On the adoption of technical regulations customs union

"LOW VOLTAGE SAFETY EQUIPMENT"

(Ver. Decision of the Commission of the Customs Union, EurAsEC

from 09.12.2011 N 884 , from 04.12.2012 N 247 )

In accordance with Article 13 of the Agreement on common principles and rules of technical

regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation on 18

November 2010, the Commission of the Customs Union (hereinafter -Commission) agreed to:

1. Adopt technical regulations of the Customs Union "On the security of low voltage" (TR TC

004/2011)(Attached).

2. Approve:

2.1. The list of standards as on a voluntary basis, in compliance with the technical regulations of the

Customs Union "On the security of low voltage" (TR TC 004/2011) (attached)

2.2. The list of standards containing rules and methods (tests) and measurements, including the

rules of sampling necessary for the application and enforcement of the technical regulations of the

Customs Union "On Low Voltage Safety "(TR TC 004/2011) and the implementation of assessment

(confirmation) of products (attached).

3. Set:

3.1. technical regulations of the Customs Union "On the safety of low voltage equipment"

(hereinafter - the Technical Regulations) come into force on 15 February 2013,

(Ver. Commission Decision EurAsEC Customs Union of 09.12.2011 N 884 )

3.2. documents for assessment (confirmation) of compliance with mandatory requirements

established by legislation states - members of the Customs Union or regulations of the Customs

Union, issued or adopted for the products to which the technical regulations of the Technical

Regulations (hereinafter - the product), prior to the entry into force of the Technical Regulations are

valid until the end of their actions, but no later than March 15, 2015, unless such documents issued or

adopted before the date of official the publication of this decision, which is valid until the end of their

validity.

From the date of entry into force of the Technical Regulations issuance or acceptance evaluation

documents (confirmation) of conformity with mandatory requirements previously established by the

legislation of - members Customs union or regulations of the Customs Union is excluded

3.3. until March 15, 2015 allowed the production and introduction of products in accordance with

regulatory requirements, the previously established laws of the - of the Customs Union or regulations

of the Customs Union, in the presence of evaluation documents (confirmation) of conformity specified

mandatory requirements issued or adopted before the effective date of the Technical Regulations.

The above products are marked national conformity (a mark of market), in accordance with the

laws of states - members of the Customs Union or the Commission Decision of 20 September 2010 N

386 .

3.3.1. Until November 15, 2013 allowed the production and issuance of the customs territory of the

Customs Union of products that are not subject to the entry into force of the Technical Regulations

mandatory assessment (confirmation) mandatory requirements established by normative legal acts of

the Customs Union, or the law of the state - a member of the Customs Union Undocumented

mandatory assessment (confirmation) and unmarked national conformity (a mark of market)

3.4. treatment products released into circulation during the period of evaluation

documents(Confirmation) compliance specified in subparagraph 3.2 of this decision as well as the

goods referred to in paragraph 3.3.1 of this Decision shall be allowed during the life of products

installed in accordance with the laws of the - of the Customs Union.

4. Secretariat of the Commission with the Parties to prepare a draft plan of action necessary for the

implementation of technical regulations and, within three months from the date of entry into force of

this Decision, to provide representation to the Commission for approval in due course.

5. Belarusian Party with Parties on the basis of the monitoring results of the application of standards

to ensure preparation of proposals for updating the list of standards referred to in paragraph 2 above,

and the view at least once a year from the date of entry into force of technical regulations in the

Secretariat of the Commission for approval in due course.

6. Parties:

6.1. before the effective date of the Technical Regulations define the state control (supervision),

responsible for the implementation of state control (supervision) over compliance with the Technical

Regulations, and to inform the Commission thereof;

6.2. from the date of entry into force of the Technical Regulations provide for state control

(supervision) over observance of technical regulations, taking into account paragraphs 3.2 - 3.4 of this

Decision.

ON SAFETY OF LOW-VOLTAGE EQUIPMENT

Foreword

1. This technical regulation of the Customs Union developed in accordance with the Agreement on

common principles and rules of technical regulation in the Republic of Belarus, the Republic of

Kazakhstan and the Russian Federation of November 182010.

2. This technical regulation of the Customs Union is designed to establish a single customs territory

of the Customs Union, a mandatory for the application and enforcement of the requirements for

low-voltage, ensuring the free movement of low voltage equipment into circulation in the common

customs territory of the Customs Union.

3. If related to low voltage equipment made other technical regulations of the Customs Union

Eurasian Economic Community (hereinafter - the EEC), which establish requirements for

low-voltage equipment, the low-voltage equipment shall meet the requirements of the technical

regulations of the Customs Union, EurAsEC, the action of which it is subject.

Article 1. Sphere of application

1. This technical regulation of the Customs Union applies to low-voltage equipment, put into

circulation in the common customs territory of the Customs Union.

1500 (inclusive), DC.

2. This technical regulation of the Customs Union does not apply to

⋆electrical equipment intended for use in potentially explosive areas

⋆of medical devices,

⋆electrical equipment lifts and hoists (other than electric vehicles),

⋆electric equipment for defense purposes;

⋆controls for pasture fences;

⋆electrical equipment designed for use on air, water, land and underground transport;

⋆electrical equipment designed for safety reactors of nuclear power plants.

3. This technical regulation of the Customs Union establishes requirements for low voltage in order

to protect human life and health, property, and prevent actions that mislead consumers (users) with

respect to its use and safety.

Article 2. Definitions

This technical regulation of the Customs Union, the following terms and their definitions:

manufacturer - a legal entity or natural person as individual entrepreneurs on their behalf

production and (or) the implementation of low-voltage equipment and responsible for its compliance

with safety requirements of technical regulations of the Customs Union,

the importer - the resident of the state - a member of the Customs Union, which is made with a

non-resident of - Member Customs union agreement for the transfer of foreign low-voltage equipment,

is implementing this equipment and is responsible for its compliance with safety requirements of the

technical regulations of the Customs Union;

nominal voltage Low voltage - input and (or) the output voltage (voltage range) Low voltage

specified by the manufacturer of the equipment and operational documents,

handling low voltage equipment on the market - the processes transition to low voltage equipment

from the manufacturer to consumer (user) in the common customs territory of the Customs Union,

which is low-voltage equipment after its manufacture;

intended use - the use of low-voltage equipment in accordance with the purpose specified by the

manufacturer of this equipment, and (or) in the operational documents,

a person authorized by the manufacturer - legal or natural person registered in the prescribed

manner by the state - a member of the Customs Union, which is defined by the manufacturer on the

basis of agreement with him for action on behalf of a conformity assessment and product placement in

the common customs territory of the Customs Union, and to lay the responsibility for product

nonconformity technical regulations of the Customs Union;

electrical equipment - equipment for the generation, transformation, transmission, distribution and

use of electrical energy, including both direct use and built-in machines, equipment, apparatus,

appliances and other products.

Article 3. Rules of market

1. Low voltage equipment into circulation in the market with its conformity to this technical

regulation of the Customs Union, and other technical regulations of the Customs Union, EurAsEC, the

action of which it is subject, and provided that it was confirmation of compliance in accordance with

Article 7 of the technical regulations of the Customs Union, as well as under other technical

regulations of the Customs Union, EurAsEC, the effect of which it is subject to.

2. Low-voltage equipment, conformity to the requirements of the technical regulations of the

Customs Union is not confirmed, there should be marked with a mark of one product on the market

states - members Customs union and is not allowed to release into circulation in the market.

3. LVD is not labeled one mark of market states - members of the Customs Union, is not allowed to

be released into circulation in the market.

Article 4. Safety requirements

Low-voltage equipment should be designed and manufactured in such a way that when it is applied

as intended and meet the requirements for installation, operation (use), storage, transportation

(transportation) and maintenance of the equipment provided:

- level of protection against direct or indirect effects of electric current

- lack of an unacceptable risk of high temperatures, arcs or radiation which can cause hazards;

- necessary level of protection from injury, rotating and stationary parts of the low-voltage

equipment,

- the necessary level of protection from the hazards of non-electrical origin arising from the

application low voltage equipment, including those caused by physical, chemical or biological agents,

- the required level of insulation and protection;

- required level of mechanical and electrical endurance,

- the required level of resistance to external factors, including the nature of the non-mechanical,

with appropriate climatic conditions of the environment,

- the absence of unacceptable risk due to overload emergency conditions and failures caused by

external and internal factors of influence,

- no unacceptable risk connecting and (or) installation.

Low-voltage equipment should be designed and manufactured in such a way that it is not the

source fire in normal and emergency conditions.

Consumer (user) should be given the necessary level of information for the safe use of low-voltage

equipment for the purpose.

Article 5. Labeling requirements and operational documents

1. Name and (or) the designation of low-voltage equipment (type, make, model), its main features

and characteristics that affect the safety and the name and (or) the trademark of the manufacturer, the

name of the country where produced low-voltage equipment, should be applied to the low-voltage

equipment and specified in the annexed operational documents.

This manufacturer's name and (or) its trademark, name and designation of low-voltage equipment

(type, make, model) should also be marked on the packaging.

2. If the information listed in paragraph 1 of this Article shall not apply to low-voltage equipment,

they can only be specified in the attached to the equipment operational documents. In this case, the

name manufacturers and (or) its trademark, name and designation of low-voltage equipment (type,

make, model (if any)) shall be marked on the packaging.

3. Low voltage marking must be legible, easy to read and apply to low-voltage equipment in an

accessible for inspection without disassembly using the tool location.

4. Operational documents to low voltage equipment should include:

- the information listed in paragraph 1 of this Article;

- information on the designation of low-voltage equipment,

- features and parameters;

terms and conditions for safe use (use) the rules and conditions for installation, storage,

transportation (transportation), marketing and disposal (if necessary - to establish requirements for

them),

- information on the measures to be taken when a fault of the equipment,

- the name and location manufacturer (the person designated by the manufacturer), importer,

information with regard to them;

- month and year of manufacture of low-voltage equipment and (or) the information on the site of

application, and how to determine the year of manufacture.

5. Operational documents executed in Russian and in the state (s) language (s) of the State - a

member of the Customs Union with the appropriate requirements of the law (s) of the state (in) -

Member (s) of the Customs Union.

Operational documents are executed on paper. These can be applied to a set of operational

Article 6. Compliance with safety requirements

1. Compliance with low voltage this technical regulation of the Customs Union is ensured by its

security requirements directly or performance requirements of the standards included in the list of

standards as a result of which, on a voluntary basis, compliance with the technical regulations of the

Customs Union.

2. Methods (tests) and measurements of low-voltage equipment is standard, included in the list of

standards containing rules and methods (tests) and measurements, including rules of sampling

necessary for the implementation and execution of the technical regulations of the Customs Union

and the implementation of assessment (confirmation) of product conformity.

Article 7. Demonstration of compliance

1. Before issuance of the market low-voltage equipment must undergo confirmation of compliance

with safety requirements of the technical regulations of the Customs Union.

Conformity Low Voltage schemes implemented in accordance with the Regulations about order of

the model evaluation schemes (confirmation) in the technical regulations of the Customs Union,

approved by the Commission of the Customs Union (hereinafter - the Commission).

2. Low Voltage Products included in the list annexed to this technical regulation of the Customs

Union, to be confirmed in the form of compliance certification (scheme 1c, 3c, 4c).

Voltage equipment that is not included in the above list, to be confirmed in the form of compliance

declaration of conformity (circuit 1d, 2d, 3d, 4d, 6d). Selecting a declaration of compliance of

low-voltage equipment not included in the list by the manufacturer (a person authorized by the

manufacturer), importer.

According to the decision of the manufacturer (the person designated by the manufacturer),

importer confirmation of compliance of low-voltage equipment not included in the list, can be in the

form of certification in accordance with paragraph 5 of this Article.

In the case of non-application of the standards referred to in paragraph 1 of Article 6 of this

technical regulation of the Customs Union, or in the absence of compliance approved low voltage is in

the form certification (scheme 1c, 3c, 4c), in accordance with paragraph 10 of this Article.

3. Certification of low-voltage equipment, produced in series, are carried out on 1c. LVD

certification by the manufacturer (the person authorized by the manufacturer).

Party Certification low voltage equipment are carried out on 3s, a single product - the scheme

4c. Batch of low-voltage equipment (single product) manufactured in the common customs territory of

the Customs Union, is the manufacturer, the batch of low-voltage equipment (single product),

imported into the common customs territory of the Customs Union, is the importer or the manufacturer

(a person authorized by the manufacturer).

4. Certification of low-voltage equipment is conducted by an accredited certification body

(assessment (confirmation)), included in the Unified Register of certification bodies and testing

laboratories (centers) of the Customs Union.

Tests for certification shall accredited testing laboratory (center), included in the Unified Register of

certification bodies and testing laboratories (centers) of the Customs Union.

5. With the certification of low voltage equipment (circuit 1c, 3c, 4c):

5.1. manufacturer (the person authorized by the manufacturer), the importer provides the

certification body (assessment (confirmation)) set of documents for low-voltage equipment, confirming

that the low voltage safety requirements of the technical regulations of the Customs Union, which

includes:

- specifications (if any)

- operational documents;

The list of standards which must meet the requirements of this low-voltage equipment from the List

of standards referred to in paragraph 1 of Article 6 of this technical regulation of the Customs Union,

the contract (supply contract) or shipping documentation (for the party of low-voltage equipment

(single product) (scheme 3c, 4c) ,

5.2. manufacturer shall take all necessary measures to ensure the production process was stable

and provided compliance manufactured low voltage requirements of this technical regulation of the

Customs Union;

5.3. Certification Body (assessment (confirmation))

5.3.1. carries out selection of specimen (s)

5.3.2. performs the identification of low-voltage equipment by establishing the identity of its

performance characteristics specified in Article 1 of the technical regulations of the Customs Union,

the provisions of article 5 of the technical regulations of the Customs Union, and the documents listed

in sub-clause 5.1, paragraph 5 of this Article;

5.3.3. organizes test specimen (s) of low-voltage equipment for compliance with standards of the

List of standards referred to in paragraph 1 of Article 6 of this technical regulation of the Customs

Union, and analyzes the report (s) of testing;

5.3.4. analyzes the state of production (Figure 1c).

If the manufacturer-certified Quality Management System, or the development and Production of

low voltage equipment evaluates the possibility of the system to provide a stable release a certified

low voltage corresponding to the requirements of the technical regulations of the Customs Union;

5.3.5. issue a certificate of conformity to a single form, approved by the Commission. The certificate

of compliance for low-voltage equipment, a mass-produced - not more than 5 years, for a party of

low-voltage equipment (single product) term of the certificate of conformity is not installed;

5.4. manufacturer (the person authorized by the manufacturer), the importer:

5.4.1. does a single sign of products on the market states - members of the Customs Union;

5.4.2. forms after the confirmation of compliance set of documents for low-voltage equipment,

which includes

the documents specified in sub-clause 5.1, paragraph 5 of this Article;

- report (s) of testing;

- analysis of production conditions,

- the certificate of conformity;

5.5. Certification Body (assessment (confirmation)) conducts inspection control of low-voltage

equipment certified by testing samples in an accredited testing laboratory (center) and (or) the

analysis of the production (Figure 1c).

6. Declaration of Conformity Low Voltage (circuit 1d, 2d, 3d, 4d, 6d) is based on:

6.1. own evidence (circuit 1d, 2d)

- testing of low-voltage equipment (low voltage equipment for the party (a single product) (Figure

2d)

- Low voltage testing and production control by the manufacturer (for low voltage equipment,

manufactured as standard) (Figure 1d);

6.2. evidence obtained with an accredited testing laboratory (center), the certification body quality

management systems, included in the Unified Register of certification bodies and testing laboratories

(centers) of the Customs Union (3d circuit, 4d, 6d):

- Low voltage testing, certification, quality management system of production or development and

production of low-voltage equipment and production control by the manufacturer ( Low-voltage

equipment, a mass-produced) (Figure 6d);

- Testing of low-voltage equipment (low voltage equipment for the party (a single product) (Figure

4d);

- Testing of low voltage equipment and production control by the manufacturer (for low voltage

equipment, manufactured as standard) (Figure 3d)

6.3. declaration of compliance of low-voltage equipment, produced commercially by manufacturers

(the person authorized by the manufacturer) schemes 1d, 3d, 6d.

Declaration of Conformity Low Voltage Party (single product) carries the manufacturer (the person

authorized by the manufacturer), the importer of the schemes 2d, 4d.

7. When declaring the conformity low voltage schemes 1e, 2e:

7.1. manufacturer (the person authorized by the manufacturer), the importer:

7.1.1. generates a set of documents proving the compliance of low voltage requirements of this

technical regulation of the Customs Union, which includes:

- specifications (if any)

- operational documents;

The list of standards corresponding to the requirements of this low-voltage equipment, from the List

of standards referred to in paragraph 1 of Article 6 of this technical regulation of the Customs Union;

- report (s) of tests carried out in the testing laboratory (center) at the option of the manufacturer

(the person designated by the manufacturer), the importer;

- certificate of compliance (if any)

- according to the manufacturer's declaration (if any) for a party of low-voltage equipment (a single

product)(Figure 2d);

- contract (supply contract) or shipping documentation for the party of low-voltage equipment

(single product) (Figure 2d),

7.1.2. performs the identification of low-voltage equipment by establishing the identity of its

performance characteristics specified in Article 1 of the technical regulations of the Customs Union,

the provisions established by Article 5 of the technical regulations of the Customs Union, and the

documents listed in subparagraph 7.1.1 of paragraph 7.1 of this Article;

7.2. Manufacturer of:

exercise operational control and shall take all necessary measures to ensure that the

manufacturing process ensures conformity of low voltage requirements of this technical regulation of

the Customs Union (Figure 1e).

Requirements for production processes and controls, and the results of their monitoring should be

7.3.1. receives a written declaration of conformity for low voltage present technical regulations of

the Customs Union on a single form, approved by the Commission, and does a single sign of products

on the market states - members of the Customs Union;

7.3.2. includes after conformity to a set of documents on low-voltage equipment as set out in

paragraph 7.1.1 of paragraph 7.1 of this Article, a declaration of conformity.

8. When declaring the conformity of low voltage schemes 3d, 4d, 6d:

8.1. manufacturer (the person authorized by the manufacturer), the importer:

8.1.1. generates a set of documents on low-voltage equipment, which includes:

specifications (if any)

operational documents;

list of standards which must meet the requirements of this low-voltage equipment from the List of

standards referred to in paragraph 1 of Article 6 of this technical regulation of the Customs Union,

the contract (supply contract) or shipping documentation (for the party low-voltage equipment

(single product) (schemes 3d, 4d);

compliance certificate (a copy of the certificate) for quality management system development and

production or production of low voltage (Figure 6d)

8.1.2. performs the identification of low-voltage equipment by establishing the identity of its

performance characteristics specified in Article 1 of the technical regulations of the Customs Union,

the provisions of article 5 of the technical regulations of the Customs Union, and the documents listed

in subparagraph 8.1.1 of paragraph 8.1 of this Article;

8.1.3. organizes test specimen (s) of low-voltage equipment for compliance standards from the List

of standards referred to in paragraph 1 of Article 6 of this technical regulation of the Customs Union;

8.2. Manufacturer:

provides operational control and shall take all necessary measures to ensure that the

manufacturing process ensures conformity of low voltage requirements of this technical regulation of

the Customs Union (3d circuit, 6d). Requirements for production processes and controls, as well as

the results of their control must be documented (in the form prescribed by the manufacturer);

take all necessary measures to ensure that the process of production and stable operation of the

quality management system of production or development and production of low voltage levels

harmonize low voltage requirements of this technical regulation of the Customs Union (Figure 6d),

8.3. manufacturer (the person authorized by the manufacturer), the importer:

8.3.1. receives a written declaration of conformity for low voltage present technical regulations of

on the market states - members of the Customs Union;

8.3.2. forms after the conformity assessment procedures set of documents for low-voltage

equipment, which includes

- the documents specified in subparagraph 8.1.1 of paragraph 8.1 of this article,

- report (s) of testing;

- declaration of conformity.

9. The declaration of conformity shall be registered in accordance with the legislation of the

Customs Union. The action begins with the declaration of the day of registration.

The term of the declaration of conformity for low voltage equipment, a mass-produced - no more

than 5 years, for a party of low-voltage equipment (single product) term of the declaration of

conformity is not installed.

10. With the certification of low voltage equipment, in case of non-application of the standards of

the List of standards referred to in paragraph 1 of Article 6 of this technical regulation of the Customs

Union, or in their absence (scheme 1c, 3c, 4c)

10.1. manufacturer (the person authorized by the manufacturer), the importer provides the

certification body (Assessment(Confirmation)) set of documents for low-voltage equipment,

confirming that the low voltage safety requirements of the technical regulations of the Customs Union,

which includes

- technical specifications (if any),

- operational documents,

a description of the technical decisions and risk assessment, confirm the safety of this technical

regulation of the Customs Union;

- contract (supply contract) or shipping documentation (for the party of low-voltage equipment

(single product) (scheme 3c, 4c);

10.2. manufacturer shall take all measures necessary to the production process was stable and

ensures compliance manufactured low voltage requirements of this technical regulation of the

Customs Union;

10.3. Certification Body (assessment (confirmation)):

10.3.1. carries out selection of specimen (s)

10.3.2. performs the identification of low-voltage equipment by establishing the identity of its

characteristics grounds set out in Article 1 of this technical regulation of the Customs Union, the

provisions set Article 5 of this technical regulation of the Customs Union, and the documents listed in

paragraph 10.1, paragraph 10 of this Article

10.3.3. conducts conformity assessment low voltage direct safety requirements of this technical

regulation of the Customs Union.

This certification authority (assessment (confirmation)

- determines, based on the security requirements of the technical regulations of the Customs Union

of the specific safety requirements for the certified low-voltage equipment;

- analyzes adopted technical solutions and risk assessment, confirm the safety of this technical

regulation of the Customs Union of the manufacturer,

- determines from the List of standards referred to in paragraph 2 of Article 6 of this technical

regulation of the Customs Union, the standards established by the method of measurement and

testing, or in their absence , defines the control procedures, measurements and tests to verify

compliance with the specific requirements of the Low Voltage Equipment Safety;

- arrange for testing of low-voltage equipment and analyzes the report (s) of testing;

10.3.4. analyzes the state of production (Figure 1c).

If the manufacturer of the certified management system of production and development and

production of low-voltage equipment evaluates the possibility of the system to ensure stable

production of certified low-voltage equipment that meets the requirements of the technical regulations

of the Customs Union;

10.3.5. issue a certificate of conformity to a single form, approved by the Commission.

The certificate of compliance for low-voltage equipment, a mass-produced - not more than 5 years,

for a party of low-voltage equipment (single product) term of the certificate of conformity is not

installed,

10.4. manufacturer (the person authorized by the manufacturer), the importer:

10.4.1. does a single sign of products on the market states - members of the Customs Union;

10.4.2. forms after the confirmation of compliance set of documents for low-voltage equipment,

which includes

- the documents specified in paragraph 10.1 of this paragraph;

- report (s) of testing;

- the results of the analysis of the production

- certificate of conformity;

10.5. Certification Body (assessment (confirmation)) conducts inspection control of low-voltage

equipment certified by testing samples in an accredited testing laboratory (center) and (or) the

analysis of the production (Figure 1c).

11. Set of documents for low-voltage equipment should be stored in the states - members of the

Customs Union:

LVD - the manufacturer (the person designated by the manufacturer) for at least 10 years from the

date of withdrawal (termination) from the production of low-voltage equipment,

low voltage party - the importer or the person designated by the manufacturer for at least 10 years

from the last date of sale of the product Party.

Article 8. Single sign marking of products on the market states - members of the

Customs Union

1. Low-voltage equipment, meeting the safety requirements of the technical regulations Customs

Union and the elapsed confirmation of compliance in accordance with Article 7 of the technical

regulations of the Customs Union shall be marked with a mark of one product on the market states -

members of the Customs Union.

2. Single sign marking of products on the market states - members of the Customs Union is to

launch low-voltage equipment in circulation in the market.

3. Single sign of products on the market states - members of the Customs Union is applied to each

unit Low voltage in any way, providing crisp and clear image for the life of low-voltage equipment, as

well as provided in the annexed operational documents.

4. May be applied as a single sign of products on the market states - members of the Customs

Union only on the packaging and in the annexed operational documents, if it cannot be applied

directly to the low voltage.

5. Low Voltage Products marked with a single sign of products on the market states - members

Customs Union with its compliance with all the technical regulations of the Customs Union, EurAsEC,

the action of which it is subject and providing for the application of the mark.

Article 9. Protection clause

State - members of the Customs Union shall take all measures to limit, ban to issue the low voltage

in the common customs territory of the Customs Union, and withdrawal from the market low-voltage

equipment that does not meet the safety requirements of the technical regulations of the Custom

Union.
