1. INTRODUCTION

1.1 Project Background The Asian Development Bank (ADB) and the Australian aid programme, through the Department of Foreign Affairs and Trade (DFAT), jointly fund the Nuku’alofa Urban Development Sector Project (NUDSP). The NUDSP is a multi-sector urban development project that is expected to contribute to Tonga’s sustainable economic development by improving the standard of living in Nuku’alofa. The outcome of the project will be effective, efficient, and sustainable urban services. Project outputs are:

(i) Output 1 – Strengthened policy environment for delivery of urban services:

The project will strengthen the policy environment for delivery of urban services in Tonga by (a) building capacity within Planning and Urban Management Agency (PUMA) to develop urban planning and management policies and to implement the Strategic Planning and Management Act for improved planning and coordination of urban services and urban infrastructure development; (b) reforming Tonga Water Board (TWB) and Waste Authority Limited (WAL) tariffs for recovery of water supply and solid waste services operations and maintenance costs; and (c) mandating the development and implementation of urban infrastructure asset management plans.

(ii) Output 2 - Effective, efficient, and sustainable water supply services in Nuku’alofa: The core subproject will (a) increase the water production at the Mataki’eua Tongamai wellfield; (b) increase the raw water storage capacity; (c) improve the management of the water supply network through the creation of supply zones and improved bulk supply metering; (d) reduce unaccounted-for- water (UFW) from the current level, estimated at about 50% to less than 25%; (e) develop consumer water meter replacement policies and replace defective consumer meters; and (f) revenue collection, billing, and financial management capacity.

(iii) Output 3 - Sustainable solid waste services in Nuku’alofa: This core

subproject will assist WAL to improve its service delivery to the residents of Nuku’alofa by: improving waste disposal operations at the Tapuhia landfill, improving and expanding solid waste collection services, and strengthening financial management capacity in WAL.

(iv) Output 4 - Other municipal services within Nuku’alofa: Other municipal

services will be improved through the implementation of selected high-priority urban infrastructure components identified in the Urban Infrastructure Development Plan (UIDP) and the National Infrastructure Investment Plan (NIPP) (candidate subprojects) and could include upgrading of sanitation, construction of drains, upgrading of roads, and replacement of overhead power lines with underground electricity cables. Candidate subprojects will be selected in accordance with the criteria and due diligence requirements and approved by the project steering committee (PSC) and Asian Development Bank (ADB).

(v) Output 5 - Raised community awareness of municipal services: The project

will raise community awareness of municipal services issues such planning and development consent requirements, household responsibilities for managing solid waste (reduce, recycle, re-use), and public health benefits of safe waste handling and disposal. The project will improve customer complaints mechanisms in TWB

and WAL, and conduct public consultation on service standards, water conservation and demand management. The community awareness programs will also highlight the responsibilities of the Nuku’alofa community as beneficiaries of urban services such as the need to pay for services. Women’s groups and community associations will be consulted and encouraged to participate in urban planning and design issues.

(vi) Output 6 - Effective project management: The project management unit

(PMU), supported by project implementation assistance consultants will provide project design and supervision, monitoring, reporting, quality and cost control, screening and preparation of resettlement plans, and initial environmental evaluations for candidate subprojects, contract administration services and monitoring of the gender action plan.

1.2 Environment and Social Unit A key requirement of the Project is to adhere to the Government of Tonga’s environmental regulations and the ADB Safeguards Policy (2009). To achieve this, the Project Management Unit (PMU) formed the Environment and Social Unit (ESU). The ESU is responsible for implementing all environmental and social monitoring and reporting processes. The ESU ensures that safeguards are integral to all aspects of project works. See Annex A for the Terms of Reference for the ESU. This report is the ninth Bi-Annual Environment and Social Unit (ESU) Monitoring Report to be submitted to the ADB. It provides an overview of all activities that have been undertaken in the reporting period of January 2018 to the end of June 2018. This includes the period of Tropical Cyclone Gita, which struck on 16th February 2018. This devastating category 4 cyclone made direct landfall on 12th February 2018, causing widespread and devastating impact on housing and public infrastructure. The cost of damage was estimated at TOP40.9 million, with 79,556 people directly affected and some 3,900 homes completely destroyed1. This has impacted on the Project, and the ESU team has been mindful of environmental and social issues arising from the event. During this reporting period, the key areas of ESU focus have been:

• Reviewing effectiveness of ESU and discussing lessons learned to date; • Ongoing regular site audits to monitor environmental and social safeguards for the TWB

wellfield development project; • Working with Gender Specialist to review the GAP and implement actions to address

gender issues within workplaces and urban services; • Progress the film making project, Women of Tonga, launching the first three short films

in the series; • Liaison with Geology Division of MLSNR to improve water monitoring capacity and

processes, particularly in relation to Tapuhia Landfill; • Selection of the ten pilot sites to construct household sanitation systems, with a focus

on poverty and gender; • Preparation works for monitoring safeguards for TWB-02 zoning project; • Ongoing work with legal specialist to strengthen the regulatory framework for improved

sanitation; • Continued work with WAL and MEIDECC to promote the new Environment

Management (Waste and Litter Control) Regulations 2016, and support implementation efforts.

The ESU team has continued to undertake environmental auditing for contract works, and continue with efforts in waste management awareness and the promotion of gender equity. The team composition is unchanged since the last reporting period, with a total of 5 members - 3 members from the PIAC team, and 2 urban planning members from NSPAO. In the team there are currently 2 female members and 3 male.

The ESU is a team based in National Spatial Planning Authority Office (NSPAO) with the responsibility to ensure all Project activities are undertaken in line with the ADB Safeguards Policy Statement (2009). It comprises of staff from the PMU (the National Spatial Planning Authority Office, NSPAO) and the Project Implementation Assistance Consultants (PIAC). The Terms of Reference for the ESU is attached as Annex A.

2 ESU ACTIVITIES - ENVIRONMENT

2.1 Introduction All sub-projects and works under the NUDSP are undertaken in accordance with the: (i) NUDSP Environmental Assessment and Review Framework, which ensures that

the environment is considered an integral component of sub-project assessment and implementation processes, and the

(ii) NUDSP Resettlement Framework for ensuring that impoverishment risks are

mitigated and sustainable livelihood and opportunities are offered to people affected by the project.

This Section highlights the ESU oversight of environmental and social risks and opportunities during the period of January to June 2018.

2.2 Solid Waste Core Sub-project Wastewater Treatment As reported in the last ESU Bi-annual Report, an issue of concern at Tapuhia has been the limited capacity of the wastewater treatment plant due to some of the pumps being non-operational. This issue has been resolved by amending one of the existing contract packages for the upgrade of the septage beds (NUDSP-SHO-2018-WAL11) to include nine replacement pumps for the treatment plant as a component of improving liquid waste management. Bidding documents were distributed in May 2018, with bids closing in June 2018. The bid evaluation is now in progress, and it is expected that the contract will be awarded in August 2018. This pathway has provided a good solution, as WAL experienced some financial hardship as a result of Tropical Cyclone Gita, and was not able to replace the pumps as previously planned. In the longer term, the upgrading of the wastewater treatment plant is a critical environmental safeguard issue. In the design of the plant, it was established to treat both septage waste liquid and leachate pumped from the landfill. However, as the waste mass grows, the volume of leachate increases. In the design of the plant, it was made clear that by 2020, the treatment plant would be working at capacity to treat the landfill leachate alone. There is a risk of the wastewater treatment becoming ineffective if it is over-loaded. Given the increasing loads of liquid waste being disposed at Tapuhia, it is important that the wastewater treatment plant be upgraded and that its treatment capacity is expanded. It is proposed that this item be part of the proposed project design under the Tonga Integrated Urban Resilience Sector Project, currently in the TRTA phase, and expected to commence in 2019. Groundwater Testing This is an area that is flagged as one for further action. Despite a number of requests from both the ESU team and the CEO of the Waste Authority, the Water Resource Section of

the Geology Division has not provided any groundwater test results since October 2017. It is understood that the groundwater monitoring program has continued to operate, but there is a problem in the communication of results. This procedure needs to be tightened in order for WAL to instigate a management response to indications of pollution. A round of external laboratory testing was undertaken through ALS Water Quality Testing in Australia. This round of water testing was undertaken across 31 sampling sites, including 5 groundwater monitoring boreholes at Tapuhia (GMW nos 1,2,3,5 and 8). Samples were taken in late October 2017, and delivered to the external laboratory in accordance with agreed sampling and testing protocols. A summary of the results is provided in Annex B. The results for dissolved metals were encouraging, with all measured parameters well below the WHO standards. The samples were also tested for pH, conductivity, dissolved solids, hardness, dissolved mercury, and dissolved major cations. None of the results indicate concerns, although the results in several indicators are raised in GMW #2 when compared to the other samples. This is the water monitoring bore closest to the septage waste treatment beds. However, the results remain within the standards, and comparable to test results from other bores throughout Tongatapu. Hazardous Waste Management The management of hazardous waste over the past six months was discussed with the WAL Management Team, and again they reported that there were no incidents of concern during the reporting period. However, it remains a persistent concern of the ESU and of ADB, as it is an ongoing risk that needs to be managed at a national level. WAL do not have the technical capacity or the facilities to deal with all hazardous waste. They have in place procedures for on-site disposal of asbestos and healthcare wastes, as well as e-waste. However, there may be ways to improve these practices, and also to consider appropriate response to other hazardous waste products that may be presented at the landfill site. There are two ways in which NUDSP can support WAL to take a more pro-active risk management approach. Firstly, to facilitate some round table sessions with key staff from WAL and the MEIDECC Pollution Control Division. The aim is to develop hazardous waste policies and procedures for Tonga, with a focus on practical responses. Being able to access appropriate expertise is the key risk management strategy, to ensure that any attempts of disposal, recycling, or exporting are undertaken within an appropriate risk management framework. Unfortunately, this proposed round table meeting did not occur during the reporting period, as the timing of the Waste Specialist visits to Tonga did not coincide with the availability of key MEIDECC staff, who were travelling at the time of the in-country inputs. However the first round table discussion has been scheduled for August 2018, with the ESU team to provide the facilitation and write up the results of the session. This discussion will then determine future steps required to implement the policy and procedures in Tonga. The second response proposed is to provide training for WAL staff in hazardous waste management. This will be included within the review of the Tapuhia Waste Facility site operations, as is proposed under the Additional Financing Package through DFAT. This is proposed in the second half of 2018. Given that expertise will be brought into country to address practical day-to-day and environmental management of the site, it makes sense to combine the hazardous waste training into the same package.

In addition, the ESU team are liaising with SPREP to be advised if there are any up-coming regional trainings that may be appropriate for key staff members from WAL. With the PacWaste project now completed, there is nothing planned in the immediate future. However, the need for hazardous waste management capacity building is a common theme throughout the region, and will be an ongoing request from member countries. During the next reporting period, WAL will be represented at the Cleaner Pacific Roundtable, hosted by SPREP. This is the first time they have participated in this regional forum, and they will be joining in policy and strategy discussions with a focus on practical measures on the ground. This will help to identify training opportunities, access technical expertise and strengthen regional partnerships. Improving Waste Management Practices The work to control illegal dumping, burning and littering has continued. WAL have received a number of requests from the community, particularly Town Officers, who would like to have signage to install at illegal dumping areas. Warning signs work well when coupled with initial clean-up works and community pressure for all households to manage wastes properly. The ESU worked with WAL staff to design signage, which is attached as Annex C. This package was provided to signwriting firms both in Tonga and New Zealand, with the bid period closing in July 2018. In addition, the bidding package includes bumper stickers and posters. The ‘no littering’ posters are planned for distribution to fale kaloas, schools, and public places, and the ‘no burning’ posters are for distribution to health clinics, schools, and public places. All posters will be laminated to ensure they have some longevity. The signs, stickers and posters all reinforce community awareness about the penalties for poor waste behaviours. An effective pathway for changing behaviours is working through schools, and empowering children to become environmental ambassadors. Super Sione and Super ‘Ana Clean Up Tonga is a children’s book designed as a learning-to-read resource for lower primary school children. It features two children who act as waste warriors, and addresses littering, pollution from burning waste, marine pollution, waste collection, reuse and recycling. The book commissioned a local artist to develop the illustrations (see Annex D), and is now in the procurement process to secure graphic design and printing services.

2.3 Water Supply Core Sub-project Well field Development Contract In this reporting period, the ESU undertook a further four site environmental monitoring audits (audit # 20 – 23) for the TWB-01 contract. These reports are attached as Annex E. The issues of significance remain consistent for the monitoring of this contract. The audits provide regular reminders of the need to improve site waste management, and safety practices, as well as to provide supervision of the contaminated soil rehabilitation. The reservoir construction is now complete, and the focus is on completion of piping and valves to connect the system. Zoning Project The TWB-02 project for water zoning in the urban area remains in the early phases of implementation due to delays in procurement by the contractor. Protecting the Water Resource The Water Resource Section of the Geology Division in MLSNR has received additional testing equipment from NUDSP under the procurement package NUDSP-SHO-2017-WAL27A-D. Whilst all four lots of this bid package have had contracts signed, not all of the equipment and materials have arrived in country. The additional field-testing equipment, laboratory equipment and consumables, and safety clothing will all contribute to the efforts to strengthen regular testing, analysis and reporting. Measuring trends over time is a critical component of water resource management.

2.4 Sanitation Sub-Project Further public convenience facilities will be constructed towards the end of 2018, including facilities at the Teufaiva Sports Facility. The ESU will provide inputs into safety and accessibility of the facilities. The design of the on-site sanitation has been completed with environmental safeguards a key consideration. The construction of ten pilot household sanitation schemes has been delayed, but will be rolled out in the second half of the year. All permissions are in place, and the households are looking forward to the completion of the project, as it will significantly improve their lives. As a component of the project, the ESU team will pilot an awareness programme on sanitation and hygiene. In Tonga, these are not comfortable discussion topics given the cultural taboos. Delivering awareness at a household level, will ensure that there is a deepened understanding of the following –

• The link between poor sanitation / hygiene and health risks; • The operational and maintenance requirements so that the water treatment system is

effective; • The necessity of hand washing, and good hygiene practice.

Women will be targeted for this awareness, as they will gain the most from improved sanitation and hygiene, being the household members who usually have responsibility for caring for sick members of the household, and for maintaining the home environment.

3 ESU ACTIVITIES – SOCIAL AND GENDER ISSUES In early July, a lunch and networking event was held to launch the next three films of the Women of Tonga series. This event featured stories from the following women -

The invitation and programme is attached as Annex F. The guest of honour was the DFAT Second Secretary, Chantelle Boland. After the screening, there was a lively Q&A session with the three women featured in the film, and the ESU team. One of the discussion points that can be taken as a lesson learned, is that a more rigorous selection process would be valuable. Having a steering committee or reference panel would be beneficial to assist with developing selection criteria, and then selecting film subjects. However, the discussion also included some caution, as the end results when ‘film-making by committee’ can be disappointing. It is also impossible to select twelve women to represent all women of Tonga. The criteria centred on work or achievements in a largely non-traditional field for women. The discussion also showed that there is a great hunger for stories, and that there would be strong support to use this story telling medium in the future to demonstrate and promote gender equity and opportunity.

4. SUMMARY AND CONCLUSIONS During this reporting period, the ESU has continued environmental and social oversight of project activities, and development of innovative ways to improve safeguards and social initiatives within the project implementing organisations. ANNEX A: ESU Terms of Reference (Updated December 2017) INTRODUCTION

The ESU is a team based in NSPAO with the responsibility to ensure all Project activities are undertaken in line with the ADB Social Safeguards Policy (2009). The ADB recommend that an ESU comprises of a minimum of three members; the Unit Head or Chairperson, a Social Focal Point, and an Environmental Focal Point. In the NUDSP ESU, there are additional members, as it is seen as an opportunity for capacity building with NSPAO staff. The current structure of the NUDSP ESU is 6 members. Four are from the Project Implementation Assistance Consultants (PIAC); two international and two national. An additional two members join the team from NSPAO.

CURRENT STRUCTURE / ROLES

ESU RESPONSIBILITIES The following is a summary of all tasks for the ESU during project implementation:

Assessment • All new sub-projects must have potential social and environmental impacts identified,

minimised and mitigated, through Initial Environmental Examination reports and/or Resettlement Plans. This work is likely to be undertaken by Project consultants, but ESU may play a support role in these activities.

• In the case of unforseen impacts occurring during implementation, such as a court dispute over land use or an environmental incident, the ESU must report this immediately to ADB, and prepare a Corrective Action Plan.

Implementation

• The ESU is responsible for implementing the Resettlement Plan, ensuring all entitlements are paid, and that affected persons are kept well informed.

• The ESU undertakes monthly environmental site audits for any civil works, such as the construction contracts at Tapuhia, and at the TWB wellfield development.

• The ESU plays a key role in implementing initiatives under the GAP to assist with improving opportunities for women in urban services, improve urban infrastructure for women, and ensure all awareness materials and project initiatives achieve gender balance and address social inclusion.

Monitoring

• The ESU must monitor the implementation of the project Gender Action Plan, and make recommendations for how to achieve the indicators.

Reporting

• Twice a year, a bi-annual EUS Report is prepared and submitted to the ADB, including updating all environmental, social and gender activities and outcomes. This is a public report and will be disseminated via the ADB website.

Nature of Inspection: 20th Monthly Report Weather Conditions: Fine sunny day Site Condition: Firm – the site and roads remain in good condition. Extent of Works: The main structure of the first reservoir is complete and all main collector pipes have been installed. General Comment and Observations:

1. Since the last audit in October, the site work has continued to progress. All new wells have now been drilled, and all new pump houses complete. The contractor has completed the upgrade of all diesel pumps into electric pumps, which reduces a significant environmental risk at the site.

2. Safety issues remain a concern at site. Whilst the well circulation pits are no longer a concern, there needs to be careful attention paid to safety precautions for remaining works. Proper safety clothing must be worn for reservoir construction tasks.

3. Most of the open trenches along the main road have been closed with cover soil. The safety taping along these roads had been removed except at specific areas and corners for cables etc. that still remain open. Contractor was advised of how important it is to keep these safety warning markings.

4. Waste management on the site continues to be much improved. There was a fair bit of waste around the reservoir site, as there had been a concrete pour that took place throughout the preceding night. Workers left water bottles and rubbish on the ground, again demonstrating the need for bins in active work sites.

5. There has been some further work on the preparation of and receival of soil in the rehabilitation area. 6. The new Reservoir has now been completed with interior painting works underway.

Nature of Inspection: 21st Monthly Report Weather Conditions: Fine sunny day Site Condition: Firm – the site and roads remain in good condition. Extent of Works: The main structure of the first reservoir is completed and all main collector pipes have been installed. There was no damage of significance after Cyclone Gita, with all construction passing these conditions! General Comment and Observations:

7. Since the last audit in January the site work has continued to progress. All new wells have now been drilled, and all new pump houses complete. The contractor upgraded all diesel pumps into electric pumps.

8. No significant damage was recorded after Cyclone Gita, except for the site office which was destroyed. The pump houses, reservoir works, and pipeline infrastructure were largely undamaged.

9. Safety issues remain a concern at site. Proper safety clothing must be worn for reservoir construction tasks. 10. Most of the open trenches along the main road had been closed with cover soil. The safety taping along these roads had been removed except at specific areas and

corners for cables etc. that still remains open. Contractor was advised of how important it is to keep these safety warning markings. 11. Soil rehabilitation works have continued in accordance to the procedure developed by the Project team 12. The new Reservoir had been completed, including the interior painting works. All pipe line pressure tests have now been completed.

Extent of Works: The Reservoir is complete, and connection of the inlet pipe to the existing reservoir has also now been completed. General Comment and Observations:

13. Since the last audit in March, the site work has continued to progress. All new wells and new pump houses are complete. The contractor has upgraded all diesel pumps into electric pumps. The reservoir is complete and the inlet pipe connecting the existing reservoir to the new reservoir is now complete.

14. Safety issues remain closely monitored on site due to the lack of attention to these details throughout the contract. Proper safety clothing must be worn for reservoir construction tasks. Safety warning tape was very poor around the trench where the inlet pipe works were complete, but the trench still open. This has been a consistent problem throughout the contract.

15. Waste management on the site continues to be inconsistent, but largely adequate. 16. Soil rehabilitation has continued as per the guidelines. 17. The new Reservoir had been completed, including interior painting. All pipe line pressure tests are now complete. 18. The new inlet pipe has been connected to the existing reservoir

One of the priorities identified to improve the urban environment in Nuku’alofa is to provide

assistance to the Tonga Water Board to upgrade water supply, production, storage and

distribution.

with the Act to provide water supply services for domestic, stock, horticultural, industrial,

19. Since the last audit in April, the site work has continued to progress, with the focus on installation of pipes and valves associated with the reservoir works. 20. Safety issues remain a concern at site. Whilst the permanent cement covers are being constructed for open trench points at the reservoir, the Contractor is still remiss

when it comes to marking around works near the road (such as using safety cones). 21. Most of the open trenches along the main road had been closed and new covers made for inspection valves and inlets. 22. Waste management on the site continues to be sporadic. 23. Soil rehabilitation work for removing the diesel contamination continues according to procedures. 24. New Inlet pipe been to the existing reservoir is now complete. 25. A new site office has been constructed to replace the one damaged during TC Gita.
