ENTERPRISE AGREEMENT CLAUSE EXPLANATIONS AND COMPARISONS | 1 +- The purpose of this document is to explain the terms of the proposed new enterprise agreement (Proposed Agreement) to staff who will be covered by it to make an informed decision before voting in the ballot. The purpose of this document is to explain the terms of the proposed new enterprise agreement (Proposed Agreement) to staff who will be covered by it to make an informed

decision before voting in the ballot.

Helpful terms and definitions:

▪ The National Employment Standards (NES) are 10 minimum employment entitlements contained in the Fair Work Act 2009 (FW Act) that have to be provided to all

employees in Australia.

▪ An enterprise agreement is an agreement made at the enterprise level (e.g. University) under the FW Act that contains terms and conditions of employment, including

wages, for a period of up to four years from the date of approval by the Fair Work Commission (FWC).

▪ Awards are documents made by the FWC that set minimum employment standards which apply in addition to the NES. Where an enterprise agreement is in place, the

▪ "Awards" means both the Higher Education Industry – Academic Staff – Award 2010, and the Higher Education Industry – General Staff – Award 2010. Where only one

of these Awards is relevant, they are referenced as the Academic Award or General Award

▪ "NES" means the National Employment Standards

▪ "FW Act" means the Fair Work Act 2009 (Cth)

▪ "Current Agreement" means the Monash University Enterprise Agreement (Academic and Professional Staff) 2014
