The Director-General submits this document to the Executive Board pursuant to 174 EX/Decision 31, 185 EX/Decision 33, 186 EX/Decision 17 (I and II), 188 EX/Decision 12 and 36 C/Resolution 108 in which new Directives concerning UNESCO’s partnership with non-governmental organizations were adopted. The reclassification of UNESCO’s partner NGOs is submitted to the Executive Board for decision or information, as the case may be, pursuant to the new Directives.

In accordance with the Directives concerning UNESCO’s relations with foundations and similar institutions, the Executive Board is informed of the admission of new foundations to official relations.

This document is to be considered with document 189 EX/NGP/2.

INTRODUCTION

1. In order to strengthen ties between UNESCO and non-governmental organizations (NGOs), the Committee on Non-Governmental Partners will meet under the chairmanship of Egypt at the 189th session of the Executive Board to consider various issues under the item entitled “Relations with non-governmental partners”.

2. Section I of this document concerns the implementation of the new Directives concerning UNESCO’s partnership with non-governmental organizations (NGOs) and deals, in particular, with the reclassification of UNESCO’s partner non-governmental organizations into two partnership categories, namely consultative partnership and associate partnership.

3. Section II of the document provides Executive Board with information on the three foundations admitted by the Director-General to maintain official relations with UNESCO since the 186th session of the Executive Board. Section III refers to the new terms of reference of the Committee on Non-Governmental Partners. Lastly, Section IV of the document provides information on other aspects of cooperation with NGO partners.

I. IMPLEMENTATION OF THE NEW DIRECTIVES ON UNESCO’S OFFICIAL NGO PARTNERS

4. At its 36th session, the General Conference adopted in 36 C/Resolution 108 new Directives concerning UNESCO’s partnership with non-governmental organizations. Those Directives establish the enabling framework for the optimum conduct of partnerships that UNESCO wishes to maintain with NGOs in order to make non-governmental organizations official partners in the formulation and implementation of UNESCO programmes. The new Directives, which supersede the previous Directives, provide, in particular, for the transition from three relational categories (operational, formal consultative and formal associate) to two partnership categories, namely consultative partnership and associate partnership.

5. Pursuant to Section XII.1 of the Directives, which concerns transitional measures, the reclassification of UNESCO’s NGO partners under the new Directives is submitted to the Executive Board for decision or information, as the case may be.

A. Non-governmental organizations admitted to associate status

6. Under Section III and Section lV.1. B of the Directives, the Executive Board shall decide on the admission of NGO partners to associate status for a renewable term of eight years, on the recommendation of the Director-General.

7. Accordingly, the Director-General recommends that the Executive Board admit 64 NGO partners to associate status.

8. Among the organizations proposed, 22 NGOs already maintain formal associate relations under the previous Directives. The Director-General also recommends that 42 NGOs that previously maintained formal consultative relations or official operational relations be reclassified in the associate status category. As a result of the analysis conducted on the file of each NGO partner and in view of their close collaboration with UNESCO and their influence on the Organization’s fields of activity, the Director-General considers that these 42 NGOs meet the criteria for admission to associate status. Individual fact sheets on all NGO partners proposed for associate status and listed below are provided in Annex I to document 189 EX/NGP/2:

9. The Executive Board is thus invited to decide the admission of a total of 64 UNESCO NGO partners to associate status.

B. Non-governmental organizations admitted to consultative status

10. Pursuant to Section II and Section lV.1. A of the Directives, the Director-General shall decide on the establishment of NGO consultative partnerships and shall inform the Executive Board once per year of the admission of new NGOs.

11. The Executive Board is thus informed of the Director-General’s decisions concerning the admission to consultative status of 283 NGOs listed in Part II of document 189 EX/NGP/2. Under the previous Directives, these organizations maintained formal consultative relations or official operational relations.

12. The Executive Board is also informed that since its 186th session, the Director-General has decided to establish consultative partnerships with the 21 new NGOs listed below, for which individual fact sheets are provided in Annex II to document 189 EX/NGP/2:

II. ADMISSION OF FOUNDATIONS

13. Under Section II and Section V of the Directives concerning UNESCO’s relations with foundations and similar institutions adopted by the General Conference at its 26th session and amended at its 28th and 29th sessions, the Director-General shall inform the Executive Board of her decision to establish official relations with foundations and similar institutions for a renewable term of six years. The Executive Board is therefore invited to note the Director-General’s decision to establish official relations for cooperation with the following three foundations:

• Amar International Charitable Foundation; • Centre for International Heritage Activities; • One Laptop per Child.

14. The individual fact sheets on these foundations are provided in Annex III to document 189 EX/NGP/2.

III. NEW TERMS OF REFERENCE OF THE COMMITTEE ON NON-GOVERNMENTAL PARTNERS

15. The Executive Board, in 188 EX/Decision 12, adopted new terms of reference for its Committee on Non-Governmental Partners. The new terms of reference include, on the one hand, improvement in the Committee’s thematic debates with its partners in order to increase efficiency and the participation of new civil society stakeholders in the Committee’s work and, on the other hand, the implementation of the new Directives in a spirit of openness, in particular, in those parts of the world where civil society remains isolated or fragile.

IV. OTHER ASPECTS OF COOPERATION WITH NON-GOVERNMENTAL PARTNERS

16. The NGO-UNESCO Liaison Committee staged an “NGO Day” on the theme “New Directives: what are the prospects for strengthened NGO-UNESCO cooperation?” on 5 December 2011 at UNESCO Headquarters. In her address to the 117 NGO representatives participating at the event, the Director-General stressed her strong commitment to cooperation between UNESCO and civil society. Mr Bernard Loing, President of the NGO-UNESCO Liaison Committee, and Mr Eric Falt, Assistant Director-General for External Relations and Public Information, too, opened the meeting. Discussions focused on ways and means of implementing and strengthening partnerships under the new Directives and on the organization of the forthcoming international conference of NGOs scheduled for late 2012. A representative from the International Organisation of La Francophonie (OIF) gave an operational account of OIF-NGO relations that was much appreciated by participants.

Decision proposed

17. After examining this document, the Executive Board may wish to adopt a decision along the following lines:

3. Appreciates the continued efforts of the Committee on Non-Governmental Partners to strengthen cooperation with NGOs in the various fields of UNESCO’s competence and at the international, regional and national levels;

UNIVERSAL FORUM OF CULTURES – NAPLES 2013

DRAFT FRAMEWORK AGREEMENT BETWEEN UNESCO AND THE FORUM OF CULTURES FOUNDATION

IN NAPLES

SUMMARY

In conformity with 36 C/Resolution 45, the present document includes the proposed framework agreement between UNESCO and the Fondazione Forum Universale delle Culture Napoli 2013 (Italy) as regards the organization of the next edition of the Universal Forum of Cultures, which will be held in Naples (Italy) in 2013. The proposed draft agreement is included in the Annex.

Any financial and administrative implications for 2012-2013 related to this event will be borne by the Fondazione Forum Universale delle Culture Napoli 2013 (Italy) and by the relevant local authorities. This proposal will have no budgetary implications for UNESCO.

I. Background

1. Building on the successful previous editions of the Universal Forum of Cultures (Barcelona, Spain, 2004; Monterrey, Mexico, 2007; and Valparaiso, Chile, 2010), by 36 C/Resolution 45 the General Conference of UNESCO at its 36th session (October-November 2011) approved the principle of holding the Universal Forum of Cultures in Naples, Italy, in 2013, on the basis of the proposal submitted by the Government of Italy. The text of 36 C/Resolution 45 reads as follows:

“The General Conference, Having examined document 36 C/COM CLT/DR.2, Having taken cognizance of the decision of the city of Naples to hold the Universal Forum of Cultures

– Naples 2013, Considering with satisfaction the great significance and success of the Universal Forum of Cultures –

Barcelona 2004 and the close links between its objectives and those of UNESCO, Also considering the excellent results of the Monterrey 2007 Forum and the Valparaiso 2010 Forum, Further considering that the organizers of the Forum of Cultures – Naples 2013 propose that

UNESCO should be their main partner, and convinced that this operation would be particularly fruitful for the attainment of common goals,

Noting, in this respect, that the costs of the Naples 2013 Forum will be fully covered by its organizers, and that this cooperation will therefore have no budgetary implications for UNESCO,

1. Approves the principle of holding the Universal Forum of Cultures – Naples 2013; 2. Delegates to the Executive Board at its 189th session, the endorsement of a draft framework

agreement between UNESCO and the Forum of Cultures Foundation in Naples”.

2. In consideration of the close links between the objectives of the Forum and those of UNESCO and in accordance with the previous editions of the Forum, the Fondazione Forum Universale delle Culture Napoli 2013 (Italy) proposed that UNESCO, within its field of competence and its expertise, should be its main partner in the organization of the Forum and be closely associated to the event.

3. The Fondazione Forum Universale delle Culture Napoli 2013 in Naples was officially established in 2009 in accordance with Italian legislation. Its founding partners are the local public authorities in Naples (Region Campania, Province and Municipality of Naples), with the participation of the Italian Ministry of Foreign Affairs.

4. The Forum will be held from 10 April to 21 July 2013 in a vast area comprising: (i) the Historic Centre of Naples, inscribed on the UNESCO World Heritage List since 1997; (ii) the recently renovated landmark area of modernist architecture located in the Mostra d’Oltremare; and (iii) the Science Centre/Città della Scienza. The neighbouring World Heritage properties of the 18th-Century Royal Palace at Caserta with the Park, the Aqueduct of Vanvitelli, and the San Leucio Complex; of the Archaeological Areas of Pompei, Herculaneum and Torre Annunziata; and of the Amalfi Coast, which are all located in the vicinity of Naples, will also be associated to the Forum event.

5. The 2013 edition of the Universal Forum of Cultures will take its inspiration from the ideals and principles of UNESCO and its main theme is: “Memory of the future: knowing one’s own roots in order to plan a common future”, with the overall aim to disseminate to the widest possible public the principles enshrined in the UNESCO Universal Declaration on Cultural Diversity. Furthermore, the sea was also included as a specific sub-theme, in order to engage on a reflection on social, cultural, political and economic aspects of coastal towns and maritime culture, particularly in the Mediterranean rim.

6. The Forum will be divided into three main sections: (i) dialogues, with a rich offer of lectures, public conversations and symposia on various topics related to the principles of the UNESCO Universal Declaration on Cultural Diversity (2001) and of UNESCO conventions in the field of culture; (ii) exhibitions, comprising five major exhibitions on archaeology, the Renaissance, cultural stratifications, contemporary African, American and European art, and on the topic “from war to human dignity”; (iii) cultural expressions, with a full programme of music, drama and

dance events, free performances and virtual events, drawing upon the 2005 UNESCO Convention on the Protection and Promotion of the Diversity of Cultural Expressions. Particular attention will be also to the renewal of historical centres and urban complexes, and to social inclusion policies (all events during the 101-day Forum will be open to all and totally free of charge).

7. The events that will take place within the Forum will be organized along the lines of an Action Plan, which will be prepared by the Fondazione Forum Universale delle Culture Napoli 2013 in close cooperation with UNESCO.

8. All financial costs linked to the organization of the Forum in Naples 2013 will be borne by the local authorities with no budgetary implications for UNESCO.

II. Proposed draft decision

9. Bearing the above considerations in mind, the Executive Board may wish to adopt a decision worded as follows:

The Executive Board,

1. Recalling 36 C/Resolution 45,

2. Having examined document 189 EX/18 Part II,

3. Taking into consideration the great significance of the previous editions of the Universal Forum of Cultures (Barcelona 2004, Monterrey 2007, and Valparaiso 2010), and recalling the close links between its objectives and those of UNESCO,

4. Approves the framework agreement between UNESCO and the Fondazione Forum Universale delle Culture Napoli 2013 proposed in the Annex of document 189 EX/18 Part II;

5. Authorizes the Director-General to sign on its behalf the framework agreement;

6. Requests the Fondazione Forum Universale delle Culture Napoli 2013 to finalize as soon as possible and in close cooperation with UNESCO the Action Plan of the Forum of Cultures 2013 in Naples.

ANNEX

DRAFT FRAMEWORK AGREEMENT CONCERNING THE UNIVERSAL FORUM OF CULTURES – NAPLES 2013

BETWEEN

The United Nations Educational, Scientific and Cultural Organization (UNESCO)

AND

The Fondazione Forum Universale delle Culture Napoli 2013, established in Naples (Italy) in 2009 among the Regione Campania, the Province of Naples (Provincia di Napoli) and the Municipality of Naples (Comune di Napoli), with the participation of the Ministry of Foreign Affairs of Italy.

Noting that the Universal Forum of Cultures – Naples 2013, an initiative of the Government of the Campania Region (Italy), the Province and the City of Naples, with the participation of the Government of Italy, seeks to facilitate dialogue among peoples, cultures and civilizations and to promote the values of peace and the principles of cultural diversity,

Considering that the event could make a significant contribution to building a culture of peace, to facilitating dialogue among peoples, cultures and civilizations, and to promoting the principles enshrined in the UNESCO Universal Declaration on Cultural Diversity,

Further noting that the planning, organization and staging of the Forum will be under the direction of the Fondazione Forum Universale delle Culture Napoli 2013,

Recalling 36 C/Resolution 45 adopted by the General Conference at its 36th session (2011),

Believing that UNESCO can make a decisive contribution to the success of the Forum through its missions, activities and links with institutions and professional circles throughout the world,

HAVE THEREFORE AGREED UPON THE FOLLOWING PROVISIONS:

1. The present framework agreement is intended to establish a framework for cooperation between UNESCO and the Fondazione Forum Universale delle Culture Napoli 2013 (hereinafter referred to as “the Foundation”) for the preparation and holding of and follow-up to the Universal Forum of Cultures – Naples 2013; it sets out the modalities of UNESCO’s association with the Forum, within the framework of the Organization’s competence and the priorities for its activities determined by its Member States; it covers the period of the preparation and staging of and follow-up to the Forum.

2. UNESCO and the Foundation shall keep each other informed of all activities of common interest that either may undertake.

3. In order to add to the Forum’s impact, UNESCO shall endeavour to ensure the broad dissemination of information on the objectives and activities of the Forum and to give them the greatest possible multiplier effect internationally.

4. The parties shall ensure that all activities undertaken in connection with the Forum are given a character distinct from that of an international exhibition, bearing in mind the 1928 Convention regarding International Exhibitions and that they are duly respectful of UNESCO’s values and principles.

5. The parties may, where necessary, conclude particular agreements between themselves or with other partners to implement specific activities involved in preparing for the Forum.

6. Subject to the availability of resources, UNESCO shall provide such technical services as may facilitate the achievement of the Forum’s objectives, in particular by mobilizing the expertise at its disposal, by providing the organizers with appropriate information, by facilitating contact between the latter and the professional circles which are its partners, and by facilitating the participation of interested international governmental and non-governmental organizations.

7. The Foundation may be given written authorization by the Director-General of UNESCO to use the name and the logo of UNESCO in accordance with the General Conference Directives established for the use of UNESCO’s name and logo. UNESCO’s name and logo shall not be used in any manner that would indicate or imply that UNESCO has any financial, managerial or legal responsibilities for the Forum. Nothing in this Agreement shall be interpreted as a waiver of UNESCO’s privileges or immunities.

8. The costs of the Forum shall be fully assumed by the organizers and UNESCO’s cooperation shall have no budgetary implications or any managerial or legal responsibilities for the Organization.

9. Each of the parties shall make available to the other appropriate facilities for the implementation of the present agreement.

10. The Foundation shall provide UNESCO with a final report of activities carried out under the present agreement.

11. This agreement shall enter into force once it has been signed by both parties; it may thereafter be amended by their common consent. One year after the close of the Forum, the framework agreement shall expire, unless terminated earlier. Each party shall have the right to terminate this Agreement by simple written notice in the event of breach thereof by the other party or due to events which may put UNESCO’s reputation at risk.

SUMMARY

In accordance with the relevant provisions of the Regulations for the general classification of the various categories of meetings convened by UNESCO, the Director-General submitted to the Executive Board, at its 187th session, proposals for invitations to the Meeting of States Parties to the 1970 UNESCO Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property (category II intergovernmental meeting), to be held at UNESCO Headquarters on 20 and 21 June 2012.

In pursuance of 187 EX/Decision 43, the Secretariat submits to the Executive Board, for approval, the list of invitations that the Director-General deems conducive to the work of the Meeting.

INTRODUCTION

1. In accordance with 187 EX/Decision 43, concerning “Invitations to the Meeting of the States Parties to the 1970 Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property”, it was decided that invitations to participate would be extended to all Parties to the Convention. Member States and Associate Members not Parties to the Convention, bodies and organizations of the United Nations system with which UNESCO had or had not concluded mutual representation agreements, other intergovernmental organizations and international non-governmental organizations may also send observers.

2. Moreover, 187 EX/Decision 43 also authorized the Director-General to extend any other invitations that she might deem conducive to the work of the Meeting of States Parties to the 1970 Convention, subject to the approval of the Executive Board at its 189th session.

3. Pursuant to 187 EX/Decision 43, the Director-General submits to the Executive Board, for approval, a list annexed hereto of the universities, research centres, institutions, professionals and art-market organizations and experts in the field that she proposes to invite to the meeting as observers. The Director-General points out that the list has been based, firstly, on regular contacts maintained by the Secretariat through action taken to combat trafficking in cultural property and, secondly, on the list of participants drawn up for the fortieth anniversary of the 1970 Convention (March 2011) and the 16th and 17th sessions of the Intergovernmental Committee for Promoting the Return of Cultural Property to its Countries of Origin or its Restitution in case of Illicit Appropriation.

Proposed draft decision

4. In the light of the foregoing, the Executive Board may wish to adopt a decision along the following lines:

1. Recalling the announcement made by the Director-General at the 186th session of the Executive Board in May 2011 that she would convene a meeting of States Parties to the 1970 Convention to review its mechanisms and implementation and to give it fresh impetus in order to combat trafficking in cultural property more effectively,

2. Recalling 187 EX/Decision 43,

3. Having examined document 189 EX/18 Part III,

4. Approves the list, submitted by the Director-General, of the invitations that she deems conducive to the work of the Meeting of States Parties to the 1970 Convention, as annexed to this document.

Following a recommendation by the Intergovernmental Committee for Physical Education and Sport (CIGEPS), to the Director-General, that preparations be made for the organization of the Fifth International Conference of Ministers and Senior Officials Responsible for Physical Education and Sport (MINEPS V) in 2013, and pursuant to Article 21 of the “Regulations for the general classification of the various categories of meetings convened by UNESCO”, the Director-General submits a list of proposed invitees to this Category II meeting to the Executive Board.

Financial implications: MINEPS V will be funded entirely by extrabudgetary resources.

BACKGROUND

1. The first International Conference of Ministers and Senior Officials Responsible for Physical Education and Sport (MINEPS) was held at UNESCO Headquarters in 1976. The forum was established to facilitate intellectual and technical exchange in the field of physical education and sport and as an institutional mechanism to articulate a coherent international strategy in this domain. Accordingly, the conference engages governments, organizations from the United Nations system and the sports movement. Since its creation, three MINEPS conferences have been convened by UNESCO (Moscow, Russian Federation in 1988; Punta del Este, Uruguay in 1999; and Athens, Greece in 2004).

2. The recommendations arising from these discussions have helped to build international understanding of the importance of the educational, cultural and social dimensions of physical education and sport. MINEPS has made substantial contributions to international dialogue on, and the establishment of a common platform for, the implementation of effective physical education and sport policies and programmes. For example, MINEPS played an important role in the development of the seminal International Charter of Physical Education and Sport (1978). This standard-setting instrument, which was amended in 1991 with the addition of Article 7 calling for the protection of ethical and moral values, remains a cornerstone of international cooperation in physical education and sport, establishing its practice as a fundamental right for all. The creation of the Intergovernmental Committee for Physical Education and Sport (CIGEPS) was another recommendation of MINEPS I. The Committee was established in 1978 to promote international cooperation, to drive government action in the field of physical education and sport, and as an institutional mechanism to ensure the implementation of the recommendations of MINEPS. Other key achievements of the Conference include the inception of the International Fund for the Development of Physical Education and Sport (FIDEPS), political endorsement of the Berlin Agenda for Action adopted by the World Summit on Physical Education, and the establishment of an Observatory on Women, Sport and Physical Education, as a category 2 centre under the auspices of UNESCO.1 MINEPS IV provided a valuable forum for the negotiation of the International Convention against Doping in Sport (2005).

MINEPS V

3. In its plenary meeting in June 2011, CIGEPS recommended to the Director-General that preparations are made for the organization of the Fifth International Conference of Ministers and Senior Officials Responsible for Physical Education and Sport (MINEPS V) in 2013. 2 CIGEPS underlined the timely nature of the proposal considering the time elapsed since the last conference (MINEPS IV, held in Athens in 2004), the global decline in physical education delivery, and the emergence of new challenges such as the management of major international sporting events and corruption, both on and off the field. The overall objective of MINEPS V is to take stock of international developments with respect to physical education and sport and to formulate strategies that accord with the principles of the International Charter of Physical Education and Sport, the Olympic Charter and other international instruments. Moreover, it is important to set an agenda for concrete actions by UNESCO and its Member States in the next Medium-Term Strategy. Accordingly, CIGEPS proposed the Conference concentrate on the following three thematic areas: (1) Sport as fundamental right for all (in the context of realizing the International Charter of Physical Education and Sport); (2) Promoting investment in physical education and sport programmes; and (3) Preserving the integrity of sport.

4. The Director-General launched the bidding process for MINEPS V in July 2011 with a view to designating a host country that would cover all costs, including interpretation, for the duration of the conference, the funding or secondment of one or more posts at UNESCO Headquarters to assist with all logistical arrangements, as well as the travel and accommodation of the UNESCO Secretariat 1 The Centre is not yet operational. 2 Report of the Intergovernmental Committee for Physical Education and Sport (CIGEPS) 2010-2011

to and from the Conference. Upon the deadline for receiving candidates, one Member State (Germany) had submitted a full proposal. While the Secretariat is studying the feasibility of holding the conference according to the criteria set by UNESCO, the Director-General submits to the 189th session of the Executive Board a list of proposed invitees, of which the chief participants will represent their governments, in accordance with Article 21 of UNESCO Regulations for a Category II meeting.

5. A report detailing the findings of the feasibility study, the Director-General’s decision and elaborated preparations for the conference will, subsequently, be submitted to the 190th session of the Executive Board for information.

PARTICIPANTS

(a) Member States and Associate Members (Article 21(1) of the Regulations)

6. The Director-General proposes that all Member States and Associate Members of UNESCO be invited to participate, with the right to vote, in the fifth International Conference of Ministers and Senior Officials Responsible for Physical Education and Sport.

(b) Non-Member States (Article 21(3) of the Regulations)

7. The Director-General proposes that those States which are not members of UNESCO but are members of one or more organizations of the United Nations system, be invited to send observers to the meeting. At the time of drafting this document, the list of such States was as follows: Holy See and Liechtenstein. It is also for the Executive Board to decide on invitations to the conference, as observers, States that may become members of any of the organizations of the United Nations system before the opening of the conference.

(c) International organizations (Articles 21(4) and (5) of the Regulations)

8. The Director-General reminds the Board that, under Article 21(4) of the Regulations, the organizations of the United Nations system with which UNESCO has concluded mutual representation agreements may send representatives to the conference. These organizations are listed in paragraph 1 of the Annex to the present document.

9. In accordance with Article 21(5) of the Regulations, the Director-General proposes that the organizations listed in paragraphs 2 to 5 of the Annex be invited to send observers to the conference.

(d) Institutions and foundations

10. The Director-General proposes that the institutions and foundations listed in paragraph 6 of the Annex be invited to send observers.

(e) Other international organizations

11. The Director-General proposes that the international organizations listed in paragraph 7 of the Annex be invited to send observers.

12. Should the Executive Board approve the proposal for invitees made by the Director-General, it may wish to adopt the following decision:

1. Recalling the recommendations of the 2011 Plenary Session of the Intergovernmental Committee for Physical Education and Sport (CIGEPS),

(a) that invitations to participate with the right to vote in the fifth International Conference of Ministers and Senior Officials Responsible for Physical Education and Sport will be extended to all Member States and Associate Members of UNESCO;

(b) that invitations to send observers to the fifth International Conference of Ministers and Senior Officials Responsible for Physical Education and Sport will be extended to all the States mentioned in paragraph 7 of document 189 EX/18 Part IV;

(c) that invitations to send representatives to the fifth International Conference of Ministers and Senior Officials Responsible for Physical Education and Sport will be extended to the organizations of the United Nations system listed in paragraphs 1 and 2 in the Annex to document 189 EX/18 Part IV;
