    THE ENVIRONMENT (PROTECTION) RULES, 1986

    S.O. 844 (E), dated the 1986 In exercise of powers conferred by Sec. 6 and 25 of

    the Environment (Protection) Act !"#6 (2" of !"#6) the $entra% &overnment hereby

    ma'es the fo%%owin r%es name%y *

    It is well settled in law that every subordinate law-making authority has

    a power to frame subordinate legislation only provided it is reasonable

    that very subordinate law-making authority has a power to frame

    subordinate legislation only provided it is reasonable and within the

    limits of the rule-making power of that body.

    !. Sort tit%e and $ommencement.+ (!) ,hese r%es may be ca%%ed the

    Environment (protection) -%es!"#6.

    2. "e#$!$t$o!%.&In these r%es n%ess the context otherwise re0ires.+

    (a) 1Act means the Environment(Protection) Act!"#6(2" of !"#6) the

    $entra% &overnment hereby ma'es the fo%%owin r%es name%y *

    (aa) 1area means a%% areas here the ha/ardos sbstances are hand%ed34

    (b) 1$entra% oard means the $entra% oard for the Prevention and $ontro%

    of ater Po%%tion constitted nder Sec. 7 of the ater (Prevention and

    $ontro% of Po%%tant) Act !"89 (6 of !"89)3

    (a) 1:orm means a :orm set forth in Appendix A to these r%es 3

    (b) 1&overnment Ana%yst means a person appointed or reconi/ed as sch nder

    sec. !73

    (c) 1Person in re%ation to any factory or premises means a person or occpier or

    his aent who has contro% over the affairs of the factory or premises and

    inc%des in re%ation to any sbstances the person in possession of the

    sbstance3

    ;(ee) 1Prohibited sbstance means the sbstance prohibited for hand%in

    (h) 1State oard means a State oard for the Prevention and $ontro% of ater

    Po%%tion constitted nder Sec. 9 of the ater (Prevention and $ontro% of

    ater Po%%tion) Act !"89 (6 of !"89) or State oard for the Prevention and

    $ontro% of Air Po%%tion constitted nder Sec. 5 of the Air (Prevention and

    $ontro% of Po%%tion) Act !"#! (!9 of !"#!).

    P'$!$*e o# $!te''etat$o! o# a %tat+te = ne may state the accepted

    princip%e of interpretation of a statte that every %eis%ation is prima facie prospective

    n%ess it is express%y or by necessary imp%ication made to have retrospective

    operation. ,he 0estion whether a statte operates retrospective%y or prospective%y is

    one of %eis%ative intent. If the terms of the statte are c%ear or nambios and it is

    manifest that the %eis%atre intended the Act to operate retrospective%y

    n0estionab%y it mst be so constred. If however the terms of a statte do not of

    themse%ves ma'e an intention certain or c%ear it sho%d be presmed to operate

    prospective%y. An act is retrospective. If it ta'es away or impairs any vested riht

    ac0ired nder an existin %aw or creates a new %iabi%ity or ob%iation in respect of

    transactions a%ready past or creates a new ob%iation or %iabi%ity in respect of post

    transactions.

    R+*e% o# $!te''etat$o!= It is we%%+'nown r%e of constrction that it is not

    for the $ort to ma'e the %aw and the %aw sho%d be app%ied even if the %aw does not

    accord with the notions of riht and wron of the $ort. ,hese are no dobt correct

    r%es of interpretation.

    . Sta!da'd% #o' e$%%$o! o' d$%ha'-e o# e!$'o!e!ta* o**+ta!t% = (!)

    :or the prposes of protectin and improvin the 0a%ity of the environment and

    preventin and abatin environment po%%tion the standards for emission or

    dischare of environmenta% po%%tants from the indstries operations or processes

    sha%% be as specified in ;Schs. I to I>4.

    (2) ?otwithstandin anythin contained in sb+r%e (!) the $entra% oard or a

    State oard may specify more strinent standards from those provided in ;Schs. I to

    I>4 in respect of any specific indstry operation or process dependin pon the

    0a%ity of the recipient system and after recordin reasons therefore in writin.

    (7) ,he standards for emission or dischare of environmenta% po%%tants

    specified nder sb+r%e (!) or sb+r%e (2) sha%% be comp%ied with by an indstryoperation or process within a period of one year of bein so specified.

    [(3-A) (i) Notwithstanding anything ontained in sub-rule(!) and

    environmental pollutants form the[industries# operation or proess other

    than those industries# operations or proesses for whih standards have

    been speifies in 'h. ! shall not eeed the relevant parameters and

    standards speified in 'h. *I+Provided that the State oards may specify more strinent standards for the

    re%evant parameters with respect to specify indstry or %ocations after recordin

    reasons therefore in writin*

    (ii) ,he State oards whi%e enforcin the standards specified in Sch. >I fo%%ow

    the ide%ines specified in Annexres I and II in that sched%e.4

    ;(7+) Any emission or dischare of environmenta% po%%tants from the

    indstries operations or processes sha%% not exceed the re%evant concentration in

    ambient air as indicated and set ot aainst each po%%tants (7) to (5) of the Sch. >II.4

    (9) ?otwithstandin anythin contained in sb+r%e (7) +

    (a) the $entra% oard or a State oard dependin on the %oca% conditions or

    natre of dischare of environmenta% po%%tants may by order specify a

    %esser period than a period specified nder sb+r%e (7) within which the

    comp%iance of standards sha%% be made by an indstry operation or

    process3

    (b) the centra% &overnment in respect of any specific indstry operation or

    process by order may specify any period other than a period specified

    nder sb+r%e (7) within which the comp%iance of standards sha%% be

    made by sch indstry operation or process.

    (5) ?otwithstandin anythin contained in sb+r%e (7) the standards for

    emission

    or dischare of environmenta% po%%tants specified nder sb+r%e (!) or sb+r%e (2)

    in respect of an indstry operation or process before the commencement of the

    Environment (Protection) (Amendment) -%es !""! sha%% be compi%ed by sch

    indstry operation or process by the 7!st

    day of @ecember !""!.4

    ;(6) ?otwithstandin anythin contained in sb+r%e (7) an indstry

    operation or

    process which has commenced prodction on or before !6th ay !"#! and has

    shown ade0ate proof of at%east commencement of physica% wor' of estab%ishment of

    faci%ities to meet the specified standards within a time+bond proramme to the

    satisfaction of the concerned State Po%%tion $ontro% oard sha%% comp%y with sch

    standards %atest by the 7!

    operation or process which has commenced prodction after the !6thday of ay

    %east commencement of physica% wor' for estab%ishment of faci%ities to meet the

    specified standards within a time+bond proramme to the satisfaction of the

    concerned State Po%%tion $ontro% oard sha%% comp%y with sch standards %atest by

    the 7!stday of @ecember !""2.4

    p%ants sha%% se beneficiated coa% with an ash content not exceedin thirty for

    percent name%y *+

    (a) any therma% power p%ant %ocated beyond one thosand 'i%ometers from the

    pit+head and

    (b) any therma% power p%ant %ocated in rban area or sensitive area or

    critica%%y po%%ted area irrespective of their distance from pit+head except

    any pit+head power p%ant.

    ,planation= :or the prpose of this r%e+

    (a) 1beneficiated coa% means coa% containin hiher ca%orific va%e bt %ower

    ash than the oriina% ash content in the raw coa% obtained throh physica%

    separation or washin process3

    (b) 1pit+head power p%ant means power stations havin captive transpiration

    system for its exc%sive se for transportation of coa% from the %oadin

    point at the minin end pto the n%oadin point at the power station

    withot sin the norma% pb%ic transportation system3

    (c) 1sensitive area means an area whose eco%oica% ba%ance is prone to be

    easi%y distrbed3

    (d) 1$ritica%%y po%%ted area means the area where po%%tion %eve% has

    reached or %i'e%y to reach to the critica% %eve% and which has beenidentified as sch by the $entra% &overnment or $entra% Po%%tion $ontro%

    oard or a State Po%%tion $ontro% oard.4

    4. Directions (!) Any diretion issued under 'e. shall be in writing.

    (") /he diretion shall speify the nature of ation to be taken and

    the time within whih it shall be omplied with by the person# offier or

    the authority to whom suh diretion is given.(7+a) ,he person. fficer or athority to whom any direction is soht to be

    issed sha%% be served with a copy of the proposed direction and sha%% be iven anopportnity of not %ess than fifteen days from the date of service of a notice to fi%e

    with an officer desinated in this beha%f the obDections if any to the isse of the

    proposed direction.

    (7+b) here the proposed direction is for the stoppae or re%ation of

    e%ectricity or water or any other service affectin the carryin on of any indstry

    operation or process and is soht to be issed to an officer or an athority a copy of

    the proposed direction sha%% a%so be endorsed to the occpier with an officer

    desinated in this beha%f sha%% be dea%t with in accordance with the procedres nder

    sb+r%e (7+a) and (9) of this r%e*

    Provided that no opportnity of bein heard sha%% be iven to the occpier if

    he had a%ready been heard ear%ier and the proposed direction referred to in sb+r%e

    (7+a) above for the stoppae or re%ation of e%ectricity or water or any other service

    was the res%tant decision of the $entra% overnment after sch ear%ier hearin.4

    (9) ,he $entra% &overnment sha%% within a period of 95 days from the date of

    receipt of the obDections. If any or from the date p to which an opportnity is iven

    to the person officer or athority to fi%e obDections whichever is ear%ier after

    considerin the obDectives. If any received from the person officer or athority

    soht to be directed and for reasons to be recorded in writin confirm modify or

    decide not to isse the proposed direction.

    () In a ase where the 0entral 1overnment is of the 2pinion that

    in view of the likelihood of a grave inury to the environment it is not

    epedient to provide an opportunity to file obetions against the

    proposed diretion# it may# for reasons to be reorded in writing# issue

    diretions without providing suh an opportunity.(6) Every notice or direction re0ired to be issed nder this r%e sha%% be

    deemed to be d%y served =

    (a) where the person to be served is a company if the docment is addressed

    in the name of the company at its reistered office or at its principa% office

    or p%ace of bsiness and is either +

    (i) sent by reistered post3 or

    (ii) de%ivered at its reistered office or at the principa% office or p%ace ofbsiness3

    (b) where the person to be served is an officer servin &overnment if the

    docment is addressed to the person and a copy thereof is endorsed to his

    ead of the @epartment and a%so to the Secretary to the &overnment as

    the case may be inchare of the @epartment in which for the time bein

    the bsiness re%atin to the @epartment in which the officer is emp%oyed is

    transacted and is either +

    (i) sent by reistered post3 or

    (ii) is iven or tendered to him3

    (c) in any other case if the docment is addressed to the person to be served

    and+

    (i) is iven or tendered to him or

    (ii) if sch person cannot be fond is affixed on some conspicos part of

    his %ast 'nown p%ace of residence or bsiness or is iven or tendered to

    some ad%t member of his fami%y or is affixed on some conspicos

    part of the %and or bi%din if any to which it re%ates or

    (iii) is sent by reistered post to that person.

    ,planation= :or the prposes of this sb+r%e+

    (a) 1company means any body corporate and inc%des a firm or other

    association of individa%s3

    (b) 1a servant is not a member of the fami%y.

    Pe'%o!= ,he word 1person has been sed to ma'e it c%ear that in order to

    exercise the powers of a $ontro%%er nder the Act the stattory fnctionary has to be

    d%y appointed by the &overnment and that he is persona desinata or desinated

    person.

    Oo't+!$t/ o# hea'$!- to the o+$e' ?o dobt the proviso to sb+r%e

    (7+b) of r%e 9 provides for an opportnity of hearin to the occpier bt it has to be

    read a%onwith sb+r%e (7+b) of which it is a part. ,he said sb+r%e provides that the

    provision is app%icab%e in a case where the notice is issed to an officer or an

    athority other than an occpier of the indstry operation or process. In the instant

    case the notice was issed to the manain partner of the firm. ence there was no

    necessity to send a copy of proposed direction to the occpier and sb+r%e (7+b) of

    the r%e 9 was not attracted in the case.

    a''/$!- o! o# 'oe%%e% a!d oe'at$o!% $! d$##e'e!t a'ea% = (!) ,he $entra%

    &overnment may ta'e into consideration the fo%%owin factors whi%e prohibitin or

    restrictin the %ocation of indstries and carryin on of processes and operations in

    different areas =

    (i) Standards for 0a%ity of environment in its varios aspects %aid

    down for an area.

    (ii) ,he maximm a%%owab%e %imits of concentration of varios

    environment po%%tants (inc%din noise) for an area.(iii) ,he %i'e%y emission or dischare of environmenta% po%%tants from

    an indstry process or operation proposed to be prohibited or

    restricted.

    (iv) ,he toporaphic and c%imatic featres of an area.

    (v) ,he bio%oica% diversity of the area which in the opinion of the

    $entra% &overnment needs to be preserved.

    (vi) Environmenta%%y compatib%e %and se.

    (vii) ?et adverse environmenta% impact %i'e%y to be cased by an

    indstry process or operation proposed to be prohibited or

    restricted.

    (viii) Proximity to a protected area nder the Ancient onments and

    Archaeo%oica% Sites and -emains Act !"5# or a sanctrary

    ?ationa% Par' ame reserve or c%osed area notified as sch nder

    the i%d Fife (Protection) Act !"82 or p%aces protected nder any

    treaty areement or convention with Internationa% conference

    association or other body.

    (ix) Proximity to hman sett%ements.

    (x) Any other factors as may be considered by the $entra% &overnment

    to be re%evant to the protection of the environment in an area.

    (2) hi%e prohibitin or restrictin the %ocation of indstries and carryin on

    of

    processes and operations in an area the $entra% &overnment sha%% fo%%ow the

    procedre hereinafter %aid down.

    (7) (a) henever it appears to the $entra% &overnment that it is expedient to

    impose prohibition or restrictions on the %ocation of an indstry or the carryin on of

    processes and operations in an area it may by notification in the fficia% &a/ette and

    in sch other manner as the $entra% &overnment may deem necessary

    from time to time ive notice of its intention to do so.

    (b) Every notification nder $%. (a) sha%% ive a brief description of the area

    theindstries operations processes in that area abot which sch notification pertains

    and a%so specify the reasons for the imposition of prohibition or restrictions on the

    %ocation of the indstries and carryin on of processes or operations in that area.

    (c) Any person interested in fi%in an obDection aainst the imposition of

    prohibition or restrictions on carryin on of processes or operations as notified nder

    $%. (a) may do so in writin to the $entra% &overnment within sixty days from the

    date of pb%ication of the notification in the fficia% a/ette.

    (d) ,he $entra% overnment sha%% within a period of one hndred and twenty

    days

    from the date of pb%ication of the notification in the fficia% &a/ette consider a%%

    the obDections received aainst sch notification and may ;within ;three hndred and

    sixty+five days4 from sch date of pb%ication4 impose prohibition or restrictions on

    %ocation of sch indstries and the carryin on of any process or operation in an area.

    ;(9) ?otwithstandin anythin contained in sb+r%e (7) whenever it appears

    to

    the $entra% &overnment that it is in pb%ic interest to do so it may dispense with the

    re0irement of notice nder $%. (a) of sb+r%e (7).4

    oe!t%

    P'oh$$t$o! o# $!$!- oe'at$o!% "$'et$o!% $%%+ed / the S+'ee

    Co+'t=

    As on today the sitation is that the minin activity in the %isted mines (accordin to

    the -aDasthan &overnment it has a%ready stopped a%% minin activities in 59 mines

    specified in its app%ication) is i%%ea% and has to stop. ay be that this wi%% have the

    effect of brinin to ha%t the activity invo%vin a ood amont of capita% and a %are

    nmber of wor'ers. t in view of the inherent i%%ea%ity attachin to them the $ort

    has no option bt to c%ose them. ,hey cannot be permitted to operate. If and when the

    $entra% &overnment recommends the p%ea of the State overnment and any of the

    areas a%ready dec%ared as protected forest are de%eted with %eave of the Spreme

    $ort can the minin activity o on in these areas. It is accordin%y directed that a%%

    minin activity in the mines mentioned in Appendix+A to the report of Sri Bstice

    .F. Bain $ommittee sha%% stop forthwith. Simi%ar%y the minin activity in the mines

    mentioned Appendix+ to the said report sha%% a%so stop forthwith in so far as they

    fa%% within the protected forest areas. ,he p%ea of the -aDasthan &overnment and of

    the mine owners sha%% be considered by @epartment of :orest and Environment of

    India and a report sbmitted to the Spreme $ort within three months. ?ow comin

    to the mines %ocated otside the protected forest areas bt within the tier reserve. Itcannot be said that the very rant of minin %easeG%icence is itse%f i%%ea% in their case

    n%ess of corse sch minin %easeG%icence or its renewa% has been ranted on or

    after ay 8 !""2 (partic%ars in this beha%f are not made avai%ab%e to the $ort). ,he

    i%%ea%ity has attached to these mines by virte of the notification issed by the

    $entra% &overnment nder Sec. 7 of the Environment (Protection) Act on ay 8

    !""2. In the circmstances it is directed that the minin activity in the mines sitated

    otside the protected forest areas bt within the tier reserve may contine for a

    period of for months. ithin this period it sha%% be open to the concerned mine+

    owners to approach the @epartment of :orest and Environment &overnment of India

    for permission to contine their minin operations. ,hey can contine the minin

    operations in these mines on%y if the $entra% &overnment permits them and sbDect to

    the orders of the $entra% &overnment in that beha%f. If no permission is obtained

    from the $entra% &overnment within the said period o for months the minin

    activity in the entire area dec%ared as tier reserve sha%% stop and cease on the expiry

    of for months.

    Re%t'$t$o!% a!d 'oh$$t$o!% 'e-a'd% o!%t'+t$o!% o' %ett$!- +

    $!d+%t'$e%= In the instant case it was he%d that a%% the restrictions and prohibitions

    reardin constrction and settin p of indstries or for any other prpose contained

    in the notification dated !"th:ebrary !""! issed by inistry of Environment and

    :orest &overnment of India nder $%. (d) of sb+r%e (7) of r%e 5 of the

    Environment (Protection) -%es !"#6 sha%% be metic%os%y fo%%owed by a%% the

    concerned States. ,he activities which have been dec%ared as prohibited within the

    $oasta% -e%ations Hone sha%% not be nderta'en by any of the respondent+states.

    ,he re%ations of permissib%e activities sha%% a%so be metic%os%y fo%%owed. ,he

    restrictions imposed by the $oasta% Areas $%assification and @eve%opment

    -e%ations contained in Annexre ! to the notification sha%% a%so be strict%y fo%%owed

    by the respondent State.

    Pe!a* P'o$%$o!= Pena% Provision is to be constred riid%y and strict%y.

    26. P'oed+'e #o' ta3$!- %a*e%= ,he $entra% &overnment or the officer

    empowered to ta'e samp%es nder Sec. !! sha%% co%%ect the samp%e in sfficient

    0antity to be divided into two niform parts and effective%y sea% and sitab%y mar'

    the same and permit the person from whom the samp%e is ta'en to add his own sea% or

    mar' to a%% or any of the portions so sea%ed and mar'ed. In case where the samp%e is

    made p in containers or sma%% vo%mes and is %i'e%y to deteriorate or be otherwise

    damaed if exposed the centra% overnment or the officer empowered sha%% ta'e two

    of the said samp%es withot openin the containers and sitab%y sea% and mar' the

    same. ,he $entra% &overnment or the officer empowered sha%% dispose of thesamp%es so co%%ected as fo%%ows3

    (i) one portion sha%% be handed over to the person from whom the

    samp%e is ta'en nder ac'now%edment3 and

    (ii) the other portion sha%% be sent forthwith to the environmenta%

    %aboratory for ana%ysis4

    -%e 6 provides abot the procedre for ta'in samp%es. ow the samp%es areta'en ana%ysed or sbmitted before the $orts have been narrated in this r%e.

    . Se'$e o# !ot$e ,he $entra% &overnment or the officer empowered

    sha%% serve on the occpier or his aent or person in chare of the p%ace a notice then

    and there in :orm I of his intention to have the samp%e ana%ysed.

    -%e 8 provides mode of servin a notice on the occpier or his aent or

    person in chare of the p%ace then and there in :orm I of his intention to have the

    samp%e ana%ysed by the $entra% &overnment or the fficer empowered.

    8. P'oed+'e #o' %+$%%$o! o# %a*e% #o' a!a*/%$%, a!d the #o' o#

    *ao'ato'/ 'eo't the'eo!. (!) samp%es ta'en for ana%ysis sha%% be sent by the

    $entra% &overnment or the officer empowered to the environmenta% %aboratory by

    reistered post or throh specia% messener a%on with :orm II.

    (2) Another copy of :orm II toether with specimen impression of sea%s of

    the officer empowered to ta'e samp%es a%on with the sea%sGmar's. If any of the

    person from whom the samp%e to ta'en sha%% be sent separate%y in a sea%ed cover by

    reistered post or throh a specia% messener to the environmenta% %aboratory.

    (7) ,he findins sha%% be recorded in :orm III in trip%icate and sined by the

    &overnment Ana%yst and sent to the officer from whom the samp%e is received for

    ana%ysis.

    (9) n receipt of the report of the findins of the &overnment Ana%yst the

    officer sha%% sent one copy of the report to the person from whom the samp%e was

    ta'en for ana%ysis the second copy sha%% be retained by him for his records and the

    third copy sha%% be 'ept by him to be prodced in the $ort before which

    proceedins if any are institted.

    9. 5+!t$o!% o# e!$'o!e!ta* *ao'ato'$e% ,he fo%%owin sha%% be the

    fnctions of environmenta% %aboratories *

    (i) to evo%ve standardi/ed methods for samp%in and ana%ysis of

    varios types of environmenta% po%%tants3

    (ii) to ana%yse samp%es sent by the $entra% overnment or the officer

    empowered nder sb+section (!) of Sec. !!3

    (iii) to carry ot sch investiations as may be directed by the $entra%

    &overnment to %ay down standards for the 0a%ity of environment

    and dischare of environmenta% po%%tants to monitor and to

    enforce the standards %aid down3

    (iv) to send periodica% reports reardin its activities to the $entra%overnment

    (v) to carry ot sch other fnctions as may be entrsted to it by the

    $entra% &overnment from time to time.
