FCPA Blog January 3, 2011 As you can see, Washington's determination regarding FCPA enforcement fines is beyond question. And 2011 looks set to be equally worrying for the industry. With the UK Bribery Act starting in April, is getting your compliance strategy in order going to be one of your key New Year's resolutions? Well, you're definitely not alone… As you know, failure to comply with either law could cripple your company. And land you in prison. And with differences, albeit small ones existing between the two Acts, can you be 100% sure your policies will be good enough to protect you?

Introducing

Plus, he'll delve into the intricacies of adapting your existing FCPA policies to comply with the UK law, to guarantee you leave the event secure in the knowledge that you know exactly how to protect your company from both the FCPA and UK Bribery Act.

SANTA'S ELVES VISIT THE HOUSTON FOOD BANKBy Marcella Vaughan, C.E.Greater Houston Expediting Management Association

thIn the United States, the 4 Thursday in November, Thanksgiving, is the “official” kickoff to the holiday season, which is a time of giving. In that spirit, the Greater Houston Expediting

thManagement Association, “GHEMA”, spent the morning of Saturday, December 4 at the Houston Food Bank helping ready boxes for distribution to the needy.Teamed with a bible study group from Texas A&M, a total of 14 GHEMA members and their families worked the assembly line with efficiency, energy and song. While tasked with packing only 20 pallets of boxes loaded with the dry and canned fixings to help fill an empty pantry, GHEMA and Texas A&M went above and beyond and completed 25 pallets. That meant that many more underprivileged Houstonians would not go hungry during the Christmas holidays. From Robert Woodum who built the boxes, ably assisted by Samantha Salinas, to Tony Bringol who tossed cans of cranberry relish into those boxes, each person found themselves armed with canned or boxed goods to fight hunger in the Houston area. Food items consisted of cereal, canned fruits and vegetables, canned meat, spaghetti sauce, dry milk and juice, to name a few.The team packed those boxes merrily, all the while singing and talking. Led by EMA Vice President Jocelyn Kocab, Christmas carols rang out to fill the warehouse with joyful noise, even if the words sometimes escaped the group. It was amazing how many songs Jocelyn knew and the fact that she remembered all the words! Humor had a foothold as well, especially when a member would start a song that wasn't known to some of the people only to hear it trail off into made-up lyrics. This truly helped to keep morale so high that we had to be told to stop work. At the end of the day, GHEMA boxed 5,907 meals for Houston's hungry which meant fewer people spent even one day without food.It was a renewal of the human spirit to spend those hours knowing that someone in need would benefit by our small sacrifice and also extremely rewarding to see so many other people or groups had the same idea and filled the building with helpers that Saturday.

SANTA'S ELVES VISIT THE HOUSTON FOOD BANK

PEOPLEAlthough the economic recovery continues at a snail's pace, we are very pleased that our membership is still slowly growing, and that our training program continues to attract participants. In January, we welcomed two new members, both from the Houston area. They are Reida Lewis, an expeditor at Technip USA, and Jorge Gonzalezrubio, a Senior Quality Professional at KBR. We also enrolled Ron Stiles from Conroe, Texas, an Expediting Specialist with Bechtel. All of them attended the Training classes offered in January, after learning about the EMA and the classes from other members.February, to date, has given us one new member, this time in Calgary. Eva Daxner, who works at Worley Parsons, learned of the Training classes to be given in Calgary from an expeditor friend, and decided to not only attend the classes, but also to join the EMA. A very warm welcome goes out to all four of our new members!

Congratulations go out to our newest Certified Expeditors. They are Lutgardo Lopez, C.E., who is at Jacobs in Calgary, Reida Lewis, C.E., Jorge Gonzalezrubio, C.E., and Marcella Vaughan, C.E., who works at Fisk/MEI in Houston.

WILD ROSE HAPPENINGSBy Mike Klamer, C.E.M.

Greetings from the frozen North! The weather is cold (really, really cold!), but the activity is heating up. In the coming months there are several large-scale energy projects scheduled to be initiated in Alberta. We expect that the demand for professional, qualified Expeditors will be amplified and believe that our members are in the best position to take advantage of the improving market. Some industry analysts are predicting that 2011/2012 will be even more active than 2008! That was a year when we were begging some of our vendors to take on work and they dictated the pace of projects based on their shop schedules. Expediting was at the center of project activity since our vendors' deliverables were often the critical path items at the center of multi-billion dollar projects. I personally have hope that the 1980s era bumper stickers will make a comeback: “Please God, let there be another Boom. I promise I won't p*** it away this time!” I think most of us who have lived through the boom/bust cycle once or twice (or more) are hoping for a robust economy. However, we are also hoping that sanity prevails and that there is a sustainable level of activity.

In Chapter news … recently, the EMA Wild Rose Chapter asked our members to complete an on-line survey. They were asked a range of questions designed to assist the Wild Rose Board in planning meaningful Chapter events in the future. Members were asked about what kind of Chapter activities they'd like to see, the frequency of those activities, the timing of events and what their recommendations would be to improve the Chapter. Thank you to those who took the time to complete the survey. Your input has already been taken into account as we plan future Chapter events.

On Wednesday, February 2, 2011, the EMA Wild Rose Chapter hosted representatives from Westpower Pumps in Calgary, Alberta. Westpower re-visited their presentation from the 2010 EMA Annual Workshop/Conference entitled “Expediting from a Vendor's Perspective”. The intent of this presentation is to put the Expeditor into the vendor's shoes in order to improve the expediting job performance. When we know what our vendor's primary drivers are, it can help us to be more effective in looking for a win-win outcome. In addition to the presentation by Westpower, Denis Murphy delivered the first module from the EMA continuing education courses, entitled “The Image of Expediting”. We hope to present more continuing education sessions in the future.

ndSometime in March, the Wild Rose Chapter will be holding our 2 (what we hope will become “annual”) “Shop Crawl”. This will entail a shop visit to a local vendor's facility followed by a social event. Details are shown elsewhere in this issue.

thFinally, we are planning to hold the EMA Basic & Advanced Training sessions in Calgary (Basic on February 19 ,

thAdvanced on March 19 ). If you or someone you know are interested in attending these training sessions, please contact Denis Murphy ( ) or Mike Klamer ( )[email protected] [email protected]

EXPERT TIPS FOR GETTING AHEAD

Moving up, getting ahead, climbing the ladder, making positive changes it all sounds good, but sometimes it seems only a chosen few ever actually make it happen. Here, from a successful author and executive search consultant, are a few tips for career success:

á Take responsibility for your own development especially important in the current business environment, where many companies have cut back their training budgets.

á Set a clear goal for yourself it's hard to have a career strategy if you don't have an idea where you want to go.

á Think in terms of maximizing your contribution to your employer how does the work you do support your company's goals?

á Be aware of what your employer and the client want and need and dedicate yourself to supplying it.

á Make a point of working well with others. Working with and through others is requisite to creating and producing results.

á Commit to improving your communication skills whether listening, presenting, persuading, or understanding messages.

á Expand your experience. Talk to your boss about opportunities on projects or assignments outside your everyday role.

á Reach out to a mentor.á Get involved in groups and professional associations to broaden your network. Taking a

leadership role will polish your expertise and enhance your resume.

THE ELUSIVE HEALTH BALANCE… AND HOW TO CATCH IT!

When I think of balance, I think of the scales of justice. Too much may be weighed on one side and then there's a desire to put something on the other scale to even things off. Life is like that. You do too much at home, at work, and then feel out of balance. Some of you may feel resentful or just plain tired, and you want to place something on the side of the scale marked “Time For Me”. Being aware that you're at that point is important so that work days don't become sick days. There's something exciting and addictive about being busy, feeling productive. There's a “rush” that comes with working under the wire, dashing from place to place, appointments packed one against another, or sitting at a computer until midnight. The next morning you may very likely start the whole process over again.Workaholism is a major problem of our society. It is responsible for the breakup of marriages and causes physical and mental problems. The casualties are your health, your family, your friendships and your enjoyment of life. Yet, while many of you instinctively know this….There are ways to help you change negative patterns. You can still get your work done at the office and at home and yet include your own name on your “to do” list. While being super-organized is important in order to achieve time for you, the following tips will enable you to cope with all your tasks and still feel energized, motivated and ready for challenges.

Focusing on your breathing stops your mind from racing and brings calmness. For about a minute, notice the air coming into your lungs and going out. Give yourself permission to think of nothing else except your breathing. If you like, you can take a slightly deeper and slower breath to enhance the exercise. Repeat a few times a day. Deep breathing practiced daily can reduce stress, insomnia, headaches and cholesterol.

One simple way to get off the merry-go-round is to slow down, or practice mindfulness. It's the opposite of mindlessness, when we go about our daily life with our mind always residing in the future or the past, but seldom in the present. Focussing on the present moment helps to slow your pace. As a result, you may notice a feeling of being in control and an enhanced enjoyment of life.Allow little things to have an impact on you. When you're driving home, can you notice a spectacular sunset and then allow its beauty to somehow reach you? If you see a laughing child or a brightly painted room, do you just glaze over? Try to really see it and feel it. Savour the delicious taste of an apple or a piece of chocolate. These small acts can make your days of your life special in some way.I challenge you to try these simple techniques each day deep breathing, slowing down, and focussing more on the moments.Rosalie Moscoe was a presenter at our annual Workshop/Conference in Toronto in 2001 and since then has kept in touch, sending us articles from her newsletter “Health in Harmony”.
