1. It has been difficult to get an answer from Ill Corps concerning MOUT Site, Range, Training Area, and Billets. Due to the fact tha G3, Ill Corps has been the only senior officer in the headquarters (he is the on one we given full understanding of mission), the requested availability has not been quickly forthcoming. After numerous phone calls, we finally got an answer at 1400 today-not the one we were looking tor: That the resources were totally booked for days we requested.

2. I immediately calle fed him the information as the briefing in Washington is Thursday (tomorrow). asked him if he wanted us to try to use a "priority" and get those who had reserved the MOUT site to postpone their training. He said there was no telling even if the overall concept was going to be approved and he counselled "wait until after the briefing." He would notify the Houston SAC who was going to brief.

' ® 3. I called • back at 1545 to ask who had the MOUT and could we also get billeting if we pushed. He said that there was 2000 extra people at Hood doing a big SINGARS test and billeting would definitely be a problem. He indicated that 1 CAV Headquarters had the MOUT site. I asked him why the division headquarters was in there-he responded that they are only using it to "live" in. So I asked him to see if they could find someplace else and give us the .site.

4. Since we were playing phone tag and 20 questions each time, I asked him to go proactive on the whole thing-"Find out when it is available-maybe March 4-6; Can we get priS'rity over 1 CAV TOC; and Is i\.$till available Feb 18-20, the original dates?" He will also check the question on the billeting, range, and training area and get info by Thurs morning.

5. Although Ill Corps has been courteous, I have been frustrated by the dismal slowness to get answers and almost recommended we have the , Ill Corps COFS, who just arrived back from NTC today. OSN 737-7509. I

2. You are hereby·appointed as an investigating officer under the provisions of AR 15-6 to inquire 'into the possible violations of AR ·37-1, "Army Accounting and Fund Control." Details of the possible violation are provided in. the enclosed memorandum.

3. You will conduct an informal investigation IAW AR 15-6 to determine the facts surrounding the alleged violation of regulation and law. You will gather sufficient pertinent facts to render a detailed report with all dates, funds and personnel

·/identified and applicable substantiating documents included. All statements will be taken on aDA Form 2823 and then·will be properly sworn. Your findings and recommendations will be reported on a DA Form 1574.

4. You must first conduct a preliminary review to gather all facts concerning this case. A preliminary report must be submitted stating the facts of the case and determining whether a violation has apparently occurred. This report must be submitted to the Army Guard Comptroller (NGB-ARC) by 30 Sep 95.

5. If your preliminary review finds a violation has apparently occurred, then a complete investigation must be accomplished. Information on conducting an investigation of a possible antideficiency act violation and a checklist for investigating officers is included in reference lb. If a complete investigation is required the report ~ust be submitted by 27 Oct 95 to NGB-ARC.

ANSWER: The military assistance provided to LEAs can be separated into four areas. National Guard units conducted six surveillance overflights of the Branch Davidian compound in January and February 1993; U.S. Army Special Forces assigned to JTF-6 conducted training for ATF agents in late February, 1993; Texas National Guard counterdrug personnel conducted an aerial diversion on the day of the raid on February 28, 1993; and post-raid support to the FBI and the ATF.

1. Texas National Guard overflights in UC 26 counterdrug aircraft took place on 6 Jan, 3, 6, 18, and 25 Feb 93. An Alabama National Guard UC 26 conducted an overflight on 14 January. These missions were intended search for armed guards and drug manufacturing facilities. (HR 104-79, p. 63-64) .

2. A Special Forces Rapid Support'Unit, attached to Joint Task Force-61 (Operation Alliance), trained members of the ATF on 25-27 February, 1993, in company-level tactical command and control, medical evacuation training, IV ABC's, and assistance with range and MOUT sites. No non-METL training. special operations training I close­quarters battle training (SOT I COB), or direct involvement in actual planning occurred. (HR 104-79, P.64)

1 JTF -6 was created in 1989 to serve as the planning and coordinating (operational) headquarters for military assistance to counterdrug operations of drug law enforcement agencies. JTF-6 is located at El Paso, TX (Ft. Bliss) and supports the Federal, .State, and local· law enforcement agencies within the southwest border region. It's region of responsibility as of 1 Ocr 95 included the entire continental U.S., Puerto Rico, and the U.S. Virgin Islands. (FROM HR104-79, P. 187, note 160)

3. The ATF requested and received 3·Helicopters and 10 counterdrug personnel from the Texas Air National Guard. These personnel conducted an aerial diversion the day of the raid on February 28, 1993 (HR 104-79, P.65).

4. Post-raid support to FBI and ATF included a limited number of ac:tive duty as well as Texas National Guard personnel. Active component · troops provided support consisting primarily of performing repairs . and maintenance on sophisticated observation and electronics equipment. Almost all of this equipment was operated by the FBI. .· One piece of equipment (electronic jamming equipment to interfere· with television reception within the compound) was operated by DOD civilian personnel (Hearings, Part 3 of 315, statement o-- I .-a 31 JUL 95 and; H~ 104-79, note 359). Nation~ -personnel helped perform maintenance on loaned vehicles and equipment (referenced specifically in later question), provided remedial training to FBI members who were to operate the Bradley's and CEVs, and provided troop services (e.g. cooks). (HR 104-79, P.82-83). Specific equipment lists and providers appear in the GAO report, "Military Assistance Provided at Branch Davidian Incident," GAO/NSIAD/OSI-99-133, August 1999. (pp. 27-29).

5. Advice/Consultation by Military Officers. 1 Senior Army officer wen~ to WACO on 13 APR 93 on the invitation of the HRT commander. This visit was in preparation for a meeting with Justice Dept. officials on 14 APR 93. This officer and another senior Army officer met with Justice, FBI, and the US Attorney General on 14 APR 93. They were there to answer questions that AG Reno might pose about the FBI's

. plan. The officers knew they were there because of their particular training, experience, and relationship with the HRT. They informed Reno they could not comment on specific FBI plans to end the standoff. Comments were provided on maintaining HRT readiness and ending a barricade situation as part of a military operation in a foreign country. (HR 104-79, P.85)

C. QUESTION: SPECIFICALLY, HOW MANY "SPECIAL OPERATIONS" PERSONNEL WERE PRESENT AND/OR INVOLVED IN THE OPERATION.

ANSWER: (Responds to all sections of Question # 1) SOF had three roles: trainer, observer, and technical assistance.

10, United States Code, Section 373) under control of Joint Task Force 6, that trained the Bureau of Alcohol, Tobacco and Firearms (ATF) in counterdrug training, including communications, medical evacuation, frrst aid and firing range support. That training was completed prior to the ATF attempt to issue search warrants on 28 Feb 93. SOF also conducted training for federal agencies from the FBI in use of surveillance equipment. · ·

.• Observer - SOF had observers (in varying numbers from one to four) throughout much of the FBI siege period (starting approximately 5· Mar 93) to gather lessons learned for use in future military operations.

• Technical assistance- SOF had two technical support personnel from approximately 4 Apr 9.3 through the FBI operation on 19 Apr 93 .. SECDEF approved via 192230Z MAR 93 CJCS message, loan of a remote observation post (OP) with two technical advisors. Restraining guidance: Equipment could be used for defensive purposes only; operators could demonstrate use and provide technical assistance but could not provide tactical advice nor direct support to ·taw enforcement operations. (From S/FP message 192230Z MAR 93).

On 19 Apr 93 (the day of the FBI operation) there were three (3) SOF personnel vicinity the FBI field headquarters - one observer plus two personnel who provided technical assistance on troubleshooting and maintenance of surveillance equipment.

At no time were any SOF personnel on site involved with tactical planning or execution of any law enforcement activity.

ANSWER: Much of the day-to-day support the Department of Defense gives to Law Enforcement Agencies (LEAs) is provided pursuant to statues that require· agencies to reimburse the Department for their use of our equipment and th~ services of our personnel. As is the case with many departments of the Federal Government, DoD has well-defmed authority , for example, in chapter 18 -of . · · · title 10 of the U.S.C or under the Economy Act iri title 31 of the Code, to provide support to other agencies on a reimbursable basis. V. REQUEST PROCESS

A. QUESTION: PLEASE DESCRIBE THE PROCESS THAT WAS USED TO ENLIST MILlTARY SUPPORT INCURRED AT WACO •

ANSWER: Reference HR 104-79, pp. 60 and GAO report, p. 4. Law . enforcement agencies (LEAs) operating in Texas may obtain military assistance for investigations having a counterdrug component from the Texas National Guard counterdrug program. This program can provide investigative support services, from aerial reconnaissance to logistics. Requests for support must . · · cite in writing a suspected drug connection., LEAs may also seek military counterdrug assistance via Operation Alliance. (GAO report, p.4) When an LEA requests counterdrug military assistance along the Southwest border, that · request is received and reviewed by qperation Alliance, which ·acts as the clearinghouse. The request is then coordinated with support organizations such as JTF-6, NORAD, the Regional Logistics Support Office, and the pertinent National Guard organizations. Operational support is provided as a joint effort by JTF-6, NORAD,.and the National Guard. Non-operational support, that would include, but is not limited to, equipment, institutional training, and use of facilities, would be provided by the Regional Logistics Support Office. To receive assistance through Operation Alliance and from these organizations, the civilian law enforcement h!vestigation must involve criminal violations of U.S. drug laws, i.e. , have a =drug nexus." This is authorized under section 1004 of the National Defense Authorization Act of 1991, 10 U.S.C. 373 (P.L. 101-510). (HR 104-79, pp. 60)

B. QUESTION: PLEASE DESCRIBE HE APPROVAL CHAIN THAT AUTHORIZED MILITARY SUPPORT TO WACO, WHAT WAS REQUESTED, AND WHO APPROVED EACH/ANY REQUEST.

ANSWER: (GAO report, pp. 6-13) ATF made two requests for military counterdrug support. One was made directly to the Texas National Guard counterdrug program, and the second was made to Operation Alliance, which approved and foxwarded the request to the Texas National Guard and Joint

. Task Force Six for their consideration. DOD provided this support under section 1004 of the National Defense Authorization Act of 1991 (P.L. 101-510). The Texas National Guard also provided counterdrug support under 32 U.S.C. 112. (See answer to question VI for a more detailed discussion of legal aspects of this support).

VI. POLICY AND LEGAL FINDINGS A. QUESTION: PLEASE DESCRIBE THE LEGAL STATUES THAT APPLIED TO MILITARY SUPPORT REQUESTED FOR THE 1993 WACO OPERATION.

ANSWER: The basic statutory authority for Defense Department support to: law enforcement agencies lies in Chapter 18, Title 10 of the United States· ~ode; Section 1004 of the National Defense Authorization Act for Fiscal Year 1991, Pub. L. No. 101-510, as amended; and Title 32 United States Code Section 112. An explanation of those provisions is provided in Appendix II of the recently. released GAO report, "Military Assistance Provided at Branch Davidian · Incident," GAO/NSIAD/OSI-99-133, August 1999.

B. QUESTION: ARE THERE ANY EXAMPLES OF MILITARY SUPPORT PROVIDED IN 1993 AT WACO THA1 WERE OUTSIDE THE LEVEL OF SUPPORT AUTHORIZED IN LEGAL STATUES?

ANSWER: The recently released GAO report, "Military Assistance Provided at Branch Davidian Incident," GAO/NSIAD/OSI-99-133, August 1999, undertook a detailed review of military support to the FBI and ATF at Waco. The report fmds that the various types of support provided at Waco qualified as either military assistance to civilian authorities or support for civilian counterdrug activities.

C. QUESTION: WHAT OTHER LEGAL AUTHORITIES ARE THERE FOR MILITARY INVOLVEMENT TO SUPPORT LAW ENFORCEMENT IN DOMESTIC ACTIVITIES?
