1. INTRODUCTION

1.1. Project Background

1. The South Asia Tourism Infrastructure Project (SATIDP) is a part of South Asian Sub-Regional Economic Co-operation (SASEC) which promotes environmentally and culturally sustainable and socially inclusive tourism growth in the South Asian sub region. This will be through: (i) integrated development of high yielding tourism circuits and destinations, (ii) effective management of tourism and environment and culture and (iii) enhancing the linkages of expanded tourism to the local communities. 2. The project was envisaged promoting responsible, sustainable and inclusive models of cluster growth in the South Asia sub–region through tourism infrastructure development that would help tap the economic opportunities in the project specific countries i.e. Nepal, India and Bangladesh, as per the agreed project lists. 3. The Indian component covers the Sikkim state. The tourist destination and its connectivity improvement in the state of Sikkim focuses on (i) World famous Buddhist Monastery at Rumtek in East Sikkim (ii) The nature based sites forming part of the Great Himalayan Trail in West Sikkim district (iii) Villages having potential of Heritage Tourism (iv) Transformation of Sikkim into a sub-regional center of learning and strengthening and development of existing Indian Himalayan Centre for Adventure and Eco-tourism at Chemchey in South Sikkim. 4. The project is being funded from external assistance from Asian Development Bank through Loan (ADB Loan No. 2578-IND) for South Asian Tourism Infrastructure Development Project, India in the state of Sikkim. The Department of Tourism, Government of Sikkim is the Executing Agency (EA). 5. Project Management and Implementation Unit (PMIU) have been established for the overall project management at state level and Project Implementation Units (PIUs) at district level. The PMIU is supported by Project Management Design and Supervision Consultants (PMDSC) engaged under the project to provide assistance to the PMIU/PIUs during project planning, designing and implementation. The Contractors has been engaged to undertake civil works for different sub projects. 6. This Annual Environmental Safeguards Monitoring report provides information pertaining for the period October 2016 to September 2017. The annual environmental Safeguards monitoring report provides compliance status related to National/ State/ Local Regulations; compliance with Safeguards loan covenants; Safeguards management plan and environmental monitoring.

2. Compliance Status with the Environmental Covenant as per Loan Agreement

8. Department of Tourism and Civil Aviation is implementing the sub-projects under Project (Loan Agreement No. 2578- IND). During the preparation of IEE’s it was certain that none of the sub projects are located within National Park, Wildlife Sanctuaries and Monuments of cultural and historical importance. Route selection surveys and detailing surveys were carried out prior to the design of the sub project activities for complying with the above stipulations. None of the sub-project sites are passing through any Wildlife Sanctuary or National Park. No sensitive area or monuments of cultural and historical importance is affected by the project activities. The environmental compliance requirement as per the Loan Agreement and its compliance status is summarized and are presented below in Table 2.1.

9. The sub-projects were identified and detailed in the project report prepared in compliance with site selection criteria as specified in the Environmental Assessment and Review Framework (EARF). The IEE and EMP were included in the bid documents and contact agreement. For the first-year sub-projects, EMP was developed prior to the signing of the Loan Agreement. IEE and EMP of Strengthening and Up-gradation of Road in East Sikkim and Strengthening and Up-gradation of Road Segments in West Sikkim were subsequently revised and included in the bid documents and contact agreement. The responsibilities of EMP implementation are to be carried out by contractors and to be monitored by the Environment Specialist of PMDSC, the Project Implementation Units (PIUs) and the Project Management and Implementation Unit (PMIU). The function of the environment and social monitoring is being done by PIUs/PMIU through PMDSC. They oversee and check the implementation of EMP by the contractors as reported by supervision consultant and coordinates activities related to the EMP implementation and monitoring at various levels. 10. Work under the sub project are in East, West and South Sikkim Districts and involve strengthening of the existing roads (East, West & South Sikkim), Integrated Redevelopment and Provision of Comprehensive Trekkers Facility and Services at existing Base Camp at Yuksom (West Sikkim), Adventure and Eco-Tourism Infrastructure and Facility Up-gradation at existing IHCAE Campus, Chemchey (South Sikkim), Procurement of Equipment’s and Training Aids for Adventure Tourism for IHCAE Chemchey (South Sikkim) and Community Based Village/Rural Responsible Eco-Tourism Development for Village Clusters at Rey - Mindu and Damthang (East, & South Sikkim).

3. Institutional Setup

11. The Department of Tourism, Government of Sikkim is the Executing Agency (EA). A state level steering committee has been established in the State of Sikkim to oversee the works within the state. Project Management and Implementation Unit (PMIU) have been established for the overall project management at state level and is

supported by Project Implementation Units (PIUs) at district level. At state level, PMIU is headed by Project Director and supported by other experts from various disciplines. At District level, PIUs are headed by Project Engineers/Coordinator. For better and proper implementation of the project, State Government has constituted PMIU and PIU committees vide notification No. 03/TD dated 04/05/2010. (Ref. Appendix 1.0 on page No. A-1 & A-2). 12 The PMIU is supported by Project Management Design and Supervision Consultants (PMDSC) engaged under the project to provide assistance to the PMIU/PIUs during project planning, designing and implementation. The PMDSC team includes a Safeguards Specialist who supports environmental management functions including updating subproject IEEs in respect to environmental management plans, assists in updating IEEs, monitoring impacts and mitigation measures associate with sub-projects. The PMIU will oversee the implementation of the environmental provision consistent with the ADB’s Environmental Policy, Environmental Assessment Guidelines, and environmental compliance requirements of Government of Sikkim and Government of India. The Contractors has been engaged to undertake civil works for different sub projects. The Contractors through its designated Environment Health Safety officer will implement all monitoring and mitigation measures in the EMP, which is part of the Contract. 4. 4.3 Stripping, stocking and preservation of top soil

Permanent Moderate The topsoil from borrow areas, areas of cutting and areas to be permanently covered will be stripped to a specified depth of 150mm and stored in stockpiles. The stockpile will be designed such that the slope does not exceed 1:2 (vertical to horizontal), and the height of the pile is to be restricted to 2m. Stockpiles will not be surcharged or otherwise loaded and multiple handling will be kept to a minimum to ensure that no compaction will occur. 4.13 Emission from Construction Vehicles, Equipment and Machinery.

2.9. Water Pollution The Contractor shall take all precautionary measures to prevent the wastewater generated during construction from entering into streams, water bodies or the irrigation system, if any. The Contractor shall avoid construction works close to streams or water bodies during monsoon. All waste arising from the project is to be disposed off in the manner that is acceptable to the State Pollution Control Board or as directed by Environmental Specialist, PMDSC. 2.10. Air Pollution and Dust Generation

The Contractor shall maintain properly (as directed by the Engineer) all roads (existing or constructed for the project), used for transporting construction materials, equipment and machineries for the works under this contract. It shall be the responsibility of the Contractor to ensure that all roads used for transportation of construction materials are clear from any dust, sand, soil, aggregates etc. that may have fallen from the transporting vehicles. The Contractor will arrange for regular water sprinkling, for dust suppression of all such roads and surfaces. All vehicles delivering goods to the site shall be covered to avoid spillage of materials and air pollution. The unloading of all materials at construction sites will be limited to day time only to avoid accidents. Screens of hessian cloth, agro-net and such other barricading material are to be erected along all dumping and

stockpiling sites, so that generation of the dust in the vicinity of such locations can be minimized to a great extent. The Contractor will take every precaution to reduce the level of dust from construction sites involving earthwork by sprinkling of water or screen/barriers. 2.11. Noise The Contractor will confirm the following: All vehicle and equipment used in construction shall strictly conform to the MoEF/CPCB/SPCB noise standards. All vehicles and equipment used in construction will be fitted with exhaust silencers. Servicing of all construction vehicles and equipment will be done regularly and during routine servicing operations, the effectiveness of exhaust silencers will be checked and if found defective will be replaced. Limits of noise emission for construction equipment used in the project such as concrete mixers, vibrators and saws shall not exceed equipment manufacturer specified noise level (measured at one meter from the edge of equipment in the free field), as specified in the Environment (Protection) rules, 1986. Maintenance of vehicles, equipment and machinery shall be regular and up to the satisfaction of the

2.12. Personal Safety Measures for Labour

The Contractor will comply with all regulations regarding safe scaffolding, ladders, working platforms, excavations, trenches and safe means of entry and egress. 2.13. First Aid The Contractor at every workplace will ensure a readily available first aid unit including an adequate supply of sterilized dressing material and appliances will be provided. Suitable transport will be provided to facilitate transfer of injured or ill person (s) to the nearest hospital. 2.14. Temporary Accommodation

The location, layout and basic facility provision of each labour camp will be submitted to PMDSC and PMIU prior to their construction. All temporary accommodation must be constructed and maintained in such a fashion that uncontaminated water is available for drinking, cooking and washing. 2.16. Flora & chance found Fauna

The Contractor will take reasonable precaution to prevent his workmen or any other persons from removing and damaging any flora (plant/vegetation) and fauna (animal) including fishing in any water body and hunting of any animal. If any wild animal is found near the construction site at any point of time, the Contractor will immediately upon discovery thereof sensitize the Environmental Specialist, PMDSC and carry out the instructions for dealing with the same. 2.17. Chance Found Archaeological Property

Rey Monastery Building not ASI protected site. All fossils, coins, articles of value of antiquity, structures and other remains or things of geological or archaeological interest discovered on the site shall be the property of the Government and shall be dealt with as per provisions of Ancient Monuments and Archaeological Sites and Remains Rules, 1959. The Contractor without prior permission of the Archaeological Survey of India shall not start construction activities.

2.18. Clean-up Operations, Restoration and Rehabilitation

The Contractor will prepare site restoration plans, which will be approved by the Environmental Specialist, PMDSC. The clean-up and restoration operations are to be implemented by the Contractor prior to demobilization. The Contractor will clear all temporary structures; dispose all garbage, night soils and POL waste as per Comprehensive Waste Management Plan and as approved by Environmental Specialist, PMDSC. All disposal pits or trenches will be filled in and effectively sealed off. Residual topsoil, if any will be distributed on adjoining/ proximate barren land or areas identified by Environmental Expert in a layer of thickness of 75 mm-l50 mm. All construction zones and any other area used/affected by the project will be left clean and tidy, at the contractor's expense, to the entire satisfaction to the Environmental Specialist, PMDSC.

3.2 Air and Noise Pollution Monitoring

The periodic monitoring of the ambient air quality, noise level, water (both ground and surface water) quality, soil pollution/contamination in the selected locations as suggested in pollution monitoring plan will be responsibility of PMIU. PMIU will appoint PCB approved pollution monitoring agency for this purpose.

3.3 Soil Erosion and Slope Stability

Visual monitoring and inspection of soil erosion and slope stability of developed site will be carried out once in every three months.

3.4 Tree Plantation The PIU/PMIU shall carry out tree plantation through Forest Department for site butification and will monitor survival rates of trees and shrubs. The PIU/PMIU through Forest Department shall carry out replanting/replacing of dead trees sapling.

5. IMPLEMENTATION OF GRIEVANCE REDRESS MECHANISM AND COMPLAINTS RECEIVED FROM STAKEHOLDERS

30. There is a provision of Grievances Redress Mechanism (GRM) related to the implementation of the project. The GRM include formation of District Level Grievance Redress Committee (GRC) comprising of District Collector, officials from Tourism and Civil Aviation Department and Revenue Officer. The GRC was formed in January 2014 vide notification issued by Secretary, Tourism and Civil Aviation Department, Government of Sikkim. (Ref. Appendix 3.0 on page A-18)

31. The Grievance Redress Committee (GRC) has been set up for East, South and West Sikkim Districts where the projects funded by Asian Development Bank are being implemented. The GRC shall determine the merit of each grievance, and resolve grievances within an outer time limit of three months of receiving the complaint. The Affected Persons has the right to refer the grievances to appropriate courts of law if not satisfied with the redress at any stage of the process. The set up GRC has the system of records keeping, contact details of complainant, date of the complaint received, nature of grievance etc. if any for the ongoing project and taking the necessary action against the complaint. During this reporting period, no formal complaint or grievances have been registered.

No grievance recorded and reported with regards to environmental issues in sub project contract packages.

6. PUBLIC CONSULTATION

32. To Check the status of environmental compliance a review meeting was conducted on 16th November 2016. The meeting was attended by representative of all six packages. The major points discussed during the meeting are as follows:

a) Compliance status of Statutory Environmental Regulation b) Strengthening of Civil Works Contractors c) Compliance of Environmental Monitoring Reports d) Compliance to Environmental Management Plan e) Capacity Building of PMIU & Contractors Staff

During project implementation, consultations with village communities were carried out in nearby sub-project packages to understand concerns related to environment and tabulated in Table 6.1 (A). 7. CONCLUSION AND RECOMMENDATIONS

33. The construction work for sub project “Strengthening and upgrading of road from Damthang to IHCAE Campus” had been completed in March 2015, while the civil works in other sub projects have been completed with stipulated time frame except package PM1: Strengthening and upgrading of existing Road from Ranka to Sajong (8.580 km) East Sikkim. Compliances to National Regulations and to Environmental Covenants as contained in ADB Loan Agreement has been found as per requirement. PMIU/PIU is monitoring the implementation of environmental safeguards measures being undertaken by the contractor on regular basis. A Grievance Redressal Committee has been constituted for the project. No major environmental concerns have been identified during the execution of the project.

• The villagers informed that due to the implementation of the project there was no impact flora and fauna.
