Safeguard the nation andindependence

Myanmar is an independent and sovereignnation. It has been standing tall among theinternational community with own monarch,own race and own culture in successive eras.And the entire national people are to constantlystrive for perpetuation of independence andsovereignty.

The colonialists occupied Myanmar afterwaging three aggressive wars in 1824, 1852 and1885 on the nation. But, the entire nationalpeople fought back the colonialists withnationalistic spirit, thus resulting in regainingthe independence and sovereignty. Since then,Myanmar has been an independent andsovereign nation.

The entire people are to be well aware ofthe fact that although the independence can belost easily, a large number of lives had to besacrificed to regain it. That is why every citizenis to cherish and value the independence thatwas regained by sacrificing a lot of lives andsweat.

By nature, Myanmar people cherish theirown nation and own race. And they value theirown literature, own culture and traditions. Fullyequipped with nationalism, they are also theones who are highly sensitive to beingdetrimental to national prestige and dignity.With the fine traditions, the entire nationalpeople are to continue safeguarding thesovereignty of nation that has been maintainedsince time immemorial.

At present, the State, the people and theTatmadaw are making concerted efforts for theemergence of a new democratic nation. In theprocess, the seven-step Road Map has been laiddown and is being implemented step by step. Asstability and peace prevails throughout thenation, remarkable progress has been made ineconomic, education, health and social sectors.

All in all, all the national brethren are toactively participate in the drive for successfulrealization of the seven-step Road Map, whileconstantly safeguarding and maintaining theindependence and sovereignty, the legacy ofancestors with Union Spirit and nationalisticspirit, for perpetuation.

YANGON, 29 Dec—Minister for InformationBrig-Gen Kyaw Hsan visited FM Radio Station ofMyanma Radio and Television, here, yesterdaymorning.

After inspecting IT room, administrationdivision, program transmitting division,advertisement and records division, transmissionroom, editing and studio, the minister spoke wordsof encouragement to the staff.

He looked into live transmissions fromMandalay FM Radio Station and PyinsawadyFM Radio Station and spoke words ofencouragement.

Next, he oversaw MRTV transmission room,

indoor camera room, modern music division,orchestra, outdoor shooting division, radioadvertisement division and MRTV-3 transmissiondivision and then spoke words of encouragement.

After looking into MRTV-4 television editingroom, studio, video records room, news room,program launching division, DVB-T room,international news editing and translation division,mess, satellite base station and transmission room,he spoke words of encouragement.

At the meetings with service personnel, theminister called for further improvement of the mediasector of the nation, counter media attacks designed todebut groundless news stories aired by certain foreign

radio stations. NEW YORK, 29 Dec—A firecracker was foundwedged between two seats on a Piedmont Airlinesplane at LaGuardia Airport, New York, on Sundayevening, local radio station reported on Monday.

A crew member on board Piedmont Airlines Flight4126 found the explosive after landing in New Yorkaround 7:30 pm on Sunday, local time.

Piedmont Airlines is an American regional airlineoperating for US Airways Express. It is a wholly ownedsubsidiary of the US Airways Group.

UN food agency says shocked at killingof staff member in Afghanistan

VLADIVOSTOK, 29 Dec—Russian Prime MinisterVladimir Putin on Tues-day said US plans for amissile defence systemwere hindering talks on anew nuclear arms reduc-tion treaty.

Speaking to reporters inthe Russian Far Easterncity of Vladivostok, Putinsaid US plans for the mis-sile shield in Europewould destroy the strate-gic balance between theUnited States and Russia.

“In order to preservebalance... we need to de-velop offensive weaponssystems,” Putin said. Headded that Russia wantedaccess to more informa-tion on US missile de-fence plans and wouldlink such a demand withthe new nuclear treaty.

The two largest nuclearpowers have been tryingto find a replacementfor the 1991 StrategicArms Reduction Treaty(START I), which led to

the biggest reduction innuclear weapons in his-tory, but have so far failedto reach a deal.

Suicide attack on PakistaniShiites kills 33

KARACHI, 29 Dec—The death toll from an overnightsuicide attack on a Shiite Muslim procession in Paki-stan’s biggest city rose on Tuesday to 33, in violenceblamed on extremists trying to hamper the fight againstmilitants by sparking a sectarian war.

Angered over Monday’s attack, Shiites set fire tobuildings and dozens of vehicles in Karachi, a sign offrustration by the minority sect, which has suffered fre-quent attacks by Sunni extremist groups who regardthem as heretical.

TV footage showed firefighters struggling to extin-guish blazes on Tuesday. Sagheer Ahmed, the Provin-cial Health Minister, said the death toll from the attackhad risen to 33. Pakistani television stations said thatthree people who were hospitalized died overnight oftheir injuries.—Internet

Afghan civilians killedin military operations

KABUL, 29 Dec—Ten civilians, mostly school chil-dren, have been killed during Western military opera-tions in eastern Afghanistan, President Hamid Karzai’soffice said on Monday, citing “initial reports”.

Karzai condemned the killings which his statementsaid took place in Kunar Province, bordering Paki-stan, on Saturday.

“Initial reports indicate that in a series of opera-tions by international forces in Kunar Province... 10civilians, eight of them school students, have beenkilled,” the statement said.

“President Karzai strongly condemns the operationwhich caused civilian deaths and has appointed a del-egation to investigate the incident,” it said.

A senior official in the Afghan government, speak-ing on condition anonymity, said the death toll couldchange because investigations are ongoing.—Internet

The WFP employee, 24,was among the eight peo-ple killed when a suicidebomber detonated explo-sives hidden in a horse-drawn cart in centralKandahar on the evening ofon 24 Dec, said the offi-cials. Three civilians and apolice officer were injuredin the blast.

DUBAI, 29 Dec—The Abu Dhabi National Oil Com-pany, the largest such company in the United ArabEmirates, has announced it will cut back its produc-tion from February, the official WAM news agency saidon Monday.

The move is “in line with (an) OPEC decision tocut production,” the report said without providing fur-ther details.

The company will cut production by between 10 per-cent and 15 percent in four major oilfields in Abu Dhabi,which alone holds more than 95 percent of UAE oil re-serves, estimated at around 100 billion barrels, it added.

The Organization of Petroleum Exporting Coun-tries (OPEC) at its meeting in Angola last week de-cided to keep its production quotas unchanged, but sev-eral members have asked for more production com-pliance to reduce inventories in the international oilmarket.—Internet

LUSAKA, 29 Dec—Japan’s Toyota has recorded aslump in the sale of its vehicles in Zambia, local news-paper The Times of Zambia reported on Monday.

Toyota Zambia said it has recorded a drop in salesby 55 percent this year compared to 2008, accordingto Times. The company’s national sales manager NeilStewart said the company had felt the effects of theglobal financial meltdown, with reduced sales in thefirst 10 months of 2009 when it sold between 80 and90 motor vehicles per month compared to 2008 whenit sold more than 100 units per month.

Audi, based in Ingolstadt, and a unit of VolkswagenAG, said it plans to spend that amount from 2009 to2012 and will increase the number of models from itscurrent 34 to a planned 42 by 2015.

China launches nationalInternet television

BEIJING, 29 Dec—China on Mondaylaunched its national Internet TV station,China Network Television (CNTV).

The online station currently includesthree major channels of news, sports andentertainment and an online communitywhere users can upload self-made videocontent and communicate with eachother.

With five overseas mirror sites, CNTVnow covers countries and regions in-cluding Europe, North America, South-east Asia, Middle West and Russia.

Mainstream media must actively ex-pand themselves to new media area toimprove their capacity of communica-

tion, said Li Changchun, a member ofthe Standing Committee of the PoliticalBureau of the Communist Party of ChinaCentral Committee, at the opening cer-emony.

Li said that establishment of the sta-tion is a major landmark event for Chi-na’s traditional media in their effort toadvance into online media. It will helpto promote the construction of a moderncommunication system of wide cover-age and advanced technology in thecountry.

The online station is wholly owned byChina Central Television.

EU, UNRWA ink fund dealto support health

programme in GazaGAZA, 29 Dec—The UN Relief and

Works Agency (UNRWA) and the Euro-pean Union (EU) signed on Monday anagreement providing 5.5 million euros insupport of the UNRWA’s health care pro-gramme in the Gaza Strip.

The new funds represent a crucial re-sponse to the agency’s financial crisis, andwill enable it to maintain the current mod-erate level of its health care activities andguarantee measures to boost the quality ofits health care services, according to a state-ment by the international organization.

The UNRWA’s commissioner general,Ms Karen Abu Zayd, and the EuropeanUnion (EU) representative to UNRWA,Mr Christian Berger, signed the agree-ment at a UN-run clinic in Gaza city.

This agreement comes as a follow-upto last week’s agreement, which was alsosigned between the two parties to provide10 million euros for the UNRWA in thewar-torn territory.

According to Ms Karen Abu Zayd, thenew agreement was crucial, given the fi-nancial shortfall the agency sufferingfrom, “the deficit will affect our basiceducation and health services for thewhole region.”—Xinhua

Russian nuclear sub resumes service after repairsVLADIVOSTOK, 29 Dec—Russian nuclear submarine Nerpa, which

is set to be leased to India, resumed naval service on Monday afterrepairs from damage sustained during a trial voyage last year.

A ceremony was held in the town of Bolshoy Kamen in Russia’sfar eastern Primorye region, where the shipbuilding plant repairingthe submarine was located. The Russian Pacific Fleet’s commander,Vice Admiral Konstantin Sidenko, attended the ceremony.

A plant official was quoted by news agencies as saying that thereliability of the submarine had been confirmed in tests.

The repair work has cost an estimated 65 million US dollars.The submarine will be leased to India’s navy for 10 years, start-

SANAA, 29 Dec— Yemen had arrested29 suspected al-Qaeda members and willcontinue to hunt down other membersof the terror network, government offi-cials said on Monday.

Al-Qaeda had planned to attack oilfacilities, government buildings and theBritish embassy, said Yemen’s NationalSecurity Chief Ali Mohammad Al-Ansi.

Yemen’s Foreign Minister Abu BakrAbdullah Al-Kurbi said the recentmonths have seen enhanced cooperationbetween his country and the UnitedStates, and the US information had beena “key element” in Yemen’s anti-terroroperations.

Al-Qaeda claimed on Monday that itwas behind the failed Christmas Day at-tempt to bomb a US-bound plane, Dubai-based Al Arabiya news channel reported.

In a statement, al-Qaeda said that their“Nigerian brother,” 23-year-old UmarFarouk Abdulmutallab, had broken allUS security barriers in getting on boarda flight from Amsterdam to Detroit on25 Dec.

The man had tried to destroy the planecarrying 289 people with an explosivedevice obtained from al-Qaeda, butfailed due to a “technical fault,” the re-port quoted al-Qaeda as saying.

anniversary. Independence is sovereignty of a nationand its people, or self-administration for peace anddevelopment of own country and people. It is commonknowledge that Myanmar and its people once lost self-administration for more than 100 years.

In colonial days, the people were at the mercyof the aliens. The people had no to shape a betterfuture of the country. Therefore, all possible wayswere sought for the entire people to set themselvesfrom the colonial rule. The people rose against thecolonialist government in physical and mentalprowess. Only with formation of national armed

The declaration reflected that the Tatmadawgave serious attention to national politics; thatmany of Tatmadaw members and those who wereanxious to regain independence had sacrificed theirlives for the national cause, so those (politicians)who would lead the nation and the entire peoplewere required to work more closely in order toexpedite the campaigns; that independence struggleswere in the interest of the entire people, not ahandful of people alone; and that therefore those(politicians) who would lead the nation and theentire people were urged to join the Anti-FascistPeople’s Freedom League (national politics) to makeconcerted efforts in independence struggles andnation-building tasks (reconstruction of the nation).

Yet, when independence was within thetouching distance, political parties collapsed intofactions. Party political movements were runninghigh, stemming from dogmatism, personality cultand vying for power. Despite winning massivesupport from the public, the AFPFL, the coalitionof the national forces, saw its political partiesbreaking away from it. Before the issues related tothe party politics had effects to the people, thenation managed to regain independence throughconsolidated unity of the people. With a view toshaping Myanmar into a new nation, the remainingnational political forces took vows on 4 January1948, as follows:—

1. We, from this time on, will see to the policy laiddown by our founding father General Aung Sanwho was a driving force for us to regainindependence.

2. We, from this time on, will remain loyal to theUnion of Myanmar.

3. We, from this time on, will enjoy the fundamentalrights and shoulder responsibilities ofindependent citizens.

4. We, from this time on, will maintain consolidatednational unity we have achieved due toexcellent performances of General Aung San.

Independence Declaration calls for harmoniouscooperation based on loyalty and a sense of duty forState security, national defence, consolidated nationalunity, and nation-building. If politicians served asexemplars in following the resolution strictly, so willthe entire people.

However, Myanmar political issues orsplitstories posed disruptions to the drive for Statestability, peace and development. The nationregained independence from the colonialists by justproving consolidated national unity. However,disunity among national forces sparked internalarmed insurgency. Nation-building tasks werestopped from making headway by insurgency andintra disputes among political parties for 14 yearsfrom 1948 until 1962. The Union was thus leadingto collapse, let alone national reconstruction.

Again the nation tried to build itself with Socialismaccording to the policy laid down in the pre-independence period. Myanmar, which had everpractised parliamentary democracy system for 14years did not get along with the one-party system.When many of the Socialist countries around theworld were poised to transform themselves to differentsystems, Myanmar was also under excessivepressures. Accordingly, Myanmar had to turn to themarket economic system and the multipartydemocracy system under the leadership of theTatmadaw in national politics.

The Tatmadaw government that has played aleadership role in national politics since 1988 laiddown national policies, State objectives and theState’s seven-step Road Map, and since then, it hasbeen implementing them. In addition, it has beenimproving infrastructures in various sectors tilltoday.

Myanmar has faced bitter experiences in the politicalarena for more than 60 years or since independence. Itis fair to say that today is the most opportune time for theentire people to work together in the process of buildinga modern, developed nation, which is to be handed fromone generation to another.

I have noticed and read a motto regardingenvironmental conservation and afforestation thatgoes “The best time to plant a tree was 20 years ago.The second best time is now.” Over 60 years ago,independence struggles and national reconstructionwere put in the fore. Reconstruction of the wholenation was still available, but all measures weretaken as far as possible to achieve the goal. Thepeople managed to ensure non-disintegration ofthe Union and further cement national solidarity.Now, almost all the infrastructural buildings havebeen constructed for proper evolution ofmultiparty democracy system and the marketeconomy. Therefore, I would say today is the mostopportune time for the people to work in practicefor democratization.

(from page16) come to think of the present government’s measuresfor development of the energy sector, comparing itwith the situation of the energy sector before 1988.

If we look at the situation of the energy sector ofMyanmar before 1988, we will find that there were 19onshore oil fields and 250.91 miles of onshore oil andnatural gas pipeline. This shows that there was nooffshore oil and natural gas production before 1988and it was hard to fully meet the domestic demand forenergy. There is plenty of oil and natural gas reservesonshore as well as offshore, but they could hardly beexploited.

Therefore, since its assumption of Stateresponsibilities in 1988, the Tatmadaw governmenthas invited foreign investments in the energy sector toincrease the production of oil and natural gas. Now,there are 47 blocks of onshore oil and natural gasfields, 26 blocks of offshore oil fields in Myanmaterritorial waters along the Mottama, Taninthayi andRakhine coasts and 18 blocks of offshore deep sea oilfields, and exploration is being carried out incooperation with foreign companies under jointventures.

TOTAL, a French company, UNOCAL of theUnited States and PTTEPI from Thailand have investedin Yadana natural gas project, a block off the Mottamacoast, and are carrying out exploration work.

Similarly, Petronas of Malaysia, Nippon oilcompany of Japan and PTTEPI of Thailand haveinvested in Yedagun project, a block off the Taninthayicoast, and are carrying out exploration and production

work in a joint venture with Myanma Oil and GasEnterprise.

It is obvious that the government is takingsystematic measures for higher socio-economic statusof national brethren, parallel development of variousregions across the Union, sufficient supply of energyand earning foreign exchange.

If we look at the situation of natural gasexploration projects being implemented by thegovernment, DAEWOO of South Korea, ONGCVidesh Ltd and GAIL Ltd of India and Korea GasCorporation of South Korea are exploring natural gasat Shwe project, a block off Rakhine coast. In 2013,it will be possible to export natural gas of Shweproject. Moreover, agreements have been signed tolay oil and natural gas pipelines between Myanmarand China. Measures are being taken for speedycompletion of natural gas exploration of Zawtikaproject and 179-mile-long Yadana-Yangon 24-inch

natural gas pipeline project. On completion of theseprojects, the entire nation will be able to enjoydevelopment in every way.

In addition, the government is trying to explorenatural gas reserves inland in the nation. New naturalgas reserves have been found in Kyaukkhwet, Apyauk,Nyaungdon, Thargyitaung, Sabai and Indaw regions.Therefore, we will have natural gas enough not onlyfor domestic consumption but also for export. I feeldelighted at the thought that the socio-economicstatus of the people will become higher.

Up to now, we have 12 onshore oil fields andfive new offshore oil fields. And 1717.74 miles of oiland natural gas pipeline has been laid. Therefore,there are 1968.65 miles of onshore oil and natural gaspipeline and 426 miles of offshore natural gas pipeline,totalling 2394.65 miles, from lower Myanmar toKyaukse region in upper Myanmar.

Thanks to the effortsthe government is makingin the long-term interestof the nation, more oiland gas are beingexplored in new inlandfields namely Kyauk-khwet, Aphyauk,Nyaungdon, Thagyi-taung/Sabai and Indaw.To explore new offshore

oil reserves along RakhineCoast, Mottama Coast andTaninthayi Coast, thegovernment is cooperatingwith the companies ofRussia, China, India,Singapore, Malaysia andSouth Korea. Such effortsare being made in order tosee development of thefuture nation andimprovement of people’ssocio-economy. At a timewhen global nations arefacing energy shortages,Myanmar has been able torelieve its energy crisisthanks to the correctleadership andfarsightedness of the Headof State.

In trying to achieve

the people’s goal ofbuilding a peaceful,modern and developednation, the energy sectoris trying to gain speed inbuilding factories,workshops and transportfacilities in accord withthe market economy thatcan help improve thesocio-economy of thepeople. With new gasblocks in Myanmar, thenation will not only enjoyits self-sufficiency of gasbut also export the surplus,thereby contributing tonational development aswell as people’s socio-economic improvement.

3. In order to carry out the development workseffectively within the Nay Pyi Taw developmentarea, the Chairman of the State Peace and Devel-opment Council shall:(a) form the Committee comprising a minimum

of 5 members to a maximum of 9 members.(b) in forming the Committee, it shall do so with

suitable citizens and determine the Chair-man, Vice-Chairman and Secretary of theCommittee simultaneously.

4. The Chairman of the Committee is the Mayor ofNay Pyi Taw.

5. The Vice-Chairman of the Committee is the Vice-Mayor of Nay Pyi Taw.

6. The Head of Office is the Joint Secretary of theCommittee.

7. The Committee shall be directly responsible tothe Chairman of the State Peace and Develop-ment Council.

Chapter IIIFunctions and Duties of the Committee

8. The Committee shall, within the limits of Nay PyiTaw development area, lay down policy, giveguidance, supervise or implement in respect of thefollowing functions and duties:(a) drawing up civil plans and establishment of

new towns;(b) administering lands in accordance with the

existing laws;(c) constructing, repairing, and maintaining,

demoliting and inspecting of buildings;(d) demoliting and resettlement of squatter

houses, buildings and wards;(e) constructing roads, bridges, and maintenance

thereof;(f) causing to remove and the removal of the

buildings which are not be free from publicroad, bridge, drainage, water pipeline andsewage pipe etcetera;

(g) prescribing conditions for traffic and for theuse of road, naming of the wards and roadsand prescribing building number;

(h) stipulating conditions for the traffic andparking of vehicles and hackney carriages,and for construction of vehicle terminals;

(i) carrying out works for sanitation, tidiness,pleasantness, beautifying, greening and live-liness;

(j) carrying out environmental conservationworks;

(k) constructing, maintaining, and supervisingof gardens, parks, playgrounds, swimmingpools and recreation centres;

(l) carrying out works for lighting of roads;(m) carrying out works for water supply;(n) carrying out works for construction and

maintenance of reservoirs, water storagereservoirs and pipelines;

(o) carrying out works for sanitation and sew-age treatment;

(p) carrying out prevention of disease and worksfor public health;

(q) constructing, maintaining, and administer-ing the markets owned by the Committee;

(r) granting permission for the construction andadministration of private-owned markets;

(s) prescribing conditions relating to foodstuffbusiness, restaurants and road-side stalls;

(t) prescribing rules relating to works whichmay be dangerous;

(u) carrying out precautionary measures againstthe danger of fire, flood, storm and naturaldisaster;

(v) granting permission to open guest houses toaccommodate local customers only;

(w) inspecting hotels, motels and guest housesrelating to development matters;

(x) granting permission the operation of andadministering ferry services, brokerage busi-nesses and private pawn shops businesses;

(y) granting permission for the establishment ofslaughter houses, the slaughter of animals forconsumption and prescribing conditions forsale of meat;

(z) holding and managing of cattle fair;(aa) granting permission for keeping and breed-

ing animals and catching and impoundingstrayed animals;

(bb) carrying out tasks to look after the strayinsane persons, lepers and beggars;

(cc) determining and demolishing cemeteries, cre-mating, building and administering cremato-riums;

(dd) carrying out development works for publicinterest;

(ee) carrying out the works of repairing, mainte-nance and extension of prescribed govern-ment offices and state-owned housing estateswith allotment fund of Government;

(ff) issuing conditions for the residents of thestate-owned housing estates, supervising andtaking action against the persons who violatethe conditions;

(gg) maintaining, placing, and managing the state-owned housing estates and apartments;

(hh) prescribing and collecting for state-ownedhousing estates and apartments rent;

(ii) carrying out the functions and duties as-signed from time to time by the Chairman ofthe State Peace and Development Council.

9. The Committee may, in carrying out its functionsand duties, and coordinate with the relevant govern-ment departments and organizations if necessary.

Chapter IVPowers of the Committee

10. The powers of the Committee are as follows:(a) demarcating and re-demarcating the territo-

rial limit of the Nay Pyi Taw developmentarea;

(b) carrying out the development works in ac-cordance with the existing laws, rules, regula-tions and bye-laws with funds owned by theCommittee;

(c) determining taxes and duties and rates in re-spect of development works and revising,assessing and collecting thereof;

(d) leasing the buildings and lands owned by theCommittee and evicting the tenants who vio-late any of the terms and conditions;

(e) using money obtained by lease of buildings orlands or by other means, for the developmentworks in accordance with the existing regula-tions and bye-laws;

(f) carrying out works contributing to develop-ment by communicating with local and for-

eign organizations or persons;(g) taking loans or grants from the Government

or from local and foreign organizations;(h) carrying out development works by forming

necessary sub-committees according to thetype of development works;

(i) carrying out by applying advanced moderntechnologies and systems to enable to carryout the development works more effectively;

(j) safeguarding to prevent trespass in the re-served lands by any person, organization anddepartment and managing systematically theproject works carried out only with the permis-sion of the Government on such reserved land;

(k) safeguarding and managing to prevent tres-pass in the committee-owned land by anyperson, organization or department;

(l) coordinating with the Ministry of Forestry inorder to determine the forest land limit withinthe limit of the Nay Pyi Taw development area;

(m) coordinating with the Ministry of Defence inorder to determine the cantonment area withinthe limit of the Nay Pyi Taw developmentarea;

(n) prohibiting and inspecting to prevent breaking,clearing, removing or felling the trees grownnaturally within the limit of the Nay Pyi Tawdevelopment area, perennial trees, edible plants,shady trees grown in state-owned estates, treesand flower plants grown on left and right sidesof the road, road islands and roundabouts with-out the permission of the committee;

(o) prohibiting and inspecting to prevent trespassand construction by any person, organizationand department within the road area deter-mined within the limit of the Nay Pyi Tawdevelopment area;

(p) exercising powers conferred from time totime by the Chairman of the State Peace andDevelopment Council.

Chapter VFinance

11. The Committee shall subsist on its own funds. If itis necessary, assistance from the Government maybe taken for the fund desiring to fullfil. In addition,it shall also take responsibility of its financialmatters.

12. The Committee shall open a separate bank accountfor it funds and has the right to expend for develop-ment works.

13. The Committee may manage in a suitable mannerto increase the fund.

14. The Committee shall open a separate bank accountfor foreign currency accurred by it and may expendfor the development works in accordance withprocedures and regulations.

15. The Committee shall:(a) after scrutinizing the annual budget estimate

drawn up and submitted by the Head of Office,submit it to the Chairman of the State Peaceand Development Council and obtain approval.Moreover, it shall be reported to the Govern-ment for the funds necessary to obtain assist-ance from the Government.

(b) submit the annual financial condition and au-dit-report within 90 days after expiry of thefinancial year to the Chairman of the StatePeace and Development Council.

Chapter VIOrganizational set-up

16. The Committee shall, based on the functions andduties, draw up the necessary organizational set-upwith the approval of the Chairman of the StatePeace and Development Council.

tional set-up under section16, include in the set-up the following service personnel contributingto the development works after consultation withthe relevant government departments and organi-zations:(a) service personnel carrying out the function

relating to precautionary measures againstdisease and public health;

(b) service personnel carrying out the function ofprecautionary measures against fire hazards;

(c) members of the Development Police Forceand other service personnel of the Committeewho carrying out the duty of security andmaintenance of discipline.

18. The Committee:(a) has the right to appoint service personnels

within the organizational set-up in accordancewith the existing regulations and bye-laws;

(b) may appoint by transfer, service person-nel who can carry out the developmentworks effectively in coordination with therelevant government departments and or-ganizations;

19. The Committee may, for enabling supervision ofservice personnel, delegate powers relating to person-nel affairs to the Head of Office as may be necessary.

Chapter VIIMaintaining the Fund and Auditing of Accounts20. The Committee shall, for enabling the Head of

Office to maintain the accounts systematicallyand to conduct auditing thereof prescribe proce-dures on accounts in coordination with the Audi-tor General.

21. The Head of Office shall(a) compile and maintain accounts in accord-

ance with the procedures on accounts asprescribed by the Committee;

(b) accept the audit of the person assigned dutyby the Auditor General, in respect of theaccounts compiled and maintained under sub-section (a).

Chapter VIIIActions taken by Administrative Means

22. The Committee may, if the holder of the license,

registration certificate or permit issued under thisLaw contravenes any of the stipulated conditionsor if he is convicted by the prescribed Court underthis Law, pass upon the license holder, permitsholder, or registration certificate holder any of thefollowing administrative order:(a) warning;(b) imposing stipulated fine;(c) suspending the license, registration certifi-

cate or permit, for a limited time;(d) cancelling the license, registration certificate

or permit.23. If there is failure to pay the imposed fine under the

administrative order, it shall be recovered as if itwere an arrears of land revenue.

Chapter IXOffences and Penalties

24. Whoever violates or fails to comply with any rulemade by the Committee under this Law shall, onconviction, be punished with imprisonment for aterm not exceeding one year or with fine not ex-ceeding kyats two hundred thousand, or with both.

25. If a person convicted under section, continues toviolate or fails to comply with such rule, he shallbe punished with fine which may extend from aminimum of kyats ten thousand to a maximum ofkyats fifty thousand for each day during which theviolation or failure continues.

26. Whoever violates or fails to comply with anycondition or any order issued by the Committeeunder this Law shall, on conviction, be punishedwith imprisonment for a term not exceeding threemonths or with fine exceeding kyats one hundredthousand or with both.

27. If a person, convicted under section 26, continuesto violate or fails to comply with such condition ororder, he shall be punished with fine which mayextend from a minimum of kyats ten thousand toa maximum of kyats fifty thousand for each dayduring which the violation or failure continues.

Chapter XMiscellaneous

28. The public and the public service personnel shallabide by the orders, bye-laws and directives issuedby the Committee since being duty bound to protectand preserve the works for cleanliness, tidiness,pleasantness, beauty, greenery and luxuriance withinthe limit of the Nay Pyi Taw development area;

29. The Committee shall, in performing its functionsand duties in exercising its powers, carry outworks involving the nature of policy, or specialplans to be implemented within the developmentarea of Nay Pyi Taw only after obtaining thepermission of the Chairman of the State Peace andDevelopment Council.

30. The Committee shall operate under its own nameand common seal and shall have perpetual succes-sion and power to sue and be sued in its corporate

name.31. The Committee is entitled to sue the responsible

department and organization if it does not receivethe reasonable value for its own immoveableproperty that are transferred to the state.

32. In order to have speedy trial and disposal ofdevelopment cases in which proceedings havebeen instituted for the violation of any rules, bye-laws or orders issued under this Law, the Com-mittee shall carry out in coordination with theSupreme Court and Office of the Attorney-Gen-eral for the opening of Courts and Law Offices atappropriate places within the Nay Pyi Taw devel-opment area.

33. The administrative order or decision passed by theCommittee under the section 22 shall be final andconclusive.

34. The Committee may in carrying out developmentworks apply the existing Development Commit-tees Law, rules, regulations, bye-laws, proce-dures, notifications, orders and directives madethereunder, in so far as they are not contrary to theobjectives and concepts of this Law.

35. The funds and moveable and immoveableproperty owned by the previous TownshipDevelopment Committees and Nay Pyi TawDevelopment Committee, within the Nay PyiTaw development area works in the process ofexecution, works which have been completed,assets and liabilities shall devolve respec-tively on the Committee.

36. (a) In executing instruments regarding transferof immoveable property situated within theNay Pyi Taw development area, the personchargeable with stamp duty shall pay theexcess percentage of stamp duty as prescribed,in addition to the value of stamp duty to bepaid under the Myanmar Stamp Act

(b) The Committee shall carry out in consulta-tion with the Ministry of Finance andRevenue to transfer and obtain the excessvalue of the stamp duty under sub-section (a).

37. The committee may, in carrying out its functionsand exercising its powers, assign duties to anyrelevant subordinate Department or by forming abody or to any person, if necessary.

38. In implementing the provisions of this Law, theCommittee may:(a) issue necessary rules with the approval of the

Chairman of the State Peace and Develop-ment Council;

(b) issue necessary procedures, bye-laws, notifi-cations, orders and directives.

and trained to handle various emergency situations butworkplace stress can take a toll on their emotions, USresearchers say.

Dr Miggie Greenberg of Saint Louis UniversitySchool of Medicine says different people react to trau-matic situations differently. It’s not uncommon to ex-perience a broad range of emotions — it’s actuallyquite normal and healthy, Greenberg says.

The challenge with first responders is that they aretrained to deal with high-intensity situations withoutemotionally reacting so the aftermath can be that muchmore devastating. Additionally, those who have expe-rienced some type of trauma in the past are more likelyto react adversely to a traumatic event, Greenberg says.

Some normal reactions include being in shock, feel-ing sad, acting more emotional, having intrusivethoughts about an incident and behaving in a hyper-vigilant manner, Greenberg says.

These should fade over time. However, when one’sday-to-day routine is frequently sidetracked by suchreactions, this may be evidence of major distress,Greenberg says.

Some signs of psychological distress include con-stant anxiety, inexplicable crying, erratic behaviour,isolation, and the increase use of drugs and/or alco-hol. This distress may require professional treatment,Greenberg says.

The conclusionwas based on analysis of CT scans of1,781 non-smokers without clinicalcardiovascular disease recruited fromsix communities in the United States.

Those reporting childhood exposureto tobacco smoke (ETS) were somewhatyounger, with an average age of 61; weremore likely to be non-Hispanic white;and less likely to have been born out-side the United States. These differenceswere statistically controlled in the analy-ses.

Approximately half of the partici-

pants in this large multiethnic cohort hadat least one regular cigarette smoker intheir childhood home. Participants withmore childhood ETS exposure had moreemphysema-like lung pixels; an averageof 20 percent of scan pixels were em-physema-like for those who lived withtwo or more smokers as a child, com-pared with 18 percent for those who livedwith one regular smoker, or 17 percentfor those who said that they did not livewith a regular inside smoker as a child.

This finding by researchers at Colum-bia University’s Mailman School of Pub-lic Health suggests that the lungs may notrecover completely from the effects ofearly-life ETS.

Websites that died in 2009BEIJING, 29 Dec— While some websites have

flourished in 2009, most notably Facebook andTwitter, others have fallen by the wayside. Manysites that died were relatively small enterprises. Buteven the big Internet giants, Google, Microsoft andYahoo ditched once popular services and websites.

January saw Google’s changes to Jaiku andDodgeball. Jaiku, a social networking, micro-blogging and lifestreaming service comparable toTwitter, was not shut but will be left to flounder. OnJanuary 14, 2009 it was announced that Googlewould be open-sourcing the product but would “nolonger actively develop the Jaiku codebase” leavingdevelopment to a “passionate volunteer team ofGooglers”. Dodgeball was a location-based socialnetworking software provider for mobile devices.Users would text their location to the service, whichthen notified them of crushes, friends, friends’friends and interesting venues nearby. Dodgeballwas shut down by Google in March 2009 andreplaced with Google Latitude. Google Notebookwas also shutdown for new users as cloud serviceslike Google Docs increased in popularity. Anothercloud service owned by Yahoo also announced itsclosure in January. Yahoo’s Briefcase had beendeemed somewhat useless by many observers.
