WHEREAS it is enacted, inter alia, by section 2 of the Offenders Probation and Parole Act, 1963, that the Act shall come into operation on a day to be fixed by Proclamation, and that it shall not be necessary to proclaim that the whole Act shall come into operation on one day, but the several Parts and sections of the Act may be proclaimed to come into operation on such days as are re- spectively fixed by Proclamation; and whereas it now appears to me desirable and expedient that Parts I, III and IV of the said Act shall some into operation: Now, therefore I, the Governor, acting with the advice and consent of the Executive Council, do hereby fix the 1st day of October, 1964, as the day on which Parts I, III and IV of the Offenders Probation and Parole Act, 1963, shall come into operation. IN pursuance of the provisions of section10 of the Fisheries Act, 1905-1962, I, the Governorof the State of Western Australia, by and withthe advice and consent of the Executive Council,do hereby prohibit all persons from taking anyfish whatsoever by means of fishing nets in thoseportions of Western Australian waters describedin Schedules A, B, C and D hereto, for the termof five years from date of publication of thisProclamation in the Government Gazette.

2. In pursuance of the provisions of the sectionaforesaid, I prohibit all persons from taking anyfish whatsoever by means of fishing nets in thatportion of Western Australian waters described inschedule E hereto, during the periods commencing8 o'clock in the afternoon of Thursday in eachweek and ending at 8 o'clock in the forenoon ofthe Sunday next following for a term of five yearsfrom date of publication of this Proclamation inthe Government Gazette.

Schedules.Schedule A.

All that portion of the waters of LeschenaultInlet bounded on the west by the railway bridgeat Point MacLeod on the east by a line of postsextending north-north-easterly from an unnamedpoint on the southern shore of the inlet, situateadjacent to and north-easterly from the mouth ofthe Preston River, to a point on the north-westernshore of the inlet situate adjacent to the northernshore of the channel connecting the inlet to thesea. Being more particularly the portion ofthe Leschenault Inlet delineated and shownbordered red on Department of Lands and SurveysMiscellaneous Plan 248.

Schedule B.The whole of the waters of the Collie River

and all its tributaries and all that portion ofLeschenault Inlet lying within a radius of 30 chainsof the northernmost extremity of Bar Island.

Schedule C.The whole of the coastal waters in the vicinity

of Bunbury known as "Hungry Hollow," beingthose waters lying between the Westerly extensions

of Clifton Street and Beach Road, in the Munici-pality of Bunbury, and within a distance measuredrectangularly from the foreshore of half a mile.

Schedule D.The whole of the waters of that part of Koorn-

bana Bay lying within a radius of one-quarter of amile of the groyne adjacent to the channel con-necting Leschenault Inlet with the Indian Ocean.

Schedule E.The whole of the waters of Leschenault Inlet

lying to the north of a line drawn from a pointmarked by a post on the southern shore of theinlet situate adjacent to and north-easterly fromthe mouth of the Preston River to a point markedby a post on the north-western shore of the inletsituate adjacent to the northern shore of the chan-nel connecting the inlet to the sea.

F. and S. 481/50.WHEREAS it is provided (inter alia) by section 59of the Factories and Shops Act, 1963, that the oc-cupier of a factory shall allow to any person em-ployed in the factory a half holiday on any dayproclaimed to be a half holiday in the district orlocality in which the factory is situate and, bysection 95 of that Act, that every shop, except anexempted shop and small shop, shall be closed, anda shopkeeper shall allow each shop assistant a halfholiday on any day that is proclaimed to be a hallholiday that is applicable to the area in which theshop is situate; and whereas it appears to me, theGovernor, expedient that a half holiday should beproclaimed for the day and place hereinafter ap-pearing: Now, therefore I, the Governor, actingwith the advice and consent of the Executive Coun-cil, do hereby proclaim the afternoon of Wednes-day the 21st day of October, 1964, to be a halfholiday, within the municipal district of, and ap-plicable to the area of, the Shire of Toodyay.

AT a meeting of the Executive Council held inthe Executive Council Chambers, at Perth, this17th day of September, 1964, the following Ordersin Council were authorised to be issued:

Explosives and Dangerous Goods Act, 1961.ORDER IN COUNCIL.

WHEREAS it is enacted, inter cilia, by section 14 ofthe Explosives and Dangerous Goods Act, 1961,that the Governor may from time to time, byOrder in Council, classify explosives and declareany specified explosive to be an authorised explosivefor the purposes of that Act and that the Governorshall not so classify or declare any explosive untilhe has defined the composition, quality and charac-ter of that explosive; but such definition in respectof the explosive is not required to be published inthe Order in Council classifying that explosive;and whereas it is further enacted that an Order in

Council made under the said section may be can-celled or from time to time varied by a subsequentOrder in Council; and whereas certain explosiveswere declared authorised explosives by an Orderin Council made by the Governor on the 22nd dayof July, 1964, and published in the GovernmentGazette on the 31st day of July, 1964; and whereasit is deemed expedient to vary that Order inCouncil in the manner hereinaftermentioned; Now,therefore, I, the Governor, acting with the adviceand consent of the Executive Council, and inexercise of the powers conferred by section 14 ofthe Explosives and Dangerous Goods Act, 1961, dohereby vary the abovementioned Order in Councilby adding thereto under the heading "CLASS 3-NITRO-COMPOUND, Division 1," the explosivesspecified in the schedule hereunder and declarethem to be authorised explosives for the purposesof the said Act, with effect from and including theday of the publication of notice of this Order inCouncil in the Government Gazette.

WHEREAS by section 33 of the Land Act, 1933-1963, it is made lawful for the Governor to directthat any reserve shall vest in and be held byany municipality, body corporate, or other personor persons to be named in the order in trust forthe like or other public purposes to be specifiedin such order; and whereas it is deemed expedientas follows:-

Corres. 5703/04.—That Reserve No. 9326 shouldvest in and be held by the Shire of Brookton intrust for the purpose of Gravel.

Corres. 2289/58.—That Reserve No. 25358 (Can-ning Location 1673) should vest in and be held bythe Shire of Gosnells in trust for the purpose ofRecreation.

Corres. 662/63.—That Reserve No. 27286 (Wil-liams Location 15448) should vest in and be heldby The Fauna Protection Advisory Committee ofWestern Australia in trust for the purpose ofConservation of Flora and Fauna.

Now, therefore, His Excellency the Governor,by and with the advice and consent of theExecutive Council, doth hereby direct that thebeforementioned reserves shall vest in and beheld by the abovementioned bodies in trust forthe purposes aforesaid, subject nevertheless to thepowers reserved to him by section 37 of the saidAct.

ORDER IN COUNCIL.

Corres. 1067/64 (R921).WHEREAS by section 288 of the Local Govern-ment Act, 1960, it shall be lawful for the Governor,on request of the Council by notice in the Govern-ment Gazette, to declare any lands reserved, oracquired, for use by the public or used by thepublic as a street, way, public place, bridge orthoroughfare, under the care, control and man-agement of a Council, or lands comprised in aprivate street, constructed and maintained to thesatisfaction of a Council as a public street, andif the Council thinks fit, that the Governor shalldeclare the width of the carriage way and foot-paths of the public street: and whereas the Shireof Armadale-Kelmscott has requested that certainlands named and described in the schedule here-under, which have been reserved for a streetwithin the Shire of Armadale-Kelmscott be de-clared a public street: Now, therefore, His Excel-lency the Governor, by and with the advice andconsent of the Executive Council, doth herebydeclare the said lands to be a public street, andsuch lands shall, from the date of this order, beabsolutely dedicated to the public as a streetwithin the meaning of any law now or hereafterin force.

Forests Act, 1918-1954.

ORDER IN COUNCIL.

F.D. 1231/62, L. and S. 1039/61.WHEREAS by the Forests Act, 1918-1954, it is pro-vided that a dedication under the said Act of Crownland as a State Forest may be revoked in wholeor in part in the following manner:

(a) The Governor shall cause to be laid onthe Table of each House of Parliament aproposal for such revocation.

(b) After such proposal has been laid beforeParliament the Governor, on a resolutionbeing passed by both Houses that suchproposal be carried out, shall by Order inCouncil revoke such dedication.

And whereas His Excellency the Governor didcause to be laid on the Table of each House ofParliament his proposal dated the 8th day of Nov-ember, 1962, for the revocation in part of the dedi-cation of Crown lands as State Forest; and whereasafter such proposal had been laid before Parlia-ment a resolution was passed by both Houses thatsuch proposal should be carried out: Now, there-fore, His Excellency the Governor, with the adviceand consent of the Executive Council, doth hereby

revoke in part the dedication of Crown land asState Forest No. 25 by excising that portion ofsuch State Forest as is described in the Schedulehereto.

order is the Beverley Shire Council.3.—Approval under this Order Required for

Certain Development.The carrying out of any development (other

than permitted development as set out in para-graph 6 of this order) on land within the scopeof this order is prohibited unless approval is firstobtained in accordance with the provisions ofparagraph 4 of this order in addition to any otherpermission or approval which may otherwise berequired by law.

4.—Application for, and Grant of, Approval.(a) No person shall carry out development (other

than permitted development as set out in para-graph 6 of this order) on land within the scopeof this order until he has applied for approvalfrom the local authority and has received thewritten approval or conditional approval of thelocal authority in accordance with the provisionsof the Act and this order.

(b) Application shall be made by or on behalfof the owner of the land and shall be accompaniedby three copies of a plan or plans drawn to scaleillustrating the proposed development and itslocation and indicating the type and construc-tion of any buildings or works proposed.

(c) The application shall be dealt with by thelocal authority in accordance with the terms ofthis order and the approval, conditional approval,or refusal of the local authority shall be issued tothe applicant together with one copy of the planor plans.

5.—Development by Public Authority.(a) Any public authority intending to carry out

development (other than permitted development)within the area covered by this order is requiredto consult the local authority in writing and tosupply such information as may be necessary toexplain the proposal.

(b) The development shall not be commenceduntil the local authority advise the public auth-ority either that the development is in conformitywith the proposed town planning scheme or canbe co-ordinated with it; but before so advisingthe local authority may require modification to thedevelopment.

(c) In the event of the modification not beingacceptable to the public authority, the develop-ment shall not be commenced but the matter shallbe referred to the Minister for determination bythe Governor as provided by subsection (9) ofsection 7B of the Act.

6.—Permitted Development.The following classes of development do not

require approval under this order and are subjectonly to local authority by-laws and other provisionsof law:—

(i) Development by public authorites and localauthorities for the purpose of their under-taking or functions on land owned by themat the time of coming into operation ofthis order.

(ii) Construction, reconstruction, repair andmaintenance of roads, railways, pipe lines,service mains, sewerage and drainage linesby public and local authorities on anypublic roadway or reserve or on any reserveor easement established for the purpose.

(iii) Extensions of or alteration, renovations ormaintenance to existing buildings withinthe curtilage of the land on which suchbuildings stand provided that the floorspace of any such buildings or group ofbuildings is not increased thereby by morethan 50 per cent.

7.—Existing Use.No provision in this order shall prevent the

continued use of any land or building for the pur-poses for which the land or building was beinglawfully used at the time of the coming intooperation of this order or shall prevent the carry-ing out of any development for which immediatelyprior to the coming into operation of this order,a permit or permits if any, required under this orany other Act authorising the development to becarried out had been obtained and was current.

8.—Appeals.(a) In the event of a person being aggrieved by

the refusal of approval or by the conditions sub-ject to which approval is granted in respect of anapplication for permission to carry out develop-ment under this order, he may appeal to theMinister against the decision. The appeal mustbe lodged in accordance with the provisions ofsubparagraph (c) of this paragraph within sixtydays after the refusal or conditional approval isserved on him.

(b) Where the local authority fails to grantapproval to an application for permission to carryout development within a period of sixty days afterreceipt of the application by the local authority,the failure shall be regarded as a refusal ofapproval and a person aggrieved by such refusalmay appeal to the Minister against the refusal.The appeal must be lodged in accordance with theprovisions of subparagraph (c) of this paragraphwithin sixty days after the expiration of the periodof sixty days from the receipt of the applicationby the local authority.

(c) Every appeal shall be in writing, shall statethe grounds on which the appeal is made, and mustbe lodged within the prescribed time at the officeof the Minister.

6.—Permitted Development.The following classes of development do not re-

quire approval under this order and are subject onlyto local authority by-laws and other provisions oflaw :—

tinued use of any land or building for the purposesfor which the land or building was being lawfullyused at the time of the coming into operation ofthis order or shall prevent the carrying out of anydevelopment for which immediately prior to thecoming into operation of this order, a permit orpermits if any, required under this or any otherAct authorising the development to be carried outhad been obtained and was current.

8.—Appeals.(a) In the event of a person being aggrieved by

the refusal of approval or by the conditions sub-ject to which approval is granted in respect of anapplication for permission to carry out develop-ment under this order, he may appeal to the Min-ister against the decision. permitted development as set out in paragraph 6of this order) on land within the scope of this orderis prohibited unless approval is first obtained inaccordance with the provisions of paragraph 4 ofthis order in addition to any other permission orapproval which may otherwise be required by law.

4.—Application for, and Grant of, Approval.(a) No person shall carry out development (other

than permitted development as set out in para-graph 6 of this order) on land within the scope ofthis order until he has applied for approval fromthe local authority and has received the writtenapproval or conditional approval of the local auth-ority in accordance with the provisions of the Actand this order.

(b) Application shall be made by or on behalfof the owner of the land and shall be accompaniedby three copies of a plan or plans drawn to scaleillustrating the proposed development and its loca-tion and indicating the type and construction ofany buildings or works proposed.

(c) The application shall be dealt with by thelocal authority in accordance with the terms ofthis order and the approval, conditional approval.or refusal of the local authority shall be issued tothe applicant together with one copy of the planor plans.

5.—Development by Public Authority.

(a) Any public authority intending to carry outdevelopment (other than permitted development)within the area covered by this order is requiredto consult the local authority in writing and tosupply such information as may be necessary toexplain the proposal.

(b) The development shall not be commenceduntil the local authority advise the public authorityeither that the development is in conformity withthe proposed town planning scheme or can be co-ordinated with it; but before so advising the localauthority may require modification to the develop-ment.

(c) In the event of the modification not beingacceptable to the public authority, the developmentshall not be commenced but the matter shall bereferred to the Minister for determination by theGovernor as provided by subsection (9) of section7B of the Act.

6.—Permitted Development.

The following classes of development do not re-quire approval under this order and are subjectonly to local authority by-laws and other provi-sions of law:—

(i) Development by public authorities andlocal authorities for the purpose of theirundertaking or functions on land ownedby them at the time of coming into opera-tion of this order.

(ii) Construction, reconstruction, repair andmaintenance of roads, railways, pipe lines,service mains, sewerage and drainage linesby public and local authorities on anypublic roadway or reserve or on any re-serve or easement established for the pur-pose.

(iii) Extensions of or alterations, renovating ormaintenance to existing buildings withinthe curtilage of the land on which suchbuildings stand provided that the floorspace of any such buildings or group ofbuildings is not increased without priorconsent of the West Kimberley Shire Coun-cil.

7.—Existing Use.

No provision in this order shall prevent the con-tinued use of any land or building for the purposesfor which the land was being lawfully used at thetime of the coming into operation of this order orshall prevent the carrying out of any developmentfor which immediately prior to the coming intooperation of this order, a permit or permits if any,required under this or any other Act authorisingthe development to be carried out had been ob-tained and was current.

8.—Appeals.

(a) In the event of a person being aggrieved bythe refusal of approval or by the conditions sub-ject to which approval is granted in respect of anapplication for permission to carry out develop-ment under this order, he may appeal to the Minis-ter against the decision. The appeal must be lodgedin accordance with the provisions of subparagraph(c) of this paragraph within sixty days after therefusal or conditional approval is served on him.

(b) Where the local authority fails to grant ap-proval to an application for permission to carry outdevelopment within a period of sixty days afterreceipt of the application by the local authority,the failure shall be regarded as a refusal of ap-proval and a person aggrieved by such refusal mayappeal to the Minister against the refusal. Theappeal must be lodged in accordance with the pro-visions of subparagraph (c) of this paragraphwithin sixty days after the expiration of the periodof sixty days from the receipt of the application bythe local authority.

(c) Every appeal shall be in writing, shall statethe grounds on which the appeal is made, and mustbe lodged within the prescribed time at the officeof the Minister.

TOWN PLANNING AND DEVELOPMENT ACT,1928-1962.

IN accordance with the provisions of subsection(2) of section 7B of the Town Planning and De-velopment Act, 1928-1962, and by direction of theMinister for Town Planning, a summary as set outhereunder of the West Kimberley Shire Council In-terim Development Order No. 1 made pursuant tothe provisions of section 7B of that Act is herebypublished for general information.

Summary.1. The West Kimberley Shire Council Interim

Shire of Goomalling.Notice to All Owners and Occupiers of Land Within

the Shire of Goomalling.UNDER the provisions of the Bush Fires Act, 1954-1963, all owners and/or occupiers of land withinthe Shire of Goomalling are required, on or beforethe 31st October, 1964, to prepare and thereaftermaintain an effective firebreak to a width of notless than ten (10) feet around the boundaries ofall crop and grass paddocks.

Every separately fenced paddock of 500 acres orexceeding that area shall be protected with a fire-break as described in the foregoing paragraph, inaddition to the perimeter firebreak on the outerboundary of the property. Where the land adjoinsa railway line the firebreak shall be double theabove width.

The owner or occupier of land who fails orneglects to comply with the regulation made in theabove notice is guilty of an offence under subsec-tion (3) of section 33 and is liable to a penalty ofnot less than five pounds (£5) nor more than onehundred pounds (£100).

PURSUANT to the powers contained in section 33of the Bush Fires Act, 1954-1963, all owners and/oroccupiers of property in townsites within the Shireof Goomalling are required, on or before the 31stOctober, 1964, to remove from the land ownedor occupied by them, all bush or inflammablematerial or to clear firebreaks in accordance withthe following:

(1) Where the land is vacant and no buildingsare erected, all bush and inflammablematerial shall be removed.

(2) If buildings are erected on the land, suchbuildings shall be immediately surroundedby a firebreak cleared of all inflammablematerial to a width of not less than 10feet.

The penalty for failure to comply with this orderis a fine of not less than £5 nor more than £100,and the Council may have the works carried out atthe owner's expense, and may recover the cost ofsuch works from the owner, or occupier, in additionto any penalties which may be inflicted for failureto comply with the order.

Shire of Northam.Notice to Owners and Occupiers of Land Within

the Shire of Northam.PURSUANT to the powers contained in section 33of the above Act, you are hereby required, on orbefore the 15th day of October, 1964, to plough,scarify, cultivate, or otherwise clear firebreaks toa width of not less than six feet in the followingpositions on the land owned or occupied by youand thereafter to maintain such firebreaks clearof all inflammable material until the 15th day ofApril, 1965:-

(1) Inside and along the whole of the ex-ternal boundaries of the property or pro-perties owned or occupied by you.

(2) Where the total area of each property ex-ceeds 500 acres, additional firebreaks mustbe provided in such positions so as to dividethe property into areas not exceeding 500acres, each area to be completely sur-rounded by a firebreak.

(3) Where buildings or haystacks are situatedon the property, additional firebreaks, notless than ten feet in width, must be pro-vided within five chains of the perimeterof such buildings or haystacks in such amanner as to completely encircle thebuildings or haystacks.

If for any reason it is considered impracticableto provide firebreaks in the position required bythis notice, the approval of the Shire Council mustbe obtained to construct such firebreaks in an al-ternative position. Approval to any such variationwill only be granted where the bush fire controlofficer for the area has first signified his approvalto the variation.

Where the land of an owner or occupier abutsa constructed road, and the owner or occupier hasburned or cleared the bush between the road forma-tion and the boundary of his land, such firebreakwill be accepted as complying with the requirementsof this notice so far as it applies to the abuttingboundaries of the property.

Provided that this order shall be deemed to havebeen complied with if the firebreaks around grow-ing or standing crops are completed on or beforethe following dates:

Shire of Merredin.PURSUANT to the powers contained in section 33of the Bush Fires Act, 1954-1963, owners and oc-cupiers of land in the Shire of Merredin are herebyrequired, on or before the 29th day of October,1964, to clear, in the manner specified hereunder,firebreaks not less than 10 feet wide inside andalong the boundaries of each separate propertyowned and occupied by them. When land so ownedor occupied is contiguous to or intersected by arailway line, notwithstanding that there may be acleared road between the railway reserve and theland so owned or occupied, all firebreaks on suchcontiguous land shall be made not less than 20 feetwide.

Where any land has been rolled or otherwiseprepared for burning off, the whole area of suchprepared land shall be completely enclosed by afirebreak, not less than 66 feet wide, to be maderound any area occupied by buildings or hay-stacks.

The firebreaks required by this notice shall beconstructed by ploughing, scarifying, or grading thewhole width of the various firebreaks. The soil forthe full width of the firebreak is to be maintainedin a condition of efficiency by all regrowth or in-

flammable material being removed therefrom asoften as may be required to keep the firebreakcompletely cleared of all inflammable material.

Where land is under crop, a swathe of such cropnot less than 10 feet wide as is growing along theboundary of any land so owned or occupied shallbe cut not later than the 31st day of October, 1964,and the swathe so cut shall be ploughed, and thesoil so ploughed shall be completely turned over.

On or before the 25th day of October, 1964, own-ers or occupiers of land within the MerredinTownsite shall remove all bush and inflammablematerial from vacant land but, where buildings areerected on the land, shall prepare and thereaftermaintain until the 31st March, 1965, effective fire-breaks around the perimeter of such buildings, andinside and along the whole of the boundary ofsuch land, cleared of all inflammable material to awidth of at least three feet, or where the boundaryis closer than three feet for that lesser distance.
