1. INTRODUCTION

The HSE Execution Plan provides Evans Vila Safety Consultant Inc. referred to in this document by the acronym EVSCI specific statement of the work plan to organize, perform, and execute the HSE responsibilities wherever we work. This plan identifies the guidelines for HSE control and will serve as the main document for the coordination of HSE management on all projects.

This plan describes the processes and procedures for ensuring that EVSCI are undertaken safely and in accordance with contractual and regulatory requirements. Additional procedures will be developed and implemented as required and as the work progresses. The principal aim is to ensure that risks to health and safety of personnel and to the environment are reduced or controlled to a level As Low as Reasonably Practicable (ALARP).

The EVSCI HSE Manager is responsible for preparing, implementing, and updating this HSE Plan as required, with the approval of the EVSCI Project/Site manager and board of directors.

EVSCI is committed to continuous improvement in HSE performance. In delivery of the work, EVSCI will commit to and implement “Behavioural Based Safety” principles which represent its vision of what is required to achieve sustainable, best industry HSE performance.

This EVSCI HSE Execution Plan shall apply to all phases of the work implementation where EVSCI has direct management responsibility for HSE. This document will be updated annually or whenever there are significant changes that can affect implementation of the EVSCI HSE systems as described in this document.

For small projects where EVSCI is a Subcontractor this plan will be built to reflect the responsibilities that are laid out in the scope of the subcontractor contract document.

1.1 SUPPORTING HSE PROGRAMS

Specific HSE management programs “generic” have been developed to define systems and controls related to implementation of the Project HSE Execution plan:

2. PURPOSE

The purpose of this HSE execution plan is to establish an effective and appropriate health, safety and environmental management strategy in order to:

Protect the health of all EVSCI, Client and Contractor employees;

Provide a safe work environment for all EVSCI, Client and Contractor employees;

Manage the security of EVSCI people and property of the work site;

Adhere to legislative requirements and applicable codes, statutes and industry best standards;

Protect assets, property, reputation, public and environment;

Consider all aspects of HSE at all stages of the work life cycle; and

This plan and associated procedures/plans/programs define the HSE and management systems standards applicable to the work site.

4. POLICIES

The HSE policy identified for this project is provided on the page numbers listed below on this page. EVSCI HSE policy statement shall be adopted and displayed in the relevant locations of Project site and communicated to all employees and project personnel including EVSCI managed contractors through site HSE orientation, safety meetings, toolbox talks, safety alerts, focus presentations and HSE communication boards. 4.4 EVSCI HSES POLICY

4.5 ALCOHOL AND DRUG POLICY AND PROGRAM

Possession of alcohol or illicit drugs on the project/work site will result in Contractors,

Subcontractors and Suppliers workers removal form the site.

EVSCI Alcohol or illicit Drugs Policy:

Prohibits the use, possession and presence

In the body of illegal alcohol or drugs.

Prohibits being unfit for work due to the use of

after effects of alcohol or drugs.

Alcohol or drug testing may be conducted for

reasonable cause and it will be conducted

for all incidents and accidents.

Refusing to take or submit to an alcohol or

Drug test when required by EVSCI/Client

team Member will result in removal from the

project/Work site.

The Alcohol and Drug Policy has been developed to

meet the Ontario Human Rights Code ISBN 0-7794-0477-7. The alcohol and drug policy

and procedure will apply to all positions, as defined in the in the EVSCI Alcohol and Drug

Program. EVSCI HSE A&D Policy shall be displayed in the relevant locations of the

project's site and communicated to all employees through site HSE orientation, safety

meetings, toolbox talks, safety alerts, focus presentations and HSE communication

boards. The Alcohol and Drug Program is available on the EVSCI document library.

4.6 SMOKING POLICY

It is EVSCI policy that smoking is prohibited in all areas other than those specifically set

aside for smoking as agreed with the client. This policy is in keeping with current legislation

prohibiting smoking in public and work spaces. Refer to the Smoke-Free Ontario Act

S.O. 1994.

The policy applies to:

Cigarettes (manufactured or rolled).

Cigars and cigarillos.

Chewing products.

Pipe products.

Any other tobacco product.

EVSCI Smoking Policy shall be displayed in the relevant locations of the project's site and communicated to all employees through site HSE orientation, safety meetings, toolbox talks, safety alerts, focus presentations and HSE communication boards.

4.7 EVSCI POLICY ON WORKPLACE, DISCRIMINATION, HARASSMENT, VIOLENCE AND HORSEPLAY

Bill 168 is an Act to amend the Ontario Occupational Health & Safety Act to introduce

Workplace Discrimination, Harassment and Violence. EVSCI recognizes that all

employees have a right to work in an environment free from unlawful discrimination,

harassment and workplace violence. EVSCI has adopted this policy as a clear message

that discrimination, harassment, whether sexual, personal or discriminatory, and

violence in the workplace will not be tolerated. EVSCI is committed to preventing these

activities including horseplay, and dealing with them effectively if they do occur.

Horseplay is rough, boisterous play or pranks that occur in the workplace. Horseplay can be activities such as joking which includes physical contact, playing around, racing, grabbing, foolish vehicle operation, and social pressure to participate in unsafe acts, harassment, and unauthorised contests. Playing jokes and having fun can lead to injuries and sometimes be deadly. Horseplay is irresponsible behaviour and is prohibited and will not be tolerated.

EVSCI Workplace Discrimination, Harassment, Violence and Horseplay Policy shall be

displayed in the relevant locations of the project's site and communicated to all

employees through site HSE orientation, safety meetings, toolbox talks, safety alerts,

focus presentations and HSE communication boards. The Workplace Discrimination,

Harassment, Violence and Horseplay procedure is available on the EVSCI document

library.

4.8 REFUSAL-TO- WORK FLOW CHART

The flow chart describes the refusal to work process and is aligned to the Ontario

Occupational Health & Safety Act Part IV Section 43. EVSCI Refusal-to-Work Flow Chart

shall be displayed in the relevant locations of the project's site and communicated to all

employees through site HSE orientation, safety meetings, toolbox talks, safety alerts,

focus presentations and HSE communication boards. The refusal to work procedure is

4.9 CELL PHONES (AND OTHER PORTABLE DEVICES)

Personnel who choose to bring personal cell phones to work will keep personal calls to a minimum. Personal cellular phones shall not be used in active worksites or in other designated locations.

Cell phone use while operating a motor vehicle is strictly prohibited. This policy applies to hand-held phones, earpieces, microphones wired to a phone, 2-way radios, or any other type of communication device which could interfere with the driver’s safe operation of the vehicle.

The driver will not create or read text/email messages while driving. This includes cell phones, Blackberry devices and any other device used to send and receive text/email messages. This inclusion also applies to devices that can create text messages or emails using voice recognition, commands or software.

Employees are not permitted to take or transmit pictures with any photographic device while on company property, including cell phones and PDAs with imagery capability, digital cameras, video cameras, or any other electronic device, without the express permission of the Client and/or EVSCI and of those persons whose image is being recorded with such a device.

If making an emergency call (911) the vehicle must be safely parked and off to the side out of the way of traffic before making the call.

Personal electronic devices (PEDs) include, but are not limited to:

Devices that could be or is used for communication.

Devices used to record images and/or audio.

Devices designated only to play video and/or audio.

Other forms of technology with image taking, eavesdropping/listening and communication capabilities.

Any other devices that can process, store and/or transmit data electronically.

No personal electronic audio, video, gaming, or other such entertainment devices may be worn or used while working on the Work Site. Should an employee bring a personal electronic device to a worksite, the secure storage of this device or devices is the sole responsibility of the employee. EVSCI, Client or the Project does not accept responsibility for lost or stolen personal electronic devices.

Company issued and approved electronic devices such as cell phones, computers, blackberries, and cameras may be used only in accordance with the provisions of the HSE Plan and its related documents. The Cell Phone Policy is available on the EVSCI document library.

5. LEADERSHIP & COMMITMENT

EVSCI recognizes that active involvement of senior management will encourage all levels of managers and supervisors to commit themselves to the safe and sustainable execution of our work activities.

It is the policy of EVSCI to carry out work activities in a manner consistent with sound health, safety and environmental management practices and to comply with applicable health, safety and environmental laws and regulations.

The EVSCI management team will be leaders in HSE performance for all of their work activities and will actively demonstrate their commitment through undertakings which include, but may not be limited to the following:

Treating HSE management and sustainability as core values through demonstrated leadership.

Developing shared objectives and promoting team building between Client management, EVSCI management and employees.

Providing adequate and suitable resources to support this HSE Plan.

Employing qualified, competent and suitable HSE specialists.

Visibly promoting HSE management and sustainability in regular meetings and by conducting regular visits with their counterparts from the Client, Contractor(s), JHSC and or Representative and the EVSCI management team.

Setting HSE and sustainability objectives and targets aligned with EVSCI and Client expectations by measuring and reviewing HSE and sustainability performance.

5.1 BEHAVIOUR BASED SAFETY

Behaviour Based Safety (BBS) will be introduced and communicated to the Work Site workforce through applicable training programs. The BBS process is based on observations of, and responses to, worker behaviours, including:

Making positive interventions when safe behaviours are observed.

Correcting and coach when at risk behaviours are observed.

Recognizing workers demonstrating safe behaviours.

Documenting observations and interventions.

Assisting with the communication of trends during toolbox talks.

Identifying safe worker behaviours for inclusion on observation reports.

Assisting new observers with observation and intervention process.

Management behaviours for the construction/mining management will also be identified and included in the BBS process.

5.2 FIVE SAFETY ESSENTIALS

The “Five” Safety Essentials” is a set of behavioural expectations for all Work Site personnel. It is a structured program to support a positive leadership culture, and creates the opportunity for managers, supervisors, foreman, and lead hands to become actively engaged in safety discussions with personnel.

The “Five” Safety Essentials are outlined below:

Communication of the Five Safety Essentials to personnel will start in the Work Site General Orientation, and continue in weekly HSE meetings. The essentials shall be displayed in the relevant locations of the project's site and communicated to all employees through site HSE orientation, safety meetings, toolbox talks, safety alerts, focus presentations and HSE communication boards to encourage all Work Site personnel to adopt these as part of their safety culture and personal behaviour when planning and executing work activities.

5.2.1 SAFETY WATCH

It is the expectation that all EVSCI, Contractors, Subcontractors and Suppliers intervene at all times where safety is being comprised using the Safety Watch Program. It involves observing behaviour and detecting at risk or unsafe activities followed by directing or modifying behaviour to achieve a safe operation.

YOU MUST INTERVENE

Intervening is about speaking up and expressing your concern when you see something unsafe, which in turn could prevent an incident from occurring.

If it’s an unsafe condition make the condition safe, but only if you can do so without putting yourself or others at risk.

If it’s a condition which cannot be made safe immediately, then you must report it to your Manager/Supervisor/Foreman/Lead hand/HSE manager/Coordinator.

There is increasing legislative focus on personal accountability for not intervening serious legal consequences can result!

Intervention is therefore an obligation, not an option!

It is an UNSAFE ACT if you Do NOT intervene!

The Near Miss Hazard cards will also be used for the Safety Watch/ Intervention/ Behavioral Based program.

5.2.2 NEAR MISS/HAZARD REPORTING

The Hazard/Near Miss cards will be located in the common locations under EVSCI

managed responsibility. The purpose of the Hazard/Near Miss card system is to ensure

that everybody is alert to potentially unsafe or unhealthy situations and to enable

personnel to take preventive action before anyone is harmed. EVSCI Contractors,

Subcontractors and Suppliers will be expected to use the EVSCI system unless

Contractors, Subcontractors and Suppliers have a process equal-to or better-than the

EVSCI system.

5.2.3 HSE MANAGEMENT LEADERSHIP TRAINING

EVSCI Project Management team, Contractor, Subcontractors and Supplier management shall demonstrate visible safety leadership and provide clear accountability for HSE in line with EVSCI Behaviour Based Safety expectations.

The Occupational Health and Safety Act (OHSA), and its regulations identify Supervisors as the people who have day-to-day responsibility to ensure the work gets done and, done safely. Under the law, a supervisor is any person with authority over you, in other words, any person who can direct you (the worker) as to when and how to do a task. Sometimes the supervisor is the same person you call the boss.

EVSCI Project Management and construction and mining supervisors/foreman/lead hand will be required to attend mandatory HSE leadership training which will include Ontario Occupational Health and Safety Act and Regulations.

It is the responsibility of all Contractors, Subcontractors and Suppliers working on the Project/Work Site to establish this same leadership training for their management and supervision.

Ontario OH&SA & Regs. R.R.O. 1990, Regulation 854 Mines and Mining Plants Minimum requirements for all Construction Supervisors include:

PART I: GENERAL

11. (1) Employers in the following types of mines and mining plants shall establish and maintain the following training programs:

(4). Mines and mining plants other than hard rock underground mines, soft rock underground mines, and mill, smelter and refinery process operations, shall have Common Core module for Generic First Line Supervisor — Surface Mining, Surface and Underground Diamond Drilling Operations, and Underground and Surface Mining Trades (Program #P770141). O. Reg. 296/11, s. 1.

The employer/EVSCI shall ensure that a worker completes all of the modules of the appropriate supervisor’s common core program within 12 months after the worker begins performing supervisory duties. O. Reg. 296/11, s. 1.

1000 hrs experience as a Supervisor/foreman or lead hand.

Workplace Hazardous Materials Information System (WHMIS) current with expiry date on card.

Norcat Orientation training current with expiry date on card.

Reading and interpretation of job details and blueprints.

Standard first aid - CPR: Current (or equivalent) with expiry date on card.

Respirator fit test training.

Fall Arrest and Rescue training.

Confined Space and Retrieval training.

Knowledge and training in Contractor HSE Program procedures, processes, forms and permits.

5.2.4 ONTARIO OH&SA & REGS. R.R.O. 1990, REGULATION 854 MINES AND MINING PLANTS

Minimum requirements for all Underground Supervisors include:

11. (1) Employers in the following types of mines and mining plants shall establish and maintain the following training programs:

1. Hard rock underground mine,

i. Common Core for Basic Underground Hard Rock Miner (Program #P770010),

ii. Specialty Modules for Underground Hard Rock Miner (Program #P770010),

The employer/EVSCI shall ensure that a worker completes all of the modules of the appropriate supervisor’s common core program within 12 months after the worker begins performing supervisory duties. O. Reg. 296/11, s. 1.

5.2.5 HSE RECOGNITION PROGRAM

The HSE Recognition Program will be implemented by EVSCI Project management team to encourage Project/Worker to develop safe behaviour and maintain work morale and an optimal work climate during the execution of the project/Work Site. Safety and safe behaviour are a condition of employment and the program will recognize practices and procedures past the norm. EVSCI HSE department will have Project/Work Site HSE Milestones set for safety performance and recognition will be given to all site

personnel who contributed.

5.2.6 EVSCI GENERAL HSE RULES

In addition EVSCI will develop an HSE Handbook which will detail the site specific rules

that apply on the Project Site. The Site General HSE Rules are basic “thou shall” or

“thou shall not” statements. They leave no room for discretion or argument. The site

general HSE hand Book will be distributed to all personnel attending the general

orientation and an acknowledgement form will be required for each individual to sign and

date. The site general rules shall be displayed in the relevant locations of the project's site

and communicated to all employees through site HSE orientation, safety meetings,

toolbox talks, safety alerts, focus presentations and HSE communication boards.

Discussed at the contractor kick off meeting and will be audited for assurance purposes.

5.2.7 EVSCI CRITICAL TASK HSE RULES

EVSCI employees, Contractors, Subcontractors and Suppliers are responsible for

ensuring compliance to the 10 EVSCI Critical Task HSE Rules. They shall be displayed

in the relevant locations of the project's site and communicated to all employees through

site HSE orientation, safety meetings, toolbox talks, safety alerts, focus presentations and

HSE communication boards. Discussed at the contractor kick off meeting and will be

audited for assurance purposes.

The EVSCI 10 Critical Task HSE Rules listed below are applicable to all EVSCI

employees, Contractors, Subcontractors and Suppliers.

Ground Disturbance.

Driving.

Confined Space.

Working at Height (over six feet 100% tie off required).

Lifting Operations.

Energy Isolations.

Pressure Testing.

Plant and Equipment.

Housekeeping.

5.2.8 EVSCI HSE ABSOLUTES

The leadership team of EVSCI has developed a set of Project/Work Site-specific HSE Absolutes, which provide basic guidance with the expectation that every person working on the work site, including contractors and sub-contractors, should be able to return home at the end of the working day without having suffered or caused harm in any way.

The project mandatory HSE Project/Work Site Absolutes will be introduced to all work site personnel via the HSE site-specific orientation, and communicated through safety meetings, toolbox talks, safety alerts, focus presentations, posted on the HSE Communication boards and discussed at the contractor kick off meeting and will be Audited for assurance purposes.

The following Project/Work Site HSE Absolutes are considered to be serious HSE violations. Noncompliance with these Absolutes rules will result in immediate removal from the Project/Work Site:

100% compliance to tie off requirement when working from an unprotected height of six feet or greater;

100% compliance with energy isolation procedures (Safety Lock out and Tag out requirements; (electrical, mechanical, Pneumatic, Hydraulic etc.);

100% compliance to NO unauthorized modification of scaffolding or work platforms;

100% compliance to requirements for obtaining and complying with the Safe Work Permits established by the work site;

100% compliance to Alcohol and Drug Policy (Fit-to Work program);

100% compliance to NO smoking in hazardous areas (Flammable areas, “Live plant areas”, Explosives, WHMIS storage areas, Battery stations etc.) and in demarcated No Smoking zones;

100% compliance to NO tampering with safety devices or emergency response equipment;

100% compliance to NOT operating equipment without the proper authority license and qualifications;

100% compliance to NO willful damage to plant or equipment (e.g., sabotage);

100% compliance to NO blatant disregard for imminent danger in properly demarcated zones (e.g., red or radiation flagged); and

100% compliance to NO Workplace Discrimination, Harassment, Violence and Horseplay. Reference, Ontario Bill 168.

The Project/Work Site will support the implementation of the HSE Absolutes through positive (i.e., recognition program) and negative (i.e., disciplinary process) reinforcement.

6. GOALS & OBJECTIVES

In accordance with the Project/Work Site HSE strategy, EVSCI will:

Promote alignment by all parties EVSCI, Client, Contractors, Subcontractors and

Suppliers to a common set of goals and objectives;

Integrate HSE delivery into all stages of the Project/Work Site;

Manage the identified HSE issues by avoidance, prevention, control and

mitigation;

Manage risks to personnel and processes/production to a level As Low as

Reasonably Practicable (ALARP);

Pursue zero damage to the environment and challenge any deviations;

6.1 HSE PROJECT BUDGET

A suitable HSE budget will be agreed upon between EVSCI and Client, taking into consideration the following program items:

Suitable number of HSE personnel, including those for the project start-up and close-out stages.

HSE Administration support.

HSE Recognition program.

HSE Supervisory Leadership training.

Orientation time for HSE and Project Management personnel.

Emergency response arrangement, e.g., preparation, training of personnel, drills, and exercises.

Any third-party audits/verification.

Suitable provisions/supply of PPE for EVSCI personnel.

Suitable provisions for safety signage and other safety communication.

Any external legal advice required.

Training requirements.

HSE publications such as orientation booklets, TASC/SLAM/FLRA Cards.

Suitable provisions to reflect EVSCI responsibility for HSE.

6.2 PROJECT HSE PERFORMANCE TARGETS

EVSCI Contractors, Subcontractors and Suppliers shall follow the established Leading

and Lagging Indicators for the Project/Work Site.

The formula for calculation of Lost Time Incident Frequency (LTIF), Total Recovery

Incident Frequency (TRIF), and All Injury Frequency (AIF) is the number of recorded

incidents multiplied by 200,000 and divided by actual man-hours worked.

7 LEGAL & OTHER REQUIREMENTS

7.1 ACT, CODES, STATUTES AND REGULATIONS

As a minimum, all EVSCI personnel will receive general awareness training to understand the following:

Employee obligations and duties.

Regulatory responsibilities, duties and obligations.

Hazard recognition.

Alcohol and Drugs.

Right to refuse or stop work where health or safety in danger.

Workplace Discrimination, Harassment, Violence & Horseplay Policy

A copy of the Ontario Occupational Health and Safety Act, Ontario Occupational Health and Safety Regulations, Ontario Regulation 1101 and Workplace Discrimination, Harassment, Violence & Horseplay Policy will be posted on bulletin boards and made available to all personnel.

7.1.2 LEGISLATION, CODES, STATUTES, STANDARDS AND INDUSTRY BEST PRACTICES

EVSCI will comply with the provisions of all relevant Ontario Legislation, Codes, Statutes,

Standards and Industry Best Practices.

The legislation applicable to the EVSCI scope of work will be identified and summarized in the Legislation Register which will be subject to periodic review. During Project phase, audits against applicable legislation will be included and implemented as part of the assurance strategy for the EVSCI Project.

The EVSCI HSE plan has been compiled using a variety of sources, including legislation, codes, standards, statues and industry best practices.

EVSCI will track applicable HSE laws, regulations, and other policies, procedures, guidelines and standards as the work advances and identify changes that relate to the work sites.

The regulatory bodies and HSE programs that will govern the EVSCI Project are listed

7.1.3 SOCIO-ECONOMIC REQUIREMENTS

Client has overall responsibility for socio-economic management. EVSCI shall comply with

all Client Socio-economic requirements.

7.1.4 ENVIRONMENTAL REQUIREMENTS

Client has overall responsibility for environmental management. EVSCI is committed to

environmental protection. As such, the prime objective is to maintain a healthy and safe

environment and to minimize impact on the environment within EVSCI scope of services.

Hazard Assessment will be conducted by EVSCI to identify and mitigate and/or reduce to

ALARP all hazards:

EVSCI accepts responsibility for protecting the environment. EVSCI Contractors,

Subcontractors and Suppliers shall at all times be responsible for protecting the

environment and the health, safety, and of their employees.

EVSCI Contractors, Subcontractors and Suppliers shall be committed to the protection of

the environment in the conduct of their respective businesses. EVSCI recognizes that

environmental excellence can only be achieved through the active participation of all stake

holders.

Contractors, Subcontractors and Suppliers are required to comply with all their

responsibilities under environmental legislation as it applies to their work and must have an

established Environmental Program of their own.

EVSCI will monitor compliance of its managed Contractors, Subcontractors and Suppliers

to client and EVSCI environmental requirements.

7.1.5 SECURITY REQUIREMENTS

Client has overall responsibility for Security Management EVSCI, Contractors,

Subcontractors and Suppliers shall comply with all Client requirements.

The purpose of project security is to protect workers, property, and other assets from

injury, harm, and damage from criminal, hostile, or malicious acts, and by implementing

suitable security provisions to manage identifiable project security needs. In conjunction

with the Client EVSCI, Contractors, Subcontractors and Suppliers will implement their own

in house security measure in order to protect all employees.

8 OCCUPATIONAL HEALTH REQUIREMENTS

Client has overall responsibility for Occupational Health requirements EVSCI, Contractors,

Subcontractors and Suppliers shall comply with all Client requirements. If required EVSCI

has an available hygienist to assist the client with their Occupational Health requirements.

9 TRAFFIC MANAGEMENT REQUIREMENTS

EVSCI recognizes that the operation of workplace vehicles is among the highest risks on Project work sites. EVSCI is committed to the effective management and elimination or reduction of this risk as part of its overall management of the HSE project execution plan.

All EVSCI HSE requirements for heavy equipment and light duty vehicles are referenced in the site traffic management procedure and is applicable to all EVSCI managed Contractors, Subcontractors and Suppliers. Contractors, Subcontractors and Suppliers are to have a site traffic management procedure equal-to or better-than the EVSCI procedure.

10 HSE RISK MANAGEMENT

10.1 PROJECT SITE LEVEL RISK AND HAZARD ASSESSMENT

EVSCI will conduct an initial Project Site level risk and hazard assessment to identify and analyze Construction/Mining and HSE risks associated with site construction/mining activities to identify appropriate and effective control measures. These will be used to develop strategies to ensure that work is done in a safe and healthy manner, limiting impacts to the environment, assets, and the public.

The Project Site level hazard assessment will be conducted through a series of working sessions involving key construction/mining team members and HSE management. Documents to be reviewed in these sessions include but may not be limited to:

Critical work inventories

Milestone schedule

Path of risk

Contracting strategies and schedule.

10.2 PROJECT HSE RISKS

The Risk Management process is an integral part of EVSCI business approach and philosophy. Through the methodology of the process, the Project/Work Site Management Team will identify what it considers to be the higher level HSE risks associated with execution of the Project/Work Site scope. Systematic assessments of health, safety and environmental risks will be conducted throughout construction/mining execution. Probable impacts and mitigation measures will be identified using Hazard Severity Matrix below.

A description of the key HSE risks for the Project/Work Site scope of work is provided in the form of a Risk Register. It is the responsibility of the EVSCI Project HSE Manager to facilitate the population, revision, and maintenance of the Project HSE Risk Register throughout the project life.

10.3 RISK REDUCTION BY DESIGN

Also part of EVSCI business approach and philosophy recognises that the most significant risk reduction opportunities exist at the design stage where risk exposures can be “engineered” out of the final workface. Risk reduction by design focuses on activities such as model reviews and HAZOPs to identify risk areas and opportunities to enhance HSE performance.

10.4 CONTRACTOR, SUBCONTRACTOR AND SUPPLIER HSE RISK MANAGEMENT

Contractors, Subcontractors and Suppliers shall conduct an initial Project/Work Site level risk and hazard assessment on their respective scopes of work to identify and analyze Construction/Mining and HSE risks associated with site construction/mining activities. A site specific risk and hazard assessment will be conducted once on site to identify any new hazards not revealed in the scope of work. The risk and hazard assessment will identify appropriate and effective control measures. These control measures will be used to develop strategies to ensure that work is done in a safe and healthy manner, limiting impacts to the environment, assets, and the public.

10.5 HSE RISK REGISTER

The EVSCI HSE Manager will maintain an HSE Risk Register, identifying high level HSE risks, existing controls, and additional controls/actions required and responsibility. The HSE Risk Register provides a structure for collating information about risks that helps in decision making about whether or how the identified risks should be treated, managed or monitored.

The risk register provides EVSCI management with a high level overview of HSE risk status throughout construction/mining execution. It is a dynamic tool that will be regularly updated as new risks are identified by such means as:

Contractor, Subcontractor and Suppliers Risk Assessments.

Tendering process.

Contractor kick-off meetings.

Baseline studies.

Assessment of new activities (HAZOPs, Failure Mode Effects Analysis, Aspect Assessments).

New legal requirements

Identification of unforeseen aspects.

Analysis of accidents and incidents.

10.5.1 RISK REGISTER

The Risk Register will be used to:

Identify and assess key HSE risks and identify priorities.

Determine HSE training and communication requirements.

10.5.2 CONTRACTOR RISK REGISTERS

Contractor(s), Sub-contractors, and Suppliers working on the Project/Work Site will provide EVSCI with a risk register for their contracted scope of work. The register must utilize the HSE Plan’s risk matrix to determine the potential results of the work activities prior to implementing control measures to mitigate or eliminate the risk.

10.5.3 JOB SAFETY ANALYSIS

A Job Safety Analysis (JSA) is a process that integrates accepted health and safety and environmental principles and practices into task or job planning. In a JSA, potential hazards associated with each step of a job are identified potential hazards and appropriate controls are documented. Contractor, Subcontractor and Suppliers shall complete a JSA for all critical tasks, including but not limited to:

Jobs or tasks associated with high incident frequencies and/or high severity risks.

Jobs or tasks with high potential for severe injuries or illnesses or the consequences of an incident, hazardous condition, or exposure to harmful substance.

New jobs for which the hazards may not be evident or anticipated.

Modified jobs for which new hazards may be associated with changes in job procedures.

Infrequently performed jobs for which workers may be at greater risk when undertaking non-routine jobs and a JSA provides a means of reviewing hazards.

New or unusual jobs and/or tasks.

Jobs which present a significant loss exposures to people, property, or the environment.

Tasks which have a history of losses.

Tasks which present a significant loss exposures to people, property, the environment and production/processes.

Tasks where work plans have been changed.

10.5.4 JOB SAFETY ANALYSIS STEPS

Job Safety Analysis will be prepared by the Contractor, Subcontractor and Suppliers in consultation with EVSCI HSE department, Project/Site Manager and/or Designate and other technical resources, as required. JSAs when completed will be reviewed by EVSCI.

Job Safety Analysis will be discussed with crews prior to performing work assignments. Workers will be given the opportunity for input into the plan. Workers performing the job will sign the JSA to verify understanding and agreement to job requirements and hazard controls to be implemented. The completed JSA will be submitted to the EVSCI HSE manager and/or HSE Coordinator.

All Contractor, Subcontractor and Suppliers personnel working on the Project Site must receive initial JSA training by their respective employers.

10.5.6 TASC/SLAM CARD

A task Analysis Safety Card and/or the Stop, Look, Assess and Manage Card is a work place task-specific risk assessment conducted daily prior to initiation of tasks. Hazard assessments such as TASC/SLAM are an industry standard and are used to identify hazards and establish controls to eliminate or reduce risks to acceptable levels. A TASC/SLAM is final crucial component of the Work Site hazard/risk identification and elimination process and will be used by Contractor, Subcontractor and Suppliers at the start of each job or task.

The TASC/SLAM is the tool used for work place planning, coordination and risk analysis. It allows supervisors/foreman/lead hands and workers to complete the safety planning process in the field and to identify the residual hazards not captured on the JSA, and to put the proper controls in place to prevent harm or loss from occurring.

TASC/SLAM are performed routinely by Workers and reviewed by Supervisor/Foreman/Lead Hands and EVSCI Coordinators:

At the beginning of a new task or a new shift.

When the size of the crew changes.

When there is a change that affects the execution of the work.

When new hazards are introduced as a result of the work activities, or other work groups.

When the information about the work changes (e.g. changed plans, unexpected task characteristics such as equipment configuration).

When site conditions change (e.g. weather, availability of tools).

The TASC/SLAM documents the steps involved in completing a task, the hazards/risks associated with the steps, and the controls that need to be put into place to eliminate or reduce the risk to acceptable levels. The TASC/SLAM shall not be used in place of a Job Safety Analysis.

Contractor, Subcontractor and Suppliers will have an appropriate TASC/SLAM process as part of their risk assessment processes.

All Contractor, Subcontractor and Suppliers personnel working on the work site must receive initial TASC/Slam training by their respective employers.

Supervisor/Foreman/Lead Hands will complete the TASC/SLAM with workers at the job site and sign off on the TASC/SLAM.

10.5.7 LAST MINUTE RISK ASSESSMENT (LMRA)

Last Minute Risk Assessments (LMRA) are undocumented, individual assessments that may be undertaken by workers before starting a task and during the execution of that task.

This process is a simple, effective and proactive behaviour-based HSE management tool that may be incorporated into Contractors’ HSE management processes in order to:

Focus worker attention on a specific task.

Assess the task.

Identify and eliminate unsafe behaviours and hazardous conditions.

Create a culture where workers are constantly assessing their own actions and worksite for hazards.

10.5.8 MANAGEMENT OF CHANGE

Management of Change (MOC) is the process used to review all proposed changes to materials, technology, equipment, procedures, personnel, and facility operations before they are implemented to determine their effects on safety vulnerabilities. If the review determines that a proposed change would impact safety vulnerabilities, then the applicable safety information will be updated on all related safe work practices, procedures, JSAs, and all employees whose job tasks will be affected by the change must be informed and retrained prior to resumption of work.

Modifications to equipment, procedures, materials, or process/production conditions will be subject to the change management review process. A knowledgeable person will

evaluate proposed changes and document them appropriately for submittal and review by EVSCI management and HSE representatives.

A hazard assessment must be conducted when a change occurs in the construction/mining plan or external influences impact the manner in which the work will be conducted. This includes, but is not limited to:

Changes in policy or objectives.

Operating licenses and permits, legal and regulatory requirements.

Changes in procedures, practices and rules.

Changes to controlled documentation.

Work processes or methods.

Requirement for a deviation or variance from established procedures.

Any change other than exact replacement in kind to equipment/ processes/hardware/software.

Changes to operating boundaries; e.g. operating envelopes.

Temporary changes which specify the period of time a change will be in effect.

Changes to specific JSAs or work procedures developed for the specified work activities.

The Management of Change process covers all activities including the initial request, implementation, review and closure of a change. Proposed changes will be managed by EVSCI and forwarded to the Client as necessary for approval.

The following items will be included in the Management of Change proposal:

Technical basis for the change.

Impact of the change on the health and safety of personnel.

Impact on the environment.

Impact of change on the supplied tools and equipment.

Necessary modifications to existing or new operating procedures.

The methodology used to analyze the impact of the change.

11 HSE MANAGEMENT STRUCTURE

EVSCI will comply with policies, programs, standards, procedures, forms, permits

required by the client and as specified in the Contract and as required by law. In

addition, under the direction of the client, EVSCI will provide HSE management

services if required at the work site in accordance with its Scope of Service and

responsibilities and will comply, and in accordance with the following:

Prepare a comprehensive site specific HSE project execution plan, as part of the overall EVSCI Management System, for those aspects of work under EVSCI direct scope, or as otherwise agreed to be included, in accordance with Clients corporate safety, health and environment policies, programs and procedures and applicable legislative and regulatory requirements.

Develop and implement EVSCI emergency response procedures in accordance with Client’s corporate policies, programs and procedures.

Provide HSE leadership through open, active engagement of all EVSCI personnel.

Ensure adherence to the EVSCI HSE program by all personnel and in accordance with the Client HSE programs.

Evaluate the HSE programs and performance of prospective Contractors, Subcontractors and Suppliers as an integral part of the prequalification process.

Ensure that all Contractors, Subcontractors and Suppliers under EVSCI direct scope develop and implement HSE programs in accordance with the Client and EVSCI HSE programs.

Develop and maintain a general HSE orientation for all EVSCI personnel in accordance with the Client and EVSCI HSE programs.

Provide detailed HSE indoctrination and training for EVSCI personnel in accordance with the client and EVSCI HSE programs.

Establish and implement an accident/incident investigation and root cause analysis reporting process.

Establish and implement a process for corrective, preventive and close out on actions.

Maintain and report HSE records and statistics.

Manage, assist and monitor the activities of Contractors, Subcontractors and Suppliers under EVSCI direct scope.

Actively participate in safety meetings at the work site (HSE toolbox talks, weekly HSE meetings, site indoctrination, and safety committee meetings, etc.).

In addition to the above HSE management services, EVSCI may also provide specific HSE support services for areas outside of EVSCI scope. This further provision of HSE support services shall, if required, be agreed in writing between the parties and clearly identify the HSE scope and responsibilities in relation to the specific areas of the work site that are outside of EVSCI direct control.

11.1 CONTRACTOR, SUBCONTRACTOR AND SUPPLIER HSE EXECUTION PLANS

Contractor, Subcontractor and Suppliers will provide EVSCI with an HSE execution plan for their scope of work that identify how work will be executed in a safe and environmentally acceptable manner. All scopes of work conducted on the Project Site will be planned, assessed for hazards/ risks, and appropriate control measures will be identified. No Contractor, Subcontractor and Supplier shall mobilize for commencement

of their scope of work without an approved HSE Execution Plan. This plan shall be reviewed and approved by EVSCI/Client Project/Site management and HSE manager.

12 HSE ORGANIGRAM STRUCTURE AND RESPONSIBILITIES

12.1 EVSCI PRESIDENT/VICE PRESIDENT

The President/Vice President shall

Follow the roles, responsibilities, duties, and obligations defined in EVSCI HSE Management Execution Plan.

Oversee the protection of all personnel, including Contractor(s), visitors, and the general public and protection of the environment, through implementation of this HSE Management Plan.

Ultimately be accountable for overall HSE performance throughout the work sites in accordance with EVSCI HSE scope of services.

Provide overall direction and support for the implementation of this HSE Plan.

Monitor to ensure EVSCI project management confirms that all specific HSE procedures are in place for work site activities, and where appropriate, for client activities.

Provide for adequate resources, facilities, and initiatives to effectively implement and manage this HSE Plan.

Enable and encourage the proactive involvement of all personnel, including Contractor(s), Subcontractors and Suppliers in managing the HSE program(s).

Monitor to ensure EVSCI project management confirms that all incident records are reviewed and verify that all follow-up action is completed in a timely manner.

12.2 EVSCI PROJECT/SITE MANAGER

Reporting to the President/Vice President, the EVSCI project/site manager and/or designate shall:

Follow the roles, responsibilities, duties, and obligations defined in EVSCI HSE Management Execution Plan.

In support of the President/Vice President, oversee the protection of all personnel on the work site including EVSCI management and staff, Contractor(s), sub-contractors, visitors and the general public, and the protection of the environment through the implementation of this HSE Plan.

Be accountable for HSE performance regarding associated work activities in accordance with EVSCI scope of services.

Provide leadership support and direction ensuring all personnel understand and carry out their responsibilities described within the HSE Plan.

Monitor to ensure that HSE meetings identified within this HSE Plan are conducted and recorded in accordance with this Plan, and participate as necessary.

Monitor to ensure that Contractor, Subcontractor and Supplier management pre-qualification checks are adequate, suitable, and that competent HSE representation, records and compliance monitoring is in place.

Monitor to ensure that specific HSE procedures are in place and used accordingly for all work site activities and where appropriate, the client site team.

Encourage and support the proactive involvement of all personnel in the management of this HSE Execution Plan.

12.3 EVSCI CONSTRUCTION SUPERINTENDENTS/COORDINATORS

Reporting to the project/site construction manager the EVSCI construction superintendent/coordinators shall:

Plan and direct the work in such a manner that the EVSCI HSE Management Execution Plan and related commitments are met.

Implement this EVSCI HSE Execution Plan and related programs, procedures, forms and permits to prevent accidents, injuries and adverse environmental impacts.

Possess a comprehensive knowledge of procedures pertaining to their work scope(s).

Consult with the HSE manager and/or Coordinators on HSE issues.

Conduct and/or participate in scheduled and unscheduled inspections of their work areas.

Ensure engineered protective measures are installed and used as required.

Assist in the development of written plans, programs and training.

Immediately report and participate in investigations of all incidents, accidents, and near miss in their area of responsibility.

Ensure that the “TASC” and/or “SLAM system” or equivalent is used in all

workplaces to assist in mitigating/eliminating hazards.

Ensure that Job Safety Analysis are prepared and reviewed with all workers prior

to work commencing.

Educate and promote the use of the EVSCI Behaviour Based Safety Program,

Intervention Program, Near Miss Hazard Reporting Process, the Five Safety

Essentials, Safety Watch Program, Site/Critical Task Rules, and the project HSE

Absolutes.

12.4 EVSCI HSE MANAGER/DESIGNATE

Reporting to the President/Vice President, the EVSCI HSE Manager and/or designate shall:

Follow the roles, responsibilities, duties, and obligations defined in EVSCI HSE Management Execution Plan.

Develop and implement the EVSCI HSE Plan for use by all EVSCI personnel Contractors, Subcontractors and Suppliers.

Liaise with the EVSCI management team, client and Contractors, Subcontractors and Suppliers to ensure alignment and consistency in the project HSE Plan development and implementation.

Schedule and participate in HSE audits or reviews for EVSCI, Client, Contractors, Subcontractors and Suppliers.

Participate in Monthly HSE walk-about, monthly workplace inspection with EVSCI, Client and Prime/General Contractor(s)

Monitor to ensure that reporting on work site HSE performance is done at the frequencies set in this HSE Plan.

Monitor to ensure that appropriate competency training, including a system to verify understanding of HSE responsibilities, is provided for all employees, and Contractors, Subcontractors and Suppliers do the same for their employees.

Oversee the development and implementation of a supervisory leadership training course to be attended by all EVSCI supervisory personnel.

Monitor to ensure that the promotion of HSE awareness and incident prevention is addressed with all levels of work site personnel through HSE notice boards and attendance at tool box meetings and weekly HSE meetings.

Assist EVSCI management in recruiting, training and evaluating HSE professionals for construction execution.

Monitor to ensure that the development of HSE written plans, programs, and training materials are used as aids in incident prevention and HSE implementation.

Monitor to ensure that orientations and other HSE training for all personnel as well as material on HSE education, promotion and awareness is done.

Monitor to ensure that the management of the HSE training records tracking system is implemented and maintained.

Monitor, mentor and functionally manage HSE personnel during the execution phase, in conjunction with respective client managers. Ensure Contractors, Subcontractors and Suppliers have a process in place to do the same.

Work in conjunction with the EVSCI management to annually review this EVSCI HSE Plan and overall HSE performance.

Work with client and EVSCI management to meet goals related to early work activities, including pre-qualifying/evaluating Contractors, Subcontractors and Suppliers in the development, distribution, and implementation of this EVSCI HSE Plan.

Monitor to ensure that the field implementation and management of this EVSCI HSE Plan is implemented, and provide guidance as necessary to familiarize all personnel with the plan.

In conjunction with the client management monitor to ensure that EVSCI management, Contractors, Subcontractors and Suppliers, oversee the implementation and operations of the medical facilities and emergency procedures.

Monitor to ensure that the administration and maintenance of the HSE related records and documentation meet the work sites agreed record retention requirements.

Participate with managers, Engineers and Contractors, Subcontractors and Suppliers on design HSE functions, including Human Factors Engineering (HFE), to ensure all aspects are adequately addressed.

In conjunction with the President/Vice President and managers, develop and manage an incentive program that recognizes efforts and contributions towards improvement and management of HSE targets.

Monitor to ensure that the development and maintenance of the Material Safety Data Sheet (MSDS) registers is implemented and current.

Evaluate Contractor HSE site-specific programs and conduct subsequent pre-mobilization meetings, inspections, etc., in compliance with this EVSCI HSE Plan.

Monitor to ensure that pre-mobilization HSE audits on Contractors, Subcontractors and Suppliers mobilizing to site is conducted.

Monitor to ensure and when possible attend HSE (toolbox) or daily pre-task HSE meetings are conducted and in conformance with this EVSCI HSE Plan.

Attend weekly/monthly HSE meetings.

Monitor to ensure and when possible participate in Joint Health & Safety Committee meetings.

Monitor to ensure that emergency procedures are in place and that drills as required by the Client and/or the Ontario Occupational Health & Safety Act and its regulations are conducted.

Monitor to ensure that EVSCI management, Contractors, Subcontractors and Suppliers, are encourage to participate in hazard identification and reporting. As well as immediate reporting of all incidents and “near miss” incidents by all site personnel.

Monitor to ensure that Contractors, Subcontractors and Suppliers, arrange for new employees to attend prescribed orientations and receive the client and EVSCI HSE Handbook.

Monitor to ensure that the development and implementation of a formal modified work program, including a process to consult with both employee and treating physician regarding an employee’s rehabilitation and early return to work.

Monitor to ensure that the EVSCI management team Educate and promote the use of the EVSCI Behaviour Based Safety Program, Intervention Program, Near Miss Hazard Reporting Process, the Five Safety Essentials, Safety Watch Program, Site/Critical Task Rules, and the project HSE Absolutes.

12.5 EVSCI ENVIRONMENTAL MANAGER

Reporting to the HSE Manager, the Evans Vila Safety Consultant Inc. Environmental Manager and/or designate shall:

Develop, implement, and maintain the environmental program defined in the Environmental Protection Plan (EPP) for the work site in accordance with Client and EVSCI and legislative policies, standards and procedures.

Coordinate the field implementation and management of the EPP.

Establish and maintain environmental specifications, practices and procedures in accordance with the Client and EVSCI environmental program.

Establish an environmental audit and inspection program to monitor compliance with this Plan and with regulatory and other requirements.

Develop environmental training for incorporation into the work site General Orientation and ensure training is consistent with the work site goals and procedures.

Work in conjunction with Client and EVSCI management representatives to review the EPP and environmental performance.

In conjunction with Client and EVSCI management develop, review and monitor environmental emergency procedures.

Ensure the display and dissemination of environmental material suitable for toolbox topics, weekly HSE meetings or other work site meetings.

Work with the Environmental Coordinators and HSE Coordinators to ensure compliance with the EPP.

Provide input on design issues regarding environmental compliance.

Participate in the preparation and approval of tender packages, and the technical evaluation of bids.

Lead environmental initiatives developed in conjunction with client and the EVSCI management team.

Provide support to client personnel in the preparation of documentation to support environmental permit applications to regulatory agencies.

Educate and promote the use of the EVSCI Behaviour Based Safety Program, Intervention Program, Near Miss Hazard Reporting Process, the Five Safety Essentials, Safety Watch Program, Site/Critical Task Rules, and the project HSE Absolutes.

12.6 EVSCI ENVIRONMENTAL COORDINATORS

Reporting to the EVSCI Environmental Manager, the Environmental Coordinators shall:

Conduct themselves in a professional and cordial manner at all times while working on the work site.

Work with Environmental Manager to meet goals related to early work activities, including pre-qualifying and evaluating work site Contractors, Subcontractors and Suppliers, and development/distribution/implementation of this EVSCI HSE Management Execution Plan and related policies and procedures during the applicable phases of the work site.

Coordinate the environmental field implementation and management of the EVSCI environmental program.

In conjunction with Contractors, Subcontractors and Suppliers, and through regular field work, evaluate work site personnel with the environmental program,

Oversee Contractors, Subcontractors and Suppliers responsibilities regarding MSDS management system, and provide support as necessary to ensure that they are current and accurate.

Evaluate Contractors, Subcontractors and Suppliers environmental work site specific programs to ensure compliance with work site environmental requirements.

Participate if required with Environmental Manager, EVSCI management Contractors, Subcontractors and Suppliers in scheduled internal or external audits.

In conjunction with EVSCI management and/or Contractors, Subcontractors and Suppliers coordinate thorough investigation of all environmental incidents.

Conduct unscheduled and scheduled inspections of work areas in conjunction with EVSCI management, Contractors, Subcontractors and Suppliers as applicable.

Attend and participate in daily HSE toolbox/pre-task and HSE meetings.

Attend weekly/monthly HSE weekly meetings.

Attend (when invited) Joint Health & Safety Committee meetings.

12.7 EVSCI OCCUPATIONAL HYGIENIST MANAGER

Reporting to the HSE manager, the manager of Occupational Hygiene shall:

Conduct audits to ensure the following compliance with Occupational Health and Safety Act and its Regulations during soil remediation projects; compliance with the WHMIS regulations; and assessment of the effectiveness of an employer’s Indoor Air Quality Management Program.

Conducted training sessions for hazardous materials abatement including, Confined Space Entry, Respiratory Protection, and the OSHA 40-hour Hazardous Waste Operations and Emergency Response (HAZWOPER).

If required conduct chemical, biological and physical contaminant characterization studies for work site. Determined if the results obtained were in compliance with legislation or industry guidelines. Prepare written reports and provided recommendations to reduce exposure, and present findings to the Client, EVSCI management team and worker groups.

Reporting to the HSE manager, the EVSCI HSE coordinators shall:

Educate and promote the use of the EVSCI Behaviour Based Safety Program, Intervention Program, Near Miss Hazard Reporting Process, the Five Safety Essentials, Safety Watch Program, Site/Critical Task Rules, and the project HSE Absolutes.

Verify, in conjunction with HSE Manager, EVSCI project management, Contractors, Subcontractors and Suppliers that first aid facilities and emergency procedures are in place.

Coordinate the administration and maintenance the HSE related records and documentation to meet the work sites agreed record retention requirements.

Facilitate, in conjunction with Contractors, Subcontractors and Suppliers the effective use of authorized work site HSE databases.

Oversee Contractors, Subcontractors and Suppliers responsibilities regarding MSDS, and provide support as necessary to ensure that the MSDS management system is current and accurate.

Evaluate Contractors, Subcontractors and Suppliers HSE work site specific programs, attend when directed subsequent pre-mobilization meetings, facilitate and attend pre-mobilization audits, and inspections to ensure compliance with Project HSE requirements.

Participate as required with HSE Manager, EVSCI management team, Contractors, Subcontractors and Suppliers in scheduled internal or external audits.

Conduct unscheduled and scheduled inspections of work areas in conjunction with EVSCI management, Contractors, Subcontractors and Suppliers, as applicable.

Attend daily toolbox/pre-task and HSE weekly meetings.

Review, monitor and update, as required, emergency procedures, in conjunction with HSE Manager.

In conjunction with Contractors, Subcontractors and Suppliers, ensure the display and dissemination of HSE material suitable for HSE daily toolbox talk’s topics, HSE weekly and/or other HSE meetings.

Work with EVSCI management, Contractors, Subcontractors and Suppliers to encourage hazard identification and reporting as well as immediate reporting of all incidents, accidents, near miss incidents by all work site personnel.

Coordinate, in conjunction with Contractors, Subcontractors and Suppliers, arrangements for new employees to attend prescribed orientations, and other training sessions.

12.9 CONTRACTOR MANAGEMENT

Contractors, Subcontractors and Suppliers shall develop an HSE Project Execution Plan that shall be equal-to or better-than the EVSCI HSE Project Management Execution Plan and must be approved prior to the Contractors, Subcontractors and Suppliers mobilization. The HSE Execution Plan shall detail the requirements of all employees when engaged in any work on the Project Site. The Contractors, Subcontractors and Suppliers shall work to a satisfactory standard, meeting all Project Work Site and legislative requirements. The Contractors, Subcontractors and Suppliers shall ensure all employees whether long term or short term, comply with their HSE Execution Plan.

Failure to comply with these requirements may result in EVSCI and/or Client terminating the contractual agreements for cause.

The Contractors, Subcontractors and Suppliers shall:

Operate in a manner that protects the health and safety of workers and ensures environmental protection.

Provide a safe and healthy workplace and systems of work that prevent the risk of illness and injury.

Provide a practical, consistent and relevant system for staff managing and overseeing the work.

Fulfill OH&SA and regulations and environmental legal requirements.

Ensure HSE prequalification of all Contractors, Subcontractors and Suppliers has been completed prior to mobilization to site.

Establish an understanding of HSE requirements expected and required of all Contractors, Subcontractors and Suppliers.

Formalize training and communication programs.

Formally establish a HSE plan to enhance the overall protection of Contractors, Subcontractors and Suppliers employees, property, and the environment.

Incorporate formal internal and external audit process to monitor and evaluate the Contractors, Subcontractors and Suppliers HSE performance.

12.10 CONTRACTOR MANAGEMENT RESPONSIBILITIES

During the Contractors, Subcontractors and Suppliers prequalification and selection process, EVSCI shall:

Conduct pre-contract assessments and approval of the Contractors, Subcontractors and Suppliers HSE management system and supporting information.

Establish an approved Contractors, Subcontractors and Suppliers list.

Conduct a Contractors, Subcontractors and Suppliers kick off meeting.

Assist the Contractors, Subcontractors and Suppliers if required to develop, manage and implement safe work practices.

Ensure that the Contractors, Subcontractors and Suppliers proposed work methods do not place any work site employees at risk of harm or create the potential for loss; considering site-specific hazards.

12.11 CONTRACTORS, SUBCONTRACTORS AND SUPPLIERS

Contractors, Subcontractors and Suppliers shall

Comply with the EVSCI/Client HSE Project Management Execution Plan and related documentation.

Provide information to EVSCI that is relevant to the contract when required and requested.

Develop site-specific HSE Project Execution Plan, programs, procedures, safe work practices, rules, forms and permits relevant to hazards and scope of work activities at the site.

Ensure compliance to the Ontario Occupational Health & Safety Act and its regulations, WSIB Act and its regulations, Environmental Protection Act and its regulations, Ontario Labour Act and its regulations, Codes, Statues, and Standards, related to the work activities and best work practices for the mining and construction industry.

12.12 PROJECT HSE PREQUALIFICATION REQUIREMENTS

All potential Contractors, Subcontractors and Suppliers or others providing labour, equipment, supplies or other services to the Project, where there is a potential for persons to access the site for hands on work, shall be evaluated by EVSCI HSE and Project/Site manager and/or designate.

Each candidate company shall be required to complete and submit a standard Project HSE Prequalification/Evaluation questionnaire and supply supporting documentation for audit, review and comment. Questionnaire will be part of the RFP.

Any documents not submitted at the time of submission of the HSE Prequalification/ Evaluation questionnaire shall cause the EVSCI management team evaluation to cease until the appropriate documents and information is provided.

12.13 WORKERS SAFETY INSURANCE BOARD

Before the Contractors, Subcontractors and Suppliers is permitted to work on the Project, proof of Registration and Good standing with the Ontario Workers’ Safety Insurance Board shall be supplied. It is the Contractors, Subcontractors and Suppliers responsibility to maintain their good standing for the duration of the contract.

Submission of Workers’ Safety Insurance Board documentation is a mandatory requirement of the Project HSE submissions. Should the Contractors, Subcontractors and Suppliers fail to include these as part of a submission qualification package, it shall be communicated back to the Contractors, Subcontractors and Suppliers and no further review shall be conducted until the appropriate documentation is received.

12.14 CONTRACTORS EXECUTION PHASE

EVSCI will monitor Contractors, Subcontractors and Suppliers compliance with the Project work site HSE Project Execution Plan requirements and implement corrective actions where required.

If Contractors, Subcontractors and Suppliers safety performance does not meet the Project’s HSE standards and/or their HSE performance deteriorates during the project they shall be required to develop and submit for approval a risk mitigation plan.

Any costs incurred due to the interruption of project schedule due to work stoppages as a result of safety performance shall be the Contractors, Subcontractors and Suppliers responsibility.

13 HSE COMMUNICATOINS AND HSE AWARNESS AND PROMOTION

HSE policies and programs can be more effectively implemented if the management system is built on the foundation of a positive, inclusive HSE culture. All work site personnel are actively encouraged to be directly involved in the ongoing development and maintenance of the HSE management system. EVSCI will use formal arrangements such as meetings, forums, and a communications network to transmit and share HSE information. These may include but are not limited to:

13.1 HSE STEERING COMMITTEE

Meetings of the HSE Steering Committee will be held monthly. Attendance at the meetings will be, EVSCI President and/or Vice President, Project/Site Manager, HSE Manager, Environmental Manager, Occupational Hygiene Manager. The EVSCI President and/or Vice President shall initially chair the meeting but the chairperson role can be designated upon approval of the Committee. The Client Project Program Director, the Client Project Manager and the Client HSE Project Manager will be invited to all meetings. Meeting minutes shall be taken and distributed to the Committee and JH&S Committee. Terms of reference for the meetings are outlined below:

To monitor and promote the establishment and maintenance of HSE programs, procedures, systems facilities and services.

To monitor work site HSE performance with regard to achievement and potential trends (positive and negative), and to identity opportunities for improvement.

To monitor and predict potential HSE hazards as the work progresses, and to provide guidance on action needs.

To provide the HSE guidance as required and resolve HSE issues and concerns, where required.

To ensure adequate resources are available to implement HSE initiatives and improvements.

To monitor the achievement of the HSE Rolling Improvement Plan and provide guidance on the actions needed to correct deficiencies.

To monitor the achievement of the compliance measurement processes, and provide guidance on issues of concern.

To monitor the effectiveness of the HSE communication processes and provide guidance on improvement where required.

To promote leadership and accountability at all levels on the work site and provide feedback on achievement.

To take the necessary actions to support cross-project learning in whatever manner is deemed applicable.

13.2 EVSCI/CLIENT HSE MANAGERS MEETING

The EVSCI HSE Manager and/or his/her designate and the client HSE Representative(s) will meet on a monthly basis (bi-weekly to start) to ensure alignment and consistency of the approach to HSE matters.

This meeting will also serve to coordinate HSE activities, find areas of strength and weakness to improve the work site, and ensure that important HSE information is passed between EVSCI and the Client to ensure the Contractors, Subcontractors and Suppliers are aware of HSE matters which relate to their work activities. Minutes will be taken and actions tracked to completion.

13.3 JOINT HEALTH AND SAFETY COMMITTEE MEMBERS/REPRESENTATIVES

EVSCI Project work site shall ensure that a Joint Health and Safety Committee (JH&S) is established in compliance with Ontario Occupational Health and Safety Act and regulations and in conformance with EVSCI corporate requirements.

Each Contractor, Subcontractor and Supplier shall establish their own JH&SC will be represented in the project wide JOH&S Committee in compliance with Ontario Occupational Health and Safety Act and regulations

Project work site JH&S Committee meetings will be held regularly to review HSE issues and planned activities, previous minutes, audits, and action points. The EVSCI Project Site Manager will ensure that those personnel nominated to carry out actions are given the resources necessary to complete the action within the agreed time-frame.

13.4 JH&S CERTIFIED MEMBERS RESPONSIBILITIES

Certified members are not required for committees at workplaces that regularly employ less than 20 workers or at projects that regularly employ less than 50 workers [O. Reg. 385/96 as amended by O. Reg. 131/98]. EVSCI, Contractors, Subcontractors and Suppliers will have two certified JH&SC members if applicable. One certified JH&SC member to represent management and one certified JH&SC member to represent the workers in compliance with Ontario Occupational Health and Safety Act and regulations.

WEEKLY WORK SITE HSE PERSONNEL MEETING

All work site HSE personnel (EVSCI, Client, Contractors, Subcontractors and Suppliers) will meet on a weekly basis to review HSE performance, HSE strengths/weaknesses, changes in site activities, and emerging issues. This meeting will also ensure consistency in the HSE approach and alignment of HSE personnel. Minutes will be maintained and actions tracked to completion.

13.5 WEEKLY AREA HSE PROGRESS MEETINGS

EVSCI Project/Site Managers will conduct weekly HSE progress meetings that will be

attended by designated EVSCI management Contractors, Subcontractors and Suppliers

representatives. The meetings will evaluate how effectively HSE planning is being

integrated into the detailed weekly schedules and identify opportunities to strengthen

workface planning and initiate changes.

The meeting will provide Contractors, Subcontractors and Suppliers management an opportunity to raise concerns, and put forth suggestions on ways and means to improve HSE performance. Meetings will also provide an opportunity to review unresolved issues and concerns from their daily and weekly crew meetings. Minutes will be maintained and actions tracked to completion.

13.6 WEEKLY HSE CREW MEETINGS

EVSCI, Contractors, Subcontractors and Suppliers will conduct weekly HSE Crew meetings led by the Superintendents and/or designates. The meeting topic(s) may be provided by the EVSCI HSE Manager, but meeting leaders are expected to select meeting topic(s) relevant to their work scope and site conditions. Meetings will generally last 30-45 minutes. EVSCI and/or Client representatives may attend Contractors, Subcontractors and Suppliers meetings to ensure compliance and quality of delivery. Attendance and minutes will be taken. Records will be retained by the respective Contractors, Subcontractors and Suppliers and shall be available for review by EVSCI HSE Coordinators on request.

13.7 DAILY TOOLBOX TALKS

Contractors, Subcontractors and Suppliers will conduct daily Toolbox Talks (TBTs) or meetings with their respective employees prior to engaging in work activities at the start of each shift. This brief daily meeting must be job-specific with HSE content (ex. Work Place Hazard Analysis/Stop Look Assess and Manage cards, Job Safety Analysis and procedures) and review general toolbox topics in accordance with work site procedures. These are anticipated to be no longer than 20 minutes in duration; however, may take longer depending on the task(s) being discussed.

TBTs will be carried out by supervisors/foremen/lead hands utilizing work site-approved forms to ensure that hazards relating to the work being conducted are clearly identified and the relevant precautions are explained. Minutes will be maintained and actions tracked to completion.

13.8 ONE-ON-ONE PERSONAL CONTACTS

EVSCI will conduct one on one Personal Contacts with work site employees to discuss relevant work at hand, hazards to be aware of and any other matters relevant to the safety and production of the work site. Documentation of these Personal Contacts will be signed by employees that took part in the discussion. Personal Contacts will be documented on work site-approved forms and kept on file at the work site

13.9 SAFETY STAND DOWNS

Safety Stand Downs may be held periodically to allow EVSCI management and Client to address safety issues directly with workers. A safety stand down can be implemented when there is a high potential risk incident learning to be communicated, in response to an incident or in response to adverse safety trends.

Safety messages that trickle down to workers may become diluted. A Safety Stand Down lead by EVSCI management can be an effective mechanism to communicate on key safety issues and demonstrate management’s commitment to HSE.

Site-wide Safety Stand Downs involving a suspension of all work activities will be conducted at the instruction of the EVSCI Project/Site Manager and/or designates in consultation with Client Management and the EVSCI HSE Manager.

A Safety Stand Down can take place at any time, and may be in response to a major incident, or as a result of safety or productivity successes. It can take place once, for a day or a week, or on a monthly basis. The important thing is to make time for safety, no matter when that might be.

Contractors, Subcontractors and Suppliers must advise the relevant EVSCI Project/Site manager and/or HSE manager prior to initiating a Safety Stand Down among their own workers.

13.10 HSE COMMUNICATION SITE NOTICE BOARDS

Each Contractor, Sub-contractor and Supplier working on the Work Site shall ensure that an HSE Communication board is installed at a location easily accessible by their employees and maintained in a clean, organized and professional manner. On a weekly basis, prior to the scheduled weekly Construction/Mining and HSE meetings, boards shall have all current information posted. HSE Communication board shall be securely mounted, kept in good repair, and are not subjected to environmental conditions which may cause damage. The board must be constructed in a manner so that it is durable, functional and reusable. A standard layout will be developed for site use.

Site communications that are intended for board distribution will be sent out both in soft copy and hard copy format to ensure that all Contractor(s), Sub-contractor and Supplier receive the same information to disseminate at the same time to their respective workforce. Communications which are of high importance will be marked accordingly.

EVSCI HSE Coordinators will audit posting boards on a monthly basis to ensure Contractor(s), Sub-contractor and Supplier maintain a high level of care and diligence. Information posted on the boards shall include, but not limited to:

HSE policy statement.

Ontario OH&SA & Regulations Mining/and/or Construction (Green Book).

WSIB Regulation 1101 (Booklet).

Workplace Discrimination, Harassment, Violence and Horseplay Policy and Procedure.

Emergency Response Plan.

The Project/Site manager and HSE Manager, or designate will approve all HSE alerts prior to distribution.

14 TRAINING

14.1 TRAINING NEEDS ASSESSMENT

EVSCI will conduct an initial assessment of training needs to define the minimum skills and knowledge required by all Project work site personnel. This assessment will be conducted using a Training Evaluation Matrix reviewed and revised periodically as site conditions change. The assessment will include legislated training requirements. It will apply to EVSCI, Contractors, Subcontractors and Suppliers working on the Project work site for the execution of their scopes of work. Training needs will be documented in the Project work site Training Matrix.

Contractors, Subcontractors and Suppliers will be provided with the Project work site Training Matrix, but in addition must conduct a training needs assessment of their own specific to their scope of work and submit to EVSCI a work site-specific Training Matrix.

14.2 COMPETENT PROJECT SITE EMPLOYEES

EVSCI Contractors, Subcontractors and Suppliers working on the Project work site shall be competent to perform their work, in accordance with the Ontario Occupational Health and Safety Act and its Regulations:

Sec. 1(1) “competent person” means a person who,

(a) is qualified because of knowledge, training and experience to organise the work and its performance,

(b) is familiar with this Act and the regulations that apply to the work, and

(c) has knowledge of any potential or actual danger to health or safety in the work place.

EVSCI, Contractors, Sub-contractors and Suppliers are responsible for ensuring that their employees are competent.

Contractors, Sub-contractors and Suppliers must maintain documentation to demonstrate proof of competency of their employees. And shall provide EVSCI with proof of such training on request. It is the responsibility of Contractors, Sub-contractors, and Suppliers to ensure that their employees arrive at the work site suitably trained and competent to perform the expected tasks and duties within their scope of work.

It is not the responsibility of EVSCI or the Project work site to compensate any Contractors, Sub-contractor or Supplier for training including costs associate with the training instructor, training time for workers and equipment used for instruction. Failure to comply with the requirements to provide competent workers will be considered non-compliance to this Project HSE Management Execution Plan and could result in removal from the site.

14.3 PROJECT SITE GENERAL ORIENTATION

EVSCI will develop a Project work site-specific general orientation program and all Contractors, Subcontractors and Suppliers are required to attend prior to commencement of work. The general orientation program will include but may not be limited to:

Injury Management & Reporting Injuries.

Alcohol & Drug Fit-to-Work.

WHMIS.

Workplace Stop Look Assess Manage process.

Norcat orientation.

Tag-In & Tag-Out for Underground.

Personal Protective Equipment requirements.

The Project work site general orientation is designed to give project site personnel a general overview of important HSE information

Contractor(s) Subcontractors and Suppliers will be required to register persons into the orientation through the project HSE administrator, and provide proof of orientation, WHMIS, Norcat training, and any other training or certification as required prior to the employees being mobilized to site.

Orientations will be introduced by a member of the EVSCI HSE Department or a member of the construction management team, with a short briefing on the work sites commitment to the health, safety and the environment.

14.4 CONTRACTOR PROJECT SITE SPECIFIC ORIENTATIONS

In addition to the Project work site general orientation, Contractor(s), Subcontractors and Suppliers will provide their own employees with a site-specific orientation that addresses HSE management specific to their scope of work.

14.5 VISITORS AND SHORT-TERM SERVICE PROVIDERS

Visitors who will be attending meetings and not performing any hands-on work shall attend the Project work site Visitors orientation.

Visitors may include but not limited to sales representatives, consultants, union officials and representatives, guests on an authorized tour, delivery drivers, prospective service providers or regulatory personnel.

14.6 CONTRACTOR/SUBCONTRACTOR TASK-SPECIFIC TRAINING

EVSCI, Contractor(s), Sub-contractors and Suppliers are responsible to ensure their employees have received adequate task-specific training required to safely conduct work on the work site.

14.7 HAZARD ASSESSMENT AND INTERVENTION TRAINING

Contractor(s), Sub-contractors, Suppliers working on the work site shall ensure that appropriate and suitable training in hazard identification, risk evaluation and control is conducted for their management, supervisors, foreman, lead hands and workers. This training will include the requirement for prompt and appropriate interventions where there is a potential for a situation to result in harm to a person, loss of property, equipment, assets or the environment.

It is the responsibility of the Contractor(s), Sub-contractors, Suppliers or other persons working on the Project work site to ensure that their employees have been suitably trained to conduct a hazard and risk assessment of their work area, and document their findings and controls on a Task Hazard Analysis Card and/or Stop Look Assess Manage Card and/or Job Hazard Analysis/Site Safety Assessment form.

14.8 TRAINING FOR NON-ROUTINE TASKS

Should work activities be encountered which are deemed to be non-routine in nature, it is the responsibility of the Contractor(s), Sub-contractors and Suppliers to plan for the work appropriately. Non-routine work will be assessed for unanticipated hazards and the associated risks, and a Job Safety Analysis (JSA)/Site Safety Analysis will be completed. During the JSA/SSA it may be determined that the non-routine work requires personnel to complete additional training to safely complete the assigned work. This training must be provided to all personnel who are not familiar with the non-routine work.

The completed JSA/SSA must be reviewed with all supervisors/foreman/lead hand and workers who will be completing the non-routine work prior to authorizing the work to commence.

Management and supervisors/foreman/lead hand will not allow any worker to conduct work activities associated with a non-routine task for which additional training requirements are identified until such training has been provided and confirmation of understanding has been received.

Should a worker be assigned a task that is not routine for their trade or qualification, it is their responsibility to inform their supervisors/foreman/lead hand.

14.9 SPECIALIZED TRAINING

Contractor(s), Sub-contractors and Suppliers will ensure that employees who are hired because on their specialized training and/or knowledge provide proof of those qualifications. Specialized training may be conducted by a third party training group who

are a recognised training company and have detailed knowledge in the requirements of the work and training needs.

Generally, personnel must have received any necessary specialized training prior to mobilizing to site, but in some cases during the implementation phase, unanticipated specialized training may be required. EVSCI representatives will review the scope of work with Contractor(s), Sub-contractors and Suppliers to determine if an alternate approach may be used to complete the task.

14.10 REFRESHER TRAINING

EVSCI, Contractor(s), Subcontractors and Suppliers conducting work on the work site must ensure that their employees receive appropriate refresher HSE training as required.

14.11 PROOF OF TRAINING

EVSCI Contractor(s), Subcontractors and Suppliers will ensure that workers who have successfully completed required training programs are issued proof of training received. The proof of training must have the expiry date on the card. Contractors, Subcontractors and Suppliers will retain training records for their own employees, and have them available on site to provide to EVSCI representatives upon request. Training records must be kept at the work site for the duration of the Contractors, Subcontractors and Suppliers contract and made available for auditing.

14.12 SHORT-SERVICE WORKERS AND NEW AND/OR INEXPERIENCED WORKERS

New and/or inexperienced workers are recognized as being a higher risk to a worksite and more likely to suffer an incident. Older, more experienced employees may have many years’ experience at their craft, but may be new to the site and also have a higher potential to be involved in an incident resulting in harm or loss. The main concern is not a lack of experience, but rather a general lack of experience in a work environment.

Short-service employees are normally any Contractors, Subcontractors and Suppliers personnel with less than six months experience in the same job type or with his/her present employer, but may be less.

It is the responsibility of all Contractors, Subcontractors and Suppliers to lead new and inexperienced employees, as well as more senior and experienced employees through a structured mentoring and coaching program to mitigate the associated risks of being introduced into a new work environment, and to build a positive culture and safe behaviours.

All Contractors, Subcontractors and Suppliers shall have a short service worker program in order to introduce new and inexperienced workers to the construction/mining industry by providing direct quality instruction and supervision for the performance of their duties. All short service workers will not only be mentored, they must be easily identifiable through an approved means of identification for an allotted mentoring period until the respective management and supervision deems the employee ready for work under normal or minimal supervision.

15 COMPLIANCE MONITORING AND REPORTING

During the contract execution phase, EVSCI shall monitor the Contractors, Subcontractors and Suppliers work activities to ensure alignment with the Project strategies and the Project HSE Execution Plan.

The methods used to evaluate the effectiveness of the HSE controls within the Project/Work site HSE management system are outlined in the following subsections.

15.1 ACTIVE MONITORING

Means of active monitoring will include but not limited to:

Inspection by joint team of site management, HSE and JH&SC representatives.

Observation of work and behaviour by supervisors, foreman, lead hands to assess compliance with site HSE rules and procedures (job observation form).

Monitor work performance against project/work site HSE objectives.

Corporate management visits incorporating HSE related activities.

Ensure that appropriate and suitable documentation is supplied and maintained.

Audit work activities and verify compliance.

Maintain good communications with the Contractors, Subcontractors and Suppliers.

Monitor how the Contractors, Subcontractors and Suppliers manages new hazards.

Monitor how the Contractors, Subcontractors and Suppliers manages incidents resulting in harm or loss.

Assess residual risks from construction/mining activities before handover and acceptance.

Verify Contractors, Subcontractors and Suppliers conformance with the project HSE program and compliance with the Act and its Regulations.

Verify all issued non-conformance and non-compliance matters have been actioned, followed up, and closed out.

Check, monitor and audit the Contractors, Subcontractors and Suppliers HSE performance and documentation.

15.2 REACTIVE MONITORING

Reactive monitoring measures accidents, incidents, ill health, hazards and non-

conformance reports.

The following reactive tools will be utilized on the Project/Work site:

Incident Review Panel.

Incident tracking system.

Monitoring performance against Project/Work site lagging indicators.

The extent of intervention by EVSCI with the Contractors, Subcontractors and Suppliers shall be dependent and influenced by a number of factors including, but not limited to, the following:

The level of risk identified associated with the work.

Complexity of the tasks associated with the work.

Organizational control of the workplace.

Interaction with other Contractors, Subcontractors and Suppliers on the project worksite.

Duration of the contract.

Incident frequencies and severity of incident.

Level of compliance with the project HSE Execution Plan.

Both active and reactive monitoring and results will be reviewed at the relevant HSE Steering Committee meetings. This is further supported by the monthly EVSCI/Client project HSE meeting.

15.3 HSE REPRESENTATIVES

Contractors shall have a full-time HSE representative when the Contractor’s site presence exceeds 15 workers (inclusive of supervisory personnel and sub-contractors). or whenever EVSCI management team recognises a need for one.

Prior to mobilization on-site, Contractors, Subcontractors and Suppliers shall submit the qualifications complete with Project roles and responsibilities of their HSE representative(s) to EVSCI HSE manager for review and Approval. It is the responsibility of the Contractors, Subcontractors and Suppliers to provide qualification information in a timely manner to not cause any schedule delays.

A second HSE representative shall be added when the Contractors, Subcontractors and Suppliers workforce reaches 75 persons, and an additional HSE representative shall be added for every additional 100 persons.

If additional resources are deemed necessary, the required staffing shall be based on the hazards present in the work area.

15.4 CONTRACTOR STEWARDSHIP

If the Contractors, Subcontractors and Suppliers are not working to expected HSE standards, EVSCI shall discuss the deficiencies with the persons concerned and attempt to work with the Contractors, Subcontractors and Suppliers to resolve identified problems, concerns or issues.

At the completion of the contract, where appropriate feedback is to be provided to the Contractors, Subcontractors and Suppliers on their HSE performance, EVSCI shall provide this feedback.

15.5 NON CONFORMANCE AND NON COMPLIANCE

During work activities conducted for the project work site, should there be non-conformance in terms of HSE or non-compliance in terms of legislation, EVSCI will:

Issue and record non-conformance reports associated with non-conformance to the Project work site HSE Plan.

Issue and record non-compliance reports associated with non-compliance to legislation.

Review and confirm corrective actions implemented as a result of incidents.

Issue formal notices to the Contractors, Subcontractors and Suppliers where agreed corrective actions have not been taken in an agreed or timely manner.

Suspend work activities.

Terminate the contact.

15.6 HSE CLOSEOUT REPORT

EVSCI will be responsible to ensure that each Contractors, Subcontractors and Suppliers is evaluated upon completion of their scope of work and demobilization from site. The HSE closeout report will be reviewed with the Contractors, Subcontractors and Suppliers.

The evaluation will be based on HSE performance, conformance and compliance to the Project HSE Execution Plan, legislation and will include, but not limited to, the following information:

HSE incident data and statistics.

Summary of significant incident(s).

Conformance issues with the project HSE plan.

Compliance Issues with legislation.

Quality of the Contractors, Subcontractors and Suppliers HSE Plan.

Safe planning and execution of work activities.

Highlights of positive and negative aspects of HSE performance.

The HSE close out report and associated data for the Contractors, Subcontractors and Suppliers will be archived and maintained for future reference. The results of the report will be communicated to the appropriate stakeholders, and the HSE record shall be taken in to consideration for future work for Contractors Subcontractors and Suppliers engagement.

15.7 ACCIDENTS / INCIDENTS / NEAR MISSES

All accidents, incidents, and near-misses must be reported and investigated, and corrective actions must be closed out within a satisfactory time-frame in accordance with the EVSCI Procedure for Accident-Incident Reporting and Investigation.

All injuries shall be reported immediately to the Health/First Aid Centre.

Any person working on the Project/Work site including but not limited to

EVSCI, Contractors, Subcontractors and Supplier employees requiring a visit to the Health Centre for both work and non-work related issues must be accompanied by their supervisor, foreman, lead hand or HSE representative.

A supervisor, foreman, lead hand or HSE representative are responsible for

signing their employee in at the Health/First Aid Centre reception as well as signing them out

15.8 ACCIDENT, INCIDENT, AND NEAR MISS NOTIFICATION REQUIREMENTS

1 All accidents, incidents and near misses will be reported to the direct supervisor/foreman/lead hand immediately.

2 Initial notification by supervisor/foreman/lead hand, and/or HSE representative responsible for the activity or the area of Contractors, Subcontractors and Supplier shall notify the EVSCI HSE Department immediately.

3 Supervisor/foreman/lead hand, and/or HSE representative of Contractors,

Subcontractors and Supplier shall report incident to Project/Work site HSE Hotline within 4 hours. Hotline boiler plate form will be made available for all Project/Work site management to use.

4 Contractors, Subcontractors and Supplier shall submit Preliminary Incident

Report to EVSCI HSE department within 12 Hours of incident occurring.

16 Contractors, Subcontractors and Supplier shall complete and submit the Final Report to EVSCI HSE department within 48 Hours.

17 Contractors, Subcontractors and Supplier must request extension for accidents

or incidents that may require more time for proper investigation. 18 Contractors, Subcontractors and Supplier will be required to use the provided EVSCI accident / incident and near miss investigation report and procedures. 19 Contractors, Subcontractors and Supplier shall implement the "Freeze the

Scene Protocol" for all incidents, not just actual or near miss high potential incidents (HIPO), until such time that approval is given by EVSCI, Client management or MOL inspector that the scene can be released.

20 EVSCI will be responsible for the statutory notification of reportable incidents involving EVSCI, Contractors, Subcontractors and Supplier personnel on site.

21 EVSCI incident review panels (IRP) will be undertaken for recordable injuries and high potential incidents to ensure that investigation findings are adequate and that resulting actions support sustainable improvement. The relevant Contractors, Subcontractors and Supplier will attend these reviews. Client will be invited to attend.

22 EVSCI will determine necessity of Root Cause Analyses for Level 2 factor of 3 for incidents or higher using selected incident investigation and root cause analysis techniques EVSCI Root Cause Methodology.

23 The lessons learned from investigation will be communicated to all EVSCI Corporate and Project work site management, staff, Client, Contractors, Subcontractors and Supplier and through site HSE orientation, safety meetings, toolbox talks, safety alerts, focus presentations and HSE communication boards.

24 EVSCI data base is the adopted Incident Management System tool. It will be used to track all the corrective actions and recommendations from the accident/ incident investigation reports. Actions will only be closed when sufficient evidence has been received and verified by the EVSCI Project work site HSE Department.

16. HSE ASSURANCE

The HSE assurance process will ensure compliance to Client(s)/EVSCI Project standards. HSE audits and inspections will be conducted on a regular basis. These audits and inspections involve the systematic review of premises, plant, and equipment to ensure the continued effective operation of HSE controls. Additionally there is direct observation of work and behaviour in order to assess the conformance with procedures, rules, and systems with a particular emphasis on health, safety and the environment. And compliance to the Act and its regulations.

16.1 HSE VISITS AND INSPECTIONS

HSE visits/inspections assist in improving HSE performance, improving employee buy in, and preventing accidents. They involve observation of work practices and/or physical conditions to identify exposures that could, if left uncorrected, result in injuries to people, losses to process, production and equipment or adverse environmental impacts.

16.2 PLANNED INSPECTIONS

Project HSE workplace planned inspections will be conducted regularly in accordance with the EVSCI HSE Workplace Inspection Program. These inspections involve the systematic inspection of premises, plant, and equipment to ensure the continued effective operation of hardware controls.

The working practices and behaviours of project personnel will also be observed directly to assess compliance with HSE procedures, safe work practices, permits and site rules.

16.4 INFORMAL INSPECTIONS

EVSCI project/site managers/, project coordinators and HSE coordinators and environmental coordinators will conduct regular, informal inspections of their area of responsibility as a part of their daily work activities and identify corrective action measures on identified non-conformances and non-compliances.

Areas of focus will include work practices, tools, equipment, and workplace physical conditions.

Contractors, Subcontractors, Suppliers supervisors/foreman/lead hands have the responsibility to investigate and inspect unsafe conditions reported by personnel under their direction.

Any condition that is immediately dangerous to life or could cause serious injury will be stopped barricaded off and/or guarded by personnel and reported forthwith. Any

condition that cannot be corrected immediately and is likely to cause damage shall be reported to the Contractors, Subcontractors, Suppliers HSE representative, superintendent, or other management personnel with corrective action taken ASAP and at least within that shift time frame.

16.5 EQUIPMENT INSPECTIONS

Contractors, Subcontractors, Suppliers will establish a program of pre-mobilization and periodic inspection of all mobile and static equipment and tools. The purpose of these inspections is to verify that the equipment is in safe operating condition, and all safeguards required by the manufacturer are in place.

Inspectors must be designated by the Contractors, Subcontractors, and Suppliers general foreman/superintendent based on competency and must have accredited training certification.

All Contractors, Subcontractors, Suppliers must have an established (CPMS) “Comprehensive Preventative Maintenance System” for all their equipment.

Requirements are:

Personnel inspecting and working on repairs to equipment must be knowledgeable, trained, and licensed. Apprentices must work under the supervision of a licensed person.

Tagging to lock out;

Tagging Do Not Operate;

Tagging to identify equipment problem; and

A documented work order process and close out process to ensure all equipment has been inspected, repaired and released when repairs are completed.

16.6 OTHER INSPECTIONS

Shall have “Competent” personnel, whose trade or experience has given them knowledge of the tool or equipment being inspected, shall inspect tools and equipment listed below.

Fall arrest equipment such as harnesses, lanyards, lifelines, horizontal cable lines and rope grabs.

Rigging such as slings, hooks, shackles, come-a-longs, hoists and chain falls.

Ladders and scaffold material (inspected on arrival at site location).

Scaffolds inspected after being built, prior to every use and weekly thereafter.

Electrical equipment such as cords, electrical tools.

GFIs, welding cables, gensets, etc.

Electrical tools and equipment shall be inspected, logged and colour coded by competent licensed electricians.

Inspection criteria established by the manufacturer for the specific tool or equipment shall be utilized. A tools and equipment inspection record form shall be used for items not specifically covered by a manufacturer’s criteria.

Upon passing an inspection, tools and equipment will be documented and colour coded. Colour coding can be done with tape being wrapped around a part of the item at an obvious location. The yearly colour codes are as follows:

1. January to March – Blue

2. April to June – Brown

3. July to September - Yellow

4. October to December - White

Colour codes will be posted at the tool cribs for the current quarter. Two weeks before the end of the current quarter, the next quarter’s colour code will be posted with the current one and a notice will be issued in the weekly tool box meeting to advice of the new colour code and inspection requirement.

The two-week lead period will allow for the gradual return of tools/equipment and avoid problems with inspection of large quantities and last minute returns. During this period both colour codes will be valid.

Defective tools requiring repairs must be tagged with a RED “Defective Tool/Equipment Tag” and returned to a central location (typically, the tool crib) for repair. Users shall record defects or required repairs on the red tag as specifically as possible. Tools/equipment that cannot be repaired to perform in the intended manner shall be removed from the project site.

Vehicles and equipment such as trucks, forklifts, scooptrams, jumbos, rock bolters, personnel hoists, cranes etc. will be maintained and repaired in accordance with the manufacturer’s specifications, or if required those of a professional Engineer. These inspections and repairs will fall into the CPMS category.

16.7 AUDITS

EVSCI will develop a program to audit compliance to site HSE requirements. Audits will be conducted for compliance to specific systems, procedures or standards. The program will also include formal cross-site audits of high risk activities such as lifting operations, confined space entry and working at height or any other critical or legislated activities.

16.8 INTERNAL AUDITS

Internal audits will be undertaken by EVSCI to evaluate Contractors, Subcontractors, and Suppliers health, safety and environmental management system objectively to determine whether they comply with regulatory requirements and if they conform to EVSCI HSE expectations and whether these arrangements are implemented effectively.

Audits will be conducted by EVSCI Project HSE department, along with members from other departments, where required. Where applicable, a Contractor, Subcontractor and Supplier will be required to develop a support and engagement plan in response to the audit conclusions.

In addition, relevant third party HSE audits may be conducted on the project which will be identified in the project Annual HSE Audit Plan.

16.9 FOCUS AUDITS

Focus audits are targeted at a specific policy, procedure, and type of work or activity to determine if there are any deficiencies or problems that may require correction through training, substitution, elimination, or introduction of new tools, equipment policies, or procedures.

Focus audits may be used as a key indicator by all site management, staff, and employees to correct identified issues: Focus audits shall include, but not be limited to:

Hot work and fire prevention.

Manual material handling - industrial ergonomics.

Pre-equipment checks.

Pressure testing safety.

Housekeeping.

Permit to work.

Compressed gas cylinders.

Confined spaces.

Task hazard analysis/Five point safety system and risk assessments.

Piling activities.

Traffic management.

Portable ladders.

Working alone.

Fuel/Chemical handling.

Waste management.

Training audits.

Spill response equipment.

17. MANAGEMENT VISITS

During the project EVSCI corporate management will undertake site visits to the project worksites. Visits will be used as opportunities to:

Conduct HSE observations.

Conduct site workplace inspections.

Address the workforce and demonstrate visible commitment to HSE.

Take part in planned HSE meetings.

Follow up issues from previous visits.

Any deficiencies identified during such visits will be discussed with Project work site management, and corrective actions will be raised and tracked to a satisfactory closeout. Visit reports will be issued to EVSCI Corporate and Project work site management, staff, Client, Contractors, Subcontractors and Supplier.

17.1 ACTION TRACKING

Findings corrective/preventive actions arising from inspections and audits will be entered into the action tracking system administered by the HSE Department. EVSCI will track completion of action items until they are adequately closed out.

17.2 REPORTING

To monitor performance against Project HSE objectives and targets, a monthly HSE

report will be compiled by the EVSCI HSE Department. The report will summarize the

Project’s HSE performance in the preceding report period.

The completed report will be distributed to the EVSCI Project management team and Client.

The report will include information such as, but not limited to statistical, leading and lagging indicators, incident summaries as necessary, activities conducted during the reporting period, and forecasted events.

Weekly and monthly EVSCI, Contractor, Sub-contractor and Supplier summaries will be prepared. Man hours shall be reported using the last Friday of the week/month as the cut-off date. Contractor, Sub-contractor and Supplier shall provide EVSCI with their weekly HSE performance summary on the following Monday, and EVSCI will forward the applicable HSE performance reports to the Client by the following Tuesday. Monthly summaries are reported year to date with the new reporting year starting in January.

18. MANAGEMENT REVIEW

A project HSE Management System Review meeting will be held once each year to ensure the effectiveness of the managements systems, joint problem solving, and the development of a constructive working relationship to enhance and promote HSE on the Project. This meeting will be attended by the EVSCI President and/or Vice President, Project Manager, Deputy Project Manager, Site Manager HSE Manager, Heads of Departments, Client representatives, and other management personnel, as required.
