T. Plain tiff and class members did not know that AT&T

would add a Tech 360 fee to these plans nor did they consent to AT&T adding a Tech 360

fee to the.se plans.

The venue is proper in th is court pursuant to Californ ia C iv il Code sections

395 and 395.5 in that some of the acts, events, and occurrences giv ing rise to th is litigation

took place in the County of Los Angeles. Plain tiff Specialized Realty , Inc. is a resident of

the County of Los Angeles; and AT&T has conducted its business, and currently does so, in

the County of Los Angeles.

23. AT&T engaged in a common course of conduct which gives rise to common

questions of law and fact which predom inate over any questions affecting only ind iv idual

members of the class. This common course of conduct— improperly charg ing Tech 360

fees w ithout know ledge and consent— affected class members in the exact same manner.

The amount of damages may differ among class members, but the fact and type of damages

is uniform among all class members and flow s directly from AT&T ’ s common conduct. A

sing le, uniform , online or pre-prin ted contract w ill govern all class members’ contractual

claim s. Californ ia law applies to every member’ s claims.

24. This shared nucleus of facts and law gives rise to numerous questions of law

and fact which do not vary from class member to class member, and which may be

share. Sim ilarly , AT&T retains approx imately one th ird of the to tal market share for these

plans in the State of Californ ia, numbering in the m illions. The number of potentia l class

members is so numerous that jo inder of all members of the classes is im practicab le.

The claim s of the representative plain tiff in th is action are typ ical of the

claim s of the members of the class, and the representative plain tiffs in terests coincide w ith

arising out of defendants’ common course of conduct as complained of herein . The

damages of each member of the class were caused directly by defendants’ w rongfu l

little incentive to pursue ind iv idual claims.

Even if every class member could afford ind iv idual litigation, the court

system could not. It would be unduly burdensome to the courts in which ind iv idual

litigation of numerous cases would proceed. Ind iv idualized litigation would also present

the potentia l for vary ing, inconsistent, or contrad ictory judgments; and would magnify the

delay and expense to all parties and to the court system resu lting from multip le trials of the

same complex factual issues. By contrast, the conduct of th is action as a class action w ith

respect to some or all of the issues presented herein , presents fewer management

difficu lties, conserves the resources of the parties and of the court system , and protects the

rights of each class member.

The proposed class defin ition is objective and class membership is easily

determ ined using customer in formation and financial records maintained by AT&T in

electron ic form . Calcu lation of damages can be accomplished using systematic means and

objective criteria. The class action mechanism is adm in istratively feasib le and prov ides the

benefit of unitary adjud ication.

December 11, 2019 for the prov ision of local and long-d istance te lephone serv ices.

February 28, 2020, Specialized was charged a Tech 360 fee in the amount of $426.25,

amounting to $1,278.75 in to tal.

AT&T charges a Tech 360 fee to its business accounts that have six or more

The grav ity of the harm caused by AT«fe.T’ s conduct of charg ing

plain tiff and class members for a serv ice they did not contract for or utilize outweighs the

utility , if any, of AT&T ’ s conduct in gamering excess profit from plain tiff and class

members that plain tiff and class rhembers did not contract for or consent to pay.

The in jury to plain tiff and the class members is substantia l. Due to AT&T ’ s

fraudulent and unfair representations, plain tiff and the class members disposed of money

that was charged in the form of the im proper month ly Tech 360 fee. This is not outweighed

by the utility , if any, of AT&T ’ s conduct in gamering excess profit through the Tech 360

serv ice fee that plain tiff and the class members did not contract for or consent to pay.

Plaintiff and class members could not themselves have reasonably avoided th is harm due to

AT&T ’ s m isrepresentations and because AT&T did not disclose the in formation plain tiff

and class members would need to discover the harm to them .

AT&T ’ s m isrepresentations and fa ilures to disclose material facts about the

Tech 360 fee were likely to deceive an ord inary consumer given AT&T ’ s

m isrepresentations and om issions regard ing the nature of the Mobile Business Plan and the

Tech 360 service.
