AUDITOR’S REPORT

BKD LLP has completed an evaluation of the City’s Compensation and Benefits. The purpose of

the project was to evaluate the May 2017 Total Rewards Assessment report prepared by Segal

Waters Consulting to identify any gaps related to meeting the objectives of the assessment,

evaluate the self-insurance presentation prepared by Lockton Companies (Lockton) and assess if

conclusions presented in the report may represent opportunities for the city’s health care plans;

and evaluate the City’s elected official compensation calculation.

The evaluation resulted in recommendations for improvements in compensation and benefits

processes, provides guidance’s for consideration of self-insurance options and adds clarification

to the elected official compensation calculation process.

We extend appreciation to OHR Compensation and Benefit departments’ personnel who assisted

and cooperated with us and BKD LLP during the evaluation.

We want to thank the city management and staff members who contributed positively to our efforts. We have performed the procedures enumerated in this report, which were agreed to pursuant to our Amendatory Agreement of the original Paragon Audit & Consulting Agreement dated November 2016. This engagement was not an audit and was not designed to provide assurance over the prevention or discovery of errors, misrepresentations, fraud, or illegal acts. Inherent limitations in any internal control structure are that errors, fraud, illegal acts, or instances of noncompliance may occur and not be detected. Controls may become inadequate because of changes in conditions or deterioration in design or operation. Two or more people may also circumvent controls or management may override the system.

Our Services were performed in conformance with International Standards for the Professional Practices of Internal Auditing established by the Institute of Internal Auditors. We were not engaged to provide an opinion with respect to the effectiveness of controls or degree of compliance with policies and procedures or applicable laws and/or regulations. Executive Summary

Background

The City & County of Denver (the city) has approximately 13,600 employees as of January 2017. The City & County of Denver’s Office of Human Resources (OHR) department develops and delivers programs and services to build workforce capability and drive business outcomes that best serve the public interest. The current merit system was established by charter amendment because the voters of Denver decided they wanted the city government to operate by merit. Under the merit system, applicants are given a chance to compete and be hired based upon their knowledge, skills, and abilities, without regard to their race, creed, national origin, political affiliation, age, sex, sexual orientation, or disability.

OHR is overseen by the Career Service Board which consists of five Denver citizens appointed by the mayor for five-year staggered terms. The Board provides oversight for OHR. It maintains the merit system, which is the foundation of the career service personnel system. It is responsible for setting policy, considering appeals, and making rule changes that enhance the work environment. The Career Service Board selects the OHR Executive Director and also appoints Career Service Hearing Officers.

Denver’s Mayor and City Council oversee OHR and the Career Service Board. The city utilizes a strong mayor-form of governmental system, which consists of an executive branch, a mayor, and a City Council as the legislative branch, all of which are elected by citizens. Changes to compensation, pay grades, classifications and benefits recommended by OHR and the Career Service Board are ultimately approved by the Mayor; in a strong mayor-form of government the mayor can also veto City Council’s actions.

The City and County of Denver’s government structure provides for wide legislative power. For example, the mayor can approve or veto any ordinances or resolutions approved by the council, sign all bonds and contractors, is responsible for city budget, and can appoint people to various city departments and commissions.

Scope and Procedures

BKD, LLP Enterprise Risk Solutions (BKD) was engaged to perform the following:

1. Evaluate the Total Rewards Assessment report (dated May 2, 2017) from Segal Waters Consulting (Segal) to assess the scope of procedures performed with respect to meeting the objectives of OHR’s assessment of compensation and benefits.

2. Evaluate presentations prepared by Lockton Companies (Lockton) and assess if the conclusions presented in these reports could represent the right opportunity for the city.

3. Evaluate the city’s elected official compensation calculation.

To complete our evaluation, we interviewed several individuals within OHR and the city and obtained various reports and data.

Compensation

Background

In November 2015, Segal was contracted by OHR to perform a total compensation analysis for the City & County of Denver. Segal’s role in the total rewards assessment was to conduct a valid, reliable, and useful market study by developing a market study methodology, identifying benchmark job titles, identifying comparable employers and other data sources, and collecting and analyzing the market data. Once the data was analyzed, Segal was to conclude on how the city’s total compensation compared to the market.

Segal’s scope of work for the engagement included:

• an analysis of the city’s pay philosophy and total rewards philosophy,

• analysis of direct compensation,

• analysis of pay practices,

• paid time off benefits,

• analysis of health and welfare benefits offerings (including employer and employee cost sharing),

• retirement benefits (including employer and employee match, if applicable), and

• any additional benefit offerings compared to similar entities.

Segal’s review was released in 2017 and included a representative sample of 102 titles within the city’s career services structure and review of compensation packages from 21 peer employees identified in conjunction with OHR.

Segal’s limited review concluded that the city’s pay and benefit package is “at market” when compared with other similar public sector organizations. In addition, when compared to the private sector, Segal concluded the city is “above market” largely due to the city’s health and retirement benefits. See Appendix A for Segal report.

Scope

The City and County of Denver Auditor’s Office engaged BKD to evaluate the Total Rewards Assessment report from Segal to assess the scope of procedures performed within the original scope of the project.

Observations and Recommendations

Observation 1

The Segal compensation report relied on inputs and sample suggestions from OHR.

Segal’s assessment was not completely independent. OHR guided or assisted with key aspects of Segal’s study by suggesting certain comparable entities and classifications to review. With respect to the comparable entities, OHR referred Segal to an established list of national cities that were maintained and chosen based upon rank of estimated population as well as those with a strong mayor-form of government (Mayor, City Council). The reviews of these cities are updated annually within the OHR department. Additionally, at the beginning of the project, OHR suggested a list of job titles. Segal reviewed those titles and then suggested their own to utilize, some of which were on OHR’s suggested list and some were not. Segal’s scope of work for which they were contracted covered a representative sample of job titles within the city, so a sample of job titles were compared to market. The titles selected were positions which had a larger number of employees so that the analysis would cover a larger population of the city’s employee base.

Observation 2

The Segal Compensation report represents a limited view of the city’s compensation landscape.

The amount of job titles analyzed by Segal was limited. The analysis was completed through sending surveys with respect to the 102 titles selected to the identified cities/entities. Only 96 titles returned with, what Segal reported as, sufficient data to analyze. Segal compared the survey responses to the city’s comparable titles. Since the scope was limited, not all job titles within the city were reviewed and compared to market data. OHR is only responsible for evaluation of pay related to individuals with positions that are defined as career service. The following classifications of employees were not included in the study (as indicated by the city municipal code Article IX, Part 1, § 9.1.1, E).

The Career Service shall comprise all employees of the city and their positions except:

(i) elected officers;

(ii) members of the Mayor's cabinet;

(iii) the Director of Excise and Licenses;

(iv) up to fifty employees appointed to serve at the pleasure of the Mayor in positions specifically designated or created by the Mayor in any department or agency of the city under the direct control of the Mayor;

(v) county court judges and magistrates;

(vi) members of the Classified Service of the Police and Fire Departments, the Police Chief if not a member of the Classified Service, the Fire Chief if not a member of the Classified Service, and the Sheriff;

(vii) attorneys and part-time employees employed by the District Attorney, other employees of the District Attorney excluded from the Career Service and placed in an alternate merit personnel system pursuant to state law, and up to ten employees

appointed to serve at the pleasure of the District Attorney in positions specifically designated or created by the District Attorney in the District Attorney's office;

(viii) certified public accountants employed by the Auditor and up to five employees appointed to serve at the pleasure of the Auditor in positions specifically designated or created by the Auditor in the Auditor's Office;

(ix) employees of the Denver Art Museum, the Denver Museum of Nature and Science, the Denver Zoological Gardens, and the Denver Botanical Gardens;

(x) persons retained on a contractual basis to perform professional or technical services for limited periods of time;

(xi) employees of the City Council, Library Commission, Civil Service Commission, Board of Adjustment, and Denver Water; and

(xii) any hearing officers and up to two employees in positions specifically designated or created by the Career Service Board, appointed to serve at the pleasure of the Board.

(xiii) any employee appointed to serve at the pleasure of the mayor for the purpose of monitoring internal investigations and disciplinary actions in the Department of Safety, and any employees appointed by the monitor to serve at the pleasure of the monitor. The appointment of any monitor by the mayor pursuant to this or any other provision of the charter shall require confirmation by the City Council.

(xiv) the Director of Elections and no more than one other employee in a position specifically designated or created by the Clerk and Recorder, appointed to serve at the pleasure of the Clerk and Recorder. Any employee of the Denver Election Commission as of July 16, 2007, and formerly excepted from the Career Service pursuant to this section shall retain his or her position as an employee of the Clerk and Recorder if the employee qualifies to retain the position in accordance with the rules of the Career Service Board.

(xv) up to five employees appointed to serve at the pleasure of the Manager of Aviation in executive or other managerial positions in the Department of Aviation.

Additionally, the number of titles and pay grades reviewed by Segal is a representative sample of the city. Per OHR, the titles analyzed by Segal were selected to cover the largest percentage of city employees but only represented 11% of the city’s job titles. The city has 903 titles and 467 different pay grades. The Segal report covered 96 of 903 benchmark titles (11%) and 68 of 467 pay grades (15%). The positions chosen covered about 47% of employees. See Appendix B for a full list of pay titles and pay grades not included.

Observation 3

An independent audit of the city’s methodologies with respect to pay plan adjustments, classifications, and benefits has not been completed.

The city’s municipal code Section 18-5 requires that every four years the Mayor commission an independent audit of survey methodologies used by OHR in their recommendations for pay plan adjustments, classifications, and benefits. The most recent audit, dated in 2016, was commissioned by OHR utilizing Segal, as has been the case in prior years when OHR/CSA commissioned similar audits. Segal completed their audit and provided some recommendations regarding changes to methodology; however, this particular audit does not appear to meet the requirements of the city’s municipal code with respect to independence. Segal’s report did not specify what professional framework or standards (i.e., GAGAS) were used during their audit.

Sec. 18-5. - Annual setting of classifications, pay plans and benefits.

(d) Audit of survey methodologies and recommendations. In 2006 and not less than once every four (4) years thereafter, the mayor shall commission an independent audit of survey methodologies, determinations regarding generally prevailing rates and prevailing practices, and recommendations regarding pay rates and benefits made by the career service board or the Office of Human Resources Executive Director in the preceding year. Results of the independent audit shall be provided by the mayor to the City Council, the career service board and the Office of Human Resources Executive Director.

Segal performed an audit of the city’s Annual Pay Survey methodologies and compared those methodologies to Segal’s own methodologies. Segal indicated in their report that they reviewed and completed the following:

• the third-party participation process,

• external data aggregation processes and the accuracy of the city’s rate determination,

• the identified labor markets and data sources,

• local and national data sources and the blending and use of the data,

• the process of linking benchmark data to occupational groups and the resulting range assignments, and

• analyzed a statistically significant number of benchmarks to ensure a strong job matching process and to recommend improvements to the process. See Appendix C for Segal audit report.

Recommendation

In an effort to confirm the findings with respect to the Segal audit of survey methodologies and recommendations, BKD recommends that the Mayor’s office commission this audit every four years as required in code Section 18-5 and address the specific objectives outlined: “The Mayor shall commission an independent audit of survey methodologies, determinations regarding generally prevailing rates and prevailing practices, and recommendations regarding pay rates and benefits made by the career service board or the Office of Human Resources Executive Director in the preceding year.” The Mayor’s office should determine and conclude on the definition of an audit and determine if that includes an independent comparison study. The Mayor’s office should select the qualified independent firm and agree to the scope work to be performed by the qualified firm. Also, BKD recommends that the firm selected utilize and describe the standards or professional frameworks used in assessing the methodologies and provide their opinions with respect to the methodologies utilized by the city.

Observation 4

OHR’s annual pay analysis does not currently include benefits analysis.

In addition to the compensation and benefit study performed every four years by an outside consultant, OHR conducts a market pay survey on an annual basis. The annual market survey completed by OHR does not include inquiries related to employee benefits; it only includes compensation. As total compensation calculations often consist of pay plans and benefits of an organization, it would be beneficial to survey the same peer groups as the compensation study regarding their benefits packages when trying to meet the city’s stated objective of attracting a competent workforce. During our assessment, we noted the following items:

• City code does not specify the frequency in which benefits should be reviewed.

• City code requires the Mayor or City Council to request a review of employee benefits, not OHR.

Sec. 18-5. - Annual setting of classifications, pay plans and benefits.

(c) Benefits. Upon the request of the mayor or the city council, the Office of Human Resources Executive Director shall survey and recommend changes to employee benefits as necessary to attract and retain a qualified and competent workforce and to maintain the city's policy to provide generally prevailing compensation to employees in the classifications set forth in subsection (a) of this section. The director shall consult with and obtain a recommendation from the employee health insurance committee as provided in division 2 of article VI of this chapter prior to recommending any change to health insurance benefits. The mayor and the city council may accept, reject or modify any benefit recommendation made by the director pursuant to this section.

Recommendations

• The Mayor’s office should indicate how often the employee benefits are to be reviewed. BKD recommends this be completed at least every other year.

• Upon request from the Mayor’s office, benefits packages should be reviewed to ensure the total compensation for city employees is in line with comparable markets.

Self-Insurance Opportunity

Background

The city utilizes Lockton Company (Lockton) for insurance brokerage services to assist and advise the city on buying and managing insurance plans, options, and plan structure. The city currently contracts with three different insurance companies to provide healthcare services for their approximately 13,600 employees. The three companies utilized are United Healthcare (UHC), Kaiser Permanente (Kaiser), and Denver Health. Currently, all three plans are operating on fully insured contracts. Fully insured contracts are healthcare plans where the employer contracts with an insurance company to cover the costs of employees and dependents, versus a self-insured plan where the employer funds health insurance benefits to employees and dependents with its own funds. In a fully insured health plan, the insurance company takes on the risk, which can often lead to higher premiums for the organization and employees. If the dollar amount in aggregate for claims increases, organizations typically experience higher renewal costs for the succeeding plan year. Alternatively, any surplus, or premiums collected minus claims paid, is realized by the insurance company instead of the city under the current fully insured model.

In November and December 2016, Lockton presented a study they completed to city leadership (members of Benefits & Finance) to show the value in the city self-insurance through UHC; according to Lockton, UHC is the only insurance provider used by the city that supports the self-insurance model. Lockton indicated that Kaiser and Denver Health do not support this. There are approximately 11,000 covered employees within the city, 60% are enrolled in Kaiser, 34% in UHC and 6% in Denver Health. In 2016 the city paid $42.6 Million to UHC out of a total estimated spend for all three insurance carriers of $94 Million.

It is important to note that under the self-insurance model, the financial risk to the city will be limited by stop-loss insurance. Stop-loss insurance policies in aggregate are designed to protect self-insured employers as a reimbursement mechanism for catastrophic claims exceeding pre-determined levels.

Lockton prepared and presented two separate presentations to city leadership within OHR and the finance organization.

• Presentation 1, in November 2016, discussed the background on self-insurance, which insurance companies the city currently has that would allow for self-insurance, and some of the limitations directly related to self-insurance. See Appendix D for presentation.

• Presentation 2, in December 2016, provided more information on the budgeting requirements and cash outlay required with self-insurance. See Appendix E for presentation.

Lockton’s presentations highlighted several benefits to the city including the calculation that the city could have realized a possible savings of $3.1 Million for the 2016 plan year for UHC policy holders only.

Scope

BKD was engaged to evaluate the Lockton presentations, assess what actions have taken place with respect to this report and to assess if self-insurance could be the right opportunity for the city.

Observations and Recommendations

Observation 1

No decisions have been made by the city regarding revising the current benefit plan relating to self-insurance. Based on a study performed in 2016 by Lockton, the city would be a good candidate for self-insurance of certain medical plan(s). Based on inquires with city staff and in corroboration with the Lockton presentations, the following was observed:

• The city has not made any decision with respect to self-insurance since the city charter/code does not clearly define who is responsible for making such a decision. Section 18-5 suggests that the Mayor or City Council should request this type of survey to be conducted by the OHR Executive Director; however, there is additional detailed within Section 18-184, the Employee Health Insurance Committee, whose duties are to “advise the career service board and the Office of Human Resources Executive Director of the needs of persons in the employ of the City and County of Denver for a medical, life, dental, and long-term disability insurance financed, in whole or in part, by the city and shall make recommendations for instituting, altering, implementing, financing or terminating such an insurance program.”

• Per Lockton’s presentations only one (UHC) of the three insurance companies utilized by the city can support the self-insurance model.

To gain further information on the feasibility of this type of insurance setup in the public sphere, BKD informally surveyed peer cities that OHR uses to benchmark the city’s compensation and benefits on an annual basis. The purpose of our survey was to assess if the city’s peers also self-fund their health insurance benefits. The results of the survey are summarized in the table below.

Recommendations

• BKD recommends that Lockton present the latest opportunities available to the city to the Employee Health Insurance Committee (EHIC) who has the authority to recommend changes to OHR and the Career Service Board.

• Any analysis performed by OHR upon the recommendation from EHIC should include the following considerations: financial, cash flow, risk tolerance levels, comparable coverage needs, and administration and compliance (fees, HIPAA, nondiscrimination).

• Should the city ultimately decide to go forward with the self-insurance option, the city should utilize EHIC, and potentially other individuals/groups from various departments within the city, to assist OHR with setup to provide comparable benefits, including plan structure and options, administration, compliance, and financial design of the program.

Elected Official Compensation

Background

Elected charter officers compensation is required to be calculated based on the following guidelines listed in Article IX, Part 2, Section 9.2.2 of the charter:

§ 9.2.2 - Limitation on salaries and benefits of elected charter officers.

(A) After January 1 of any general election year for elected Charter officers, but before the general election, the salaries of such officers shall be fixed by ordinance for the ensuing term within the limits set forth in this section. The salaries shall not exceed the lesser of:

(i) The current salaries adjusted for the cumulative percentage change over the preceding four years in the Consumer Price Index for All Urban Consumers, Denver-Boulder-Greeley, or its successor index; or

(ii) The current salaries adjusted for the cumulative percentage change over the preceding four (4) years in the mean salary of employees in the Career Service.

(B) Salaries fixed by ordinance pursuant to this section shall become effective on the first day of the ensuing term. The ordinance, once it is enacted, shall be self-executing and may not be modified, repealed or superseded during the term of office.

(C) Elected charter officers may, to the extent provided by ordinance, receive benefits paid to or on behalf of employees by the city, in an amount not to exceed the amount established by ordinance for Career Service employees.

In 2015 and in years prior, City Council has requested OHR’s assistance in completing the calculations using the Consumer Price Index (CPI) as well as career service percentage changes. For the past election cycle in 2015, OHR calculated the cumulative percentage change of employees in career services using the city’s merit budget for all regular limited and unlimited full-time career service positions. Per the Classification and Compensation Manual last updated February 2018, the merit budget which was used to calculate the cumulative salary increases, states:

The City and County of Denver maintains an annual pay for performance program that includes both a performance review and a merit increase. When available, an eligible career service employee may receive a merit increase based on the employee's performance rating. The City and County of Denver’s merit budget is approved by Budget, Career Service Board, City Council and the mayor each year. Observations and Recommendations

Observation 1

The elected official compensation calculation process and the roles and responsibilities involved should be better defined and clarified.

The salaries for elected charter officers (officials) are to be calculated based on guidelines listed in Article IX, Part 2, Section 9.2.2 of the charter. This section requires salary adjustments for officials to be adjusted for the cumulative percentage change over the preceding four years in the mean salary of the employees in the Career Service. Based on our review of this process, BKD observed the following:

• The charter does not indicate who will conduct research and perform the compensation calculation used to determine the elected official’s compensation for the succeeding four years.

• The charter specifically states the second calculation (ii from § 9.2.2 (A)) is supposed to be the mean salary percentage increases. The charter does not appear to delineate between merit based increases and other increases, such as promotional increases, which may affect career service cumulative salary percentage increases.

• There appears to be no formalized process in place to assess and validate that appropriate data is being used when performing this calculation. For example, there are no documented procedures explaining where data is obtained, what data is obtained, and how the data is processed and/or calculated.

• The methodology of how raises are applied is not consistent. For example, in some instances, the agreed raise amount is applied to official’s salary each year respectively. In other cases, the officials were given four years’ worth of raises immediately (lump sum; not distributed over four years).

Recommendations

• BKD recommends that the charter be reviewed and enhanced to include roles and responsibilities with respect to determining the official’s compensation calculation and the process as well as potential clarification regarding the calculations used.

• OHR and City Council should jointly formulate procedural documentation around the calculation of official compensation to include where data is obtained, how data is obtained, who obtains data, who performs the calculations, who reviews the calculation, what data fields are considered, timing of the calculation, timing of the payout and any other steps that need to be considered during the process, including retention of documentation for audit purposes.

Narrative for Recommendation OHR agrees that to ensure independence is maintained, the Mayor’s Office should initiate this quadrennially required process, unless OHR has initiated a Request for Proposal to examine the Classification and Pay Plan, or the Annual Pay Survey Analysis, as this supersedes the timing and resets the deadline of when the next quadrennially review is needed. In other words, the DRMC does not prevent OHR from engaging an outside consultant to review the entire classification and pay plan, changes, which may necessitate changes to the pay survey methodology. If this should occur, the next required audit would be initiated after the implementation of a new Classification and Pay Plan.

COMPENSATION RECOMMENDATION In an effort to confirm the findings with respect to the Segal audit of survey methodologies and recommendations, BKD recommends that the Mayor’s office commission this audit every four years as required in code section 18-5 and address the specific objectives outlined: “The Mayor shall commission an independent audit of survey methodologies, determinations regarding generally prevailing rates and prevailing practices, and recommendations regarding pay rates and benefits made by the career service board or the Office of Human Resources Executive Director in the preceding year”. The Mayor’s office should determine and conclude on the definition of an audit and determine if that includes an independent comparison study. The Mayor’s office should select the qualified independent firm and agree to the scope work to be performed by the qualified firm. Also, BKD recommends that the firm selected utilize and describe the standards or professional frameworks used in assessing the methodologies and provide their opinions with respect to the methodologies utilized by the City.

Narrative for Recommendation The Employee Health Insurance Committee (“EHIC”), which is appointed by the Mayor, will be presented the 2019 benefit rates at the May 2018 scheduled meeting. The EHIC is expected to make a recommendation to the Executive Director of OHR regarding the 2019 plan designs at this meeting so that benefit costs can be reviewed and approved by City Council and the Mayor in time for the 2019 budget submission and 2019 benefits open enrollment period in October 2018. As such, we are unable to initiate such a study impacting the 2019 benefits offering as the processes are already well underway. The EHIC will reconvene in January 2019 and could engage a consultant benefits study in early 2019 to provide recommendations to consider for the 2020 benefits offering.

Observations regarding health care self-insurance: • No decisions have been made by the City regarding revising the current benefit plan relating to self-

insurance.

BENEFITS RECOMMENDATION The Mayor’s office should indicate how often the employee benefits are to be reviewed and potentially update the code to more clearly define this. In addition, upon request, the Mayor’s office should send a formal request to OHR for benefits to be reviewed. Narrative for Recommendation As our insurance broker, Lockton regularly provides benefits considerations to OHR and the EHIC as part of their ongoing benefits consultancy to the City and OHR and will continue to do so. OHR introduced the recommendation to consider self-funding of our medical plans to the EHIC in 2016 and again in 2017. We also requested that Lockton provide a very thorough overview presentation to the EHIC regarding self-funding benefits structures and options. Lockton and OHR also partnered with and responded to questions from EHIC members and the City’s Budget Management Office (“BMO”) regarding the benefits of moving to a self-funding (versus fully insured funding) structure. The recommendation was to consider implementing a self-funded structure in 2020, after the expiration of the favorable two-year rate guarantee with our medical plan provider for the benefit years 2018 and 2019. During 2018, OHR has continued to work with BMO and Lockton regarding all the requirements to move to a self-funding structure for 2020 medical plans and other benefits options and costs. Lockton and OHR’s final analysis and recommendation to EHIC will include the items listed in the recommendation above.

SELF-INSURANCE RECOMMENDATION BKD recommends that Lockton present the latest opportunities available to the City to the Employee Health Insurance Committee (EHIC) who has the authority to recommend changes to OHR and the Career Service Board. Any analysis performed by OHR upon the recommendation from EHIC should include the following considerations: financial, cash flow, risk tolerance levels, comparable coverage needs, and administration and compliance (fees, HIPAA, nondiscrimination). Should the City ultimately decide to go forward with the self-insurance option, the City should utilize EHIC, and potentially other individuals/groups from various departments within the City, to assist OHR with providing comparable benefits including plan structure and options, administration, compliance, and financial design of the program.

Observations regarding elected official compensation: • The Denver City Charter does not indicate who will conduct research and perform the compensation calculation used to determine the elected officials’ compensation for the succeeding four years. • The charter specifically states the second calculation (ii from § 9.2.2 (A)) is supposed to be the mean salary percentage increases. The charter does not appear to delineate between merit based increases and other increases, such as promotional increases, which may affect career service cumulative salary percentage increases. • There appears to be no formalized process in place to assess and validate that appropriate data is being used when performing this calculation. For example, there are no documented procedures explaining where data is obtained, what data is obtained, and how the data is processed and/or calculated. • The methodology of how raises are applied is not consistent. For example, in some instances, the agreed raise amount is applied to officials’ salary each year respectively. In other cases, the officials were given four years worth of raises immediately (lump sum; not distributed over four years).

ELECTED OFFICIAL COMPENSATION RECOMMENDATION BKD recommends that the charter be reviewed and enhanced to include roles and responsibilities with respect to determining the official’s compensation calculation and the process as well as potential clarification regarding the calculations used. OHR and City Council should jointly formulate procedural documentation around the calculation of official compensation; to include where data is obtained, how data is obtained, who obtains data, who performs the calculations, who reviews the calculation, what data fields are considered, timing of the calculation, timing of the payout and any other steps that need to be considered during the process, including retention of documentation for audit purposes.
