Section 7: Prevention and Control of Pollution

1. Nobody shall create pollution in such a manner as to cause significant adverse impacts on the environment or likely to be hazardous to public life and people's health, or dispose or cause to be disposed sound, heat radioactive rays and wastes from any mechanical devices, industrial enterprises, or other places contrary to the prescribed standards.

2. If it appears that anyone has carried out any act contrary to Subsection (1) and caused significant adverse impacts on the environment, the concerned agency may prescribe necessary terms in regard thereto or may prohibit the carrying out of such an act.

3. If it appears that the use of any types of substance, fuel, tools or device has caused or is likely to cause significant adverse impacts on the environment, the Ministry may, by a notification in the Nepal Gazette, forbid the use of such substance, fuel, tools or device.

4. Other provision relating to the prevention and control of pollution shall be as prescribed.

What MUST be doneThe company must follow the provision to protect the

environment by not involving in activities which produces pollution.

The company should prevent and control pollution as prescribed in other provisions

What MUST NOT be Done The company must not create pollution which causes

significant adverse impacts on the environment or likely to be hazardous to public life and people's health.

The company must not dispose or cause to be disposed sound, heat radioactive rays and wastes contrary to the prescribed standards.

The company must not use any types of substance, fuel, tools or device that causes or is likely to cause significant adverse impacts on the environment.

ProcedureIt is discretionary because despite the presence of Ministry and prescribed standards in the provision, nothing is written about step by step procedure needed to implement the provision or measures to determine the pollution.

Degree of UncertaintyLow: Ministry is very firm regarding control of pollution and control measures will surely be implemented.

Degree of ComplexityHigh: The company has to follow stringent procedures to ensure that the standards are maintained.

Managerial Implication Lobbying to pressurize government to allocate separate industrial zones for carpet manufacturers. This will ease the waste management process.

Section 12: To Allow Collection of Samples

In order to study, examine or analyze the pollution, sound, heat and wastes to be or likely to be generated from any industry, factory, machine, vehicle etc. the concerned person, organization or proponent shall be required to allow the person or institution authorized from the concerned agency to collect samples of such objects or substances, as per necessity

What MUST be DoneThe company must cooperate with the authorized institution or person from a concerned agency whoever is collecting samples of such objects or substances to study, examine or analyze the pollution, sound, heat and wastes created by it.

What MUST NOT be doneThe company must not act against the provision.

ProcedureIt is discretionary as the section doesn’t mention the substances to be examined and who is the concerned authority to collect the samples .

Degree of UncertaintyMedium: As the section states that the concerned agency will itself collect the sample to determine the pollution emitted by the company, if there is any but it doesn’t mention about who the concerned agency is and how it will determine the entire procedures’ result.

Degree of Complexity

Low: The concerned authority will themselves come to collect the samples. The company just have to facilitate them.

Managerial ImplicationThe managers to avoid the

negative results in the first hand should adopt environment friendly production process

The managers should inform and train all employees of the company beforehand on how to cooperate with the authorized inspectors.
