Background

n For systems over 3,300 population (1,000 connections) an Emergency Response Plan (ERP) is required

n All systems over 3,300 must send a certification to EPA that they have updated their ERP to include the results of their Security Vulnerability Assessment by December 31, 2004

n All Public Water Systems (PWS) must have an Emergency Notification Plan (ENP)

2002 Bioterrorism Act

n Requires systems to complete or update an ERP that incorporates the VA:n Plans, procedures, and identification of equipment

that can be used in the event of an attackn Actions, procedures, and identification of

equipment that can significantly lessen the impact of an attack to protect public health and a safe supply of drinking water

n Coordinate with the local emergency planning committee (LEPC)

Instructions for ERP CertificationWhat has to be sent to EPA?n An ERP Certification letter including:

n PWS ID#, system name, and system addressn Name of person signing letter and their contact information

(address, phone, fax, and emailn Language in letter that you “certify to the Administrator that

the system has prepared or revised an ERP that incorporates the results of the VA and the plan includes actions, plans, procedures, and identification of equipment and other requirements in Section 1433(b) of the 2002 Bioterrorism Act.”

n Do NOT send the ERP, but keep a copy of the letter sent to EPA

n Law requires system to maintain a copy of the ERP for 5 years
