CALL TO ORDER

Harold L. Godwin, M.D., President of the Board of Medical Examiners of the State of NorthCarolina, called the meeting to order at 8:30p.m. on March 15, 1989, at the Embassy SuitesHotel, Raleigh, North Carolina.

The Board members present at this meeting included: Nicholas Emanuel Stratas, M.D. ,Secretary; Eben Alexander, Jr. , M.D.; John Thomas Daniel, Jr. , M.D., Hector Himel Henry,II, M.D.; John Wesley Nance, M.D.; F.M. Simmons Patterson, Jr., M.D.; and Mrs. KatluynHowell Willis.

Staff members present included: Bryant D. Paris, Jr. ; Donald R. Pittman; William H.Breeze, Jr.; Robert J. Broyles; L. D. Beaver; Kathy Burke; and Betty Ann Preston.

OWENS, Robert Carl, M.D. —Morganton, NC

On March 17, 1989, the Board of Medical Examiners of the State of North Carolina held ahearing regarding the sununary suspension of Dr. Owen's license.

At the conclusion of. these proceedings, the Board unanimously adopted a motion made byDr. Patterson and seconded by Dr. Henry that the Board of Medical Examiners of the Stateof North Carolina revoke Dr. Owens' license to practice medicine in the State of NorthCarolina.

MAGEE, Archibald Carter, M.D. —Washington, NC

On March 17, 1989, the Board of Medical Examiners of the State of North Carolina held ahearing regarding Dr. Magee's mental competence to practice medicine.

At the conclusion of these proceedings, the Board adopted a motion made hy Dr. Godwinand seconded by Dr. Stratas that Dr. Magee did not possess the mental competence topractice medicine. Dr. Alexander voted to conclude that Dr. Magee did possess the mentalcompetence to practice medicine.

MEETING WITH DEAN OF ECU MEDICAL SCHOOL

On March 15, 1989, Dr. Hallock, Dean of the ECU Medical School, met with the Board.The Board reviewed its purpose for meeting with the deans of the various medical schoolswithin North Carolina. Dr. Godwin reviewed the various requests for special privilege, i.e.,"Peter Cotton" type requests for licensure, when the occasion does not warrant it.Dr.Hallock commented on Dr. Duckett's proposed work with the cognitively impairedphysician. The problem of physicituls prescribing controlled substances for chronic painwas discussed.

The Board discussed some difficulty it was having with physicians who were using andabusing the PA regulations and with PA's not following the regulations. These problemspersist despite various communications between the Board and the parties involved,including a visit by Mr. Paris to ECU to speak on this subject. Dr. Hallock indicated that hehas instituted weekly meetings with the clinical chairmen and monthly meetings with all thechain+en and will keep on top of the PA situation.

Dr. Hallock thanked the Board for the opportunity to meet with them. He indicated hewould like to continue meeting with them on a regular basis.

DUNCAN, George Clovis, Jr., M.D. —Asheville, NC

As a result of the informal interview on March 16, 1989, the Board adopted the followingmotion made by Dr. Henry and seconded by Dr. Daniel that Board issue a one-yearcontinuation of Dr. Duncan's temporary license, restricted to the Developmental EvaluationCenter in Asheville, NC.

MAUK, Louis Michael, M.D. —Lenoir, NC

As a result of the informal interview on March 16, 1989 and the information provided by Dr.Mauk via fax on March 19, 1989, the Board adopted the following motion made by Dr.Alexander and seconded by Dr. Henry that the Board extend Dr. Mauk's temporary licenseto June 25, 1989.

WULZ, Curtis Eugene, M.D. - Greenville, NC

As a result of a licensure interview on March 16, 1989, the Board adopted a motion that ifand when the Board receives a letter meeting its approval from Dr. Wulz's ProgramDirector, the Board issue Dr. Wulz a full license.

GONZALEZ, Edgardo, M.D. —Asheville, NC

On March 18, 1989, the Board adopted a motion made by Dr. Godwin and seconded by Dr.Henry that the Board of Medical Examiners deny Dr. Gonzalez' application for licensure onthe basis that he has not passed Flex.

SHAW, James Robert, M.D. - Asheville, NC

On March 18, 1989, the Board,adopted a motion made by Dr. Henry and seconded by Dr.Godwin that the Board issue Dr. Shaw a one year temporary license.

On March 18, 1989, the Board adopted a motion made by Dr. Patterson and seconded by Dr.Stratas that the Board issue Dr. Jones a one-year temporary license, restricted tonon-operative medicine in or out of the hospital.

On March 18, 1989, the Board adopted a motion made by Dr. Henry and seconded by Dr.Godwin that the Board of Medical Examiners deny Dr. Goldstein's application for licensureon the basis that he had not passed Flex.

TURNER, Charles Wesley, M.D. - Danville, VA

On March 18, 1989, the Board adopted a motion made by Dr. Godwin and seconded by Dr.Henry that the Board of Medical Examiners hold Dr. Turner's application for licensure inabeyance until he takes and passes Flex II.

On March 19, 1989, the Board of Medical Examiners unaniumously aclopted a motion madeby Dr. Daniel and seconded by Dr. Godwin that the Board approve the 377 initialapplications and 227 recertification applications for Advanced Life Support personnelsubmitted by the Office of Emergency Medical Services. The Board also adopted a motionmade by Dr. Daniel and seconded by Dr. Godwin that the Board approve the 354 Bee StingCertifications submitted by the Office of Emergency Medical Services.

On March 19, 1989, the Board of Medical Examiners unanimously adopted a motion madeby Dr. Patterson and seconded by Dr. Henry that the Octobe 1989 meeting be held at theEmbassy Suites Hotel, Raleigh, North Carolina.

ANTIVIVISECTION LEGISLATION

On March 19, 1989, the Board of Medical Examiners unanimously adopted a motion madeby Dr. Alexander and seconded by Dr. Henry that the Board inform Dr. Bruton that theBoard go on record as opposing any effort that would restrict, or in any way liiii, theethical and medically scientific research which includes the use of animals.

EMPLOYING UNLICENSED NURSES

On March 19, 1989, the Board of Medical Examiners adopted a motion made by Dr.Patterson and seconded by Dr. Nance (Dr. Stratas voted in opposition to the motion) that theBoard accept as information the report from the Board of Nursing regarding physicians'employment of unlicensed nurses.

PA ADMINISTRATION OF RKIROBULBAR AND PERIBULBAR ANESTHESIA

On March 19, 1989, the Board of Medical Examiners adopted a motion made by Dr. Stratasand seconded by Dr. Patterson (Dr. Henry voted in opposition to the motion) that the Boardaccept as information the letter from C. Richard Epes, M.D. regarding PA administration ofretobulbar and peribulbar anesthesia and inform Mr. Epes to reread the Board's bulletinregarding its position on this issue.

PA HEALTH dk EFFECI IVENESS PROGRAM

On March 19, 1989, the Board of Medical Examiners unanimously adopted a motion madeby Dr. Godwin and seconded by Dr. Patterson that the Board respond to the issue ofunpairment of Physician Assistants in writing and inform the North Carolina Academy ofPhysician Assistants that this program is a good idea, that the Board implemented theNCPHEP program through an increase in fees, and that the Board would be happy to ask Dr.Vanderberry to meet with them.

PARAPROFESSIONAL BOARD

On March 19, 1989, the Board of Medical Examiners unanimously adopted a motion madeby Dr. Godwin and seconcled by Dr. Henry that the Board deny the request by Dr. ScottBowers of the establishment of a paraprofessional board and that the Board write Dr.Bowers thanking hun for his efforts.

On March 19, 1989, the Board of Medical Examiners unanimously adopted a motion madeby Dr. Stratas and seconded by Dr. Daniel that the Board request the Legislative Committeeof the Medical Society to work towards elevating the penalty for practicing medicinewithout a license to a felony.

On March 19, 1989, the Board of Medical Exaininers unanimously adopted a motion madeby Dr. Godwin and seconded by Dr. Alexander that a Malpractice Review Committee beformed consisting of Drs. Stratas and Henry; that a copy of the Malpractice Report beincluded in all Board members' books; that physicians who have had difficulty in the past behighlighted in these reports.

LICENSURE INTERVIEWS

On March 19, 1989, the Board of Medical Examiners unanimously adopted a motion madeby Dr. Patterson and seconded by Dr. Henry that beginning with the May, 1989 meeting,licensure interviews will be divided into three groups.

COMPLAINT PROCEDURE

On March 19, 1989, the Board of Medical Exatniners unanimously adopted a motion macleby Dr. Patterson and seconded by Dr. Godwin that the President of the Board will review allcomplaints and bring his recommendations to the Board and that all Board members willreceive a copy of the Complaint list.

MISCELLANEOUS MEETING ITEMS

On March 19, 1989, the Board of Medical Examiners unanimously adopted a motion madeby Dr. Stratas and seconded by Dr. Patterson that

1. responses to physicians regarding not coming for informal interviews must bediscussed by the President and Executive Secretary

2. informal interview invitations should go out as soon as possible after each meeting

3. letters received addressed to individual Board members should be copied and sentto the Board member on the date received in the Board's office

4. the Board meeting wi11 convene on Wednesday evenings at 7:00 or 7:30 p.m. ;there will be no scheduled dinner

5. the lunch break for Thursday and Saturday will be one and a half hours.
