Background- The necessity of this act was very much felt after the
Bhopal Gas Tragedy.
The laws existing before this act generally focused onspecific types of pollution & not the generalmanagement principles for protection of theenvironment.
Some major areas of hazards e.g. disposal of toxic wastes were not covered.
There was inadequate linkage in handling mattersrelated to industrial & environment safety.

This act is conceived as an umbrella act.
Enactment of this is a follow up action taken by the
Govt. of India on the decisions taken at the UnitedNations Conference on Human Environment held atStockholm in june,1972, in which India participated.

Objectives-( To implement the decisions of the aforesaid
conference-UNCHE)
1. To protect & to improve the environment.2. Prevention of hazards of human beings.
3.Prevention of hazards of other living creatures, plants& property.
The act is applicable to the entire country.

Rules & regulations under the environment
protection act,1986 notified by central govt.1. Hazardous waste (Mgmt. & Handling) rules- 1989,
provides safeguards in handling hazardous wastes.
2.Manufacture, storage & Import of Hazardous chemicalrules-1989 provides safeguards in handling hazardouschemicals.
3. Coastal zone regulation, 1991-regulates activities in the
coastal zone between the low tide line & 500 m fromthe high tide line.
4. Rules of the manufacture, use, import, export &storage of hazardous micro-organisms.

5. Rules on emergency planning, preparedness &response for Chemical Accidents, 1986- providessafeguards against chemical accidents.
6. Notification for EIA, 1994-makes it compulsory forcertain category of projects to take prior EIA clearancefrom the central govt. before execution.
