The City Council met in regular session at the above place and date. Meeting was called to order at 8:00a.m. Mayor Oscar Leeser present and presiding and the following Council Members answered roll call: Ann Morgan Lilly, Larry Romero, Emma Acosta, Carl Robinson, Michiel R. · Noe, Eddie Holguin, Jr., Lilia Limon, and Gortney Carlisle Niland. That the City Manager be authorized to sign a Cable Relocation Reimbursable Agreement (AJW­FN-CSA-14-2123) between the City of El Paso and the Federal Aviation Administration ("FAA") whereby the FAA will provide services necessary for the modification or relocation of FAA conduit or cables as part of the Realignment of Taxiway "A" Project at the El Paso International Airport. ·

WHEREAS, on June 30, 2010, the City of El Paso, and the Federal Aviation Administration ("FAA") entered into a Preliminary Design Reimbursable Agreement whereby the FAA provided engineering services associated with the Runway 08R-26L Extension Project at the El Paso International Airport;

WHEREAS, the Runway 08R-26L Extension Project involved relocating the threshold of Runway 08R and extending Runway 26L;

WHEREAS, on June 14, 2011 the City Manager was authorized to sign a Non-Federal Reimbursable Agreement (AJW-FN-CSA-1 0-2028), which allowed the FAA to replace aging FAA equipment and to relocate its related infrastructure which serve Runway 08R and Runway 26L; and

WHEREAS, the City desires to donate the replaced FAA equipment and relocated infrastructure which serve Runway 08R and Runway 26L to the FAA, and the FAA agrees to operate and maintain the facilities for the benefit of air carriers, military, general aviation aircraft personnel and the standard use by the general public; and

WHEREAS, Section 303(c)(1) of the Federal Aviation Act of 1958, as amended, authorizes FAA acceptance of non-Federal navigational and air traffic control facilities and equipment to serve a public safety need; and

NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

WHEREAS, by resolution dated September 3, 1996, the City of El Paso approved of the creation of the El Paso Downtown Management District ("District");

WHEREAS, pursuant to Chapter 375 of the Texas Local Government Code ("Code") the District was legally created by order of the Texas Natural Resources Conservation Commission on March 10, 1997;

WHEREAS, pursuant to Section 375.064(a) of the Code, on November 20, 2013 the Board of Directors of the District ("Board") convened a meeting open to the public for the purpose of recommending a slate of persons to serve as members of the Board; and

WHEREAS, pursuant to Section 375.064(b) of the Code, the City Council is required to approve or disapprove recommendations submitted by the Board.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

That the City Council approves the recommendation of the Board of Directors of the El Paso Downtown Management District that the following person be appointed as a director of the District:

That the City Manager be authorized to sign a Contract of Sale between the City of El Paso and First National Bank of Fabens, a Texas corporation, for the purchase of a portion of the property commonly known as 9339 Alameda Avenue, El Paso, Texas more particularly described as A portion of Tract 3-B, Block 47, Ysleta Grant, City of El Paso, El Paso County, Texas, in the amount of $140,000.00, and that the City Manager, be authorized to sign any necessary documents to accomplish the intent of this Resolution.

3N. *R E S 0 L U T I 0 N

That the City Council approves the expenditure of additional available funding in the amount of One Hundred Thirty Three Thousand Nine Hundred Seventy Eight and 00/100 Dollars ($133,978.00) to Urban Associates, Inc. for additional construction costs for the Sun Metro Operations and Maintenance Facility, solicitation No 2012-074 and that the City Manager be authorized to establish the funding sources and make any necessary budget transfers and execute any and all documents necessary for execution of this change order. The change order provides for a pre-engineered metal building canopy for the exterior hazardous storage area to comply with requirements to cover any materials that are deemed hazardous. No additional time is added to contract time. The new contract sum, including this change order is Twenty Eight Million Nine Hundred Four Thousand Two Hundred Eighty One and 60/100 ($28,904,281.60).

30. *R E S 0 L U T I 0 N

That the City Manager be authorized to sign the First Amendment to the Agreement for Professional Services by and between the City of El Paso and ECM International, Inc. a Texas Corporation, for a project known as "Sun Metro Operation and Maintenance Facility" to add additional professional services for extension of Construction Management in the amount of Sixty Five Thousand and N0/1 00 Dollars ($65,000.00) thereby extending the amount of the contract from $602,325.50 to $667,325.50.

WHEREAS, in accordance with Chapter 9.04 of the El Paso City Code, O'Neill, Patrick K., referred to as owner, regardless of number, of the hereinafter described property, was given notice that said property constituted a public nuisance due to the accumulation of trash, vegetation and weeds or other objectionable, unsightly or unsanitary matter in violation of Chapter 9.04 of the El Paso City Code; and the owner failed to comply with due notices. In accordance with El Paso City Code Chapter 9.04, the

Environmental Services Department proceeded to clean and dispose of the trash, vegetation, weeds or other rubbish; and

WHEREAS, the Director of the Environmental Services Department has reported the cost of doing such work in the amount hereinafter set forth.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

1. The City Council determines the actual cost of removing the accumulated trash, vegetation and weeds or other rubbish located on said property, being:

7414 Camino Del Sol Drive, more particularly described as Lot(s) 11 (19919.00 Sq Ft), Block 1, Lomas Del Sol #1 Subdivision, El Paso, El Paso County, Texas, PID #L626-999-00 1 0-11 00

to be $101.21, performed by the Environmental Services Department of the City of El Paso, and, the cost of recording the Resolution in the office of the El Paso County Clerk, $24.00, making a total of ONE HUNDRED TWENTY FIVE AND 21/100 DOLLARS ($125.21). The City Council finds that the work was completed on the 19th day of July, 2013, and approves the costs described herein.

2. The City Council, in accordance with Chapter 9.04 of the El Paso City Code, declares the above total amount ONE HUNDRED TWENTY FIVE AND 21/100 DOLLARS ($125.21) to be a lien on the above described property, said amount being due and payable within ten (1 0) days from the date of City Council approval, and thereafter bearing ten percent ( 1 0%) interest per annum.

3. The City Clerk is directed to give notice of the lien by filing a copy of this Resolution for record with the County Clerk.

4. All records of the City Clerk's office relating to the proceeding against the above described property are made a part of this Resolution by reference.

to be $170.09, performed by the Environmental Services Department of the City of El Paso, and, the cost of recording the Resolution in the office of the El Paso County Clerk, $24.00, making a total of ONE HUNDRED NINETY FOUR AND 09/100 DOLLARS ($194.09). The City Council finds that the work was completed on the 28th day of August, 2013, and approves the costs described herein.

WHEREAS, Ordinance No. 18059, approved by the City Council of the City of El Paso on August 6, 2013, authorizes the Council to declare limited periods of "amnesty" to allow borrowers of items from the El Paso Public Library to return overdue items or items previously considered lost, without payment of the applicable· overdue fines or fees for lost items: and

WHEREAS, The Library desires to encourage donations of canned and non-perishable food donations to the MLK Canned Food Drive, an initiative of the City of El Paso, as well as the return of overdue or items previously considered lost to the Library.

That the City Manager be authorized to sign Amendment #7 to the Professional Services Contract, dated May 17, 2010, between the City of El Paso and Johnson Controls, Inc., a Wisconsin Corporation, to perform utility cost reduction measures, specifically new LED street light upgrades, to implement Phase VII of the City-wide Energy Operational Savings, for an amount of $7,500,000.00, which will be funded with a State Energy Conservation Office (SECO) Loan; and, that the City Manager, or her designee, be authorized to execute a State Energy Conservation Office Revolving Loan Agreement between the City of El Paso and the Texas State Comptroller of Public Accounts in an amount not to exceed $7,500,000 in order to fund the subject energy efficiency project. . These authorizations are subject to final approval by the City Attorney's office of all necessary documents to effectuate the transaction.

RESOLUTION

WHEREAS, the 81 st Regular Session of the Texas Legislature passed H. B. 4004, signed into law by the Governor of Texas May 23, 2009 which amended Texas Government Code Section 1502.070 to provide that the management and control of a utility system may be vested in a board of trustees consisting of not more than seven members, one of whom must be the Mayor of El Paso;

WHEREAS, Ordinance No. 017167 passed and approved by the City Council on August 11, 2009, increased the composition of the El Paso Water Utilities Public Service Board from five (5) to seven (7) members;

WHEREAS, on December 31, 2013 a vacancy for the Environmental or Health category will occur on the Board;

WHEREAS, by City Council Resolution dated August 11, 2009, the City Council of the City of El Paso established the El Paso Water Utilities Public Service Board Selection Committee, which met on Tuesday, November 19, 2013 and approved the nomination of the following candidates to fill the vacancy: RichardT. Schoephoerster (eligible for reappointment); John Walton; and William John Wolff in that order of priority.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL PASO:

That the City of El Paso hereby reappoints Richard T. Schoephoerster, PhD, PE to fill the vacancy in the Environmental or Health category. The term of the appointment shall commence on January 1, 2014 and shall be for four (4) years.

Dr. John Walton, citizen, commented.

Motion made by Mayor Pro Tempore Niland, seconded by Representative Romero, and carried to APPROVE the Resolution.

That the City Attorney is authorized to take any and all action necessary, both affirmative and defensive, as necessary, in connection with this lawsuit through outside counsel. This Motion is intended to grant broad authority to City Attorney to take action necessary to address these matters, including but not limited to, the initiation and response to, litigation, complaints and any other administrative or judicial proceedings or process, in consultation with the City Manager through outside counsel.
