This 13th annual one day festival will take the theme of the "Dynamics of Modem Korean". Festival highlights include live music and performances through the day, an Olympic style Tae Kwon Do Black Belt Tournament, a food and wine pavilion, traditional souvenirs and gifts, face painting and crafts for the kids and a photo booth with traditional costumes to wear.

SUBJECT: WESTRAY CRIMINAL CODE AMENDMENTS

PURPOSE: To provide the Committee with information on the Westray Criminal Code Amendments

RECOMMENDATION:

1. THAT the Committee receive this report for its information.

REPORT

At its open meeting of March 10, 2014 Council received as a delegation Mr. Ron Corbeil, the Health, Safety and Environmental Coordinator of the United Steel, Paper and Forestry, Rubber, Manufacturing, Energy, Allied Industrial and Service Workers International Union. Mr. Corbeil presented two short videos noting that more than 1,000 Canadian workers are killed each year at work, and suggesting that the Westray Criminal Code amendments that hold employers criminally accountable for the health and safety of their workers are not being utilized.

Mr. Corbeil requested that Council adopt the following resolution:

"WHEREAS it has been more than two decades since the Westray mine disaster in Nova Scotia and a decade since amendments were made to the Criminal Code of Canada to hold corporations, their directors and executives criminally accountable for the health and safety of workers; and

WHEREAS police and prosecutors are not utilizing the Westray amendments, and not investigating workplace fatalities through the lens of criminal accountability; and

WHEREAS more than 1,000 workers a year are killed at work;

THEREFORE BE IT RESOLVED that this Council support a campaign to urge our provincial/territorial goverrunent, specifically the Attorney-General and Labour Minister, to ensure that:

• there is greater coordination among regulators, police and Crowns so that health and safety regulators are trained to reach out to police when there is a possibility that Westray amendment charges are warranted."

Arising from Council discussion, a motion was adopted that the resolutions be referred to the Executive Committee of Council for review.

Bill C-4S amended the Criminal Code to provide new rules attributing criminal liability to employers for failing to take reasonable steps to prevent workplace injury to their employees. It became law on March 31, 2004. The Bill C-4S amendments are often referred to as the "Westray Amendments".

The impetus for Bill C-4S was the 1992 Westray coal mine disaster in Nova Scotia in which 26 miners were killed as a result of a methane gas explosion in the mine. Prior to the disaster, serious safety concerns had been raised by employees, union officials and government inspectors, but few changes had been instituted by the mining company to address these concerns. Criminal charges, including manslaughter charges, were brought against the company and certain of its managers. The criminal prosecutions were pursued through the Courts but ultimately no convictions were obtained. A Royal Commission ofInquiry was establlshed to investigate the disaster and its recommendations included those that were advanced through Bill C-4S.

The key provision introduced into the Criminal Code under Bill C-4S is s.217.1:

"217.1 Everyone who undertakes, or has the authority, to direct how another person does work or performs a task is under a legal duty to take reasonable steps to prevent bodily harm to that person, or any other person, arising from that work or task."

Being a matter of criminal law , s.217.1 investigations are carried out by the police and recommendations as to charges are made to Crown Counsel. As s.217.1 is a criminal offence, charges must be proved against the accused "beyond a reasonable doubt". In determining whether to proceed with charges, Crown Counsel determines whether there is a reasonable likelihood of obtaining a conviction.

Conversely, investigations of provincial workers' safety legislation, which generally govern this area of the law, are carried out by specialized workplace safety investigators rather than the

police. While infractions of the provincial legislation can be prosecuted by Crown, the legislation often provides for the imposition of "administrative penalties" by the provincial body that administers the provincial legislation, and the imposition of higher employer assessments. Additionally, prosecution of provincial worker safety legislation does not attract the rigorous standard of proof required to secure a criminal conviction, so securing a conviction is not as difficult.

According to the website of the Canadian Centre for Occupational Safety there have only been eight cases where s.217.1 has been applied in a criminal prosecution. Of these, four resulted in convictions, one in a guilty plea, one in an acquittal, one in the Crown dropping charges, and one in a plea bargain whereby the accused pleaded guilty only to charges under the applicable provincial worker safety legislation.

An application request for $7,000 has been received from the Ethiopian Community Association of BC for the Ethiopian Community Festival 2014 August 9 at Swangard Stadium. This annual event includes an Ethiopian coffee ceremony, Ethiopian cultural dance, live entertainment, a market place, cultural displays, food vendors and sampling, and a children's activity tent.

The Ethiopian Community Association of BC supports landed immigrants and new Canadians with information, advice, and guidance to facilitate the integration of Ethio-Canadians in British Columbia and to foster the retention and development of their cultural heritage within the framework of multiculturalism.

annual one day festival will take the theme of the "Dynamics of Modem Korean." Festival highlights include live musi6 and performances through the day, an Olympic style Tae Kwon Do Black Belt Tournament, a fbod and wine pavilion, traditional souvenirs and gifts, face painting and crafts for the kids and a bhoto booth with traditional costurnes to wear.

The Korean Cultural Heritage Society is a non profit organization which serves to promote multiculturalism and celebEI te Korean culture and heritage. Since 2002 the Korean Cultural Heritage Society has organi ed the festival which serves as a vehicle to unite community and promote businesses and org 'zations that aim to reach the Korean Canadian demographic.

Dear Sir/Madam:

Please accept this letter from Burnaby Seniors Outreach Services SOCiety as our application for a financial grant from the City of Burnaby.

"Growing old is not for the faint of heart!" I'm sure that many of us have chuckled over this aphorism; that is, until we are seniors and experiencing those life altering changes and losses which, at times, can be so overwhelming. Those golden years, when annoying aches and pains give over to serious physical health concerns; when our social support network shrinks as family and friends become less available to us through distance, death, and incapacity; and the opportunities to make new connections diminishes. The meaningful roles which once defined our purpose in life, our self-worth, are no longer open to us.

Facing these changes and losses can be unbelievably challenging, and coping with them and moving on does take courage. Sometimes it takes a listening ear and a helping hand to overcome the feelings of loss, loneliness, and depression associated with widowhood, serious health problems, social isolation, and increasing personal dependence.

Since our inception in 1987 as a non-profit organization, the Burnaby Seniors Outreach Services Society (BSOSS), through our peer counselling and related activities, has been committed to:

• supporting the emotional well-being of seniors experiencing emotional difficulties;

• helping seniors deal more effectively with people; • aSSisting our clients to access appropriate community programmes and services;

• developing social support networks; and, • maintaining the greatest level of independence and dignity possible.

Our services, provided without cost to the senior, include one-to-one supportive counselling, facilitated

peer support groups, community outreach, professional consultation, education, information dissemination, referral as needed, and meaningful volunteer opportunities for seniors. Many of our services are not available elsewhere in the community.

Our programmes include:

• Peer Counselling - a confidential one-to-one supportive service to seniors facing emotional stress because of life changes;

• Communications and Counselling Skills Training - an extensive course for the volunteer peer counsellors;

• Reconnections - an experience of self-discovery and personal growth which assists seniors to develop or enhance the skills and confidence they may need to find purpose or reconnect into the community after they have experienced a significant loss; and,

• Burnaby Family Caregivers Project - a programme which offers information and group support to help alleviate the stress of those providing care to aged or disabled family or friends.

The society is directed by a voluntary Board, all of whom are seniors, coordinated by part-time staff, and functions with a dedicated group of service and administrative volunteers.

Our premise is that seniors are uniquely qualified to provide support and encouragement to other seniors who are struggling to cope with significant losses and changes in their lives. Extensive skills training combined with warm, caring personalities plus the knowledge, insight, and wisdom gained from lifetime experiences give the peer helpers the understanding, empathy, and patience to assist others.

The key to successful peer helping is the training in the fundamentals of empathic listening, counselling techniques, age-related issues, and community resources which we provide all our support volunteers. The opportunity to learn and do something meaningful and rewarding Is also of immeasurable value to the senior peer volunteers. They take away with them effective interpersonal and life skills to use for themselves and share with those with whom they come in contact on a daily basis. Because the. volunteers are themselves seniors, they are subject to the same losses and changes as their peers, and attrition is an anticipated occurrence. Regular training courses are essential to keep our volunteer corps strong.

At present we have 29 active trained counselors with 9 languages and cultures represented. We are able to serve people who have difficulty with English and whose religion and ethnic customs are very diverse.

It is projected that, within the next few years, the number of seniors in Burnaby will increase, with the most significant increases in the age group over 80 years. These are the same women and men who will be the most vulnerable to the life changing incidents which rob them of their ability to find the fulfilment in their later years which they deserve.

It is essential for us to maintain a vital programme and a well-trained body of volunteers to continue providing this support service which has been so highly valued in our community. Our volunteer service programme is a very cost effective way of providing benefit to those in need.

BSOSS funding comes primarily from special fund raising activities, membership dues, a Community Gaming grant and other government and foundation grants for specific programmes, and donations from individuals and community organizations.

The financial support from the City of Burnaby in previous years has been a significant factor in allowing BSOSS voll!nteers to give hope and guidance to more than 3000 Burnaby elder citizens. A financial grant once again this year, will help US in our efforts to maintain and enhance our regular

peer counselling programme.

· BSOS5 is a nc;m-profit, volunteer driven service organization, incorporated in May 1987 - #50022454.

· Mission: BS05S is dedicated to promoting the well being of seniors through the support of their peers.

· Purpose: To promote seniors' independence, self-esteem and the achievement of individual goals.

· BSOSS was incorporated under the B.C. Societies Act in May of 1987 as Burnaby Seniors Peer Counselling Society. The name was officially changed in 1991 to Burnaby Seniors Outreach Services Society to reflect a broader mandate and expanded services.

· BSOSS is directed by a voluntary Board of Directors all of whom are seniors.

• Target population: seniors in Burnaby experiencing difficulties resulting from isolation, loneliness, depression, abuse, grief, loss, anxiety, health and economic concerns, caregiver stress and other unresolved issues

• Methods: one-to-one supportive counselling, facilitated peer support groups, community outreach, Consultation, education, research, information dissemination, referral when necessary to issue specific community agencies and professionals

• Programmes: Seniors Peer Counselling; Reconnections (Reconnecting Seniors Into The Community); Burnaby Family Caregivers; Outreach--into community-based seniors programmes; Annual Caregiver Resource and information Fair

• Training: extensive training and follow-up provided in communications and counselling skills and Age­related issues to Senior Peer Counsellors; education/information series for family and friend (unpaid) caregivers and the general public

• Volunteer opportunities: seniors do something personalty enriching, meaningful, useful and stimulating through peer helping and Board direction

· Referrals: self referrals; concerned family or friend; Fraser Health Home Health and mental health case managers; family doctors; psychiatrists; hospital social workers; home support agencies; other community organizations and agencies working with older persons; Senior Citizens Centres

· Personnel: Programme Director (13 hours per week); Programme Assistant (10 hours per week); Coordinator of Caregiver Programme (contract); Bookkeeper (contract)

· Peer Counselling Statistics 2013:

One-to-one supportive counselling has been provided by 16 - 21 Peer Counsellors while 4 Peer Counsellors provide supportive services within multi-level care facilities, a seniors centre and ethno­specific communities.

In 2013 we provided 96 individual seniors with peer counselling, an average of 34 individuals receiving visits at anyone time.

In 2013 63 new referrals were accepted.

Peer Counsellors report an average of 200 hours of volunteer service each month.

Support has been provided to approximately 500 additional individuals-seniors or their family-which have not resulted in a peer counselling assignment but which have required research and/or resource information.

Two training courses in Communications and Counselling Skills were offered with 16 participants graduating and available to accept peer counselling referrals.
