8. Conditions of Business – EST Directory Advertising8.1 These conditions shall apply to all online listings in the EST Directory website: www.estdirectory.com accepted

for publication. Any other proposed condition shall be void unless incorporated clearly in written instructions andspecifically accepted by the Publisher.

8.2 All Product and Company Listings and any Advertisements placed are accepted subject to the Publisher’sapproval of the copy and to the space being available.

8.3 If it is intended to include in an advertisement a competition or a special offer or merchandise other than thatnormally associated with the advertised product, full details must be submitted at the time of booking.

8.4 The Publisher reserves the right to omit or suspend an advertisement, Product or Company Listing at any timefor good reason, in which case no claim on the part of any Advertiser for damage or breach of contract shall arise.Should such omission or suspension be due to the act or default of the Advertiser or his servants or agents, thenthe space reserved for the advertisement/listing shall be paid in full notwithstanding that theadvertisement/listing has not appeared. Such omission or suspension shall be notified to the Advertiser as soonas possible.

8.5 If the Publisher considers it necessary to modify the space or alter that date or position of insertion or make anyother alteration, the Advertiser will have the right to cancel if the alterations requested are unacceptable, unlesssuch changes are due to an emergency or circumstances beyond the Publisher’s control. Every care is taken toavoid mistakes but the Publisher cannot accept liability for any errors due to third parties, subcontractors orinaccurate copy instructions.

8.6 The Advertiser warrants that the advertisement/listing does not contravene any Act of Parliament nor is it in anyother way illegal or defamatory or an infringement of any other party’s rights or an infringement of the BritishCode of Advertising Practice. Country of origin (other than the United Kingdom) of goods advertised must beshown in advertisements if so required by statute of statutory or other regulations.

8.7 The Advertiser will indemnify the Publisher fully in respect of any claim made against the Publisher arising fromthe advertisement. The Publisher will consult with the Advertiser as to the way in which such claims are to behandled.

8.8 Advertisement/Product Listing rates are subject to revision at any time and orders are accepted on conditionthat the price binds the Publisher only for the 12 months period from the date of order. In the event of a rateincrease, the Advertiser will have the option to cancel the order without surcharge or continue the order at therevised advertisement rates.

8.9 Invoices will be raised as follows: 100% on booking of Advertisement/Listing Accounts are due for settlementwithin 30 days from date of invoice. We understand and will exercise our statutory right to claim interest andcompensation for debt recovery costs under the late payment legislation if we are not paid according to thiscredit term of 30 days. Advertisers’ listings will be live from date of receipt of order but removed if the conditionsset out in 9)(i) are not met.

8.10 Advertisers are responsible for uploading their own Product or Company Listings. Any advertisement copy,including but not limited to sponsored pages or advertising banners and buttons will be uploaded by thePublisher. Complaints regarding reproduction of advertisements must be received in writing within one calendarmonth of the cover date.

8.11 Advertisers’ property, artwork, etc. are held at Owners’ risk and should be insured by them against loss ordamage from whatever cause.

8.12 For the purpose of these conditions, Advertisers shall refer to the Advertiser or his Agent whichever is theprincipal.

8.13 These conditions and all other express items of the contract shall be governed and construed in accordance withthe Laws of England.

8.14 These conditions (Section 8) are the only conditions upon which the Advertiser or any agent acting on behalf ofthe Advertiser is prepared to deal with the Publisher and they shall govern the Contract to the entire exclusion ofall other terms.

9. Our Legal Obligations and limits on liability9.1 Nothing in these Terms and Conditions shall exclude or limit Our liability for fraudulent misrepresentation or for

death or personal injury resulting from Our negligence or the negligence by Us, Our employees or agents.9.2 We do not accept any liability for damage to Your computer system or loss of data that results from Your use of

the Website and We cannot guarantee that any files that You download are free from viruses, contamination ordestructive features.

9.3 Whilst We use all reasonable endeavours to correct any errors or omissions as soon as practicable once theyhave been brought to Our attention, We do not warrant that the information on the Website itself will be free fromerrors or omissions.

9.4 We do not warrant that the Website will be available uninterrupted and in a fully operating condition.9.5 Access to the Website may be suspended temporarily and without notice in the case of system failure,
